7979 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
8080 SECTION 1. NEW LAW A new section of law to be codified
8181 in the Oklahoma Statutes as Section 1450.1 of Title 12, unless there
8282 is created a duplication in numbering, reads as follows:
8383 A. As used in this section:
8484 1. “Algorithm” means a set of instruct ions designed to perform
8585 a specific task;
8686 2. “Hate speech” means a phrase concerning content that an
8787 individual arbitrarily finds offensive based on his or her personal
8888 moral code;

140140 3. “Obscene” means that to the average person, applying
141141 contemporary community standards, the dominant theme of the mate rial
142142 taken as a whole appeals to prurient interest;
143143 4. “Political speech” means speech relating to the state, the
144144 government, the body politic, public administration or government
145145 policymaking. Political speech includes speech by the government or
146146 candidates for office and any discussion of social issues.
147147 Political speech does not include speech concerning the
148148 administration or the law of or relating to the civil aspects of
149149 government;
150150 5. “Religious speech” means a set of unproven answers, truth
151151 claims, faith-based assumptions and naked assertions that attem pt to
152152 explain the greater questions like how things were created, what
153153 humans should or should not be doing and what happens after death;
154154 and
155155 6. “Social media website” means a website or application that
156156 allows a user to construct a public or semi -public profile and
157157 enables users to communicate with each other for the primary purpose
158158 of posting information, comments, messages or images and:
159159 a. is open to the public,
160160 b. has more than seventy -five million (75,000,000)
161161 subscribers, and
162162 c. has not been specifically affiliated with any one
163163 political party or religion from its inception.

215215 Social media website shall not include electronic m ail or any online
216216 service, application or website consisting primarily of news,
217217 sports, entertainment or other information or c ontent that is not
218218 user-generated but is preselected or curated by the provider and for
219219 which any chat, comment or interacti ve functionality is inciden tal
220220 to, directly related to or dependent on the provis ion of such
221221 content.
222222 B. The owner or operator of a social media website who
223223 contracts with users in this state is subject to a private right of
224224 action by a social media website user if the so cial media website
225225 purposely:
226226 1. Deletes or censors a social media website user’s political
227227 speech or religious speech; or
228228 2. Uses an algorithm to suppress political speech or religious
229229 speech.
230230 C. 1. Damages available to a social media website user und er
231231 this section shall include:
232232 a. damages in an amount not to ex ceed Seventy-five
233233 Thousand Dollars ($75,000.00) per intentional deletion
234234 or censoring of the social media website user’s
235235 speech,
236236 b. actual damages,
237237 c. punitive damages if aggravating factors are present ,

290290 d. other applicable forms of equitable reli ef.
291291 2. The prevailing party in a cause of action under this section
292292 may be awarded costs and reasonable attorney fees.
293293 3. A social media website that restores from deletion or
294294 removes the censoring of a so cial media website user’s speech in a
295295 reasonable amount of time may use such fact to mitigate any damages .
296296 D. A social media website may not use the social media website
297297 user’s alleged hate speech as a basis for justification or defense
298298 to the action against the social media website at trial.
299299 E. 1. A social media website shall be immune from liability
300300 under this section if it deletes or censors a social media website
301301 user’s speech or uses an algorithm to disfavor or censure speech
302302 that:
303303 a. calls for immediate acts of violence,
304304 b. is obscene or pornographic in nature,
305305 c. is the result of operational error,
306306 d. is the result of a court order,
307307 e. comes from an inauthentic source or involved false
308308 impersonation,
309309 f. entices criminal conduct,
310310 g. involves the bullying of minors, or
311311 h. violates or misappropriates cop yright, trademark or
312312 other intellectual property.

364364 2. A social media website s hall not be liable under this
365365 section for a social media website u ser’s censoring of the speech of
366366 another social media website user.
367367 F. Only users who are eighteen (18) years o f age or older shall
368368 have standing to bring an action pursuant to this section .
369369 G. The Attorney General may bring a civil cause of action under
370370 this section on behalf of social media we bsite users who reside in
371371 this state whose political speech or religio us speech has been
372372 censored by a social media website.
373373 SECTION 2. This act shall become effective November 1, 2022.
