75	75	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
76	76	SECTION 1. AMENDATORY 15 O.S. 2021, Section 753, is
77	77	amended to read as follows:
78	78	Section 753. A person engages in a practice which is declared
79	79	to be unlawful under the Oklahoma Consumer Protection Act when, in
80	80	the course of the person ’s business, the person:
81	81	1. Represents, knowingly or with reason to know, that the
82	82	subject of a consumer transaction is of a particular make or brand,
83	83	when it is of another;
84	84	2. Makes a false or misleading representation, knowi ngly or
85	85	with reason to know, as to the source, sponsorship, approva l, or
86	86	certification of the subject of a consum er transaction;

145	145	know, as to the characteristics, ingredients, uses, benefits,
146	146	alterations, or quantities of the subject of a c onsumer transaction
147	147	or a false representation as to the sponsorship, approval, status,
148	148	affiliation or connection of a person therewith;
149	149	6. Represents, knowingly or with reason to know, that the
150	150	subject of a consumer transaction is original or new if the p erson
151	151	knows that it is reconditioned, reclaimed, used, or secondhand;
152	152	7. Represents, knowingly or with reason to know, that the
153	153	subject of a consumer transaction is of a particular standard, style
154	154	or model, if it is of another;
155	155	8. Advertises, knowingly o r with reason to know, the subject of
156	156	a consumer transaction with intent not to sell it as advertised;
157	157	9. Advertises, knowingly or with reason to know, the subject of
158	158	a consumer transaction with intent not to supply reasonably expected
159	159	public demand, unless the advertisement discloses a limitation of
160	160	quantity;

212	212	10. Advertises under the guise of obtaining sales personnel
213	213	when in fact the purpose is to sell the subject of a consumer
214	214	transaction to the sales perso nnel applicants;
215	215	11. Makes false or misleadin g statements of fact, knowingly or
216	216	with reason to know, concerning the price of the subject of a
217	217	consumer transaction or the reason for, existe nce of, or amounts of
218	218	price reduction;
219	219	12. Employs “bait and switch” advertising, which consists of an
220	220	offer to sell the subject of a consumer transaction which the seller
221	221	does not intend to sell, which advertising is accompanied by one or
222	222	more of the following practices:
223	223	a. refusal to show the subject of a consumer tran saction
224	224	advertised,
225	225	b. disparagement of the ad vertised subject of a consumer
226	226	transaction or the terms of sale,
227	227	c. requiring undisclosed tie -in sales or other
228	228	undisclosed conditions to be me t prior to selling the
229	229	advertised subject of a consumer transaction ,
230	230	d. refusal to take orders for the subject of a consumer
231	231	transaction advertised for delivery within a
232	232	reasonable time,
233	233	e. showing or demonstrating defective subject of a
234	234	consumer transaction which the seller knows is

288	288	f. accepting a deposit for the subject of a consumer
289	289	transaction and subsequently charging the buyer for a
290	290	higher priced item, or
291	291	g. willful failure to m ake deliveries of the subject of a
292	292	consumer transaction within a re asonable time or to
293	293	make a refund therefor upo n the request of the
294	294	purchaser;
295	295	13. Conducts a closing out sale without having first ob tained a
296	296	license as required in the Oklahoma Consumer P rotection Act;
297	297	14. Resumes the business for which the closing out sale was
298	298	conducted within thirty -six (36) months from the expiration date of
299	299	the closing out sale license;
300	300	15. Falsely states, knowingly or with reason to know, that
301	301	services, replacements or repairs are needed;
302	302	16. Violates any provision of the Oklahoma Health Spa Act;
303	303	17. Violates any provision o f the Home Repair Fraud Act;
304	304	18. Violates any provision of the Consumer Disclosure of Prizes
305	305	and Gifts Act;
306	306	19. Violates any provision of Sec tion 755.1 of this title or
307	307	Section 1847a of Title 21 of the Oklaho ma Statutes;
308	308	20. Commits an unfair or decepti ve trade practice as defined in
309	309	Section 752 of this title;

368	368	23. Offers to purchase a mineral or royalty interest through an
369	369	offer that resembles an oil and gas lease and that the consumer
370	370	believed was an oil and gas lease;
371	371	24. Refuses to honor gift certificates, warranties, or any
372	372	other merchandise offered by a person in a consumer transaction
373	373	executed prior to the closing of the business of the person without
374	374	providing a purchaser a means of redeeming such merchandise or
375	375	ensuring the warranties offered will be honored by another person;
376	376	25. Knowingly causes a charge to be made by any billing method
377	377	to a consumer for services which the person knows was not auth orized
378	378	in advance by the consumer;
379	379	26. Knowingly causes a charge to be made by any billing method
380	380	to a consumer for a product or products whic h the person knows was
381	381	not authorized in advance by the consumer;
382	382	27. Violates Section 752A of this title;
383	383	28. Makes deceptive use of another ’s name in notification or
384	384	solicitation, as defined in Section 752 of this title;

437	437	service is recommended or endorsed by a named third person;
438	438	30. Falsely states that information about the consumer,
439	439	including but not limited to, the name, address or phone number of
440	440	the consumer has been provided by a third pe rson, whether that
441	441	person is named or unnamed;
442	442	31. Acting as a deb t collector, contacts a debtor and threatens
443	443	to file a suit against the debtor over a debt barred by the statute
444	444	of limitations which has passed for filing suit for such debt; or
445	445	32. Acting as a debt collector, contacts a debtor and uses
446	446	obscene or profane language to collect a debt ; or
447	447	33. Targets knowingly, or with reason to know, minors with
448	448	content or messages containing obscene material or sexual conduct as
449	449	defined in Section 1024.1 of Title 21 of the Oklahoma Statutes.
450	450	SECTION 2. This act shall become effective November 1, 2022.
