3866 SECTION 1. AMENDATORY 59 O.S. 2011, Section 1682, as

4898 2. “Committee” means the Committee of Electrical Examiners
4999 appointed by the Board;

51100 3. “Electrical apprentice” means any person sixteen (16) years
52101 of age or older whose principal occupation is the learning of and
53102 assisting in the installation of electrical work under the direct
54103 supervision of a licensed journeyman electrician or electrical
55104 contractor;

57105 4. “Journeyman electrician ” means any person other than an
58106 electrical contractor who engages in the actual installation,
59107 alteration, repair or renovation of electrical facilities or
60108 electrical construction work unless specifically exempted by the
61109 provisions of the Electrical License Act;

63110 5. “Electrical contractor ” means any person skilled in the
64111 planning, superintending and practical installation of electrical
65112 facilities who is familiar with the laws, rules and regulations
66113 governing such work. Electri cal contractor also means any
67114 individual, firm, partnership, corporation, limited liability
68115 company, or business performing skills of an electrical contractor
69116 or an electrician or the business of contracting, or furnishing
70117 labor or labor and materials for the installation, repair,
71118 maintenance or renovation of electrical facilities or electrical
72119 construction work according to the provisions of the Electrical
73120 License Act;

75148 6. “Electrical facilities ” means all wiring, fixtures,
76149 appurtenances, and appliances for, and in connection with, a supply
77150 of electricity within or adjacent to any building, structure or
78151 conveyance on the premises but not including the connection with a
79152 power supply meter or other power supply source;

81153 7. “Category” means the classification by which licenses and
82154 electrical work may be limited. Such categories shall include but
83155 shall not be limited to installation, maintenance, repair,
84156 alteration, residential, oilfield , and commercial;
85-
86157 8. “Temporary journeyman electrician ” means any person other
87158 than a person permanently licensed as a journeyman electrician or
88159 electrical contractor in this state who meets the temporary
89160 licensure requirements of Section 1685.1 of this title;

93161 9. “Variance and Appeals Board ” means the Oklahoma State
94162 Electrical Installation Code Variance and Appeals Board;

96163 10. “Electrical construction work ” means installation,
97164 fabrication or assembly of equipment or systems included in
98165 “premises wiring” as defined in the National Electrical Code
99166 (reference 158:40-1-4. Standard of Installation), and which is
100167 hereby adopted and incorporated by reference. Electrical
101168 construction work includes , but is not limited to , installation of
102169 raceway systems used for any electrical purposes, and installation
103170 of field-assembled systems such a s ice and snow melting, pipe -
104171 tracing, and manufactured wiring systems. Electrical construction

105199 work shall not include in -plant work performed by employees of the
106200 company owning the plant, work performed by telecommunications
107201 employees for telecommunicatio ns companies, or installation of
108202 factory-assembled appliances or machinery which is not part of the
109203 premises wiring unless wiring interconnections external to the
110204 equipment are required in the field; and

112205 11. “Electrical work” means work consisting primari ly of the
113206 layout, installation, maintenance, repair, testing or replacement of
114207 all or part of electrical wires, conduits, apparatus, fixtures,
115208 appliances or equipment for transmitting, carrying, controlling or
116209 using electricity in, on, outside or attached to a building,
117210 structure, property or premises. Electrical work shall not mean
118211 work that is related to or facilitates the construction,
119212 installation or maintenance of all or part of an electrical system,
120213 but which does not involve actual work with any of the electrical
121214 components provided in this definition ; and

123215 12. “Student electrical intern ” means any person sixteen (16)
124216 years of age or older who complies with the requirements for
125217 registration under Section 1686 of this title .

127218 B. Class 2 and Class 3 ci rcuits shall be exempt from the
128219 requirements of electrical licensing of either an electrical
129220 contractor or a journeyman electrician, provided the work is
130221 performed in accordance with the National Fire Protection
131222 Association 70 requirements for Class 2 and Class 3 circuits.

135250 SECTION 2. AMENDATORY 59 O.S. 2011, Section 1686, is
136251 amended to read as follows:

138252 Section 1686. A. The Construction Industries Board shall, upon
139253 proper application and payment of fee, register as an electrical
140254 apprentice and issue a certificate of such registration to any
141255 person who furnishes satisfactory proof to the Board that the
142256 applicant is:

144257 1. Sixteen (16) years of age or over older; or
145-
146258 2. Enrolled in a school or federal training program for
147259 electrical apprentices recognized by the Board , or employed as an
148260 electrical apprentice with an active licensed electrical contractor.

150261 B. The Construction Industries Board shall, upon proper
151262 application and payment of fee, register as a student electrical
152263 intern and issue a certificate of such registration to any person
153264 who furnishes satisfactory proof to the Board that the applicant is:

155265 1. Sixteen (16) years of age or older; and
156-
157266 2. Enrolled in high school and enrolled in a work -ready or
158267 similar program recognized by the Board.

160268 C. All applications for examination, license or renewal of
161269 license shall be made in writing to the Board on forms provided, if
162270 necessary, by the Board. All applications shall be accompanied by
163271 the appropriate fee.

165272 C. D. Apprentices and student electrical interns , when required
166273 by the Board, shall provide such documents, statements or other

168302 history record check as defined by Section 150.9 of Title 74 of the
169303 Oklahoma Statutes.

171304 SECTION 3. AMENDATORY 59 O.S. 2011, Section 1688, is
172305 amended to read as follows:

174306 Section 1688. A. No license shall be issued for longer than
175307 one (1) year, and all licenses shall expire on the last day in the
176308 birth month of the lice nsee. A license may be renewed upon
177-

179309 application and payment of fees thirty (30) days preceding or
180310 following the date the license is due. Licenses renewed more than
181311 thirty (30) days following the date of expiration may be renewed
182312 only upon application and payment of all required fees and payment
183313 of any penalty for late renewal established by the Board and upon
184314 compliance with any applicable continuing education requirements
185315 established by the Board and this act the Electrical License Act .
186316 No penalty for late renewal shall be charged to any holder of a
187317 license which expires while the holder is in military service, if an
188318 application for renewal is made within one (1) year following the
189319 service discharge of the holder.

191320 B. No journeyman or contractor license shall be renewed unless
192321 the licensee has completed the required hours of continuing
193322 education, as determined and approved by the Committee of Electrical
194323 Examiners and approved by the Construction Industries Board.

196351 C. An apprentice registration certificate or a student intern
197352 registration certificate shall be issued for one (1) year, at which
198353 time the apprentice may reregister upon meeting the requirements of
199354 the Construction Industries Board and paying the renewal fee.

201355 SECTION 4. AMENDATORY 59 O.S. 2011, Section 1689, as
202356 amended by Section 23, Chapter 313, O.S.L. 2015 (59 O.S. Supp. 2020,
203357 Section 1689), is amended to read as follows:

205358 Section 1689. A. The Construction Industries Board or its
206359 designee and the Committee of Electrica l Examiners shall act as the
207360 Electrical Hearing Board and shall comply with the provisions of
208361 Article II of the Administrative Procedures Act, Section 308a et
209362 seq. of Title 75 of the Oklahoma Statutes.

211363 B. Any administrative hearing on suspensions, revocat ions or
212364 fines shall be conducted by a hearing examiner appointed by the
213365 Board. The hearing examiner ’s decision shall be a final decision
214366 which may be appealed to a district court in accordance with the
215367 Administrative Procedures Act.

217368 C. The Electrical Hea ring Board may, upon its own motion, and
218369 shall, upon written complaint filed by any person, investigate the
219370 business transactions of any electrical contractor, journeyman
220371 electrician or, electrical apprentice , student electrical intern or

223372 poultry house contractor license. Upon a finding by clear and
224373 convincing evidence, the Board shall suspend or revoke any license
225374 or registration obtained by false or fraudulent representation.

226402 Upon a finding by clear and convincing evidence, the Board shall
227403 also suspend or revoke any license or registration for any of the
228404 following:

230405 1. Making a material misstatement in the application for a
231406 license or registration, or the renewal of a license or
232407 registration;
233-
234408 2. Loaning or illegally using a license;
235-
236409 3. Demonstrating in competence to act as a journeyman
237410 electrician or electrical contractor;
238-
239411 4. Violating any provisions of the Electrical License Act, or
240412 any rule or order prescribed by the Board or any ordinance for the
241413 installation of electrical facilities made or enacted by a city or
242414 town by authority of the Electrical License Act;
243-
244415 5. Willfully failing to perform normal business obligations
245416 without justifiable cause; or
246-
247417 6. Failing to maintain a registration or license as required by
248418 law in another state while registered in this state as a nonresident
249419 contractor.

251420 D. Any person whose license or registration has been revoked by
252421 the Electrical Hearing Board may apply for a new license one (1)
253422 year from the date of such revocation.

255423 E. Notwithstanding any other provision of l aw, a political
256424 subdivision of this state that has adopted a nationally recognized
257425 electrical code and appointed an inspector pursuant to the

258453 provisions of Section 1693 of this title or pursuant to the
259454 provisions of the Oklahoma Inspectors Act for such wor k shall have
260455 jurisdiction over the interpretation of the code and the
261456 installation of all electrical work done in that political
262457 subdivision, subject to the provisions of the Oklahoma Inspectors
263458 Act. Provided, a state inspector may work directly with an
264459 electrical contractor, journeyman electrician or, electrical

267460 apprentice or student electrical intern in such a locality if a
268461 violation of the code creates an immediate threat to life or health.

270462 F. In the case of a complaint about, investigation of , or
271463 inspection of any license, registration, permit or electrical work
272464 in any political subdivision of this state which has not adopted a
273465 nationally recognized electrical code and appointed an inspector
274466 pursuant to the provisions of Section 1693 of this title or p ursuant
275467 to the provisions of the Oklahoma Inspectors Act for such work, the
276468 Construction Industries Board shall have jurisdiction over such
277469 matters.

279470 G. 1. No individual, business, company, corporation,
280471 association or other entity subject to the provision s of the
281472 Electrical License Act shall install, modify or alter electrical
282473 facilities in any incorporated area of this state which has not
283474 adopted a nationally recognized electrical code and appointed an
284475 inspector pursuant to the provisions of Section 1693 of this title
285476 or pursuant to the provisions of the Oklahoma Inspectors Act for

286504 such work without providing notice of such electrical work to the
287505 Construction Industries Board. A notice form for reproduction by an
288506 individual or entity required to make such notice shall be provided
289507 by the Construction Industries Board upon request.

291508 2. Notice to the Construction Industries Board pursuant to this
292509 subsection shall not be required for electrical maintenance or
293510 replacement of existing electrical appliances or fi xtures or of any
294511 petroleum refinery or its research facilities.

296512 3. Enforcement of this subsection is authorized pursuant to the
297513 Electrical License Act, or under authority granted to the
298514 Construction Industries Board.

300515 SECTION 5. NEW LAW A new section of law to be codified
301516 in the Oklahoma Statutes as Section 1699 of Title 59, unless there
302517 is created a duplication in numbering, reads as follows:

304518 One student electrical intern is allowed to work per physical
305519 job site with direct supervis ion under a single journeyman or
306520 electrical contractor; provided, however, that no such student
307521 electrical intern shall be counted against the maximum number of
308522 apprentices who are allowed by law or regulation to work under the

311523 supervision of a single jour neyman or contractor. A student
312524 electrical intern is not allowed to work on high voltage systems
313525 defined by the National Electrical Code.
