8181 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
8282 SECTION 1. NEW LAW A new section of law to be codified
8383 in the Oklahoma Statutes as Section 7-101 of Title 30, unless there
8484 is created a duplication in numb ering, reads as follows:
8585 This act shall be known and may be cited as the "Oklahoma
8686 Standby Guardianship Act ".
8787 SECTION 2. NEW LAW A new section of law to be codified
8888 in the Oklahoma Statutes as Se ction 7-102 of Title 30, unless there

142142 1. "Deported" means an alien or noncitizen having been
143143 involuntarily removed from the United States and sent back to their
144144 country of origin;
145145 2. "Deportation proceeding" means any proceeding by which an
146146 alien or noncitizen may be expelled from the United Sta tes for
147147 violations of immigration law;
148148 3. "Designation" means a writing which is voluntarily ex ecuted
149149 in conformance with the requirements of Section 3 of this act and
150150 signed by a parent and names a person to act as standby guardian;
151151 4. "Parent" means a genetic or adoptive parent or parent
152152 determined in accordance with the standards set forth in Se ction
153153 7700-201 of Title 10 of the Oklahoma Statutes, and includes a
154154 person, other than a parent, who has physical custody of a child and
155155 who has either been awa rded custody by a court or claims a right to
156156 custody;
157157 5. "Qualified parent" means a parent who has been deported or
158158 is currently the subject of a deportation pro ceeding, as evidenced
159159 in writing, by a court of appropriate jurisdiction or by a state or
160160 the federal government;
161161 6. "Standby guardian" means a person who, in accordance with
162162 this act, is designated in writing or approved by the court to
163163 temporarily assume the duties of guardian of the person or guardian
164164 of the property, or both, of a minor child on behalf of or in

216216 conjunction with a qualified par ent upon the occurrence of a
217217 triggering event; and
218218 7. "Triggering event" means the event upon the occurrence of
219219 which the standby guardian may be authorized to act. The triggering
220220 event shall be specifie d in the court order or written designation
221221 and shall be the earlier of either the commencement o f a deportation
222222 proceeding or the deportatio n of the qualified parent.
223223 SECTION 3. NEW LAW A new section of law to be codified
224224 in the Oklahoma Statutes as Section 7-103 of Title 30, unless there
225225 is created a duplication in numb ering, reads as follows:
226226 A. A parent may execute a written designation of a standby
227227 guardian at any time. The written designation shall state:
228228 1. The name, address and birthdate of the child affected;
229229 2. The triggering event; and
230230 3. The name and address of the person designated as standby
231231 guardian or alternate.
232232 The written designation shall be signed by the parent. The
233233 designated standby guardian or alternate ma y not sign on behalf of
234234 the parent. The signed designation shall be delivered to the
235235 standby guardian and any alternate named as soon as practicable.
236236 B. Following such delivery of the designation, the authority of
237237 a standby guardian to act for a qualifie d parent shall commence upon
238238 the occurrence of the specified triggering event and the qualified
239239 parent's written consent to such commencement signed by the parent.

291291 C. A standby guardian under a designation shall have the
292292 authority of a guardian of the per son and a guardian of the property
293293 of the child, unless otherwise specified in the designation.
294294 D. A designated standby guardian or alternate shall file a
295295 petition for approval as standby guardian. The petition shall be
296296 filed as soon as practicable after the occurrence of the triggering
297297 event but in no event later than thirty (30) days after the date of
298298 the commencement of his or her authority. The authority of the
299299 standby guardian shall cease upon his or her failure to so file but
300300 shall recommence upon such filing. The petition shall be
301301 accompanied by a copy of the designation and any documentation
302302 supporting the occurrence of the triggering event.
303303 E. Upon the filing of a petition, notice of the filing shall
304304 promptly be given to each parent of the chil d whose identity and
305305 whereabouts are known to the p etitioner. The court shall direct the
306306 issuance of summonses to the child, if the child is twelve (12)
307307 years of age or older and the proposed standby guardian and
308308 alternate, if any, and such other persons as appear to the court to
309309 be proper or necessary pa rties to the proceedings including the
310310 child's parents, guardian, legal custodian or other person standing
311311 in loco parentis, if the identity and whereabouts of such persons
312312 are known.
313313 F. The court shall enter an order approving the designated
314314 guardian as standby guardian upon finding that:

366366 1. The person was duly designated as standby guardian pursuant
367367 to this section and the designation has not been revoked;
368368 2. A specified triggering event occurred, and the parent
369369 consented to commencement of the standby guardian's authority;
370370 3. The best interests of the child will be served by approval
371371 of the standby guardian; and
372372 4. If the petition is by an alternate, that the designated
373373 standby guardian is unwilling or unable to serve.
374374 G. An order approving the stan dby guardian shall not be entered
375375 without a hearing if there is another known parent, stepparents,
376376 adult siblings, or other adult related to the child by blood,
377377 marriage or adoption who requests a hearing within ten (10) days of
378378 the date that notice of the filing was sent or if there is other
379379 litigation pending regarding custody of the child.
380380 H. Prior to any hearing on the petition, the court may appoint
381381 a discreet and competent attorney at law as guardian ad litem to
382382 represent the child. The qualified parent shall not be required to
383383 appear in court if the parent is detained and unable to appear, or
384384 upon motion for any other good cause shown.
385385 SECTION 4. NEW LAW A new section of law to be codified
386386 in the Oklahoma Statutes as Section 7-104 of Title 30, unless there
387387 is created a duplication in numb ering, reads as follows:
388388 A. Upon petition of any person, the district court of the
389389 jurisdiction in which a child resides may approve a perso n as

441441 standby guardian for a child of a qualified pa rent upon the
442442 occurrence of a specified triggering event. If requested in the
443443 petition, the court may also approve an alternate standby guardian
444444 identified by the petitioner to act in the event that at an y time
445445 after approval pursuant to this section the standby guardian is
446446 unable or unwilling to assume the responsibilities of the standby
447447 guardianship.
448448 B. The petition shall state:
449449 1. The name and address of the petitioner and his or her
450450 relationship to the child, the name and address of the child 's
451451 qualified parent and the name and address of any other parent of the
452452 child whose identity and whereabouts are known to the petitioner or
453453 can reasonably be ascertained;
454454 2. The name, address and birthdate of the child;
455455 3. The nature of the proposed triggering e vent including when a
456456 qualified parent's consent would be effective in those cases w here
457457 such consent is chosen as the triggering event;
458458 4. Whether the parent has been deported or the deportation
459459 process has commenced and, if so, when and by whom;
460460 5. The name and address of the person proposed as standby
461461 guardian and any alternate and whe ther the petition requests that
462462 such person be given authority as a guardian of the person or
463463 guardian of the property of the minor, or both;

515515 6. A statement of any known reasons as to why the child's other
516516 parent is not assuming or should not assume the responsibilities of
517517 a standby guardian; and
518518 7. Whether there is any prior judicial history regarding
519519 custody of the child or any pending litigation regarding custody of
520520 the child.
521521 SECTION 5. NEW LAW A new section of law to be codified
522522 in the Oklahoma Statutes as Section 7-105 of Title 30, unless there
523523 is created a duplication in numb ering, reads as follows:
524524 A. The authority of a standby guardian ap proved by the court
525525 may be revoked by the qualified parent by filing a notice of
526526 revocation with the court. The notice of revocation shall identify
527527 the standby guardian or alternate standby guardian to wh ich the
528528 revocation will apply. A copy of the revocation shall also be
529529 delivered to the standby guardian whose authority is revoked and any
530530 alternate standby guard ian who may then be authorized to act.
531531 B. At any time following his or her approval by the c ourt, a
532532 standby guardian approved by the court may decline to serve by
533533 filing a written statement of refusal with the court and having the
534534 statement personally serv ed on the qualified parent and any
535535 alternate standby guardian who may then be authorized to act.
536536 C. When a written designation has been executed but is not yet
537537 effective because the triggering event has not yet occurred, the
538538 parent may revoke, or the prospective standby guardian may refuse ,

590590 the designation by notifying the other party in writing . A written
591591 designation may also be revoked by the execution of a subsequent
592592 inconsistent designation.
593593 D. When a standby guardian 's authority becomes effective upon
594594 the occurrence of a triggering event of the qualified parent, the
595595 standby guardian's authority to act on behalf of th e qualified
596596 parent continues even though the qualified parent is not deported or
597597 the deportation proceeding is dismissed, unless the quali fied parent
598598 notifies the standby guardian and the court, in writing, that the
599599 standby guardian's authority is revoked due to the triggering e vent
600600 expiring.
601601 E. If at any time the court finds that the parent no longer
602602 meets the definition of "qualified parent," the court shall rescind
603603 its approval of the standby guardian.
604604 SECTION 6. NEW LAW A new se ction of law to be codi fied
605605 in the Oklahoma Statutes as Section 7-106 of Title 30, unless there
606606 is created a duplication in numb ering, reads as follows:
607607 A child's parent, stepparent, adult sibling or any adult rela ted
608608 to the child by blood, marriage or adoption may petition the court
609609 which approved the standby guardian at any time following such
610610 approval and prior to any termination of the standby guardianship
611611 for review of whether continuation of the standby guardi anship is in
612612 the best interests of the child. Notice of the filing of a petition
613613 shall promptly be given to the standby guardian, the child, if the
