36	65		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

38	66		SECTION 1. AMENDATORY 59 O.S. 2011, Section 1682, as
39	67		amended by Section 1, Chapter 17, O.S.L. 2018 (59 O.S. Supp. 202 0,
40	68		Section 1682), is amended to read as follows:

42	69		Section 1682. A. As used in the Electrical License Act:

44	70		1. “Board” means the Construction Industries Board;

48	98		2. “Committee” means the Committee of Electrical Examiners
49	99		appointed by the Board;

51	100		3. “Electrical apprentice” means any person sixteen (16) years
52	101		of age or older whose principal occupation is the learning of and
53	102		assisting in the installation of electrical work under the direct
54	103		supervision of a licensed journeyman electrician or electrical
55	104		contractor;
56		-
57	105		4. “Journeyman electrician ” means any person other than an
58	106		electrical contractor who engages in the actual installation,
59	107		alteration, repair or renovation of electrical facilities or
60	108		electrical construction work unless specifically exempted by the
61	109		provisions of the Electrical License Act;
62		-
63	110		5. “Electrical contractor ” means any person skilled in the
64	111		planning, superintending and practical installation of electrical
65	112		facilities who is familiar with the laws, rules and regulations
66	113		governing such work. Electri cal contractor also means any
67	114		individual, firm, partnership, corporation, limited liability
68	115		company, or business performing skills of an electrical contractor
69	116		or an electrician or the business of contracting, or furnishing
70	117		labor or labor and materials for the installation, repair,
71	118		maintenance or renovation of electrical facilities or electrical
72	119		construction work according to the provisions of the Electrical
73	120		License Act;

75	148		6. “Electrical facilities ” means all wiring, fixtures,
76	149		appurtenances, and appliances for, and in connection with, a supply
77	150		of electricity within or adjacent to any building, structure or
78	151		conveyance on the premises but not including the connection with a
79	152		power supply meter or other power supply source;

81	153		7. “Category” means the classification by which licenses and
82	154		electrical work may be limited. Such categories shall include but
83	155		shall not be limited to installation, maintenance, repair,
84	156		alteration, residential, oilfield , and commercial;
85		-
86	157		8. “Temporary journeyman electrician ” means any person other
87	158		than a person permanently licensed as a journeyman electrician or
88	159		electrical contractor in this state who meets the temporary
89	160		licensure requirements of Section 1685.1 of this title;

93	161		9. “Variance and Appeals Board ” means the Oklahoma State
94	162		Electrical Installation Code Variance and Appeals Board;
95		-
96	163		10. “Electrical construction work ” means installation,
97	164		fabrication or assembly of equipment or systems included in
98	165		“premises wiring” as defined in the National Electrical Code
99	166		(reference 158:40-1-4. Standard of Installation), and which is
100	167		hereby adopted and incorporated by reference. Electrical
101	168		construction work includes , but is not limited to , installation of
102	169		raceway systems used for any electrical purposes, and installation
103	170		of field-assembled systems such a s ice and snow melting, pipe -
104	171		tracing, and manufactured wiring systems. Electrical construction

106	200		company owning the plant, work performed by telecommunications
107	201		employees for telecommunicatio ns companies, or installation of
108	202		factory-assembled appliances or machinery which is not part of the
109	203		premises wiring unless wiring interconnections external to the
110	204		equipment are required in the field; and
111		-
112	205		11. “Electrical work” means work consisting primari ly of the
113	206		layout, installation, maintenance, repair, testing or replacement of
114	207		all or part of electrical wires, conduits, apparatus, fixtures,
115	208		appliances or equipment for transmitting, carrying, controlling or
116	209		using electricity in, on, outside or attached to a building,
117	210		structure, property or premises. Electrical work shall not mean
118	211		work that is related to or facilitates the construction,
119	212		installation or maintenance of all or part of an electrical system,
120	213		but which does not involve actual work with any of the electrical
121	214		components provided in this definition ; and
122		-
123	215		12. “Student electrical intern ” means any person sixteen (16)
124	216		years of age or older who complies with the requirements for
125	217		registration under Section 1686 of this title .

127	218		B. Class 2 and Class 3 ci rcuits shall be exempt from the
128	219		requirements of electrical licensing of either an electrical
129	220		contractor or a journeyman electrician, provided the work is
130	221		performed in accordance with the National Fire Protection
131	222		Association 70 requirements for Class 2 and Class 3 circuits.

135	250		SECTION 2. AMENDATORY 59 O.S. 2011, Section 1686, is
136	251		amended to read as follows:

138	252		Section 1686. A. The Construction Industries Board shall, upon
139	253		proper application and payment of fee, register as an electrical
140	254		apprentice and issue a certificate of such registration to any
141	255		person who furnishes satisfactory proof to the Board that the
142	256		applicant is:
143		-
144	257		1. Sixteen (16) years of age or over older; or
145		-
146	258		2. Enrolled in a school or federal training program for
147	259		electrical apprentices recognized by the Board , or employed as an
148	260		electrical apprentice with an active licensed electrical contractor.
149		-
150	261		B. The Construction Industries Board shall, upon proper
151	262		application and payment of fee, register as a student electrical
152	263		intern and issue a certificate of such registration to any person
153	264		who furnishes satisfactory proof to the Board that the applicant is:
154		-
155	265		1. Sixteen (16) years of age or older; and
156		-
157	266		2. Enrolled in high school and enrolled in a work -ready or
158	267		similar program recognized by the Board.

160	268		C. All applications for examination, license or renewal of
161	269		license shall be made in writing to the Board on forms provided, if
162	270		necessary, by the Board. All applications shall be accompanied by
163	271		the appropriate fee.

165	272		C. D. Apprentices and student electrical interns , when required
166	273		by the Board, shall provide such documents, statements or other

169	303		Oklahoma Statutes.

171	304		SECTION 3. AMENDATORY 59 O.S. 2011, Section 1688, is
172	305		amended to read as follows:

174	306		Section 1688. A. No license shall be issued for longer than
175	307		one (1) year, and all licenses shall expire on the last day in the
176	308		birth month of the lice nsee. A license may be renewed upon
177		-

179	309		application and payment of fees thirty (30) days preceding or
180	310		following the date the license is due. Licenses renewed more than
181	311		thirty (30) days following the date of expiration may be renewed
182	312		only upon application and payment of all required fees and payment
183	313		of any penalty for late renewal established by the Board and upon
184	314		compliance with any applicable continuing education requirements
185	315		established by the Board and this act the Electrical License Act .
186	316		No penalty for late renewal shall be charged to any holder of a
187	317		license which expires while the holder is in military service, if an
188	318		application for renewal is made within one (1) year following the
189	319		service discharge of the holder.

191	320		B. No journeyman or contractor license shall be renewed unless
192	321		the licensee has completed the required hours of continuing
193	322		education, as determined and approved by the Committee of Electrical
194	323		Examiners and approved by the Construction Industries Board.

196	351		C. An apprentice registration certificate or a student intern
197	352		registration certificate shall be issued for one (1) year, at which
198	353		time the apprentice may reregister upon meeting the requirements of
199	354		the Construction Industries Board and paying the renewal fee.

201	355		SECTION 4. AMENDATORY 59 O.S. 2011, Section 1689, as
202	356		amended by Section 23, Chapter 313, O.S.L. 2015 (59 O.S. Supp. 2020,
203	357		Section 1689), is amended to read as follows:

205	358		Section 1689. A. The Construction Industries Board or its
206	359		designee and the Committee of Electrica l Examiners shall act as the
207	360		Electrical Hearing Board and shall comply with the provisions of
208	361		Article II of the Administrative Procedures Act, Section 308a et
209	362		seq. of Title 75 of the Oklahoma Statutes.

211	363		B. Any administrative hearing on suspensions, revocat ions or
212	364		fines shall be conducted by a hearing examiner appointed by the
213	365		Board. The hearing examiner ’s decision shall be a final decision
214	366		which may be appealed to a district court in accordance with the
215	367		Administrative Procedures Act.

217	368		C. The Electrical Hea ring Board may, upon its own motion, and
218	369		shall, upon written complaint filed by any person, investigate the
219	370		business transactions of any electrical contractor, journeyman
220	371		electrician or, electrical apprentice , student electrical intern or

223	372		poultry house contractor license. Upon a finding by clear and
224	373		convincing evidence, the Board shall suspend or revoke any license
225	374		or registration obtained by false or fraudulent representation.

226	402		Upon a finding by clear and convincing evidence, the Board shall
227	403		also suspend or revoke any license or registration for any of the
228	404		following:
229		-
230	405		1. Making a material misstatement in the application for a
231	406		license or registration, or the renewal of a license or
232	407		registration;
233		-
234	408		2. Loaning or illegally using a license;
235		-
236	409		3. Demonstrating in competence to act as a journeyman
237	410		electrician or electrical contractor;
238		-
239	411		4. Violating any provisions of the Electrical License Act, or
240	412		any rule or order prescribed by the Board or any ordinance for the
241	413		installation of electrical facilities made or enacted by a city or
242	414		town by authority of the Electrical License Act;
243		-
244	415		5. Willfully failing to perform normal business obligations
245	416		without justifiable cause; or
246		-
247	417		6. Failing to maintain a registration or license as required by
248	418		law in another state while registered in this state as a nonresident
249	419		contractor.

251	420		D. Any person whose license or registration has been revoked by
252	421		the Electrical Hearing Board may apply for a new license one (1)
253	422		year from the date of such revocation.

255	423		E. Notwithstanding any other provision of l aw, a political
256	424		subdivision of this state that has adopted a nationally recognized
257	425		electrical code and appointed an inspector pursuant to the

259	454		provisions of the Oklahoma Inspectors Act for such wor k shall have
260	455		jurisdiction over the interpretation of the code and the
261	456		installation of all electrical work done in that political
262	457		subdivision, subject to the provisions of the Oklahoma Inspectors
263	458		Act. Provided, a state inspector may work directly with an
264	459		electrical contractor, journeyman electrician or, electrical

267	460		apprentice or student electrical intern in such a locality if a
268	461		violation of the code creates an immediate threat to life or health.

270	462		F. In the case of a complaint about, investigation of , or
271	463		inspection of any license, registration, permit or electrical work
272	464		in any political subdivision of this state which has not adopted a
273	465		nationally recognized electrical code and appointed an inspector
274	466		pursuant to the provisions of Section 1693 of this title or p ursuant
275	467		to the provisions of the Oklahoma Inspectors Act for such work, the
276	468		Construction Industries Board shall have jurisdiction over such
277	469		matters.

279	470		G. 1. No individual, business, company, corporation,
280	471		association or other entity subject to the provision s of the
281	472		Electrical License Act shall install, modify or alter electrical
282	473		facilities in any incorporated area of this state which has not
283	474		adopted a nationally recognized electrical code and appointed an
284	475		inspector pursuant to the provisions of Section 1693 of this title
285	476		or pursuant to the provisions of the Oklahoma Inspectors Act for

288	506		individual or entity required to make such notice shall be provided
289	507		by the Construction Industries Board upon request.

291	508		2. Notice to the Construction Industries Board pursuant to this
292	509		subsection shall not be required for electrical maintenance or
293	510		replacement of existing electrical appliances or fi xtures or of any
294	511		petroleum refinery or its research facilities.

296	512		3. Enforcement of this subsection is authorized pursuant to the
297	513		Electrical License Act, or under authority granted to the
298	514		Construction Industries Board.

300	515		SECTION 5. NEW LAW A new section of law to be codified
301	516		in the Oklahoma Statutes as Section 1699 of Title 59, unless there
302	517		is created a duplication in numbering, reads as follows:
303		-
304	518		One student electrical intern is allowed to work per physical
305	519		job site with direct supervis ion under a single journeyman or
306	520		electrical contractor; provided, however, that no such student
307	521		electrical intern shall be counted against the maximum number of
308	522		apprentices who are allowed by law or regulation to work under the

311	523		supervision of a single jour neyman or contractor. A student
312	524		electrical intern is not allowed to work on high voltage systems
313	525		defined by the National Electrical Code.
