109-BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
110-SECTION 1. AMENDATORY 63 O. S. 2021, Section 426 , is
111-amended to read as follo ws:
112-Section 426. A. The tax on retail medical marijuana sales will
113-be established at seven percent (7%) of the gross amount recei ved by
114-the seller.
115-B. This tax will be collected at the point of sale. Exc ept as
116-provided for in subsection D C of this section, tax proceeds will be

201+the Oklahoma Sales Tax Code to provide funds for the financing of
202+the program provided for by the Oklahoma Social Security Act and to
203+provide revenues for the support of the fu nctions of the state
204+government of Oklahoma, and for this purpose it is hereby expressly
205+provided that, revenues derived pursuant to the provisions of the
206+Oklahoma Sales Tax Code, subject to the apportionment require ments
207+for the Oklahoma Tax Commission an d Office of Management and
208+Enterprise Services Joint Computer Enhancement Fund provided by
209+Section 265 of this title, shall be apportioned as follows:

255-dispensing, cultivating, processing, testing, trans porting, storage,
256-research, and the use of and sale of medical marijuana pursuant to
257-the Oklahoma Medical Marijuana and Patient Protection Act.
258-B. The Department sh all provide support staff to perform
259-designated duties of the Authority. The Department sh all also
260-provide office space for meetings of the A uthority.
261-C. The Department shall implement the pr ovisions of the
262-Oklahoma Medical Marijuana and Patient Protecti on Act consistently
263-with the voter-approved State Question No. 788, Initiative Petition
264-No. 412, subject to the provisions of the Oklahoma Med ical Marijuana
265-and Patient Protection Act.
266-D. The Department shall exercise its respective powers and
267-perform its respective duties and functions as specified in the
268-Oklahoma Medical Marijuana and Patient Protection Act and this title
269-including, but not l imited to, the following:
270-1. Determine steps the s tate shall take, whether administrative
271-or legislative in natur e, to ensure that research on marijuana and
272-marijuana products is being conducted for publi c purposes, including
273-the advancement of:
274-a. public health policy and public safety policy,
275-b. agronomic and horticultural best practices, and
276-c. medical and pharmacopoeia best practices;
277-2. Contract with third-party vendors and other governmental
278-entities in order to carry out the respective duties and f unctions

306-Protection Act;
307-3. Upon complaint or upon its own motion and upon a comp leted
308-investigation, levy fines as prescribed in applicable laws , rules
309-and regulations and suspend, revoke or not renew licenses pursuant
310-to applicable laws, rules a nd regulations;
311-4. Issue subpoenas for the appearance or production of persons,
312-records and things in connection with disciplinary or contested
313-cases considered by the Department;
314-5. Apply for injunctive or declaratory relief to enforce the
315-provisions of applicable laws, rules and regulations;
316-6. Inspect and examine all licensed premises of medical
317-marijuana businesses, research facilities, education fac ilities and
318-waste disposal facilities in which medi cal marijuana is cultivated,
319-manufactured, sold, st ored, transported, tested, distributed or
320-disposed of;
321-7. Upon action by the federal gove rnment by which the
322-production, sale and use of marijuana in Okl ahoma does not violate
323-federal law, work with the O klahoma State Banking Department and the
324-State Treasurer to develop good practices and standards for banking
325-and finance for medical marijuan a businesses;
326-8. Establish internal control procedures for lice nses including
327-accounting procedures, reporting pro cedures and personnel policies;

354-9. Establish a fee schedule and collect fees for performing
355-background checks as the Commissioner deems appr opriate. The fees
356-charged pursuant to this paragraph shall not exceed the actual cost
357-incurred for each background check;
358-10. Establish a fee schedule and collect fees for material
359-changes requested by the licensee; and
360-11. Establish regulations, which require a medical marijuana
361-business to submit information to t he Oklahoma Medical Marijuana
362-Authority, deemed rea sonably necessary to assist the Authority in
363-the prevention of diversion of medical marijuana by a licensed
364-medical marijuana business. Such information required by the
365-Authority may include, but shall no t be limited to:
366-a. the square footage of the licen sed premises,
367-b. a diagram of the licensed premises ,
368-c. the number and type of lights at the licensed medical
369-marijuana commercial grower bus iness,
370-d. the number, type and production capacity of equipment
371-located at the medical marijuana processing facilit y,
372-e. the names, addresses and telephone numbers of
373-employees or agents of a medical marijuana business,
374-f. employment manuals and standard o perating procedures
375-for the medical marijuana business, and
376-g. any other information as the Authority reasonably
377-deems necessary; and
346+Revolving Fund, but in no event shall such
347+apportionment exceed Five Million Dollars
348+($5,000,000.00) in any fiscal year, and
349+(2) sixty-four percent (64%) shall be placed to the
350+credit of the Oklahoma Tourism Capital
351+Improvement Revolving Fund, but in no event shall
352+such apportionment exceed Nine Million Dollars
353+($9,000,000.00) in any fiscal year, and
354+b. any amounts which exceed the limitations of
355+subparagraph a of this paragraph shall be placed to
356+the credit of the General Revenue Fund; and
357+5. For the fiscal year beginning Ju ly 1, 2015, and for each
358+fiscal year thereafter, six one-hundredths percent (0.06%) shall be
359+placed to the credit of the Oklahoma Historical Society Capital
360+Improvement and Operations Revolving Fund, but in no event shall
361+such apportionment exceed the tota l amount apportioned pursuant to
362+this paragraph for the fiscal year ending on June 30, 2015. Any
363+amounts which exceed the limitations of this paragraph shall be
364+placed to the credit of the General Revenue Fund.
365+B. Provided, for the fiscal year beginning July 1, 2007, and
366+every fiscal year ther eafter, an amount of revenue shall be
367+apportioned to each municipality or county which levies a sales tax
368+subject to the provisions of Section 1357.10 of this title and
369+subsection F of Section 2701 of this title equa l to the amount of

404-12. Establish programs and prov ide funding, from the revenues
405-apportioned pursuant to paragraph 4 of subsection C of Section 426
406-of this title, to support county sheriffs to enforce the
407-requirements of state law with respect to the comm ercial growth of
408-medical marijuana or other related business activity for which a
409-license is required pursuant to the provisions of law governing the
410-production, cultivation, transportation, distribution, sale, or
411-other actions related to medical marijuana .
412-SECTION 3. NEW LAW A ne w section of law to be codified
413-in the Oklahoma Statutes as Section 427.3A of Title 63, unless there
414-is created a duplication in numbering, reads as follo ws:
415-There is hereby crea ted in the State Treasury a revolving fund
416-for the Oklahoma Medical Marijuana Authority to be designated the
417-"County Sheriff Public Safe ty Grant Revolving Fund". The fund shall
418-be a continuing fund, not subject to fiscal year limit ations, and
419-shall consist of all monies received by the Oklahoma Medical
420-Marijuana Authority from the apportionment of the excise tax on
421-medical marijuana as pro vided by Section 426 of Title 63 of the
422-Oklahoma Statutes. All monies accruing to the credit o f said fund
423-are hereby appropriated and may be budg eted and expended by the
424-Oklahoma Medical Marijuana Authority for the purpose specified by
425-paragraph 12 of subs ection D of Section 427.3 of Title 63 of the
426-Oklahoma Statutes. Expenditures from said fund s hall be made upon
427-warrants issued by the State Trea surer against claims filed as

620-B. Provided, for the fiscal year beginning July 1, 2007, and

622-apportioned to each municipality or co unty which levies a sales tax
623-subject to the provisions of Section 1357.10 of this title and
624-subsection F of Section 2701 of this title equa l to the amount of

822-SECTION 5. AMENDATORY 70 O.S. 2021, Section 3 -104, is

854-1. Adopt policies and make rules f or the operation of the
855-public school system of the state;
856-2. Appoint, prescribe the duties and fix the compensation of a
857-secretary, an attorney and all other personnel necessary for the
858-proper performance of the functions of the State Board of Education.
859-The secretary shall not be a member of the Board;
860-3. Submit to the Governor a departmental bud get based upon
861-major functions of the Department as prepared b y the State
862-Superintendent of Pu blic Instruction and supported by detailed data
863-on needs and proposed operations as partially determined by the
864-budgetary needs of local school districts filed wi th the State Board
865-of Education for the ensuing fiscal year. Appropriations therefor
866-shall be made in lump-sum form for each major item in the budget as
867-follows:
868-a. State Aid to schools,
869-b. the supervision of all other functions of general and
870-special education including general control, free
871-textbooks, school lunch , Indian education and all
872-other functions of the Board and an amount sufficient
873-to adequately staff and administer these services, and
874-c. the Board shall determine the details by which the
875-budget and the appropriations are administered.
876-Annually, the Board shall make preparations to
877-consolidate all of the functions of the Department in
549+Oklahoma Statutes, but in no event shall the total amou nt
550+apportioned in any fiscal year pursua nt to this paragraph exceed the
551+amount of redbud school grant funds awarded pursuant to subsection B
552+of Section 3-104 of Title 70 of the Oklahoma Statutes;
553+3. Fourteen and eight hundred seventy -five thousandths perc ent
554+(14.875%) of the total proceeds of t he levy to the Department of

569+this subsection, shall be remitted to the General Revenue Fund.
570+SECTION 3. This act shall become effective July 1, 2022.
571+SECTION 4. It being immediately necessary for the preservation
572+of the public peace, health or safety, an emergency is hereby

906-for administration shall be designated as a part of
907-the total appropriation;
908-4. On the first day of December preceding each regular session
909-of the Legislature, p repare and deliver to the Governor and the
910-Legislature a report for the year ending June 30 immed iately
911-preceding the regular session of the Legislature. The report shall
912-contain:
913-a. detailed statistics and other information concerning
914-enrollment, attendance, expenditures including State
915-Aid, and other pertinent data for all public schools
916-in this state,
917-b. reports from each and every division within the State
918-Department of Education as submi tted by the State
919-Superintendent of Public Instruction and any ot her
920-division, department, institution or other agency
921-under the supervision of the Board,
922-c. recommendations for the improvement of the public
923-school system of the state,
924-d. a statement of the receipts and expenditures of the
925-State Board of Education for t he past year, and
926-e. a statement of plans and recommendations for the
927-management and improvement of public schools and such

957-5. Provide for the f ormulation and adoption of curricula,
958-courses of study and other instructional aids necessary for the
959-adequate instruction of pupils in the public schools;
960-6. Have authority in matters perta ining to the licensure and
961-certification of persons for instructi onal, supervisory and
962-administrative positions and services in the public schools of the
963-state subject to the provisions of Section 6-184 of this title, and
964-shall formulate rules governing th e issuance and revocation of
965-certificates for superintendents of schools, principals,
966-supervisors, librarians, clerical employees, school nurses, school
967-bus drivers, visiting teachers, classroom teachers and for other
968-personnel performing instructional, ad ministrative and supervisory
969-services, but not including members of boards of education and other
970-employees who do not work directly with pupils, and may charge a nd
971-collect reasonable fees for the issuance of such certificat es:
972-a. the State Department of E ducation shall not issue a
973-certificate to and shall revoke the ce rtificate of any
974-person who has been convicted, whether upon a verdict
975-or plea of guilty or upon a plea of nolo contendere,
976-or received a suspended sentence or any probationary
977-term for a crime or an attempt to commit a crime

1017-for in any of said laws,
1018-b. all funds collected by the State Department of
1019-Education for the issuance of certificate s to
1020-instructional, supervisory and administrative
1021-personnel in the public schools of the state shall be
1022-deposited in the "Teachers' Certificate Fund" in the
1023-State Treasury and may be expended by the State Board
1024-of Education to finance the activities of th e State
1025-Department of Education necessary to admin ister the
1026-program, for consultative services, publication costs,
1027-actual and necessary travel expenses as provided in

1059-balance in the Teachers' Certificate Fund in excess of
1060-Ten Thousand Dollars ($10,000.00) on June 30 of any
1061-fiscal year shall be transferre d to the General
1062-Revenue Fund of the State of Oklahoma. Until July 1,
1063-1997, the State Board of Education shall have
1064-authority for approval of teacher education programs.
1065-The State Board of Education shall also have authority
1066-for the administration of tea cher residency and
1067-professional development, subject to the provisions of
1068-the Oklahoma Teacher Preparation Act;
1069-7. Promulgate rules governing the classification, inspection,
1070-supervision and accrediting of all public nursery, kindergarten,
1071-elementary and secondary schools and on-site educational serv ices
1072-provided by public school districts or state -accredited private
1073-schools in partial hospitalization programs, day treatment programs,
1074-and day hospital progr ams as defined in this act for persons between
1075-the ages of three (3) and twenty-one (21) years of age in the state.
1076-However, no school shall be denied accreditation s olely on the basis
1077-of average daily attendance.

1104-Any school district which maintains an elementary school and
1105-faces the necessity of relocati ng its school facilities because of
1106-construction of a lake, either by state or federal authority, which
1107-will inundate the school facilities, shall be entitled to receive
1108-probationary accreditation from the State Board of Education for a
1109-period of five (5) years after the effective date of this act an d
1110-any school district, otherwise qualified, shall be entitled to
1111-receive probationary accreditation from the State Board of Education
1112-for a period of two (2) consecutive years to attain the minimum
1113-average daily attendance. The Head Start and public nurse ries or
1114-kindergartens operated from Community Action Program funds shal l not
1115-be subjected to the accrediting rules of the State Board of
1116-Education. Neither will the State Board of Education make rules
1117-affecting the operation of the public nurseries and ki ndergartens
1118-operated from federal funds secured through Community Actio n
1119-Programs even though they may be operating in the public schools of
1120-the state. However, any of the Head Start or public nurseries or
1121-kindergartens operated under federal regulations may make
1122-application for accrediting from the State Board of Education but
1123-will be accredited only if application for the approval of the
1124-programs is made. The status of no school district shall be changed
1125-which will reduce it to a lower classification un til due notice has
1126-been given to the proper authorities thereof and an opportunity

1155-Private and parochial schools may be accre dited and classified
1156-in like manner as public schools or, if an accrediting association
1157-is approved by the State Boa rd of Education, by procedures
1158-established by the State Board of Education to accept accreditation
1159-by such accrediting association, if appli cation is made to the State
1160-Board of Education for such accrediting;
1161-8. Be the legal agent of the State of Oklahoma to accept, in
1162-its discretion, the provisions of any Act of Congress appropriating
1163-or apportioning funds which are now, or may hereafter be, provided
1164-for use in connection with any phas e of the system of public
1165-education in Oklahoma. It shall prescribe su ch rules as it finds
1166-necessary to provide for the proper distribution of such funds in
1167-accordance with the state and federal laws;
1168-9. Be and is specifically hereby designated as the ag ency of
1169-this state to cooperate and deal with any officer, board or

1203-"National School Lunch A ct", and said State Board of Education is
1204-hereby authorized and directe d to accept the terms and provisions of
1205-said act and to enter into such agreements, not in conflict with the
1206-Constitution of Oklahoma or th e Constitution and Statutes of the
1207-United States, as may be necessary or appropriate to secure for the
1208-State of Oklahoma the benefits of the school lunch program
1209-established and referred to in said act;
1210-11. Have authority to secure and administer the ben efits of the
1211-National School Lunch Act, Public Law 396 of the 79th Congress of
1212-the United States, in the State of Okla homa and is hereby authorized
1213-to employ or appoint and fix the compensation of such additional
1214-officers or employees and to incur such exp enses as may be necessary
1215-for the accomplishmen t of the above purpose, administer the
1216-distribution of any state funds appropriated by the Legislature
1217-required as federal matching to reimburse on children's meals;
1218-12. Accept and provide for the administra tion of any land,
1219-money, buildings, gifts, donat ion or other things of value which may
1220-be offered or bequeathed to the schools under the supervision or
1221-control of said Board;
1222-13. Have authority to require persons having administrative
1223-control of all school districts in Oklahoma to make such regular and
1224-special reports regarding the activities of the schools in said
1225-districts as the Board may deem needful for the proper exercise of
1226-its duties and functions. Such authority shall include the right of

1253-the State Board of Education to withhold all state fund s under its
1254-control, to withhold official recognition, including accred iting,
1255-until such required reports have been filed and accepted in the
1256-office of said Board and to revoke the certificates of persons
1257-failing or refusing to make such reports;
1258-14. Have general supervision of the school lunch program. The
1259-State Board of Education may sponsor workshops for personnel and
1260-participants in the school lunch program and may develop, print and
1261-distribute free of charge or sell any materials, books and bulletins
1262-to be used in such school lunch programs. There is hereby created
1263-in the State Treasury a revolving fund for the Board, to be
1264-designated the School Lunch Workshop Revolving Fund. The fund shall
1265-consist of all fees derived from or on behalf of any partic ipant in
1266-any such workshop sponsored by the State Board of Education, o r from
1267-the sale of any materials, books and bulletins, and such funds shall
1268-be disbursed for expenses of such workshops and for develop ing,
1269-printing and distributing of such materials, books and bulletins
1270-relating to the school lunch program. The fund sha ll be
1271-administered in accordance with Section 155 of Title 62 of the
1272-Oklahoma Statutes;
1273-15. Prescribe all forms for school district a nd county officers
1274-to report to the State Board of Education where required. The State
1275-Board of Education shall also pres cribe a list of appropriation
1276-accounts by which the funds of school districts shall be budgeted,

1306-16. Provide for the establishment of a uniform system of pupil

1308-17. Have authority to provide for the he alth and safety of
1309-school children and school personnel while under the jurisdiction of
1310-school authorities;
1311-18. Provide for the supervision of the transportation of
1312-pupils;
1313-19. Have authority, upon request of the local school board, to
1314-act in behalf of the public schools of the state in the purchase of
1315-transportation equipm ent;
1316-20. Have authority and is hereby required to perform all duties
1317-necessary to the adminis tration of the public school system in
1318-Oklahoma as specified in the Oklahoma School Code; a nd, in addition
1319-thereto, those duties not specifically mentioned herein if not
1320-delegated by law to any other agency or official;
1321-21. Administer the State Public Com mon School Building
1322-Equalization Fund established by Section 32 of Article X of the
1323-Oklahoma Constitution. Any monies as may be appropriated or
1324-designated by the Legislature, other than ad valorem taxes, any
1325-other funds identified by the State Department of Education, which
1326-may include, but not be limited to, grants-in-aid from the federal

1353-government for building purposes, the proceeds of all property that
1354-shall fall to the state by escheat, penalties for unlawful holding
1355-of real estate by corporations, an d capital gains on assets of the
1356-permanent school funds, shall be deposited in the State Pu blic
1357-Common School Building Equalization Fund. The fund shall be used to
1358-aid school districts and charter schools in acquiring buildings,
1359-subject to the limitations fixed by Section 32 of Article X of the
1360-Oklahoma Constitution. It is hereby declared that the term
1361-"acquiring buildings" as used in Section 32 of Article X of t he
1362-Oklahoma Constitution shall mean acquiring or improving school
1363-sites, constructing, repairi ng, remodeling or equipping buildings,
1364-or acquiring school furniture, fixtures, or equipmen t. It is hereby
1365-declared that the term "school districts" as used in Section 32 of
1366-Article X of the Oklahoma Co nstitution shall mean school districts
1367-and eligible charter schools as defined in subsection B of this
1368-section. The State Board of Education sh all disburse redbud school
1369-grants annually from the State Public Common School Building
1370-Equalization Fund to public schools and eligible charter schools
1371-pursuant to subsection B of this sec tion. The Board shall
1372-promulgate rules for the implementation of d isbursing redbud school
1373-grants pursuant to this section. The State Board of Education shall
1374-prescribe rules for making grants of aid from, and for otherwise
1375-administering, the fund pursuan t to the provisions of this
1376-paragraph, and may employ and fix the d uties and compensation of
1377-

1404-personnel deemed necess ary to carry out the provisions of this
1405-paragraph. The cost of administering the fund shall be paid from
1406-monies appropriated to the State Board of Education for the
1407-operation of the State Department of Education. From monies
1408-apportioned to the fund, the State Department of Education may
1409-reserve not more than one-half of one percent (1/2 of 1%) for
1410-purposes of administering the fund;
1411-22. Recognize that the Director of the Oklahoma Departme nt of
1412-Corrections shall be the administrative authority for the sch ools
1413-which are maintained in the state reformatories and shall appoint
1414-the principals and teachers in such schools. Provided, that rules
1415-of the State Board of Education for the classificat ion, inspection
1416-and accreditation of public schools shall be applic able to such
1417-schools; and such schools shall comply with standards set by the
1418-State Board of Education; and
1419-23. Have authority to administer a revolving fund which is
1420-hereby created in the State Treasury, to be designated the
1421-Statistical Services Revolvin g Fund. The fund shall consist of all
1422-monies received from the various school districts of the state, the
1423-United States Government, and other s ources for the purpose of
1424-furnishing or financing statistical services and for any other
1425-purpose as designated b y the Legislature. The State Board of
1426-Education is hereby authorized to enter into agreements with school

1455-projects. The Statistical Services Revolving Fund shall be
1456-administered in accordance with Section 155 of Title 62 of the

1458-B. 1. The redbud school grants shall be determined by th e
1459-State Department of Education as follows:
1460-a. divide the county fo ur-mill levy revenue by four to
1461-determine the nonchargea ble county four-mill revenue
1462-for each school district,
1463-b. determine the amount of new re venue generated by the
1464-five-mill building fund levy as authorized by Section
1465-10 of Article X of the Oklahoma Con stitution for each
1466-school district as reported in the Ok lahoma Cost
1467-Accounting System for the preceding fiscal year,
1468-c. add the amounts calculat ed in subparagraphs a and b of
1469-this paragraph to determine the nonchargeable millage
1470-for each school district,
1471-d. add the nonchargeable millage in each district
1472-statewide as calculated in subparagraph c of this
1473-paragraph and divide the total by the average daily
1474-membership in public schools statewide based on the
1475-preceding school year's average daily membership,
1476-according to the provisions of Section 18-107 of this

1506-e. all eligible charter schools shall be included in

1509-eligible charter school, and the total number of
1510-districts shall be used to determine the statewide
1511-average baseline local funding per student,
1512-f. for each school district or eligible c harter school
1513-which is below the baseline local funding per student,
1514-the Department shall subtract the baseline local
1515-funding per student from the average nonchargeable
1516-millage per student of the school district or eligible
1517-charter school to determine the nonchargeable millage
1518-per student shortfall for each dis trict, and
1519-g. the nonchargeable millage per student shortfall for a
1520-school district or eligible charter school shall be
1521-multiplied by the average daily membership of the
1522-preceding school year of the e ligible school district
1523-or eligible charter school. Thi s amount shall be the
1524-redbud school grant amount for the school district or
1525-eligible charter school.

1552-2. For fiscal year 2022, m onies for the redbud school grants
1553-shall be expended from the funds apportioned pursuant to Section 2
1554-426 of this act Title 63 of the Oklahoma Statutes . For fiscal year
1555-2023 and each subsequent fiscal year, monies for the redbud school
1556-grants shall be appropriated apportioned pursuant to Section 2 426
1557-of this act, not to exceed three-fourths (3/4) of the tax collected
1558-in the preceding fiscal year pursuant to Section 426 of Title 63 of
1559-the Oklahoma Statutes as determined by the Oklahoma Tax Commission.
1560-For fiscal year 2023 and each subs equent fiscal year, if such
1561-appropriated funds are insufficient to fund the redbud school
1562-grants, then an additional apportionment of funds shall be made from
1563-sales tax collections as provided by subsection D of Section 3 of
1564-this act Title 63 of the Oklaho ma Statutes and Section 1353 of Title
1565-68 of the Oklahoma Statutes. If the apportionment of both funds
1566-revenue sources are insufficient, the Department s hall promulgate
1567-rules to permit a decrease to the b aseline local funding per st udent
1568-to the highest amount allowed with the funding available. The
1569-Department shall ensure the amounts necessary to fund the redbud
1570-school grants are provided to the Oklahoma Tax Commission by July 1
1571-of the applicable fiscal year .
1572-3. As used in this section, "eligible charter school" shall
1573-mean a charter school which is sponsored pursuant to the provisions
1574-of the Oklahoma Charter School Act. Provided, however, "eligible
1575-charter school" shall not include a charter school sponsored by the
1576-

1603-which provide in-person or blended instruction , as provided by
1604-Section 1-111 of this title, to not less than two-thirds (2/3) of
1605-students as the primary means of instructional service delivery.
1606-4. The Department shall d evelop a program to acknowledge the
1607-redbud school grant recipients and shall include elected members of
1608-the Oklahoma House of R epresentatives and Oklahom a State Senate who
1609-represent the school districts and eligible charter schools.
1610-5. The Department shall create a dedicated page on its website
1611-listing annual redbud school grant recipients, amount awarded to
1612-each recipient and other pertinent information about the Redbud
1613-School Funding Act.
1614-6. The Department shall provide the Chair of the House
1615-Appropriations and Budget Committee and the Chair of the Se nate
1616-Appropriations Committee no later than February 1 of each year with
1617-an estimate of the upcoming yea r's redbud school grant allocation as
1618-prescribed by this section.
1619-SECTION 6. This act shall become effective July 1, 2022.
1620-SECTION 7. It being immediately necessary for the preservation
1621-of the public peace, health or safety, an emergency is hereby
1622-declared to exist, by reas on whereof this act shall t ake effect and
1623-be in full force from and after its passage and approval. "

1716-SECTION 8. AMENDATORY 63 O.S . 2021, Section 426, as
1717-amended by Section 2, Chapter 563, O.S.L. 2021, is amended to read
1718-as follows:
1719-Section 426. A. The tax on retail medical marijuana sales will
1720-be established at seven percent (7%) of the gross amount received by
1721-the seller.
1722-B. This tax will be collected at t he point of sale. Except as
1723-provided for in subsection D, tax proceeds will be applied primarily
1724-to finance the regulatory office.
1725-C. Except as provided for in subsection D, if proceeds from the
1726-levy authorized by subsection A of this section exceed the budgeted
1727-amount for running the regulatory office, any surplus shall be
1728-apportioned with seventy-five percent (75%) going to the General
