8383 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
8484 SECTION 1. AMENDATORY 70 O.S. 2011, Section 13 -101.2, as
8585 last amended by Section 1, Chapter 1, O.S.L. 2020 (7 0 O.S. Supp.
8686 2020, Section 13-101.2), is amended to read as follows:
8787 Section 13-101.2. A. There is hereby created the Lindsey
8888 Nicole Henry Scholarships for Students with Disabilities Program.
8989 The Lindsey Nicole Henry Scholarships for Students with Disabi lities
9090 Program is established to pro vide a scholarship to a private school
9191 of choice for students with disabilities for whom an individualized

143143 education program (IEP) in accordance with the Individuals with
144144 Disabilities Education Act (IDEA) or an individua lized service plan
145145 pursuant to Section 1-4-704 of Title 10A of the Oklahoma Statutes
146146 has been developed at any time prior to notifying the State
147147 Department of Education of the intent to participate in the Program
148148 and the IEP is in effect at the time the re quest for a scholarship
149149 is received by the State Department of Education or for students who
150150 have at least one parent who is incarcerated pursuant to subsec tion
151151 L of this section. Scholarships shall be awarded beginning with the
152152 2010-2011 school year.
153153 B. The parent or legal guardian of a p ublic school student with
154154 a disability or with at least one parent who is incar cerated
155155 pursuant to subsection L of this section may exercise their parental
156156 option and request to have a Lindsey Nicole Henry Scholarship
157157 awarded for the child to enroll in and attend a private school in
158158 accordance with this se ction and the scholarship shall be awarded
159159 if:
160160 1. The student has spent the prior school year in attendance at
161161 a public school in this state. For purposes of this sect ion, "prior
162162 school year in attendanc e" means that the student was enrolled in
163163 and reported by a school district for funding purposes during the
164164 preceding school year regardless of whether or not the student had
165165 an IEP at the time the student was counted fo r funding purposes. A

218218 who transfers to a school in this state from out of state or from a
219219 foreign country pursuant to a permanent change of station orders of
220220 the parent shall be exempt f rom the requirements of this paragra ph
221221 but shall be required to meet all other eligibil ity requirements to
222222 participate as provided for in this section. A student who has been
223223 provided services under an Individ ual Family Service Plan through
224224 the SoonerStart program and during transition was evaluated and
225225 determined to be eligible for school district services shall be
226226 exempt from the requirements of this paragraph but shall be required
227227 to meet all other eligibili ty requirements to participate as
228228 provided for in this section. A student who was in out-of-home
229229 placement with the Department of Hu man Services, who was adopted
230230 while in the permanent custody of the Department of Human Services
231231 or, who was in out-of-home placement with the Office of Juvenile
232232 Affairs or who has at least one parent who is incarcerated pursuant
233233 to subsection L of this section shall be exempt from the
234234 requirements of this paragraph but shall be required to meet all
235235 other eligibility requirements to participate as provided for in
236236 this section; and
237237 2. The parent or legal gu ardian has obtained acceptance for
238238 admission of the student to a private school that is eligible for
239239 the program as provided in subsection H of this section and has
240240 notified the State Department of Education of the reque st for a
241241 scholarship. Requests to p articipate in the program made after

293293 December 1 shall be granted, but funding for scholarships requested
294294 after December 1 shall not be available until the beginning of the
295295 next school year. The request shall be through a communication
296296 directly to the Depa rtment in a manner that creates a written or
297297 electronic record of the request and the date of receipt of the
298298 request. The Department shall notify the school district upon
299299 receipt of the request. For purposes of continu ity of educational
300300 choice, the scholarship shall remain in force until the student
301301 returns to a public school, graduates from high school or reaches
302302 the age of twenty-two (22), whichever occurs first. At any time,
303303 the parent or legal guardian of the stude nt may remove the student
304304 from the private school and place the student in another priv ate
305305 school that is eligible for the program as provided in subsection H
306306 of this section or place the student in a public school.
307307 C. A student shall be eligible for a sc holarship if the parent
308308 or legal guardian of the student made a request for a scholarsh ip
309309 for the 2010-2011 school year and the student transferred to an
310310 eligible private school but was subsequently denied a scholarship
311311 because the student did not have an IEP in effect on October 1,
312312 2009, but did meet all other eligibility requirements as se t forth
313313 in the Lindsey Nicole Henry Scholarships for Students with
314314 Disabilities Program Act.
315315 D. A student shall not be eligible for a Lindsey Nicole Henry
316316 Scholarship if the student is not having regular and direct contact

369369 private school.
370370 E. School districts shall notify the parent or legal guardian
371371 of a public school student with a disability or a public school
372372 student who has at least one parent who is incarcerated pursuant to
373373 subsection L of this section of all options available pursuant to
374374 this section and infor m the parent or legal guardian of the
375375 availability of information about the program from the State
376376 Department of Education throug h the toll-free telephone number or
377377 website. The notification shall be provided with or included in the
378378 copy of the "Parents Rights in Special Education: Notice of
379379 Procedural Safeguards " document given to parents at lea st annually
380380 or as otherwise required by law.
381381 F. 1. Acceptance of a Lindsey Nicole Hen ry Scholarship shall
382382 have the same effect as a parental revocation of consen t to service
383383 pursuant to 20 U.S.C., Sections 1414(a)(1)(D) and 1414(C) of the
384384 IDEA.
385385 2. Upon acceptance of a Lindsey Nicole Henry Scholarship, the
386386 parent or legal guardian shall as sume full financial responsibility
387387 for the education of the student, includi ng but not limited to
388388 transportation to and from the private school.
389389 G. If the parent or leg al guardian requests a Lindsey Nicol e
390390 Henry Scholarship and the student is accepted by the private school
391391 pending the availability of a space for the student, the parent or

443443 legal guardian of the student shall notify the State Department of
444444 Education before entering the private school and bef ore December 1
445445 in order to be eligible for the scho larship during the school year
446446 when a space becomes available for the studen t in the private
447447 school. If notification is made after December 1, payment of the
448448 scholarship shall not begin until the next sch ool year.
449449 H. 1. To be eligible to participate in the Lindsey Nicole
450450 Henry Scholarships for Students with Disabilities Program , a private
451451 school shall notify the State Department of Education of its intent
452452 to participate. The notice shall specify the gra de levels and
453453 services that the private school has available for students with
454454 disabilities who are participating in the schola rship program. The
455455 State Department of Education shall approve a private school as
456456 eligible to participate in the scholarship pr ogram upon
457457 determination that the private school:
458458 a. meets the accreditation requirements set by the State
459459 Board of Education o r another accrediting association
460460 approved by the State Board of Education. The State
461461 Department of Education shall list on its website all
462462 accrediting associations approved by th e Board,
463463 b. demonstrates fiscal soundness by having been in
464464 operation for one (1) school year or providing the
465465 State Department of Education with a statement by a
466466 certified public accountant confirming tha t the

518518 private school desiring to participate is ins ured and
519519 the owner or owners have sufficient capital or credit
520520 to operate the school for the upcoming year by serving
521521 the number of students anticipated with expected
522522 revenues from tuition and other source s that may be
523523 reasonably expected. In lieu of a st atement, a surety
524524 bond or letter of credit for the amount equal to the
525525 scholarship funds for any quarter may be filed with
526526 the Department,
527527 c. complies with the antidiscr imination provisions of 42
528528 U.S.C., Section 2000d,
529529 d. meets state and local health and s afety laws and
530530 codes,
531531 e. will be academically accountable to the parent or
532532 legal guardian for meeting the educational needs of
533533 the student,
534534 f. employs or contracts with teachers who hold
535535 baccalaureate or higher degrees, or have at least
536536 three (3) years of teaching experience in public or
537537 private schools, or have special skills, kn owledge, or
538538 expertise that qualifies them to provide instruction
539539 in subjects taught,
540540 g. complies with all state laws relating to general
541541 regulation of private schools, and

593593 h. adheres to the tenets of its published disciplinary
594594 procedures prior to the expul sion of a scholarship
595595 student.
596596 2. Upon approval of a private school, the State Department of
597597 Education shall provide on its webs ite all information and material
598598 submitted by the private school with its application.
599599 I. 1. Lindsey Nicole Henry Scholarship Program participants
600600 shall comply with the following:
601601 a. the parent or legal guardian shall select the private
602602 school from the schools approved for eligibility
603603 pursuant to subsection H of this section and apply for
604604 the admission of the child,
605605 b. the parent or legal guardian shall request the
606606 scholarship no later than December 1 of the school
607607 year during which the scholarship is req uested,
608608 c. any student participating in the scholar ship program
609609 shall attend throughout the school year, unless
610610 excused by the school for illness or other good cause,
611611 and shall comply fully with the code of conduct for
612612 the school,
613613 d. the parent or legal gu ardian shall fully comply with
614614 the parental involve ment requirements of the private
615615 school, unless excused by the school for il lness or
616616 other good cause, and

668668 e. upon issuance of a scholarship warrant, the parent or
669669 legal guardian to whom the warrant is mad e shall
670670 restrictively endorse the warrant to the pr ivate
671671 school for deposit into the account of the private
672672 school. The parent or legal guardian may not
673673 designate any entity or individual associated with the
674674 private school as the attorney in fact for the parent
675675 or legal guardian to endorse a warrant. A p arent or
676676 legal guardian who fails to comply with this
677677 subparagraph shall for feit the scholarship.
678678 2. A participant who fails to comply with this subsection
679679 forfeits the scholarship.
680680 J. Provisions governi ng payment of a Lindsey Nicole Henry
681681 Scholarship shall be as follows:
682682 1. The State Department of Education shall calculate the total
683683 cost of all scholarships for all eligible students in the state.
684684 The State Department of Education shall then reserve or retain from
685685 the total amount appropriated to the St ate Board of Education for
686686 State Aid purposes and any other revenue availabl e for allocation
687687 for State Aid purposes the total cost for all scholarship payments;
688688 2. The maximum scholarship granted for an e ligible student with
689689 disabilities shall be a calcul ated amount equivalent to the total
690690 State Aid factors for the applicable sch ool year multiplied by the
691691 grade and disability weights generated by that student for the

743743 applicable school year. The disability weights used in calculating
744744 the scholarship amount shall include all disability weights which
745745 correspond to the disabilities i ncluded in the multidisciplinary
746746 evaluation and eligibility group summary for the student at the time
747747 the request for a scholarsh ip is made by the parent or legal
748748 guardian. The maximum scholarship amount shall be calculated by the
749749 State Board of Education for each year the student is participating
750750 in the scholarship program;
751751 3. The amount of the scholarship shall be the amount cal culated
752752 in paragraph 2 of this subsection or the am ount of tuition and fees
753753 for the private school, whichever is less, minus up to two and one-
754754 half percent (2 1/2%) of the scholarship amount which may be
755755 retained by the State Department of Education as a f ee for
756756 administrative services rendered. The amoun t of any assessment fee
757757 required by the private school and the amount associ ated with
758758 providing services and therapies to address the disabilities of the
759759 student may be paid from the total amount of the sc holarship. The
760760 amount of the scholarship shall be prorated to reflect the number of
761761 days remaining in the current school year, if the scholarship
762762 request is granted after the beginning of the school year;
763763 4. The State Department of Education shall notify the private
764764 school of the amount of the scholarshi p within ten (10) days after
765765 receiving the request for a scholarship, when t he total State Aid
766766 factors have been determined for the current fiscal year. The

818818 initial payment shall be made after the Departm ent verifies
819819 admission acceptance and enrollment. Quarterly payments shall be
820820 made upon verification of continued enrollment a nd attendance at the
821821 private school. Payment shall be made by the Department with an
822822 individual warrant made payable to the pare nt or legal guardian of
823823 the student and mailed by t he Department to the private school that
824824 the parent or legal guardian choose s. The parent or legal guardian
825825 shall restrictively endorse the warrant to the private schoo l for
826826 deposit into the account of th e private school;
827827 5. The State Department of Educa tion shall not be responsible
828828 for any additional costs associated with speci al education and
829829 related services incurred by the private school for the student
830830 including the cost of teachers, equipment, mater ial, and special
831831 costs associated with the special education class;
832832 6. The State Department of Education shall establish a tol l-
833833 free telephone number or website that provides parents or legal
834834 guardians and private schoo ls with information about the progra m;
835835 7. The State Department of Education shall requ ire an annual,
836836 notarized, sworn compliance statement by participating privat e
837837 schools certifying compliance with state laws and shall retain all
838838 records received from a participating private school. The S tate
839839 Department of Education shall post on its webs ite the annual
840840 compliance statement for each participating private school; a nd

892892 8. The State Department of Education shall cross -check the list
893893 of participating scholars hip students with the public school
894894 enrollments prior to each scholarship payment to av oid duplication.
895895 K. 1. The State Superintendent of Public Instruction shal l
896896 deny, suspend, or revoke the participation of a private school in
897897 the scholarship program i f it is determined that the private school
898898 has failed to comply with the provisions of this section. However,
899899 in instances in which the noncompliance is correctab le within a
900900 reasonable amount of time and in which the health, safety , or
901901 welfare of the students is not threatened, the Superint endent may
902902 issue a notice of noncompliance which sh all provide the private
903903 school with a time frame within which to provide evi dence of
904904 compliance prior to taking action to suspend or revoke participation
905905 in the scholarship program.
906906 2. If the Superintende nt intends to deny, suspend , or revoke
907907 the participation of a private school in the scholarship program,
908908 the Department shall n otify the private school of the proposed
909909 action in writing by certified mail and regular mail to the private
910910 school's address of record with the Department. The Department
911911 shall also notify any parents or legal guardians of scholarship
912912 students attending the private school. The notification shall
913913 include the reasons for the proposed action and n otice of the
914914 timelines and procedure s set forth in this subsection.

966966 3. The private school that is adversely affected by the
967967 proposed action shall have fifteen (15 ) days from receipt of the
968968 notice of proposed action to file with the Department a request fo r
969969 an administrative hearing proceedi ng pursuant to the Administrative
970970 Procedures Act.
971971 4. Upon receipt of a request for a hearing, the State Board of
972972 Education shall commence a hearing within sixty (60) days after the
973973 receipt of the formal written request and enter an order within
974974 thirty (30) days after the hearing.
975975 5. The Board may immedia tely suspend payment of scholarship
976976 funds if it is determined that there is probable cause to believe
977977 that there is an imminent threat to the health, safety , or welfare
978978 of the students or fraudulent activi ty on the part of the private
979979 school.
980980 L. A parent or legal guardian who requests a Lindsey Nicole
981981 Henry Scholarship for a public school student who has at least one
982982 parent who is incarcerated sha ll provide to the State Board of
983983 Education documentation verifying a parent is incarcerated in the
984984 custody of the Department of Corrections, another state 's prison
985985 system or the Federal Bureau of Prisons including but not limited to
986986 the Department of Corrections inmate num ber.
987987 M. No liability shall arise on the part of the state, the State
988988 Board of Education, the State Department of Education or a school
989989 district based on the award or use of any scholarship provided

10431043 M. N. The inclusion of private schools within options available
10441044 to public school students in Oklahoma shall not expand the
10451045 regulatory authority of the state or any school district to impose
10461046 any additional regulation of private schools beyond those reasonably
10471047 necessary to enforce the requirements expressly set forth in this
10481048 section.
10491049 N. O. If the State Department of Education determines that a
10501050 school district prior to the effective date of this act August 26,
10511051 2011, has failed to comply with the provisions of the Lindsey Nicole
10521052 Henry Scholarships for Students with Disabil ities Program Act and
10531053 has failed to make full or partial scholarship payments for eligible
10541054 students, the Department shall have authority to reduce the amount
10551055 of State Aid allocated to the school d istrict or require the school
10561056 district to make repayment to the Department of State Aid
10571057 allocations in an amount equal to the amount of scholarship payments
10581058 the school district failed to make. The Department shall make
10591059 payment to the parent or legal guard ian in the amount the school
10601060 district failed to make in the manner as provided for in subsection
10611061 J of this section.
10621062 O. P. The State Department of Education shall annually prepare
10631063 and post on its website a report of Lindse y Nicole Henry
10641064 Scholarships for Students with Disabilities Program. The annual

11241124 participation in the program, grade level, economically
11251125 disadvantaged status, racial and ethnic groups and disability
11261126 category or eligibility due to subsection L of this section .
11271127 SECTION 2. This act shall become effective September 1, 2021.
