149149 SECTION 1. NEW LAW A new section of l aw to be codified
150150 in the Oklahoma Statutes as Section 1-508.1 of Title 63, unless
151151 there is created a duplication in numbering , reads as follows:
152152 As used in this act:
153153 1. “Contact” means an individual who i s known to have
154154 associated with an infected individ ual and who has the opportunity
155155 to become infected;
156156 2. “Contact data” means information collected through contact
157157 tracing. The term includes names or medical, epidemiological,
158158 individual mobility or other data;
159159 3. “Contact tracer” means a person employe d, contracted, or
160160 engaged by the State Department of Health, a county health
161161 department or a city-county health department to conduct contact
162162 tracing;
163163 4. “Contact tracing” means identifying individuals who may have
164164 been exposed to an infected individual f or the purpose of containing
165165 the spread of a communicable disease by notifying a contact of the
166166 exposure and need for testing and self-quarantine; and
167167 5. “Infected individual” means an individual known or
168168 reasonably suspected to be infected with a communi cable disease.
169169 SECTION 2. NEW LAW A new section of law to be codified

223223 A. This act shall not apply to a law enforcement agency or
224224 peace officer.
225225 B. This state, a political subdivision of this state , or an
226226 agent of this state or of a political subdivision of this state may
227227 conduct contact tracing only in accordance with this act.
228228 C. Subject to the availability of funds, the State Department
229229 of Health, a county health department or a city-county health
230230 department may employ, contract for, or engage the services of
231231 contact tracers if the department determines that contact tracing is
232232 necessary to perform a public health duty required by law.
233233 SECTION 3. NEW LAW A new section of law to be codified
234234 in the Oklahoma Statutes as Section 1-508.3 of Title 63, unless
235235 there is created a duplication in numbering, reads as follows:
236236 A. The State Commissioner of Health by rule shall prescribe
237237 qualification and training requirements for contact tracers to
238238 ensure contact tracers comply with this act. A contact tracer shall
239239 not conduct contact tracing und er this act unless the contact tracer
240240 satisfies the qualification and training requirements prescribed by
241241 rules of the Commissioner.
242242 B. Before collecting any contact data, a contact tracer shall
243243 execute a sworn affidavit in the form prescribed by the State
244244 Department of Health acknowledging the contact tracer’s familiarity
245245 with the requirements of this act, including confidentiality.

297297 C. The State Department of Health, a county health department
298298 or a city-county health department employing, contracting with or
299299 engaging the services of a contact tracer shall maintain a copy of
300300 the contact tracer’s affidavit until the later of:
301301 1. The first anniversary of the date the cont act tracer’s
302302 duties end; or
303303 2. The date the retention period for the affidavit expires
304304 under an applicable records re tention schedule.
305305 SECTION 4. NEW LAW A new section of law to be codified
306306 in the Oklahoma Statutes as Section 1-508.4 of Title 63, unless
307307 there is created a duplicati on in numbering, reads as follows:
308308 A. A contact tracer shall not disclose to a contact the
309309 identity of an infected individual.
310310 B. A contact tracer may collect only contact data specifically
311311 authorized by rules of the Commissioner.
312312 C. The State Department of Health, a county health department,
313313 a city-county health department or a contact tracer shall not
314314 produce contact data under a subpoena unless the subpoena is:
315315 1. Issued by a court; and
316316 2. Accompanied by a valid prote ctive order preventing further
317317 disclosure of the data.
318318 D. The State Department of Health, a county health department,
319319 a city-county health department or a contact tracer:

371371 1. Shall use contact data for contact tracing purposes only and
372372 is prohibited from using the contact data for any other purpose;
373373 2. Shall ensure the contact data remains confidential;
374374 3. Shall not release or disclose the contact data unless the
375375 release or disclosure:
376376 a. is necessary to conduct contact tracing , and
377377 b. complies with the laws of this state governing
378378 prevention and control of disease including, but not
379379 limited to, Section 1-501 et seq. of Title 63 of the
380380 Oklahoma Statutes; and
381381 4. Shall ensure the contact data is safely and securely
382382 destroyed in accordance with department rule when the contact data
383383 is no longer necessary for contact tracing .
384384 E. Contact data collected unde r this act shall be confidential
385385 and shall not be subject to disclosure under the Oklahoma Open
386386 Records Act.
387387 SECTION 5. NEW LAW A new section of law to be codified
388388 in the Oklahoma Statutes as Section 1-508.5 of Title 63, unless
389389 there is created a duplication in numbering, reads as follows:
390390 A. The State Department of Health, a county health department,
391391 a city-county health department or a contact tracer shall not
392392 require an individual to participate i n contact tracing or prohibit
393393 an individual from participating in contact tracing.

445445 B. A contact or infected individual who in good faith discloses
446446 to a contact tracer information requested by the contact tracer in
447447 accordance with this act is not criminally or civilly liable for the
448448 disclosure.
449449 C. A contact or infected individual who fails to participate in
450450 contact tracing is not criminally or civilly liable for the failure
451451 to participate.
452452 SECTION 6. NEW LAW A new section of law to be codified
453453 in the Oklahoma Statute s as Section 1-508.6 of Title 63, unless
454454 there is created a duplication in numbering, reads as follows:
455455 A. Except as provided by subsection B of this s ection, the
456456 State Department of Health, a county health department, a city-
457457 county health department or a contact tracer shall not use location
458458 data obtained from a cell phone , or other device through which
459459 personal wireless services are transmitted, to identify or track
460460 directly or indirectly the movement of individuals for contact
461461 tracing purposes.
462462 B. An individual may voluntarily elect to authorize the State
463463 Department of Health, a county health department, a city-county
464464 health department or a contact tracer to utilize the individual’s
465465 location data for contact tracing pu rposes.
466466 C. A contact tracer shall not require a third party to collect
467467 or maintain location data regarding contacts or infected individuals
468468 for contact tracing purposes.

520520 D. Except as provided by subsection E of this se ction, a
521521 contact tracer shall not obtain contact data related to a contac t or
522522 infected individual from a third party.
523523 E. A contact tracer may obtain contact data voluntarily
524524 collected and maintained by a third party only if:
525525 1. The third party provides t he data to the contact tracer
526526 voluntarily and with the consent of the inf ected individual or
527527 contact whose information is disclosed; or
528528 2. The data is provided pursuant to a valid warrant.
529529 F. The State Department of Health, a county health department
530530 or a city-county health department shall implement and maintain
531531 reasonable procedures including any appropriate corrective action to
532532 protect from unlawful use or disclosure any contact data collected
533533 or maintained by the department under this act.
534534 G. The State Department of Health, a county health department
535535 or a city-county health department shall destroy or arrange for the
536536 destruction of contact data the department is not required to retain
537537 that is within the department’s custody or control by shredding,
538538 erasing or otherwise modifying the contact data to ensure it is
539539 unreadable or indecipherable through any means.
540540 SECTION 7. NEW LAW A new section of law to be codified
541541 in the Oklahoma Statutes as Section 1-508.7 of Title 63, unless

594594 A. A person may bring a civil action to enjoin a violation of
595595 this act.
596596 B. A person commits an offense if the person knowingly violates
597597 this act. An offense under this subsection shall be a misdemeanor.
598598 C. The actions and remedi es provided by this act are not
599599 exclusive and are in addition to any other action or remedy provided
600600 by law.
601601 SECTION 8. NEW LAW A new section of law to be codified
602602 in the Oklahoma Statutes as Se ction 1-508.8 of Title 63, unless
603603 there is created a duplication in numbering , reads as follows:
604604 The State Commissioner of Health shall adopt rules necessary to
605605 implement this act.
606606 SECTION 9. NEW LAW A new section of law to be codified
607607 in the Oklahoma Statutes as Sectio n 24A.33 of Title 51, unless there
608608 is created a duplication in numbering , reads as follows:
609609 Contact data collected by the State Department of Health, a
610610 county health department, a city -county health department or a
611611 contact tracer under this act shall be co nfidential and may be kept
612612 confidential by the department.
613613 SECTION 10. It being immediately necessary for the pr eservation
614614 of the public peace, health or safety, an emergency is hereby
615615 declared to exist, by reason whereof this act shall take effect and
616616 be in full force from and after its p assage and approval.
