6359 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
6460 SECTION 1. NEW LAW A new section of law to be codified
6561 in the Oklahoma Statutes as Section 57 of Title 78, unless there is
6662 created a duplication in numb ering, reads as follows:
6763 It shall be a deceptive trade practice for an on-line business
6864 operating within this state to use or allow to be embedded any
6965 redirect tracking feature, link or hyperlink on its Internet website
66+that redirects a consumer unknowingly to a third party website to

97-that redirects a consumer unknowingly to a third party website to
9893 complete a financial transaction, unless the original on -line
9994 business website uses a redirect statem ent that clearly appears to
10095 the consumer prior to the redirect to a third-party website. The
10196 redirect statement shall have language substantially similar to:
10297 "You are being redirected to a third-party website that (is/is not)
10398 (associated/affiliated) wi th this business".
10499 SECTION 2. AMENDATORY 78 O.S. 2011, Section 53, is

106101 Section 53. A. A person engages in a deceptive trade practice
107102 when in the course of business, vocation , or occupation, the person:
108103 1. Passes off goods or services as those of another;
109104 2. Knowingly makes a false re presentation as to the source,
110105 sponsorship, approval , or certification of goods or services;
111106 3. Knowingly makes a false representation as to affiliation,
112107 connection, association with , or certification by another;
113108 4. Uses deceptive representations or desi gnations of geographic
114109 origin in connection with goods or services;
115110 5. Knowingly makes a false representation as to the
116111 characteristics, ingredients, uses, benefits or quantities of goods
117112 or services or a false representation as to the sponsorship,
118113 approval, status, affiliation, or connection of a person therewith;

147141 7. Represents that goods or services are a particular standard,
148142 quality, or grade, or that goods are a particular style or model, if
149143 they are another;
150144 8. Disparages the goods, services , or business of another by
151145 false or misleading representation of fact;
152146 9. Advertises goods or services which differ from those offered
153147 for sale in the advertisements;
154148 10. Advertises goods or service s with intent not to supply
155149 reasonably expectable public demand, unless the advertisement
156150 discloses a limitation of quantity;
157151 11. Makes false or misleading statements of fact concerning the
158152 reasons for, existence of, or amounts of price reductions;
159153 12. Advertises the price of an item after deduction of a rebate
160154 unless the actual selling price is advertised and clear and
161155 conspicuous notice is given in the advertisement that a mail -in
162156 rebate is required to achieve the lower net price;
163157 13. Misrepresents the geographic location of the supplier by
164158 listing a fictitious business name or an assumed business name in a
165159 local telephone directory if:
166160 a. the name misrepresents the geographic location of the
167161 supplier,
168162 b. the listing fails to identify the locality and s tate

198191 forwarded or otherwise transferred to a business
199192 location that is outside the calling area covered by
200193 the local telephone directory, or
201194 d. the business location of t he supplier is located in a
202195 county that is not contiguous to a county in the
203196 calling area covered by the local telephone directory;
204197 or
205198 14. Lists a fictitious business name or assumed business na me
206199 in a directory assistance database if:
207200 a. the name misrepresents the geographic location of the
208201 supplier,
209202 b. calls to the local telephone number are routinely
210203 forwarded or otherwise transferred to a business
211204 location that is outside the local calling ar ea, or
212205 c. the business location of the supplier is located in a
213206 county that is not contiguous to a county in the local
214207 calling area; or
215208 15. Fails to use a written redirect statement on its on-line
216209 business website to notify the customer that he or she is being
217210 redirected away from the original on-line business website to a
218211 third-party website to complete a financial transaction. The
219212 redirect statement shall have language substantially similar to:

249241 B. Evidence that a person has engaged in a deceptive trade
250242 practice shall be prima facie evidence of intent to injure
251243 competitors and to destroy or substantially lessen competition .
252244 C. The deceptive tr ade practices listed in this section are in
253245 addition to and do not limit the types of unfair trade practices
254246 actionable at common law or under other statutes of this state.
255247 SECTION 3. AMENDATORY 15 O.S. 2011, Section 753, as
256248 amended by Section 1, Chapter 258, O.S.L. 2012 (15 O.S. Supp. 2020,
257249 Section 753), is amended to read as follows:
258250 Section 753. A person engages in a practice which is declared
259251 to be unlawful under the Oklah oma Consumer Protectio n Act when, in
260252 the course of the person 's business, the person:
261253 1. Represents, knowingly or wi th reason to know, that the
262254 subject of a consumer transaction is of a particular make or brand,
263255 when it is of another;
264256 2. Makes a false or misleading representa tion, knowingly or
265257 with reason to know, as to th e source, sponsorship, approval, or
266258 certification of the subject of a consumer transaction;
267259 3. Makes a false or misleading representation, knowingly or
268260 with reason to know, as to affili ation, connection, ass ociation

307298 knows that it is reconditioned, reclaimed, used , or secondhand;
308299 7. Represents, knowingly or with reason to know, that the
309300 subject of a consumer transaction is of a particula r standard, style
310301 or model, if it is of another ;
311302 8. Advertises, knowingly or with reason to know, the subject of
312303 a consumer transaction with intent not to sell it as advertised;
313304 9. Advertises, knowingly or with reason to know, the subject of
314305 a consumer transaction with intent not to supply reasonably expected
315306 public demand, unless the advertisement discloses a limitation of
316307 quantity;
317308 10. Advertises under the guise of obtaining sales pe rsonnel
318309 when in fact the purpose is to sell the subject of a consumer
319310 transaction to the sales personnel applicants;

347337 11. Makes false or misleading statements of fact, knowingly or
348338 with reason to know, concerning the price of the subject of a
349339 consumer transaction or the reason for, existence of, or amounts of
350340 price reduction;
351341 12. Employs "bait and switch" advertising, which consists of an
352342 offer to sell the subject of a consumer transaction which the seller
353343 does not intend to sell, which advertising is acco mpanied by one or
354344 more of the following practices:
355345 a. refusal to show the subject of a consumer transaction
356346 advertised,
357347 b. disparagement of the advertised subject of a consumer
358348 transaction or the terms of sale,
359349 c. requiring undisclosed tie -in sales or other
360350 undisclosed conditio ns to be met prior to selling the
361351 advertised subject of a consumer transaction,
362352 d. refusal to take orders for the subject of a consumer
363353 transaction advertised for delivery within a
364354 reasonable time,
365355 e. showing or demonstrating defectiv e subject of a
366356 consumer transaction which the seller knows is
367357 unusable or impracticable for the purpose set forth in
368358 the advertisement,

397386 transaction and subsequently charging the buyer for a
398387 higher priced item, or
399388 g. willful failure to make deliveries of the subject of a
400389 consumer transaction within a reasonable time or to
401390 make a refund therefor upon the request of the
402391 purchaser;
403392 13. Conducts a closing out sale without having first ob tained a
404393 license as required in the Oklahoma Consumer Protection Act;
405394 14. Resumes the busin ess for which the closing out sale was
406395 conducted within thirty-six (36) months from the expiration date of
407396 the closing out sale license;
408397 15. Falsely states, knowingly or with reason to know, that
409398 services, replacements or repairs are needed;
410399 16. Violates any provision of the Oklahoma Health Spa Act;
411400 17. Violates any provision of the Home Repair Fraud Act;
412401 18. Violates any provision of the Consumer Disclosure of Prizes
413402 and Gifts Act;
414403 19. Violates any provi sion of Section 755.1 of this title or
415404 Section 1847a of Title 21 of the Oklahoma Statutes;
416405 20. Commits an unfair or deceptive trade practice as defined in
417406 Section 752 of this title ;
418407 21. Violates any provision of Section 169.1 7111 of Title 8 36

448436 specified in the contract entered into pursuant to the Perpetual
449437 Care Fund Act;
450438 22. Misrepresents a mail solicita tion as an invoice or as a
451439 billing statement;
452440 23. Offers to purchase a mineral or royalty interest through a n
453441 offer that resembles an oil and gas lease and that the consumer
454442 believed was an oil and gas lease;
455443 24. Refuses to honor gift certificates, warra nties, or any
456444 other merchandise offered by a person in a consu mer transaction
457445 executed prior to the closing o f the business of the person without
458446 providing a purchaser a means of redeeming such merchandise or
459447 ensuring the warranties offered will be honored by another person;
460448 25. Knowingly causes a charge to be made by any billing method
461449 to a consumer for service s which the person knows was not auth orized
462450 in advance by the consumer;
463451 26. Knowingly causes a charge to be made by any billing method
464452 to a consumer for a product or pr oducts which the person knows was
465453 not authorized in advance by the consumer;
466454 27. Violates Section 752A of this title;
467455 28. Makes deceptive use of another 's name in notification or
468456 solicitation, as defined in Section 752 of this title ;
469457 29. Falsely states or implies that any person, product or
470458 service is recommended or endorsed by a named th ird person;

499486 including, but not limited to, the name, address or phone number of
500487 the consumer has been provided by a third person, whether that
501488 person is named or unnamed;
502489 31. Acting as a debt collec tor, contacts a debtor and threatens
503490 to file a suit against the debtor over a debt barred by the statute
504491 of limitations which has passed for filing suit for such debt; or
505492 32. Acting as a debt collector, conta cts a debtor and uses
506493 obscene or profane langua ge to collect a debt; or
507494 33. Fails to use a written redirect statement on its on-line
508495 business website to notify the customer that he or she is being
509496 redirected away from the original on-line business website to a
510497 third-party website to complete a financi al transaction. The
511498 redirect statement shall have language substantially similar to:
512499 "You are being redirected to a third-party website that (is/is not)
513500 (associated/affiliated) with this business ".
514501 SECTION 4. It being immediately necessar y for the preservation
515502 of the public peace, health or safety, an emergency is hereby
516503 declared to exist, by reason whereof this act shall take eff ect and
517504 be in full force from and a fter its passage and approval.
