77	77	BE IT ENACTED BY THE PEOPLE O F THE STATE OF OKLAHOMA:
78	78	SECTION 1. NEW LAW A new section of law to be codified
79	79	in the Oklahoma Statutes as Section 198.3 of Title 40, unless there
80	80	is created a duplication in numbering, reads as follows:
81	81	A. It shall be unlawful fo r an employer to discharge or in any
82	82	other manner discriminate against an employee because the employee
83	83	has inquired about, discussed or disclosed the wages of the employee
84	84	or another employee with someone employed by the company; however,
85	85	an employer may prohibit a human resource employee, supervisor or
86	86	other employee whose job responsibilities require and allow access
87	87	to other employees' wage information from disclosing such
88	88	information except as may be required or allowed in the legitimate

141	141	or discharge such employee for disclosing any prohibited wage
142	142	information.
143	143	B. The provisions of this section shall apply only to employers
144	144	having twenty-five or more employees.
145	145	SECTION 2. AMENDATORY 40 O.S. 2011, Section 198.2, is
146	146	amended to read as follows:
147	147	Section 198.2. It shall be the duty of the Commissioner of
148	148	Labor to enforce the provisions of this act Section 198.1 of this
149	149	title and Section 1 of this act . Whenever the Commissioner is
150	150	informed of any alleged violations thereof, it shall be his or her
151	151	duty to investigate same and, in his discretion, said . The
152	152	Commissioner is hereby authorized to institute proceedings for the
153	153	enforcement of penalties herein provided befor e any court of
154	154	competent jurisdiction . Any employer who violates the provisions of
155	155	this act shall be deemed guilty of a misdemeanor and shall upon
156	156	conviction thereof, be punished by violations of the provisions of
157	157	Section 198.1 of this title and Section 1 of this act. The
158	158	Commissioner is authorized to im pose a fine of not less than Twenty-
159	159	five Dollars ($25.00) One Hundred Dollars ($100.00) nor more than
160	160	One Hundred Dollars ($100.00) Two Hundred Dollars ($2 00.00) for each
161	161	separate violation per pay period . In addition, upon a finding by
162	162	the Commissioner of Labor of a violation under this act, the
163	163	employer shall pay any back pay found to be owed to the employee .
