5950 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHO MA:
6051 SECTION 1. AMENDATORY 63 O.S. 2011, Section 2 -302, as
6152 last amended by Section 57, Chapter 161, O.S.L. 2020 (63 O.S. Supp.
6253 2020, Section 2-302), is amended to read as f ollows:
6354 Section 2-302. A. Every person who manufactures, distributes,
6455 dispenses, prescribes, administers or uses for scientific purposes
6556 any controlled dangerous substance within or into this state, or who
6657 proposes to engage in the manufa cture, distribution, dispensing,
6758 prescribing, administering or use for scie ntific purposes of any
59+controlled dangerous substance within or into this state shall
60+obtain a registration issued by the Director of the Oklahoma State
61+Bureau of Narcotics and Dang erous Drugs Control, in accordance with
62+rules promulgated by the Director. Persons registered by the

95-controlled dangerous substance within or into this state shall
96-obtain a registration issued by the Director of the Oklahoma State
97-Bureau of Narcotics and Dangerous Drugs Control, in accordance with
98-rules promulgated by the Director. Persons registered by the
9989 Director under Section 2 -101 et seq. of this title to manufacture,
10090 distribute, dispense, or co nduct research with controlled dangerous
10191 substances may possess, manufacture, distribute, dispense, or
10292 conduct research with those subs tances to the extent authorized by
10393 their registration and in conformity with the other provisions of
10494 the Uniform Controll ed Dangerous Substances Act. Every wholesaler,
10595 manufacturer or distributor of any drug product containing
10696 pseudoephedrine or phenylpro panolamine, or their salts, isomers, or
10797 salts of isomers shall obtain a registration issued by the Director
10898 of the Oklahoma State Bureau of Narcotics and Dangerous Drugs
10999 Control in accordance with rules promulgated by the Director and as
110100 provided for in Section 2-332 of this title.
111101 B. Out-of-state pharmaceutical suppliers who provide controlled
112102 dangerous substances to indiv iduals within this state shall obtain a
113103 registration issued by the Director of the Oklahoma State Bureau of
114104 Narcotics and Dangerous Dru gs Control, in accordance with rules
115105 promulgated by the Director. This provision shall also apply to
116106 wholesale distributors who distribute controlled dangerous
117107 substances to pharma cies or other entities registered within this
118108 state in accordance with rule s promulgated by the Director.
109+C. Every person who owns in whole or in part a public or
110+private medical facility for whi ch a majority of patients are issued
111+on a reoccurring monthl y basis a prescription for opioids,
112+benzodiazepines, barbiturates or cariso prodol, but not including

146-C. Every person who owns in whole or in part a public or
147-private medical facility for which a majority of patients are issu ed
148-on a reoccurring monthly basis a prescription for opioids,
149-benzodiazepines, barbiturates or carisoprodol, but not including
150139 Suboxone or buprenorphine, shall obtain a registration issued by the
151140 Director of the Oklahoma S tate Bureau of Narcotics and Dangerous
152141 Drugs Control.
153142 D. Every manufacturer and distributor required to register
154143 under the provisions of this section shall provide all data required
155144 pursuant to 21 U.S.C., Section 827(d)(1) information regarding the
156145 sale of controlled dangerous substances on a monthly basis to the
157146 Oklahoma State Bureau of Narcotics and Dangerous Drugs Control.
158147 Controlled dangerous substances in Schedule I shall be reported in
159148 accordance with rules promulgated by the Director. Reporting of
160149 controlled dangerous substances pursuant to 21 U.S.C., Section
161150 827(d)(1) in Schedules II, III, IV and V may be in the same format
162151 used in reporting the same or similar information to the federal
163152 Drug Enforcement Adm inistration and shall include, but not b e
164153 limited to:
165154 1. The manufacturer's or distributor's name, address, phone
166155 number, DEA registration number and controlled dange rous substance
167156 registration number issued by the Bureau;
168157 2. The name, address and DEA registration number of the entity
169158 to whom the controlled dangerous sub stance was sold;
159+3. The date of the sale of the controlled dangerous substance;
160+4. The name and National Drug Code of the controlled dangerous
161+substance sold; and

197-3. The date of the sale of the controlled dangerous substance;
198-4. The name and National Drug Code of the controlled dangerous
199-substance sold; and
200188 5. The number of containers and the strength and quantity of
201189 controlled dangerous substanc es in each container sold.
202190 E. The information m aintained and provided pursuant to
203191 subsection D of this section shall be confidential and not open to
204192 the public. Access to the information shall, at the discretion of
205193 the Director, be limited to:
206194 1. Peace officers certified pursuant to the provisions of
207195 Section 3311 of Title 70 of the Oklahoma Statutes who are employed
208196 as investigative agents of the Oklahoma State Bureau of Narcotics
209197 and Dangerous Drugs Control or the Office of t he Attorney General;
210198 2. The United States Drug Enforcement Administration D iversion
211199 Group Supervisor; and
212200 3. A multicounty gr and jury properly convened pursuant to the
213201 provisions of the Multicounty Grand Jury Act.
214202 F. Manufacturers, distributors, home ca re agencies, hospices,
215203 home care services, medical facility owners referred to in
216204 subsection C of this section and scientific r esearchers shall obtain
217205 a registration annually. Other practitioners shall obtain a
218206 registration for a period to be determined b y the Director that will
219207 be for a period not less than one (1) year nor more than three (3)
220208 years.
209+G. Every trainer or handler of a canine controlled dangerous
210+substances detector who, in the ordinary course of such trainer 's or
211+handler's profession, desires to possess any controlle d dangerous

248-G. Every trainer or handler of a canine controlled dangerous
249-substances detector who, in the ordinary course of such trainer 's or
250-handler's profession, desires to possess any controlled dang erous
251238 substance, annually, shall obtain a registration issued by the
252239 Director for a fee of Se venty Dollars ($70.00). Such persons shall
253240 be subject to all applicable provisions of Section 2 -101 et seq. of
254241 this title and such applicable rules promulga ted by the Director for
255242 those individuals identi fied in subparagraph a of paragraph 32 of
256243 Section 2-101 of this title. Persons registered by the Director
257244 pursuant to this subsection may possess controlled dangerous
258245 substances to the extent authorized by t heir registration and in
259246 conformity with the oth er provisions of the Uniform Controlled
260247 Dangerous Substances Act.
261248 H. The following persons shall not be required to register and
262249 may lawfully possess controlled dangerous substanc es under the
263250 provisions of Section 2-101 et seq. of this title:
264251 1. An agent, or an employee thereof, of any registered
265252 manufacturer, distributor, dispenser or user for scientific purposes
266253 of any controlled dangerous substance, if such agent is acting in
267254 the usual course of such agen t's or employee's business or
268255 employment;
269256 2. Any person lawfully acting under the direction of a p erson
270257 authorized to administer controlled dangerous substances under
271258 Section 2-312 of this title;
259+3. A common or contract carrie r or warehouser, or an emplo yee
260+thereof, whose possession of any controlled dangerous substance is

299-3. A common or contract carrier or warehouser, or an employee
300-thereof, whose possession of any controlled dangerous substance is
301287 in the usual course of such carrier's or warehouser's business or
302288 employment;
303289 4. An ultimate user or a person in possession of any controlled
304290 dangerous substance pursuant to a lawful o rder of a practitioner;
305291 5. An individual pharma cist acting in the usual course of such
306292 pharmacist's employment with a pharmacy registered pursuant to the
307293 provisions of Section 2 -101 et seq. of this title;
308294 6. A nursing home lic ensed by this state;
309295 7. Any Department of Mental Health and Substance Abuse Services
310296 employee or any person whose facility con tracts with the Department
311297 of Mental Health and Substance Abuse Services whose possession of
312298 any dangerous drug, as defined in Se ction 353.1 of Title 59 of t he
313299 Oklahoma Statutes, is for the purpose of deli very of a mental health
314300 consumer's medicine to the consumer's home or residence;
315301 8. Registered nurses and licensed practical nurses; and
316302 9. An assisted living facility licensed b y the State of
317303 Oklahoma.
318304 I. The Director may, by rule, waive the requiremen t for
319305 registration or fee for registration of certa in manufacturers,
320306 distributors, dispensers, prescribers, administrators , or users for
321307 scientific purposes if the Director finds i t consistent with the
322308 public health and safety.
309+J. A separate registration shall be required at each principal
310+place of business or professional practice where the applicant

350-J. A separate registration shall be required at each principal
351-place of business or professional practice where the applicant
352337 manufactures, distributes, dispenses, prescribes, administers , or
353338 uses for scientific purposes controlled dan gerous substances.
354339 K. The Director is authorize d to inspect the establishment of a
355340 registrant or applicant for registration in accordance with rules
356341 promulgated by the Director.
357342 L. No person engaged in a profession or occupati on for which a
358343 license to engage in such activity is provided by law shall b e
359344 registered under the Uniform Controlled Dangerous Substances Act
360345 unless such person holds a valid license of such person 's profession
361346 or occupation.
362347 M. Registrations shall be is sued on the first day of Nov ember
363348 of each year. Registrations may be issued at other times,; however,
364349 upon certification of the professional licensing board.
365350 N. The licensing boards of all professions and occupations to
366351 which the use of controlled dangero us substances is incidental shall
367352 furnish a current list to the Director, n ot later than the first day
368353 of October of each year, of the persons holding valid licenses. All
369354 such persons except persons exempt from registration requirements
370355 under subsection H of this section shall be su bject to the
371356 registration requirements of Secti on 2-101 et seq. of this title.
372357 O. The licensing bo ard of any professional defined as a mid-
373358 level practitioner shall notify and furnish to the Director, not
359+later than the first da y of October of each year th at such
360+professional holds a valid license, a c urrent listing of individuals

401-later than the first day of October of each year that su ch
402-professional holds a valid license, a current listing of individuals
403387 licensed and registere d with their respective boards to prescribe,
404388 order, select, obtain and administer controlled dangerous
405389 substances. The licensing board shall immediately not ify the
406390 Director of any action subsequently tak en against any such
407391 individual.
408392 P. Beginning Novemb er 1, 2010, each registrant that prescribes,
409393 administers or dispenses methadone shall be required to check the
410394 prescription profile of the patient on the cen tral repository of the
411395 Oklahoma State Bureau of Narcotics and Dangerous Drugs Control.
412396 SECTION 2. This act shall become effective November 1, 2021.
