147147 Section 350. The county commissioners and members of the county
148148 excise board of each county shall designate and publish or post on a
149149 newspaper’s website or a government website between the 1st and 20th
150150 of January each year which holidays the county offices will be
151151 closed.
152152 SECTION 2. AMENDATORY 19 O.S. 2011 , Section 444, is
153153 amended to read as follows:
154154 Section 444. It shall be the mandatory duty of the board of
155155 county commissioners to cause to be published publish in a newspaper
156156 published in the county, or placed on a newspaper’s website or a
157157 government website, a full and complete report of all its official
158158 proceedings at each regular and special meeting, except blanket
159159 purchase orders, within the time provided for in Sections 445 and
160160 446 of this title, and the board o f county commissioners shall pay
161161 for the same from the appropriation as provided in this se ction.
162162 The board of county commissioners may also order the publication of
163163 the official proceedings in a newspaper to be printed in any other
164164 than the English Langu age whenever it shall deem it necessary for
165165 the better information of the inhabitants. The board of county
166166 commissioners may omit the listing of all employees and their
167167 salaries approved for payment in the monthly publication of
168168 proceedings. However, it shall be the mandatory duty of the board
169169 of county commissioners to cause to be published a full and complete
170170 report of all the county employees and their salaries paid ann ually.

222222 An asterisk shall be placed in front of the names of employees paid
223223 for less than the full twelve (12) months of the preceding calendar
224224 year. The listing shall reflec t the gross salary o f every employee
225225 reported to the Internal Revenue Service on the W-2 Form of the
226226 employee. Such annual publication of the employees and their
227227 salaries shall be published annually in th e month of February for
228228 the preceding calendar year in a newspaper of the county which meets
229229 the requirements set forth in Section 1 06 of Title 25 of the
230230 Oklahoma Statutes or placed on a newspaper ’s website or a government
231231 website.
232232 It shall also be the man datory duty of the board of county
233233 commissioners and the county excise board, each fiscal year, to take
234234 such steps as may be necessa ry and proper under the statutes
235235 relating to estimates of needs and appropriations, to appropriate,
236236 in the General Governmen t account within the general fund of the
237237 county, an amount sufficient to pay for the publication of all such
238238 proceedings during the fiscal year, at the legal rate therefor, but
239239 in no event less than the total of lega l claims for publication of
240240 such proceedings during the immediately preceding fiscal year .
241241 SECTION 3. AMENDATORY 25 O.S. 2011, Section 106, is
242242 amended to read as follows:
243243 Section 106. No legal notice, advertisement, or publicatio n of
244244 any kind required or provided for b y the laws of this state to be
245245 published in a newsp aper shall have forc e or effect unless published

297297 in a legal newspaper of the coun ty. A legal newspaper of the county
298298 is any newspaper which, during a period of one hundred four (104)
299299 consecutive weeks imm ediately prior to the first publication of such
300300 notice, advertisement, or publication:
301301 1. has Has maintained a paid general subscri ption circulation
302302 in the county; and
303303 2. has Has been admitted to the United States mails as paid
304304 second-class mail matter; and
305305 3. has Has been continuously and uninterrupted ly published in
306306 the county. If there is no legal newspaper in a county, then all
307307 legal notices, advertisements, or publications of any kind required
308308 or provided for by the laws of this state shall be publ ished in a
309309 legal newspaper in an adjoining county o f this state, which
310310 newspaper has general circulation in the county or political
311311 subdivision in which such notice is required ; and
312312 4. Has maintained a newspaper Internet website or has access to
313313 a statewide Internet website established and maintained by a press
314314 association in Oklahoma as a repository for such legal notices .
315315 Nothing in this section shall invalidate the publication of such
316316 legal notices, advertisements , or publications in a newspaper which
317317 has moved its place of publication from one location in the county
318318 to another location in the same county without breaking the
319319 continuity of its regular issues for the requisite length of time,
320320 or the name of which ma y have been changed when said the change of

373373 regulations. Failure to issue or publish said the newspaper for a
374374 period of fourteen (14) days due to fire, accident, or other
375375 unforeseen cause, or by reason of the pendency of mortgage
376376 foreclosure, attachment, execution, or other legal p roceedings
377377 against the type, presses, or other personal property used by the
378378 newspaper, shall not be deemed a failure to maintain continuous and
379379 consecutive publicat ion as required by the provisions of thi s
380380 section, nor shall said the failure invalidate th e publication of a
381381 notice otherwise valid. Failure to issue or publish a newspap er
382382 qualified to publish legal notices, advertisements, or publications
383383 of any kind, for a period totaling not more than four teen (14)
384384 consecutive days during a calendar year s hall not be deemed a
385385 failure to maintain continuous and consecutive publication a s
386386 required by the provisions of this section, nor shall said the
387387 failure invalidate the publication of a notice otherwise va lid.
388388 SECTION 4. AMENDATORY 25 O.S. 2011, Section 311, as last
389389 amended by Section 4, Chapter 3, O.S.L. 2020 (25 O.S. Supp. 2020,
390390 Section 311), is amended to read as follows:
391391 Section 311. A. Notwithstanding any other provisions of law,
392392 all regularly scheduled, continued or reconve ned, special or
393393 emergency meetings of public bodies shall be preceded by public
394394 notice as follows:

446446 1. All public bodies shall give notice in writing by December
447447 15 of each calendar year of the schedule sh owing the date, time and
448448 place of the regularly sch eduled meetings of such public bodies for
449449 the following calendar year;
450450 2. All state public bodies, including, but not limited to,
451451 public trusts and other bodies with the state as beneficiary, shall
452452 give such notice to the Secretary of State;
453453 3. All county public bodies including, but not limited to,
454454 public trusts and any other bodies with the county as beneficiary,
455455 shall give such notice to the county clerk of the county wherein
456456 they are principally locat ed;
457457 4. All municipal public bodies, including, but not limited to,
458458 public trusts and any other bodies with the municipality as
459459 beneficiary, shall give such notice to the municip al clerk of the
460460 municipality wherein they are principally located;
461461 5. All multicounty, regional, areawide or district public
462462 bodies including, but not limited to, district boards of education,
463463 shall give such notice to the county clerk of the county where in
464464 they are principally located, or if no office exists, to the county
465465 clerk of the county or counties served by such public body ;
466466 6. All governing boards of state institutions of higher
467467 education, and committees and subcommittees thereof, shall give such
468468 notice to the Secretary of State. All other public bodies covered
469469 by the provisions of the Oklahoma Open Meeting Act which exis t under

521521 the auspices of a state institution of higher education, but a
522522 majority of whose members are not members of the institu tion’s
523523 governing board, shall give such notice to the county clerk of the
524524 county wherein the institution is principally located;
525525 7. The Secretary of State and each county clerk or municipal
526526 clerk shall keep a record of all notices received in a register o pen
527527 to the public for inspection during regular office hours, and, in
528528 addition, shall make known upon any request of any person t he
529529 contents of the register;
530530 8. If any change is to be made of the date, time or place of
531531 regularly scheduled meetings of publ ic bodies, then notice in
532532 writing shall be given to the Secretary of State or county clerk or
533533 municipal clerk, as required herein , not less than ten (10) days
534534 prior to the implementation of any such change;
535535 9. In addition to the advance public notice in w riting required
536536 to be filed for regularly scheduled meetings, described in par agraph
537537 1 of this subsection, all public bodies shal l, at least twenty-four
538538 (24) hours prior to such regularly scheduled meetings, display
539539 public notice of the meeting by at least one of the following
540540 methods:
541541 a. by posting information that includes date, t ime, place
542542 and agenda for the meeting in prominent public view at
543543 the principal office of the public body or at the
544544 location of the meeting if no office exists, or

598598 accordance with Section 3106.2 of Title 74 of the
599599 Oklahoma Statutes. Additionally, the public body
600600 shall offer and consistently maintain an email
601601 distribution system for distribution of such notice of
602602 a public meeting required by this subsecti on, and any
603603 person may request to be included witho ut charge, and
604604 their request shall be accepted. The emailed notice
605605 of a public meeting required by this subsection shall
606606 include in the body of the email or as an attachment
607607 to the email the date, time, p lace and agenda for the
608608 meeting and it shall be sen t no less than twenty -four
609609 (24) hours prior to the meeting. Additionally, except
610610 as provided in subparagraph c of this paragra ph, the
611611 public body shall make the notice of a public meeting
612612 required by this subsection available to the public in
613613 the principal office of the public body or at the
614614 location of the meeting during normal business hours
615615 at least twenty–four (24) hours prio r to the meeting,
616616 or
617617 c. upon the effective date of this act on March 18, 2020,
618618 and until November 15, 2020, or the Governor decla ring
619619 the state of emergency to be terminated, whichever

672672 required to make the notice of a public me eting
673673 available to the public in the principal office of th e
674674 public body or at the location of the meeting dur ing
675675 normal business hours at least twenty -four (24) hours
676676 prior to the meeting;
677677 10. The twenty-four (24) hours required in paragraph 9 of this
678678 subsection shall exclude Saturdays, Sundays and holidays lega lly
679679 declared by the State of Oklahoma. The posting or distribution of a
680680 notice of a public meeting as described in paragraph 9 of this
681681 subsection shall not preclude a public body from considering at its
682682 regularly scheduled meeting any new business. “New business”, as
683683 used herein, shall mean any matter no t known about or which could
684684 not have been reasonably foreseen prior to the time of the posting;
685685 11. In the event any meeting is to be continued or reconvened,
686686 public notice of such action including date, time and place of the
687687 continued meeting, shall be given by announcement at the original
688688 meeting. Only matters appearing on the agenda of the meeting which
689689 is continued may be discussed at the con tinued or reconvened
690690 meeting;
691691 12. Special meetings of publ ic bodies shall not be held without
692692 public notice being given at least forty -eight (48) hours prior to
693693 the meetings. Such public notice of date, time and place shall be
694694 given in writing, in person or by telephonic means to the Secretary

747747 bodies in the manner set forth in paragraphs 2, 3, 4, 5 and 6 of
748748 this subsection. The public body also shall cause written notice of
749749 the date, time and place of the meeting to be mailed or delivered to
750750 each person, newspaper, wire service, radio station an d television
751751 station that has filed a written request for notice of meetings of
752752 the public body with the clerk or secretary of the public body or
753753 with some other person designated by the public body. Such written
754754 notice shall be mailed or delivered at lea st forty-eight (48) hours
755755 prior to the special meeting. The public body may charge a fee of
756756 up to Eighteen Dollars ($18.00) per year to persons o r entities
757757 filing a written request for notice of meetings, and may require
758758 such persons or entities to renew the request for notice annually.
759759 In addition, all public bodies shall, at least twenty -four (24)
760760 hours prior to such special meetings, display pu blic notice of the
761761 meeting, setting forth thereon the date, time, place and agenda for
762762 the meeting. Only matt ers appearing on the posted agenda may be
763763 considered at the special meeting. Such public notice shall be
764764 posted in prominent public view at the p rincipal office of the
765765 public body or at the location of th e meeting if no office exists.
766766 Twenty-four (24) hours prior public posting shall exclude Saturdays,
767767 Sundays and holidays legally declared by the State of Oklahoma. In
768768 lieu of the public posting r equirements of this paragraph, a public
769769 body may elect to follow the requirements found in subparagraph b of

822822 notice is required for special meetings and that the forty -eight-
823823 hour requirement shall exclude Saturdays, Sundays and holidays
824824 legally declared by the State of Oklahoma; and
825825 13. In the event of an emergency, an emergency meeting of a
826826 public body may be held without the public notice heretofore
827827 required. Should an emergency meeting of a public body be
828828 necessary, the person calling such a meetin g shall give as much
829829 advance public notice as is re asonable and possible under the
830830 circumstances existing, in person or by telephonic or electronic
831831 means.
832832 B. 1. All agendas required pursuant to t he provisions of this
833833 section shall identify all items of b usiness to be transacted by a
834834 public body at a meet ing including, but not limited to, any proposed
835835 executive session for the purpose of engaging in deliberations or
836836 rendering a final or intermediat e decision in an individual
837837 proceeding prescribed by the Ad ministrative Procedures Act.
838838 2. If a public body p roposes to conduct an executive session,
839839 the agenda shall:
840840 a. contain sufficient information for the public to
841841 ascertain that an executive session will be proposed,
842842 b. identify the items of business and pu rposes of the

897897 C. In addition to the requirements for publication of public
898898 notice pursuant to this section , a public body or other g overnmental
899899 entity shall publish any required notice on the website of the
900900 public body or governmental entity , if available.
901901 SECTION 5. AMENDATORY 28 O.S. 2011, Section 121, is
902902 amended to read as follows:
903903 Section 121. A. In all cases where publication of legal
904904 notices is required or allowed by law, the person or official
905905 desiring publication shall be required to pay:
906906 1. For all matters other than tabular matter, fourteen c ents
907907 ($0.14) per word for first insertion, and thirte en cents ($0.13) per
908908 word for each subsequent insertion , with each separate group of
909909 numerals included in the matter to be counted as one word,
910910 regardless of the num ber of digits involved;
911911 2. Effective November 1, 2005, for all matters other than
912912 tabular matter, fifteen cents ($0.15) per word for first insert ion,
913913 and fourteen cents ($0.14) per word for each subsequent insertion,
914914 with each separate group of numerals i ncluded in the matter to be
915915 counted as one word, regardless of the number of digits involve d;
916916 and
917917 3. For all tabular matter, in not to exceed eig ht-point type,
918918 including but not limited to, lists of persons, firms, and

971971 of lands and town lots upon which taxes are delinquent, sev enty
972972 cents ($0.70) per line per newspaper column in wid th, for first
973973 insertion, and sixty -five cents ($0.65) per line per newspaper
974974 column in width, for each subsequ ent insertion.
975975 B. The county treasure r shall collect the cost of publication
976976 of lists of lands and town lots sold for delinquent taxes at
977977 original sale or resale from the individuals purchas ing the lands
978978 and town lots at the sale or resale involved, and s hall deposit all
979979 monies collected to t he credit of the fund of the county which paid
980980 the cost of publication. The publisher of the notice shall b e paid
981981 for the publication of the notice from the general fund of the
982982 county or, if monies are not available i n the general fund of the
983983 county at the time of publication, from the “Resale-Property Fund”
984984 of the county.
985985 C. When a notice is required by statu te to be published by a
986986 state or local governmental entity more than once and is paid for by
987987 the entity and the cost of publication is not paid in advan ce by or

10481048 in the printed newspaper. A hyperlink to legal notices shall be
10491049 provided on the front page of the newspaper ’s Internet website that
10501050 provides access to the legal notices without charge. If there is a
10511051 specified size and placement required for a printed legal notice,
10521052 the size and placement of the notice on the newspaper ’s Internet
10531053 website should optimize its online visibility in keeping with the
10541054 print requirement. The newspaper’s Internet website shall contain a
10551055 search function to facilitate searching legal notices and shall
10561056 present the legal notices as the dominant subject matter of those
10571057 pages that contain such notices.
10581058 2. Upon request of a person, newspapers that publish notices
10591059 shall provide electronic mail notification to tha t person of legal
10601060 notices when such notices are printed in the newspaper and added to
10611061 the newspaper’s Internet website. The electronic mail notification
10621062 shall be provided without charge and notification for the electronic
10631063 mail registry shall be available on the front page of the legal
10641064 notices section of the n ewspaper’s Internet website. For any legal
10651065 notice required to be published more than once, electronic mail
10661066 notification required by this subsection shall apply only to the
10671067 first publication in the ser ies of that notice.

11191119 3. Any error in the placement of a governmental legal notice on
11201120 a newspaper’s Internet website shall be considered harmless error
11211121 and the requirement of proper legal notice shall be deemed to have
11221122 been met.
11231123 SECTION 6. AMENDATORY 68 O.S. 2011, Section 3106, as
11241124 last amended by Section 5, Chapter 25, O.S.L. 2020 (68 O.S. Supp.
11251125 2020, Section 3106), is amended to read as follo ws:
11261126 Section 3106. A. Except for periods governed by the provisions
11271127 of subsection C of Sect ion 3148 of this title, the county treasurer,
11281128 according to the law, shall give notice of delinquent t axes and
11291129 special assessments by publication once a week for two (2)
11301130 consecutive weeks at any time after April 1, but prior to the end of
11311131 September following the year the taxes were first due and payable,
11321132 in some newspaper in the county to be designated by the county
11331133 treasurer. Such notice shall contain a notification that all lands
11341134 on which the taxes are delinquent and remain due and unpaid will be
11351135 sold in accordance with Section 3105 of this title, a list of the
11361136 lands to be sold, the name or names of the last record owner or
11371137 owners as of the preceding December 31 or later as reflected by the
11381138 records in the office of the county assessor, which records shall be
11391139 updated based on real property conveyed after Octob er 1 each year
11401140 and the amount of taxes due and delinquent. If the sale involves
11411141 property upon which is located a manufactured home the no tice shall

12021202 assessor, which records shall be up dated based on real property
12031203 conveyed after October 1 each year, a notice stating the amount of
12041204 delinquent taxes owed and informing the ow ner that the subject real
12051205 property will be sold as provided for in Section 3105 of this title
12061206 if the delinquent taxes are not paid and showing the legal
12071207 description of the property of the own er being sold. Failure to
12081208 receive said the notice shall not inva lidate said the sale. The
12091209 county treasurer shall charge and col lect in cash, cashier’s check
12101210 or money order, in addit ion to the taxes, interest and penalty, the
12111211 publication fees as provided by the p rovisions of Section 121 of
12121212 Title 28 of the Oklahoma Stat utes, and Five Dollars ($5.00) plus
12131213 postage for mailing the noti ce, which shall be paid into the county
12141214 treasury or whatever fund the publication and mailing fee exp enses

12721272 owner of the manufactured home and the county treasurer provides

12741274 shall also be sent to the last -known address of the owner of the
12751275 real property on which the manufactured home is located.
12761276 SECTION 7. AMENDATORY 68 O. S. 2011, Section 3127, is
12771277 amended to read as follows:
12781278 Section 3127. The county treasurer, according to the law, shall
12791279 give notice of the resale of such real estate by publication of said
12801280 the notice once a week for four (4) two (2) consecutive weeks
12811281 preceding such sale, in some newspaper, or newspaper Internet
12821282 website as described in Section 106 of Title 25 of the Oklahoma
12831283 Statutes, having been continuously published one hundred four (104)

13461346 sale, a statement of the date on which said the real estate taxes

13491349 remain unpaid and a statement that the same has not been redeemed,
13501350 the total amount of all deli nquent taxes, costs, penalties and

13521352 such real estate will be sold to the highest bidder for cash. It
13531353 shall not be necessary to set forth the amount of taxes, penalties,
13541354 interest and costs a ccrued each year separately, but it shall be
13551355 sufficient to publish the total amount of all due and unpaid taxes,
13561356 penalties, interest and costs. The county treasurer shall, at least
13571357 thirty (30) days prior to such resale of real estate, give notice by
13581358 certified mail, by mailing to the record owner of said the real
13591359 estate, as shown by the records in the county assessor’s office,
13601360 which records shall be updated based on r eal property conveyed after
13611361 October 1 each year, and to all mortgagees of record of said the
13621362 real estate a notice stating the time and place of said the resale
13631363 and showing the legal description of the real property to be s old.
13641364 If the county treasurer does not know and cannot, by the exercise of
13651365 reasonable diligence, ascertain the address of any mortgagee of
