6356 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
6457 SECTION 1. AMENDATORY 22 O.S. 2011, Section 929, is
6558 amended to read as follows:
6659 Section 929. A. Upon any appeal of a conviction by the
6760 defendant in a noncapital criminal case, the appellate court, if it
6861 finds prejudicial error in the sentenci ng proceeding only, may set
6962 aside the sentence rendered and remand the case to the trial court
63+in the jurisdiction in which the defendant was originally sentenced
64+for resentencing. N o error in the sentencing proceeding shall

97-in the jurisdiction in which the defendant was originally sentenced
98-for resentencing. No error in the sentencing proceeding shall
9991 result in the reversal of the conviction in a criminal case unless
10092 the error directly affected the determination of guilt.
10193 B. When a criminal case is remanded for vacation of a sentence,
10294 the court may shall:
10395 1. Set the case for a nonjury sentencing proceeding; or
10496 2. If the defendant or the prosecutor so requests in wri ting
10597 was originally sentenced by a jury , impanel a new sente ncing jury
10698 unless jury resentencing is waived by the defendant and the
10799 prosecutor.
108100 C. If a written request for a jury trial is filed within twenty
109101 (20) days of the date of the appellate court ord er, the trial court
110102 shall impanel a new jury for the purpose of conducting a new
111103 sentencing proceeding.
112104 1. The defendant may affirmatively waive resentencing before
113105 the appropriate trial court within ninety (90) days o f the appellate
114106 court order remanding for resentencing; provided, however, the
115107 defendant may not waive resentencing after the commencement of t he
116108 resentencing hearing or t rial. The defendant may not waive
117109 resentencing on an appeal or petition for a writ o f extraordinary
118110 relief sought by the prosecution or if the original sentence was
119111 unlawful. If the defendant affirmatively waives resentencing
120112 pursuant to this subsection, the original sentence shall be
113+reinstated by the trial court. A sentence reinstated pursuant to
114+this subsection shall no t be appealable by the defendant.

148-reinstated by the trial court. A sentence reinstated pursuant to
149-this subsection shall not be appealable by the defendant.
150141 D. All exhibits and a tra nscript of all testimony and other
151142 evidence properly admitted in the prior trial and sentencing shall
152143 be admissible in the new sentencing proceeding. The defendant may
153144 testify at his or her resen tencing proceeding in accordance with the
154145 requirements of the Oklahoma Evidence Code. Additional relevant
155146 evidence may be admitted including tes timony of witnesses who
156147 testified at the previous trial.
157148 2. The provisions of this section are procedural and shall
158149 apply retroactively to any defendant sentenced in this state.
159150 D. E. This section shall not be construed to amend or be in
160151 conflict with the provisions of Section 701.10 or 701.10a of Title
161152 21 of the Oklahoma Stat utes relating to sentencing and resen tencing
162153 in death penalty cases; Section 438 860.1 of this act title relating
163154 to the trial procedure for defendants prosecuted for second or
164155 subsequent offense; or the provisions of Sections 439 926.1 and 440
165156 927.1 of this act title relating to assessment o f punishment in the
166157 original trial proceedings.
167158 SECTION 2. This act shall become effective November 1, 2021.
