7979 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
8080 SECTION 1. NEW LAW A new section of law t o be codified
8181 in the Oklahoma Statutes as Section 456.2a of Title 74, unless there
8282 is created a duplication in numbering, reads as follows:
8383 A. 1. A racial impact statement shall be prepared as provided
8484 in this section for any bill filed in the Senate or House of
8585 Representatives that will:
8686 a. create a new offense,
8787 b. significantly change an existing offense,
8888 c. change the penalty for an existing offense, or

142142 2. A racial impact statement shall be prepared and filed with
143143 the chair of the committee to which the bill is referred bef ore the
144144 bill is heard in the committee during a regular or special session
145145 of the Legislature.
146146 3. If a bill requiring a racial impact statement is amended, a
147147 revised racial impact statement shall be prepared f or the bill as
148148 amended.
149149 B. 1. Except as provided in paragraph 2 of this subsection,
150150 the Oklahoma Statistical Analysis Center at the Oklahoma State
151151 Bureau of Investigation , with the assistance of the Department of
152152 Mental Health and Substance Abuse Services, shall prepare the racial
153153 impact statement required by this section.
154154 2. The Oklahoma Statistical Analysis Center at the Oklahoma
155155 State Bureau of Investigation , with the assistance of the Office of
156156 Juvenile Affairs, shall prepare a racial impact statement for a bill
157157 pursuant to subsection A of this section that has an impact on
158158 minors.
159159 3. The racial impact statement shall include without
160160 limitation:
161161 a. the estimated number of criminal cases per year that
162162 the bill will affect,

214214 b. the impact of the bill on a minority as defined in
215215 subsection E of this secti on,
216216 c. the impact of the bill upon correctional facilities
217217 and services, and
218218 d. other matters deemed relevant to the bill at issue.
219219 C. 1. If a racial impact sta tement indicates a disparate
220220 impact on a minority as defined in subsection E of this section , the
221221 sponsor of the bill shall consider whether the bill may be amended
222222 to achieve its purpose with a lessened impact on minorities.
223223 2. If a bill is amended to l essen its impact on minorities, the
224224 sponsor of the bill shall identify in writing, in the bill and the
225225 racial impact statement, the methodology used to lessen the impact
226226 on minorities in the amended proposal.
227227 3. If the sponsor of the bill elects not to ame nd the bill or
228228 if the racial impact statement for an amended bill continues to
229229 indicate a disparate impact on a minority, the sponsor of the bill
230230 shall:
231231 a. withdraw the bill, or
232232 b. identify in writing, in the bill and the racial impact
233233 statement, his or he r reasoning for proceeding with
234234 the bill despite the disparate impact.
235235 D. 1. If a bill is scheduled for a floor hearing in the Senate
236236 or House of Representatives and a racial impact statement is
237237 required by this section and has not been provided by the a uthor of

289289 the bill or by the committee to which the bill was referred, the
290290 presiding officer of the Senate or House of Representatives shall
291291 cause the bill to be referred for the preparation of a racial impact
292292 statement, which shall be filed with the presiding officer at least
293293 five (5) days prior to the bill again being scheduled for a floor
294294 hearing.
295295 2. The bill shall not be called back up for consideration until
296296 a racial impact statement has been filed with the presiding officer.
297297 E. For purposes of this s ection, “minority” shall mean African
298298 American, Hispanic American, American Indian or Native A merican,
299299 Asian and Pacific Islander.
300300 SECTION 2. This act shall become effective November 1, 20 21.
