3965 An Act relating to the Oklahoma Children’s Code;
4066 amending 10A O.S. 2011, Section 1 -4-602, which
4167 relates to petitions for adjudication; requiring

4369 amendments to internal documents; prohibiting use of
4470 certain allegations against parent in future
4571 proceedings; providing for retroactive applica bility;

5177 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5278 SECTION 1. AMENDATORY 10A O.S. 2011, Section 1 -4-602, is
5379 amended to read as follows:
5480 Section 1-4-602. If the court finds that the factual
5581 allegations of the petition are not support ed by a preponderance of
5682 the evidence, the court shall order the petition dismissed and shall
5783 order the child discharged from any custody. The child ’s parents,
5884 guardian or other legal custodian shall also be discharged from any
5985 restriction or other previo us temporary order. Upon the dismissal
6086 of the petition, the Department of Human Services shall make
6187 necessary amendments in its internal documents to reflect that any
6288 allegations that may have been substa ntiated were determined by the

140+court to not be supp orted by a preponderance of the evidence and
91141 that the petition was dismissed. Any substantiated allegations that
92142 were part of a petition which was dismissed shall not be used
93143 against the parent in any fut ure court proceeding and shall be
94144 treated by the Department as if the allegations were
95145 unsubstantiated. This section shall be retroactive and shall apply
96146 regardless of when the allegations were substantiated.
97147 SECTION 2. This act shall bec ome effective November 1, 202 1.
