79	79	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
80	80	SECTION 1. NEW LAW A new section of law t o be codified
81	81	in the Oklahoma Statutes as Section 456.2a of Title 74, unless there
82	82	is created a duplication in numbering, reads as follows:
83	83	A. 1. A racial impact statement shall be prepared as provided
84	84	in this section for any bill filed in the Senate or House of
85	85	Representatives that will:
86	86	a. create a new offense,
87	87	b. significantly change an existing offense,
88	88	c. change the penalty for an existing offense, or

142	142	2. A racial impact statement shall be prepared and filed with
143	143	the chair of the committee to which the bill is referred bef ore the
144	144	bill is heard in the committee during a regular or special session
145	145	of the Legislature.
146	146	3. If a bill requiring a racial impact statement is amended, a
147	147	revised racial impact statement shall be prepared f or the bill as
148	148	amended.
149	149	B. 1. Except as provided in paragraph 2 of this subsection,
150	150	the Oklahoma Statistical Analysis Center at the Oklahoma State
151	151	Bureau of Investigation , with the assistance of the Department of
152	152	Mental Health and Substance Abuse Services, shall prepare the racial
153	153	impact statement required by this section.
154	154	2. The Oklahoma Statistical Analysis Center at the Oklahoma
155	155	State Bureau of Investigation , with the assistance of the Office of
156	156	Juvenile Affairs, shall prepare a racial impact statement for a bill
157	157	pursuant to subsection A of this section that has an impact on
158	158	minors.
159	159	3. The racial impact statement shall include without
160	160	limitation:
161	161	a. the estimated number of criminal cases per year that
162	162	the bill will affect,

214	214	b. the impact of the bill on a minority as defined in
215	215	subsection E of this secti on,
216	216	c. the impact of the bill upon correctional facilities
217	217	and services, and
218	218	d. other matters deemed relevant to the bill at issue.
219	219	C. 1. If a racial impact sta tement indicates a disparate
220	220	impact on a minority as defined in subsection E of this section , the
221	221	sponsor of the bill shall consider whether the bill may be amended
222	222	to achieve its purpose with a lessened impact on minorities.
223	223	2. If a bill is amended to l essen its impact on minorities, the
224	224	sponsor of the bill shall identify in writing, in the bill and the
225	225	racial impact statement, the methodology used to lessen the impact
226	226	on minorities in the amended proposal.
227	227	3. If the sponsor of the bill elects not to ame nd the bill or
228	228	if the racial impact statement for an amended bill continues to
229	229	indicate a disparate impact on a minority, the sponsor of the bill
230	230	shall:
231	231	a. withdraw the bill, or
232	232	b. identify in writing, in the bill and the racial impact
233	233	statement, his or he r reasoning for proceeding with
234	234	the bill despite the disparate impact.
235	235	D. 1. If a bill is scheduled for a floor hearing in the Senate
236	236	or House of Representatives and a racial impact statement is
237	237	required by this section and has not been provided by the a uthor of

289	289	the bill or by the committee to which the bill was referred, the
290	290	presiding officer of the Senate or House of Representatives shall
291	291	cause the bill to be referred for the preparation of a racial impact
292	292	statement, which shall be filed with the presiding officer at least
293	293	five (5) days prior to the bill again being scheduled for a floor
294	294	hearing.
295	295	2. The bill shall not be called back up for consideration until
296	296	a racial impact statement has been filed with the presiding officer.
297	297	E. For purposes of this s ection, “minority” shall mean African
298	298	American, Hispanic American, American Indian or Native A merican,
299	299	Asian and Pacific Islander.
300	300	SECTION 2. This act shall become effective November 1, 20 21.
