60 | 51 | | SECTION 1. AMENDATORY 63 O.S. 2011, Section 2 -302, as |
---|
61 | 52 | | last amended by Section 57, Chapter 161, O.S.L. 2020 (63 O.S. Supp. |

62 | 53 | | 2020, Section 2-302), is amended to read as f ollows: |

63 | 54 | | Section 2-302. A. Every person who manufactures, distributes, |
---|
64 | 55 | | dispenses, prescribes, administers or uses for scientific purposes |
---|
65 | 56 | | any controlled dangerous substance within or into this state, or who |
---|
66 | 57 | | proposes to engage in the manufa cture, distribution, dispensing, |
---|
67 | 58 | | prescribing, administering or use for scie ntific purposes of any |
---|
99 | 89 | | Director under Section 2 -101 et seq. of this title to manufacture, |
---|
100 | 90 | | distribute, dispense, or co nduct research with controlled dangerous |
---|
101 | 91 | | substances may possess, manufacture, distribute, dispense, or |
---|
102 | 92 | | conduct research with those subs tances to the extent authorized by |
---|
103 | 93 | | their registration and in conformity with the other provisions of |
---|
104 | 94 | | the Uniform Controll ed Dangerous Substances Act. Every wholesaler, |
---|
105 | 95 | | manufacturer or distributor of any drug product containing |
---|
106 | 96 | | pseudoephedrine or phenylpro panolamine, or their salts, isomers, or |
---|
107 | 97 | | salts of isomers shall obtain a registration issued by the Director |
---|
108 | 98 | | of the Oklahoma State Bureau of Narcotics and Dangerous Drugs |
---|
109 | 99 | | Control in accordance with rules promulgated by the Director and as |
---|
110 | 100 | | provided for in Section 2-332 of this title. |
---|
111 | 101 | | B. Out-of-state pharmaceutical suppliers who provide controlled |
---|
112 | 102 | | dangerous substances to indiv iduals within this state shall obtain a |
---|
113 | 103 | | registration issued by the Director of the Oklahoma State Bureau of |
---|
114 | 104 | | Narcotics and Dangerous Dru gs Control, in accordance with rules |
---|
115 | 105 | | promulgated by the Director. This provision shall also apply to |
---|
116 | 106 | | wholesale distributors who distribute controlled dangerous |
---|
117 | 107 | | substances to pharma cies or other entities registered within this |
---|
118 | 108 | | state in accordance with rule s promulgated by the Director. |
---|
150 | 139 | | Suboxone or buprenorphine, shall obtain a registration issued by the |
---|
151 | 140 | | Director of the Oklahoma S tate Bureau of Narcotics and Dangerous |
---|
152 | 141 | | Drugs Control. |
---|
153 | 142 | | D. Every manufacturer and distributor required to register |
---|
154 | 143 | | under the provisions of this section shall provide all data required |
---|
155 | 144 | | pursuant to 21 U.S.C., Section 827(d)(1) information regarding the |
---|
156 | 145 | | sale of controlled dangerous substances on a monthly basis to the |
---|
157 | 146 | | Oklahoma State Bureau of Narcotics and Dangerous Drugs Control. |
---|
158 | 147 | | Controlled dangerous substances in Schedule I shall be reported in |
---|
159 | 148 | | accordance with rules promulgated by the Director. Reporting of |
---|
160 | 149 | | controlled dangerous substances pursuant to 21 U.S.C., Section |
---|
161 | 150 | | 827(d)(1) in Schedules II, III, IV and V may be in the same format |
---|
162 | 151 | | used in reporting the same or similar information to the federal |
---|
163 | 152 | | Drug Enforcement Adm inistration and shall include, but not b e |
---|
164 | 153 | | limited to: |
---|
165 | 154 | | 1. The manufacturer's or distributor's name, address, phone |
---|
166 | 155 | | number, DEA registration number and controlled dange rous substance |
---|
167 | 156 | | registration number issued by the Bureau; |
---|
168 | 157 | | 2. The name, address and DEA registration number of the entity |
---|
169 | 158 | | to whom the controlled dangerous sub stance was sold; |
---|
200 | 188 | | 5. The number of containers and the strength and quantity of |
---|
201 | 189 | | controlled dangerous substanc es in each container sold. |
---|
202 | 190 | | E. The information m aintained and provided pursuant to |
---|
203 | 191 | | subsection D of this section shall be confidential and not open to |
---|
204 | 192 | | the public. Access to the information shall, at the discretion of |
---|
205 | 193 | | the Director, be limited to: |
---|
206 | 194 | | 1. Peace officers certified pursuant to the provisions of |
---|
207 | 195 | | Section 3311 of Title 70 of the Oklahoma Statutes who are employed |
---|
208 | 196 | | as investigative agents of the Oklahoma State Bureau of Narcotics |
---|
209 | 197 | | and Dangerous Drugs Control or the Office of t he Attorney General; |
---|
210 | 198 | | 2. The United States Drug Enforcement Administration D iversion |
---|
211 | 199 | | Group Supervisor; and |
---|
212 | 200 | | 3. A multicounty gr and jury properly convened pursuant to the |
---|
213 | 201 | | provisions of the Multicounty Grand Jury Act. |
---|
214 | 202 | | F. Manufacturers, distributors, home ca re agencies, hospices, |
---|
215 | 203 | | home care services, medical facility owners referred to in |
---|
216 | 204 | | subsection C of this section and scientific r esearchers shall obtain |
---|
217 | 205 | | a registration annually. Other practitioners shall obtain a |
---|
218 | 206 | | registration for a period to be determined b y the Director that will |
---|
219 | 207 | | be for a period not less than one (1) year nor more than three (3) |
---|
220 | 208 | | years. |
---|
251 | 238 | | substance, annually, shall obtain a registration issued by the |
---|
252 | 239 | | Director for a fee of Se venty Dollars ($70.00). Such persons shall |
---|
253 | 240 | | be subject to all applicable provisions of Section 2 -101 et seq. of |
---|
254 | 241 | | this title and such applicable rules promulga ted by the Director for |
---|
255 | 242 | | those individuals identi fied in subparagraph a of paragraph 32 of |
---|
256 | 243 | | Section 2-101 of this title. Persons registered by the Director |
---|
257 | 244 | | pursuant to this subsection may possess controlled dangerous |
---|
258 | 245 | | substances to the extent authorized by t heir registration and in |
---|
259 | 246 | | conformity with the oth er provisions of the Uniform Controlled |
---|
260 | 247 | | Dangerous Substances Act. |
---|
261 | 248 | | H. The following persons shall not be required to register and |
---|
262 | 249 | | may lawfully possess controlled dangerous substanc es under the |
---|
263 | 250 | | provisions of Section 2-101 et seq. of this title: |
---|
264 | 251 | | 1. An agent, or an employee thereof, of any registered |
---|
265 | 252 | | manufacturer, distributor, dispenser or user for scientific purposes |
---|
266 | 253 | | of any controlled dangerous substance, if such agent is acting in |
---|
267 | 254 | | the usual course of such agen t's or employee's business or |
---|
268 | 255 | | employment; |
---|
269 | 256 | | 2. Any person lawfully acting under the direction of a p erson |
---|
270 | 257 | | authorized to administer controlled dangerous substances under |
---|
271 | 258 | | Section 2-312 of this title; |
---|
301 | 287 | | in the usual course of such carrier's or warehouser's business or |
---|
302 | 288 | | employment; |
---|
303 | 289 | | 4. An ultimate user or a person in possession of any controlled |
---|
304 | 290 | | dangerous substance pursuant to a lawful o rder of a practitioner; |
---|
305 | 291 | | 5. An individual pharma cist acting in the usual course of such |
---|
306 | 292 | | pharmacist's employment with a pharmacy registered pursuant to the |
---|
307 | 293 | | provisions of Section 2 -101 et seq. of this title; |
---|
308 | 294 | | 6. A nursing home lic ensed by this state; |
---|
309 | 295 | | 7. Any Department of Mental Health and Substance Abuse Services |
---|
310 | 296 | | employee or any person whose facility con tracts with the Department |
---|
311 | 297 | | of Mental Health and Substance Abuse Services whose possession of |
---|
312 | 298 | | any dangerous drug, as defined in Se ction 353.1 of Title 59 of t he |
---|
313 | 299 | | Oklahoma Statutes, is for the purpose of deli very of a mental health |
---|
314 | 300 | | consumer's medicine to the consumer's home or residence; |
---|
315 | 301 | | 8. Registered nurses and licensed practical nurses; and |
---|
316 | 302 | | 9. An assisted living facility licensed b y the State of |
---|
317 | 303 | | Oklahoma. |
---|
318 | 304 | | I. The Director may, by rule, waive the requiremen t for |
---|
319 | 305 | | registration or fee for registration of certa in manufacturers, |
---|
320 | 306 | | distributors, dispensers, prescribers, administrators , or users for |
---|
321 | 307 | | scientific purposes if the Director finds i t consistent with the |
---|
322 | 308 | | public health and safety. |
---|
352 | 337 | | manufactures, distributes, dispenses, prescribes, administers , or |
---|
353 | 338 | | uses for scientific purposes controlled dan gerous substances. |
---|
354 | 339 | | K. The Director is authorize d to inspect the establishment of a |
---|
355 | 340 | | registrant or applicant for registration in accordance with rules |
---|
356 | 341 | | promulgated by the Director. |
---|
357 | 342 | | L. No person engaged in a profession or occupati on for which a |
---|
358 | 343 | | license to engage in such activity is provided by law shall b e |
---|
359 | 344 | | registered under the Uniform Controlled Dangerous Substances Act |
---|
360 | 345 | | unless such person holds a valid license of such person 's profession |
---|
361 | 346 | | or occupation. |
---|
362 | 347 | | M. Registrations shall be is sued on the first day of Nov ember |
---|
363 | 348 | | of each year. Registrations may be issued at other times,; however, |
---|
364 | 349 | | upon certification of the professional licensing board. |
---|
365 | 350 | | N. The licensing boards of all professions and occupations to |
---|
366 | 351 | | which the use of controlled dangero us substances is incidental shall |
---|
367 | 352 | | furnish a current list to the Director, n ot later than the first day |
---|
368 | 353 | | of October of each year, of the persons holding valid licenses. All |
---|
369 | 354 | | such persons except persons exempt from registration requirements |
---|
370 | 355 | | under subsection H of this section shall be su bject to the |
---|
371 | 356 | | registration requirements of Secti on 2-101 et seq. of this title. |
---|
372 | 357 | | O. The licensing bo ard of any professional defined as a mid- |
---|
373 | 358 | | level practitioner shall notify and furnish to the Director, not |
---|
403 | 387 | | licensed and registere d with their respective boards to prescribe, |
---|
404 | 388 | | order, select, obtain and administer controlled dangerous |
---|
405 | 389 | | substances. The licensing board shall immediately not ify the |
---|
406 | 390 | | Director of any action subsequently tak en against any such |
---|
407 | 391 | | individual. |
---|
408 | 392 | | P. Beginning Novemb er 1, 2010, each registrant that prescribes, |
---|
409 | 393 | | administers or dispenses methadone shall be required to check the |
---|
410 | 394 | | prescription profile of the patient on the cen tral repository of the |
---|
411 | 395 | | Oklahoma State Bureau of Narcotics and Dangerous Drugs Control. |
---|
412 | 396 | | SECTION 2. This act shall become effective November 1, 2021. |
---|
