7979 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
8080 SECTION 1. AMENDATORY 26 O.S. 2011, Section 4 -109.3, as
8181 last amended by Section 1, Chapter 242, O.S.L. 2017 (26 O.S. Supp.
8282 2020, Section 4-109.3), is amended to read as follows:
8383 Section 4-109.3. A. When a qualified elec tor applies for
8484 issuance or renewal o f an Oklahoma driver license, or issuance of a
8585 state identification card i ssued pursuant to Section 6 -105 of Title
8686 47 of the Oklahoma Statutes, he or she shall be provided voter
8787 registration services as required by the National Voter Registration
8888 Act. All completed paper voter registration applications sh all be
8989 transmitted by the agency accepting the application at the close of

141141 business each week to the State Election Board in preaddressed,
142142 postage-prepaid envelopes pro vided by the State Election Board. I f
143143 a person registers or declines to register to vot e, the office at
144144 which the person submits the voter registration application or the
145145 fact that the person declined to register shall remain confidential
146146 and will be used only for voter registration purposes .
147147 B. A change of address for an Oklahoma driver li cense or state
148148 identification card submitted by a registered voter shall also serve
149149 as a change of address for voter registration purposes if the new
150150 address is within the same county where the voter is re gistered to
151151 vote. If the new address is outside th e county where the vote r is
152152 currently registered to vote, the voter shall be sent a notice and
153153 application with instructions for registering to vote at the new
154154 address. A change of address for an Oklahoma driver license or
155155 state identification card shall not be used to update a voter
156156 registration address if the registrant states in writing that the
157157 change of address is not for voter registration purposes.
158158 C. Motor license agents shall receive fifty cents ($0.50) per
159159 valid paper voter registration applicat ion or application for change
160160 in voter registration taken by themselves and employees of the motor
161161 license agent's office taken at the agent 's office, payable by the
162162 State Election Board.
163163 D. The Oklahoma Tax Commission shall notify the Secretary of
164164 the State Election Board of m otor license agent appointments. The

216216 Oklahoma Department of Public Safety shall notify the Secretary of
217217 the State Election Board of motor licens e agents qualified to issue
218218 driver licenses.
219219 E. The Secretary of the State Election Boa rd is authorized to
220220 develop with the Department of Public Safety a system to
221221 electronically transmit voter registration applications from motor
222222 license agencies to the State Election Board or county electi on
223223 boards. Such system shall be consistent with th e requirements for
224224 electronic submission of voter registration applications provided in
225225 Section 4-109.4 of this title.
226226 F. The Secretary of the State Election Board sha ll develop a
227227 system by which the Depa rtment of Public Safety and motor license
228228 agents shall provide to the Secr etary electronic records containing
229229 the legal name, age, residence, citizenship information and the
230230 electronic signature of each person who is a qualified elector or
231231 will be a qualified elector within the next two (2) years.
232232 G. Upon receiving the electron ic record for and electronic
233233 signature of a qualified elector or a person who will become a
234234 qualified elector within the next two (2) years, th e Secretary shall
235235 provide the informati on to the county election board of the county
236236 in which the person may be r egistered or preregistered as a
237237 qualified elector. The Secretary or county election board shall
238238 notify each person of the process to:
239239 1. Decline being registered as a qualified ele ctor; or

291291 2. Adopt a political party affiliation.
292292 H. If a person notified under subsection G of this section does
293293 not decline to be registered as an elector within twenty -one (21)
294294 calendar days after the Secretary or county election board issues
295295 the notification, the person's electronic record and electro nic
296296 signature submitted under subsection F of this section shall
297297 constitute a completed registration card for the person for purposes
298298 of this section. The person sha ll be registered to vote if the
299299 county election board determines that the person is a qual ified
300300 elector and the person is not already registered to vote.
301301 I. A county election board shall not send a ballot to, or add
302302 to an elector registration list, a pers on who meets eligibility
303303 requirements until at least twenty-one (21) calendar days after t he
304304 Secretary or county election board provided notification to the
305305 person as described in subsection G of this section.
306306 J. The Secretary of the State Election Board shall promulgate
307307 rules and procedures t o implement the requirements of this section.
308308 SECTION 2. This act shall become effective November 1, 20 21.
