8080 SECTION 1. AMENDATORY 40 O.S. 2011, Section 4-508, as
8181 last amended by Section 10, Chapter 251, O.S.L. 2019 (40 O.S. Supp.
8282 2020, Section 4-508), is amended to read as follows:

8484 INFORMATION TO BE KEPT CO NFIDENTIAL - DISCLOSURE.
8585 A. Except as otherwise p rovided by law, information obtained
8686 from any employing unit or individual pursuant to the a dministration
8787 of the Employment Security Act of 1980, any workforc e system program
8888 administered or monitored by the Oklahoma Employment Security
8989 Commission, and determinations as to the benefit rights of any

141141 individual shall be kept confidential and shall not be disclosed or
142142 be open to public inspection in any manner rev ealing the
143143 individual's or employing unit's identity. Any claimant or
144144 employer, or agent of eithe r as authorized in writing, shall be
145145 supplied with information from the records of the Oklah oma
146146 Employment Security Commission, to the extent necessary for th e
147147 proper presentation of the claim or complaint in any proc eeding
148148 under the Employment Security Ac t of 1980, with respect thereto.
149149 B. Upon receipt of written request by any employer who
150150 maintains a Supplemental Unemployment Benefit (SUB) Plan, the
151151 Commission or its designated representative may release to that
152152 employer information regarding weekly ben efit amounts paid its
153153 workers during a specified te mporary layoff period, provided the
154154 Supplemental Unemployment Benefit (SUB) Plan requires benefit
155155 payment information before Supplemental Unemployment Benefits can be
156156 paid to the workers. Any information disclosed under this provision
157157 shall be utilized so lely for the purpose outlined herein and shall
158158 be held strictly confidential by the employer.
159159 C. The provisions of this section shall not prevent the
160160 Commission from disclosing the following information a nd no
161161 liability whatsoever, civil or criminal, shal l attach to any member
162162 of the Commission or any employee thereof for any error or omission

215215 1. The delivery to taxpayer or clai mant a copy of any report or
216216 other paper filed by the taxpayer or claimant pursuant to the
217217 Employment Security Act of 1980;
218218 2. The disclosure of information to any person for a purpose as
219219 authorized by the taxpayer or claimant pursuant to a waiver of
220220 confidentiality. The waiver shall be in wr iting and shall be
221221 notarized;
222222 3. The Oklahoma Depa rtment of Commerce may have access to dat a
223223 obtained pursuant to the Employment Security Act of 1980 pursuan t to
224224 rules promulgated by the Commission. The information obtained shall
225225 be held confidential by the Department and any of its agents and
226226 shall not be disclosed or be open to public inspect ion. The
227227 Oklahoma Department of Commerce, however, may release ag gregated
228228 data, either by industry or county, provided that the aggregation
229229 meets disclosure requir ements of the Commission;
230230 4. The publication of st atistics so classified as to prevent
231231 the identification of a particular report and the items thereof;
232232 5. The disclosing of information or evidence to the Attorney
233233 General or any district attorney when the information or evidence is
234234 to be used by the offic ials or other parties to the proceedings to
235235 prosecute or defend allegations of violations of the Employment
236236 Security Act of 1980. The information disclosed to the At torney
237237 General or any district attorney shall be kept confidential by them
238238 and not be disclosed except when presented to a court in a

290290 prosecution of a violation of Section 1 -101 et seq. of this tit le,
291291 and a violation by the Attorney General or district att orney by
292292 otherwise releasing the inform ation shall be a felony;
293293 6. The furnishing, at the discretion of the Commission, of any
294294 information disclosed by the records or files to any official person
295295 or body of this state, any other state or of the United Sta tes who
296296 is concerned with the administr ation of assessment of any similar
297297 tax in this state, any other state or the United States;
298298 7. The furnishing of information to other state agencies for
299299 the limited purpose of aiding in the collection of debts owed b y
300300 individuals to the requesting agencie s or the Oklahoma Employment
301301 Security Commission;
302302 8. The release to employees of the Depart ment of Transportation
303303 or any Metropolitan Planning Organization a s defined in 23 U.S.C.,
304304 Section 134 and 49 U.S.C., Section 5303 of information required for
305305 use in federally mandated regional transportation plannin g, which is
306306 performed as a part of its of ficial duties;
307307 9. The release to employees of the State Treasurer 's office of
308308 information required to verify or evaluate the effectiveness of the
309309 Oklahoma Small Business Linked Deposit Program on job creation;
310310 10. The release to employees of the Attorney General, the
311311 Department of Labor, the Workers ' Compensation Commission, and the
312312 Insurance Department for use in investigatio n of workers'
313313 compensation fraud;

365365 11. The release to employees of any Oklahoma state, Okl ahoma
366366 county, Oklahoma municipal or Oklah oma tribal law enforcement agency
367367 for use in criminal investi gations and the location o f missing
368368 persons or fugitives from ju stice;
369369 12. The release to employees of the Center of International
370370 Trade, Oklahoma State University, of information required for t he
371371 development of International Trade for employers doing bus iness in
372372 the State of Oklahoma;
373373 13. The release to employees of the Oklahoma State Regents for
374374 Higher Education of information required for use in the de fault
375375 prevention efforts and/or collectio n of defaulted student loans
376376 guaranteed by the Oklahoma Guara nteed Student Loan Program . Any
377377 information disclosed under thi s provision shall be utilized solely
378378 for the purpose outlined herein and shall be held str ictly
379379 confidential by the Oklahoma State Regents for Higher Education;
380380 14. The release to employees o f the Oklahoma Department of
381381 Career and Technology Education, the Oklahoma State Regents of
382382 Higher Education, the Center for Economic and Management Resea rch of
383383 the University of Oklahoma, the Ce nter for Economic and Business
384384 Development at Southwestern Oklahom a State University, o r a center
385385 of economic and business research or development at a comprehensive
386386 or regional higher education institution within T he Oklahoma State
387387 System of Higher Educat ion of information required to identify
388388 economic trends and to complete performance accountability reports

440440 required by the Workforce Innovation Opportunity Act . The
441441 information obtained shal l be kept confidential by the Oklahoma
442442 Department of Career and Technology Education , the Oklahoma State
443443 Regents of Higher Education , and the higher education institution
444444 and shall not be disclosed or be open to public inspection . The
445445 Oklahoma Department of Career and Technology Education, the Oklahoma
446446 State Regents of Higher Education, and the higher education
447447 institution may release aggreg ated data, provided that the
448448 aggregation meets disclosure requirements of the Commission . For
449449 the limited purpose of completing performance accountability reports
450450 required by the federal Workforce Innovation and Opportunity Act,
451451 the Oklahoma Department of Career and Technology Education , the
452452 Oklahoma State Regents of Higher Education and the higher education
453453 institution may contract with a pri vate agent or contractor pursuant
454454 to 20 CFR Section 603.5(f) to complete the required reports, and
455455 confidential information may be shared with the private agent or
456456 contractor to the extent necessary to com plete the required reports;
457457 provided, such agent or contractor shall not release, disclose or
458458 open for public inspect ion any confidential information re ceived for
459459 purposes of completing reports;
460460 15. The release to employe es of the Office of Management and
461461 Enterprise Services of information required to ide ntify economic
462462 trends. The information obtained shall be kept confidential by the
463463 Office of Management and Enterprise Services and shall not be

516516 and Enterprise Services may release aggreg ate data, provided that
517517 the aggregation meets disclosu re requirements of the Commiss ion;
518518 16. The release to employees of the Department of Mental Health
519519 and Substance Abuse Services of information required to evaluate the
520520 effectiveness of mental health an d substance abuse treatment and
521521 state or local program s utilized to divert persons f rom inpatient
522522 treatment. The information obtained shall be kept confidential by
523523 the Department and shall not be disclosed or be open to public
524524 inspection. The Department of Mental Health and Substance Abuse
525525 Services, however, may release aggregated data, either by treatment
526526 facility, program or larger aggregate units, provided that the
527527 aggregation meets disclosure requirements of the Oklahoma Employment
528528 Security Commission;
529529 17. The release to employees of the Attorney Genera l, the
530530 Oklahoma State Bureau o f Investigation, and the Insurance Department
531531 for use in the investigation of insurance fraud and health care
532532 fraud;
533533 18. The release to employees of public housing agencie s for
534534 purposes of determining eligibility pursuant to 42 U.S.C., Section
535535 503(i);
536536 19. The release of wage and benefit claim information, at the
537537 discretion of the Commissio n, to an agency of this state or its
538538 political subdivisions that operate a program or activity designated

590590 as a required partner in the Work force Innovation and Opportuni ty
591591 Act One-Stop delivery system pursuant to 29 U.S.C.A., Section
592592 3151(b)(1), based on a showing of need made to the Commission and
593593 after an agreement concerning the release of information is entered
594594 into with the entity receiv ing the information;
595595 20. The release of information to the State Wage Interchange
596596 System, at the discretion of the C ommission;
597597 21. The release of information to the Bureau of the Census of
598598 the U.S. Department of Commerce for the purpose of economic and
599599 statistical research;
600600 22. The release of employer tax information and benefit claim
601601 information to the Oklahoma Healt h Care Authority for use in
602602 determining eligibility for a program that will provide s ubsidies
603603 for health insurance premiums for qualified e mployers, employees,
604604 self-employed persons, and unemployed persons;
605605 23. The release of employer tax information and benefit claim
606606 information to the State Department of Rehabilitation Services for
607607 use in assessing results and outcomes of clients served;
608608 24. The release of information to any state or federal law
609609 enforcement authority when necessary in the investigation of any
610610 crime in which the Commission is a victim. Information that is
611611 confidential under this section shall be held confidential by the
612612 law enforcement authority unless and until it is required for use in
613613 court in the prosecution of a defendant in a crimi nal prosecution;

665665 25. The release of information to vendors that contract with
666666 the Oklahoma Employment Security Commission to provide for t he
667667 issuance of debit cards, to conduct electronic fund transfers, to
668668 perform computer programming operations, or to p erform computer
669669 maintenance or replacement operations; provided the vendor agrees to
670670 protect and safeguard the information it receives and to destroy the
671671 information when no longer needed for the purposes set out in the
672672 contract;
673673 26. The release to employ ees of the Office of Juvenile Affairs
674674 of information for use in assessing results and outcomes of clients
675675 served as well as the effectivene ss of state and local juvenile and
676676 justice programs including prevention and treatment programs. The
677677 information obtained shall be kept confidential by the Office of
678678 Juvenile Affairs and shall not be d isclosed or be open to public
679679 inspection. The Office of Juvenile Affairs may releas e aggregated
680680 data for programs or larger aggregate units, provided that the
681681 aggregation meets disclosure requirements of the Oklahoma Employment
682682 Security Commission;
683683 27. The release of information to vendors that contract wit h
684684 the State of Oklahoma for th e purpose of providing a public
685685 electronic labor exchange system that will support the Oklahoma
686686 Employment Security Commission's operation of an employment service
687687 system to connect employers with job seekers and military vete rans.
688688 This labor exchange sys tem would enhance the stability and security

740740 of Oklahoma's economy as well as support t he provision of veterans'
741741 priority of service. The vendors may perform computer prog ramming
742742 operations, perform computer maintenance or re placement operations,
743743 or host the electronic solution; provided, each vendor agrees to
744744 protect and safeguard all info rmation received, that no information
745745 shall be disclosed to any third party, that the use of the
746746 information shall be restricted to the sco pe of the contract, and
747747 that the vendor shall properly dispose of all information when no
748748 longer needed for the purpo ses set out in the contract; or
749749 28. The release of employer tax information and bene fit claim
750750 information to employees of a county public defender's office in the
751751 State of Oklahoma and the Oklahoma Indigent Defense System for the
752752 purpose of determining fi nancial eligibility for the services
753753 provided by such entities.
754754 D. Subpoenas to comp el disclosure of information made
755755 confidential by this statute shall not be valid, e xcept for
756756 administrative subpoenas issued by federal, state, or local
757757 governmental agencies that have been granted subpoena power by
758758 statute or ordinance. Confidential inf ormation maintained by the
759759 Commission can be obtained by order of a court of record that
760760 authorizes the release of the records in writing. All
761761 administrative subpoenas or court orders for production of documents
762762 must provide a minimum of twenty (20) days from the date it is
763763 served for the Commission to produ ce the documents. If the date on

815815 which production of the documents is required is less than twenty
816816 (20) days from the date of service, the subpoena or order shall be
817817 considered void on its face as an u ndue burden or hardship on the
818818 Commission. All admini strative subpoenas, court orde rs or notarized
819819 waivers of confidentiality authorized by paragraph 2 of subsection C
820820 of this section shall be presented with a request for records within
821821 ninety (90) days of the date the document is issued or signed, and
822822 the document can only be used one t ime to obtain records.
823823 E. Should any of the disclosures provided for in this section
824824 require more than casual or incidental staff time, the Commission
825825 shall charge the cos t of the staff time to the party requesting the
826826 information.
827827 F. It is further provi ded that the provisions of this section
828828 shall be strictly interpreted and shall not be construed as
829829 permitting the disclosure of any other information contained in the
830830 records and files of the Commission.
831831 SECTION 2. This act shall become effective July 1, 2021.
832832 SECTION 3. It being immediately necessary for t he preservation
833833 of the public peace, health or safety, an emergency is hereby
834834 declared to exist, by reason whereof this act shall take effect an d
835835 be in full force from and after its pass age and approval.
