7575 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
7676 SECTION 1. AMENDATORY 22 O.S. 2011, Section 2002, as
7777 amended by Section 2, Chapter 97, O.S.L. 2020 (22 O.S. Supp. 2020,
7878 Section 2002), is amended to read as follows:
7979 Section 2002. A. Disclosure of Evidence by the Stat e.
8080 1. Upon request of the defense, the state s hall disclose the
8181 following:
8282 a. the names and addresses of witnesses which the state
8383 intends to call at trial, together with their
8484 relevant, written or recorded statement, if any, or if
8585 none, significant summa ries of any oral statement,
8686 b. law enforcement reports made in connection with the
8787 particular case,

140140 of any oral statements made by the accused or made by
141141 a codefendant,
142142 d. any reports or statements ma de by experts in
143143 connection with the particular case, including results
144144 of physical or mental examinations and of scientific
145145 tests, experiments, or comparisons,
146146 e. any books, papers, documents, photographs, tangible
147147 objects, buildings or places which the p rosecuting
148148 attorney intends to use in the heari ng or trial or
149149 which were obtained from or belong to the accused,
150150 f. any record of prior criminal convictions of the
151151 defendant, or of any codefendant, and
152152 g. Oklahoma State Bureau of Investigation (OSBI) rap
153153 sheet/records check on any witness listed by the state
154154 or the defense as a witness who will testify at trial,
155155 as well as any convictions of any witness revealed
156156 through additional record check s if the defense has
157157 furnished Social Security numbers or date of birth for
158158 their witnesses, except OSBI rap she et/record checks
159159 shall not provide date of birth, Social Security
160160 number, home phone number or address.

212212 2. The state shall provide the defendant any evidence favorable
213213 to the defendant if such evidence is mat erial to either guilt or
214214 punishment.
215215 3. The prosecuting attorney’s obligations under this standard
216216 extend to:
217217 a. material and information in the possession or control
218218 of members of the prosecutor ’s staff,
219219 b. any information in the possession of law enforc ement
220220 agencies that regularly report to the pro secutor of
221221 which the prosecutor should reasonably know, and
222222 c. any information in the possession of law enforcement
223223 agencies who have reported to the prosecutor with
224224 reference to the particular case of which t he
225225 prosecutor should reasonably know.
226226 4. a. If the state intends to introduce testimony of a
227227 jailhouse an informant, the state shall disclose at
228228 least ten (10) days prior to trial:
229229 (1) the complete criminal history of such informant,
230230 including any dismisse d charges,
231231 (2) any deal, promise, inducement or be nefit that the
232232 state or law enforcement agency has made or may
233233 make in the future to the jailhouse informant in
234234 connection with the testimony of such informant,

286286 (3) the specific statements or recordings mad e by the
287287 suspect or defendant and the time, place and
288288 manner of the disclosure to the jailhouse
289289 informant,
290290 (4) all other filed cases in which the state intended
291291 to introduce the testimony of the jailhouse
292292 informant in connection with a deal, promise,
293293 inducement or benefit, the nature of the deal,
294294 promise, inducement or benefit, and whether the
295295 testimony was admitted in the case,
296296 (5) whether at any time the jailhouse informant
297297 recanted the testimony or statement, and if so, a
298298 transcript or copy of such recan tation, if any,
299299 and
300300 (6) any other information rele vant to the credibility
301301 of the informant.
302302 b. Each district attorney ’s office shall maintain a
303303 central record that tracks each case in which the
304304 state intended to introduce the testimony of the
305305 jailhouse informant against a suspect or defendant in
306306 connection with a deal, promise, inducement or
307307 benefit, the nature of the deal, promise, inducement
308308 or benefit and whether such testimony or statements
309309 were admitted in the case. Such record shall be sent

361361 to the District Attorneys Council which shall maintain
362362 a statewide record of such information. Records
363363 maintained pursuant to this paragraph shall only be
364364 accessible to prosecutors and shall not be subject to
365365 the Oklahoma Open Records Act. By September 15 of
366366 each year, the District Attorneys Council shall
367367 publish an annual report of aggregate, de-identified
368368 data regarding the total number of cases tracked
369369 pursuant to this section, and the number of cases
370370 added during the previous fiscal year pursuant to this
371371 section by each district attorney ’s office. A copy of
372372 the report shall be distributed to the Governor, the
373373 President Pro Tempore of the Senate, the Speaker of
374374 the House of Representatives and the chairs of the
375375 Senate and House Judiciary Committees.
376376 c. For purposes of this paragraph, “jailhouse informant”
377377 means a person who provides, or who the prosecutor
378378 intends to provide, testimony about admissions or
379379 other relevant information made to him or her by the
380380 suspect or defendant while both persons were detained
381381 or incarcerated in a penal institution.
382382 B. Disclosure of Evidence by the Defendant.
383383 1. Upon request of the state, the defense shall be required to

436436 a. the names and addresses of witnesses which the defense
437437 intends to call at trial, t ogether with their
438438 relevant, written or recorded s tatement, if any, or if
439439 none, significant summaries of any oral statement,
440440 b. the name and address of any witness, other than the
441441 defendant, who will be called to show that the
442442 defendant was not present at the time and place
443443 specified in the information or indictment, together
444444 with the witness’ statement to that fact,
445445 c. the names and addresses of any witness the defendant
446446 will call, other than himself, for testimony relating
447447 to any mental disease, mental de fect, or other
448448 condition bearing upon his mental s tate at the time
449449 the offense was allegedly committed, together with the
450450 witness’ statement of that fact, if the statement is
451451 redacted by the court to preclude disclosure of
452452 privileged communication.
453453 2. A statement filed under subparagraph a, b or c of par agraph
454454 1 of subsection A or B of this section is not admissible in evidence
455455 at trial. Information obtained as a result of a statement filed
456456 under subsection A or B of this section is not admissible in
457457 evidence at trial except to refute the testimony of a witness whose
458458 identity subsection A of this section requires to be disclosed.

510510 3. Upon the prosecuting attorney ’s request after the time set
511511 by the court, the defendant shall allow him access at any reasona ble
512512 times and in any reasonable manner to inspect, photograph, copy, or
513513 have reasonable tests made upon any book, paper, document,
514514 photograph, or tangible object which is within the defendant ’s
515515 possession or control and which:
516516 a. the defendant intends to o ffer in evidence, except to
517517 the extent that it con tains any communication of the
518518 defendant, or
519519 b. is a report or statement as to a physical or mental
520520 examination or scientific test or experiment made in
521521 connection with the particular case prepared by and
522522 relating to the anticipated testimony of a person w hom
523523 the defendant intends to call as a witness, provided
524524 the report or statement is redacted by the court to
525525 preclude disclosure of privileged communication.
526526 C. Continuing Duty to Disclose.
527527 If, prior to or during trial, a party discovers additional
528528 evidence or material previously requested or ordered, which is
529529 subject to discovery or inspection under the Oklahoma Criminal
530530 Discovery Code, such party shall promptly notify the other party,
531531 the attorney of the other party, or the court of the existence of
532532 the additional evidence or material.

585585 Motions for discovery may be made at the time of the district
586586 court arraignment or thereafter; provided that requests for police
587587 reports may be made s ubject to the provisions of Section 258 of this
588588 title. However, a request pursuant to Section 258 of this title
589589 shall be subject to the discretion of the district attorney. All
590590 issues relating to discovery, except as otherwise provided, will be
591591 completed at least ten (10) days prior to trial. The court may
592592 specify the time, place and manner of making the discovery and may
593593 prescribe such terms and conditions as are just.
594594 E. Regulation of Discovery.
595595 1. Protective and Modifying Orders. Upon motion of the state
596596 or defendant, the court may at any time ord er that specified
597597 disclosures be restricted, or make any other protective order. If
598598 the court enters an order restricting specified disclosures, the
599599 entire text of the material restricted shall be sealed a nd preserved
600600 in the records of the court to be mad e available to the appellate
601601 court in the event of an appeal.
602602 2. Failure to Comply with a Request. If at any time during the
603603 course of the proceedings it is brought to the attention of the
604604 court that a party has failed to comply with this rule, the court
605605 may order such party to permit the discovery or inspection, grant
606606 continuance, or prohibit the party from introducing evidence not
607607 disclosed, or it may enter such other order as it deems just under
608608 the circumstances.

660660 3. The discovery order shall not incl ude discovery of legal
661661 work product of either attorney which is deemed to include legal
662662 research or those portions of records, correspondence, reports, or
663663 memoranda which are only the opinions, theories, or conclusions of
664664 the attorney or the attorney ’s legal staff.
665665 F. Reasonable cost of copying, duplicating, videotaping,
666666 developing or any other cost associated with this Code for items
667667 requested shall be paid by the party so requesting; however, any
668668 item which was obtained from the defendant by the state of which
669669 copies are requested by the defendant shall be paid by the state.
670670 Provided, if the court determines the defendant is indigent and
671671 without funds to pay the cost of reproduction of the required items,
672672 the cost shall be paid by the Indigent Defender S ystem, unless
673673 otherwise provided by law.
674674 SECTION 2. This act shall become effective November 1, 2021.
