149	149	SECTION 1. NEW LAW A new section of l aw to be codified
150	150	in the Oklahoma Statutes as Section 1-508.1 of Title 63, unless
151	151	there is created a duplication in numbering , reads as follows:
152	152	As used in this act:
153	153	1. “Contact” means an individual who i s known to have
154	154	associated with an infected individ ual and who has the opportunity
155	155	to become infected;
156	156	2. “Contact data” means information collected through contact
157	157	tracing. The term includes names or medical, epidemiological,
158	158	individual mobility or other data;
159	159	3. “Contact tracer” means a person employe d, contracted, or
160	160	engaged by the State Department of Health, a county health
161	161	department or a city-county health department to conduct contact
162	162	tracing;
163	163	4. “Contact tracing” means identifying individuals who may have
164	164	been exposed to an infected individual f or the purpose of containing
165	165	the spread of a communicable disease by notifying a contact of the
166	166	exposure and need for testing and self-quarantine; and
167	167	5. “Infected individual” means an individual known or
168	168	reasonably suspected to be infected with a communi cable disease.
169	169	SECTION 2. NEW LAW A new section of law to be codified

223	223	A. This act shall not apply to a law enforcement agency or
224	224	peace officer.
225	225	B. This state, a political subdivision of this state , or an
226	226	agent of this state or of a political subdivision of this state may
227	227	conduct contact tracing only in accordance with this act.
228	228	C. Subject to the availability of funds, the State Department
229	229	of Health, a county health department or a city-county health
230	230	department may employ, contract for, or engage the services of
231	231	contact tracers if the department determines that contact tracing is
232	232	necessary to perform a public health duty required by law.
233	233	SECTION 3. NEW LAW A new section of law to be codified
234	234	in the Oklahoma Statutes as Section 1-508.3 of Title 63, unless
235	235	there is created a duplication in numbering, reads as follows:
236	236	A. The State Commissioner of Health by rule shall prescribe
237	237	qualification and training requirements for contact tracers to
238	238	ensure contact tracers comply with this act. A contact tracer shall
239	239	not conduct contact tracing und er this act unless the contact tracer
240	240	satisfies the qualification and training requirements prescribed by
241	241	rules of the Commissioner.
242	242	B. Before collecting any contact data, a contact tracer shall
243	243	execute a sworn affidavit in the form prescribed by the State
244	244	Department of Health acknowledging the contact tracer’s familiarity
245	245	with the requirements of this act, including confidentiality.

298	298	or a city-county health department employing, contracting with or
299	299	engaging the services of a contact tracer shall maintain a copy of
300	300	the contact tracer’s affidavit until the later of:
301	301	1. The first anniversary of the date the cont act tracer’s
302	302	duties end; or
303	303	2. The date the retention period for the affidavit expires
304	304	under an applicable records re tention schedule.
305	305	SECTION 4. NEW LAW A new section of law to be codified
306	306	in the Oklahoma Statutes as Section 1-508.4 of Title 63, unless
307	307	there is created a duplicati on in numbering, reads as follows:
308	308	A. A contact tracer shall not disclose to a contact the
309	309	identity of an infected individual.
310	310	B. A contact tracer may collect only contact data specifically
311	311	authorized by rules of the Commissioner.
312	312	C. The State Department of Health, a county health department,
313	313	a city-county health department or a contact tracer shall not
314	314	produce contact data under a subpoena unless the subpoena is:
315	315	1. Issued by a court; and
316	316	2. Accompanied by a valid prote ctive order preventing further
317	317	disclosure of the data.
318	318	D. The State Department of Health, a county health department,
319	319	a city-county health department or a contact tracer:

371	371	1. Shall use contact data for contact tracing purposes only and
372	372	is prohibited from using the contact data for any other purpose;
373	373	2. Shall ensure the contact data remains confidential;
374	374	3. Shall not release or disclose the contact data unless the
375	375	release or disclosure:
376	376	a. is necessary to conduct contact tracing , and
377	377	b. complies with the laws of this state governing
378	378	prevention and control of disease including, but not
379	379	limited to, Section 1-501 et seq. of Title 63 of the
380	380	Oklahoma Statutes; and
381	381	4. Shall ensure the contact data is safely and securely
382	382	destroyed in accordance with department rule when the contact data
383	383	is no longer necessary for contact tracing .
384	384	E. Contact data collected unde r this act shall be confidential
385	385	and shall not be subject to disclosure under the Oklahoma Open
386	386	Records Act.
387	387	SECTION 5. NEW LAW A new section of law to be codified
388	388	in the Oklahoma Statutes as Section 1-508.5 of Title 63, unless
389	389	there is created a duplication in numbering, reads as follows:
390	390	A. The State Department of Health, a county health department,
391	391	a city-county health department or a contact tracer shall not
392	392	require an individual to participate i n contact tracing or prohibit
393	393	an individual from participating in contact tracing.

445	445	B. A contact or infected individual who in good faith discloses
446	446	to a contact tracer information requested by the contact tracer in
447	447	accordance with this act is not criminally or civilly liable for the
448	448	disclosure.
449	449	C. A contact or infected individual who fails to participate in
450	450	contact tracing is not criminally or civilly liable for the failure
451	451	to participate.
452	452	SECTION 6. NEW LAW A new section of law to be codified
453	453	in the Oklahoma Statute s as Section 1-508.6 of Title 63, unless
454	454	there is created a duplication in numbering, reads as follows:
455	455	A. Except as provided by subsection B of this s ection, the
456	456	State Department of Health, a county health department, a city-
457	457	county health department or a contact tracer shall not use location
458	458	data obtained from a cell phone , or other device through which
459	459	personal wireless services are transmitted, to identify or track
460	460	directly or indirectly the movement of individuals for contact
461	461	tracing purposes.
462	462	B. An individual may voluntarily elect to authorize the State
463	463	Department of Health, a county health department, a city-county
464	464	health department or a contact tracer to utilize the individual’s
465	465	location data for contact tracing pu rposes.
466	466	C. A contact tracer shall not require a third party to collect
467	467	or maintain location data regarding contacts or infected individuals
468	468	for contact tracing purposes.

520	520	D. Except as provided by subsection E of this se ction, a
521	521	contact tracer shall not obtain contact data related to a contac t or
522	522	infected individual from a third party.
523	523	E. A contact tracer may obtain contact data voluntarily
524	524	collected and maintained by a third party only if:
525	525	1. The third party provides t he data to the contact tracer
526	526	voluntarily and with the consent of the inf ected individual or
527	527	contact whose information is disclosed; or
528	528	2. The data is provided pursuant to a valid warrant.
529	529	F. The State Department of Health, a county health department
530	530	or a city-county health department shall implement and maintain
531	531	reasonable procedures including any appropriate corrective action to
532	532	protect from unlawful use or disclosure any contact data collected
533	533	or maintained by the department under this act.
534	534	G. The State Department of Health, a county health department
535	535	or a city-county health department shall destroy or arrange for the
536	536	destruction of contact data the department is not required to retain
537	537	that is within the department’s custody or control by shredding,
538	538	erasing or otherwise modifying the contact data to ensure it is
539	539	unreadable or indecipherable through any means.
540	540	SECTION 7. NEW LAW A new section of law to be codified
541	541	in the Oklahoma Statutes as Section 1-508.7 of Title 63, unless
542	542	there is created a duplication in numbe ring, reads as follows:

596	596	B. A person commits an offense if the person knowingly violates
597	597	this act. An offense under this subsection shall be a misdemeanor.
598	598	C. The actions and remedi es provided by this act are not
599	599	exclusive and are in addition to any other action or remedy provided
600	600	by law.
601	601	SECTION 8. NEW LAW A new section of law to be codified
602	602	in the Oklahoma Statutes as Se ction 1-508.8 of Title 63, unless
603	603	there is created a duplication in numbering , reads as follows:
604	604	The State Commissioner of Health shall adopt rules necessary to
605	605	implement this act.
606	606	SECTION 9. NEW LAW A new section of law to be codified
607	607	in the Oklahoma Statutes as Sectio n 24A.33 of Title 51, unless there
608	608	is created a duplication in numbering , reads as follows:
609	609	Contact data collected by the State Department of Health, a
610	610	county health department, a city -county health department or a
611	611	contact tracer under this act shall be co nfidential and may be kept
612	612	confidential by the department.
613	613	SECTION 10. It being immediately necessary for the pr eservation
614	614	of the public peace, health or safety, an emergency is hereby
615	615	declared to exist, by reason whereof this act shall take effect and
616	616	be in full force from and after its p assage and approval.
