4661 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
4762 SECTION 1. NEW LAW A new section of law to be codified
4863 in the Oklahoma Statutes as Section 5-114.1 of Title 29, unless
4964 there is created a duplication in numbering, reads as follows:
5065 A. Pursuant to Section 5-401 of Title 29 of the Oklahoma
5166 Statutes, the Oklahoma Wildlife Conservation Commission is
5267 authorized to declare an open season to hunt and harvest velvet
5368 bucks during the last week of August only in those counties or parts
54-of counties of this state where, in the judgment of the Commission,
55-the population of deer exist in sufficient quantity and health to
56-warrant an open season. An open season to hunt and harvest velvet
57-bucks shall be declared by a Commission resolution n ot less than ten
58-(10) days before the season is opened. The duration of a declared
59-open season shall not exceed four (4) days and be restricted to a
60-limit of one velvet buck per hunt during the season.

96+of counties of this state where, in the judgment of the Commission,
97+the population of deer exist in sufficient quantity and health to
98+warrant an open season. An open season to hunt and harvest velvet
99+bucks shall be declared by a Commission resolution not less than ten
100+(10) days before the season is opened. The duration of a declared
101+open season shall not exceed four (4) days and be restricted to a
102+limit of one (1) velvet buck per hunt during the season.
87103 B. The Commission shall authorize muzzle loaders as the sole
88104 method for shooting, hunting, killing, wounding, taking, or
89105 attempting to shoot, hunt, kill, wound, or take any velvet buck
90106 during a declared open season .
91107 C. During a declared open season legal residents of Oklahoma
92108 and non-residents may hunt velvet bucks provided the person has a
93109 valid deer license, velvet buck permit, or stamp as otherwise
94110 provided by law in this state. All velvet bucks shot, killed,
95111 wounded, taken, and harvested shall count against the licensee’s
96112 annual bag limit for deer in this state.
97113 D. The Commission is authorized to prescribe rules necessary
98114 for the proper conduct and policing of a declared open season for
99115 the hunting and harvestin g of velvet bucks; the velvet antler size;
100116 the kind of bucks that may be taken; and the dates and time limits
101117 of such season. The Commission shall be authorized to cancel a
102118 declared velvet buck open season for any reason deemed appropriate
103119 including, but not limited to, disease, we ather, deer population,
104-and herd health. Any cancelation of a declared velvet buck open
105-season shall prohibit the Commission from refunding or crediting any
106-fees paid for a velvet buck permit, stamp, or license.
107-E. All laws and rules pertaining to velvet bucks in this state
108-shall be enforceable by the Department of Wildlife Conservation and
109-its agents. The Commission shall set velvet buck licenses, pe rmits,
110-and/or stamps by rule.

147+and herd health. Any cancelation of a declared velvet buck open

150+E. All laws and rules pertaining to velvet bucks in this state
151+shall be enforceable by the Department of Wildlife Conservation and
152+its agents. The Commission shall set velvet buck licenses, pe rmits,
153+and/or stamps by rule.
137154 F. The Commission is authorized to require by rule that any
138155 person participating in a declared velvet buck open season or
139156 hunting in open areas during a declared velvet buck open season to
140157 procure a special permit, stamp, or license to participate in a
141158 declared velvet buck open season or to hunt in such open areas
142159 during a declared velvet buck open season and may charge residents
143160 and nonresidents fees and such other compensation for those Oklahoma
144161 surface holders participating in the Acres for Wildlife Pro gram.
145162 The rate of such fees and compensation shall be determined by the
146163 Oklahoma Wildlife Conservation Commission. No exemptions shall be
147164 permitted.
148165 G. Velvet buck open seasons, closed seasons, bag limits, catch
149166 limits, possession limits , and territorial limitations set forth in
150167 law or rule are hereby declared to be based on the existence of a
151168 normal population of deer prior to the Commission declaring a velvet
152169 buck open season. Such seasons, catch limits, bag limits,
153170 possession limits, and territorial limitations as se t by law or rule
154-shall prevail and be in fu ll force and effect for deer so long as
155-the population or numbers of deer remain normal in areas of this
156-state.
157-H. For purposes of this section :
158-1. “Velvet buck” means a male deer with velvet antler; and
159-2. “Velvet antler” means the whole cartilaginous ant ler is
160-exhibited in a precalcified growth stage of the Cervidae family.

199+the population or numbers of deer remain normal in areas of this
200+state.
201+H. For purposes of this section :
202+1. “Velvet buck” means a male deer with velvet antler; and
203+2. “Velvet antler” means the whole cartilaginous ant ler is
204+exhibited in a precalcified growth stage of the Cervidae family.
187205 The deer antler must be covered in velvet-like hair that is
188206 essentially skin that supplies nutrients and blood flow to the
189207 growing bone and antler underneath.
190208 SECTION 2. This act shall become effec tive July 1, 2022.
191209 SECTION 3. It being immediat ely necessary for the preservation
192210 of the public peace, health or safety, an emergency is hereby
193211 declared to exist, by reason whereof this act shall take effect and
194212 be in full force from and a fter its passage and approval.
