79	79	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
80	80	SECTION 1. AMENDATORY Section 1, Chapter 163, O.S.L.
81	81	2019 (26 O.S. Supp. 2020, Section 3-130), is amended to read as
82	82	follows:
83	83	Section 3-130. A. The Secretary of the State Election Board
84	84	shall have the authority to direct the secretary of the election
85	85	board of selected counties to conduct a post-election audit of
86	86	election results upon the completion of elections scheduled pursuant
87	87	to Sections 1-101, 1-102, 1-103, 3-101 and 13A-103 of this title for
88	88	the purpose of maintaining the security of the election system .
89	89	Such audits shall verify whether the voting devices and software

142	142	audits required pursuant to this subsection sh all be completed for
143	143	no fewer than three elections in a minimum of three randomly
144	144	selected counties.
145	145	B. In addition to the post -election audits required pursuant to
146	146	subsection A of this section, the Secretary of the State Election
147	147	Board may direct the secretary of a county election board to co nduct
148	148	a post-election audit of election results, for the purpose of
149	149	maintaining the security of the elec tion system by ensurin g that
150	150	voting devices and soft ware used in a particular election correctly
151	151	tabulated votes.
152	152	B. The method, timing and procedures for conducting a post -
153	153	election audit shall be determ ined by the Secretary of the State
154	154	Election Board.
155	155	C. The secretary of a county election board shall re port the
156	156	findings of a post-election audit required pursuant to this section
157	157	to the Secretary of the State Election Board, and such re port shall
158	158	be available to the public.
159	159	D. The Secretary of the State Election Board may pro mulgate
160	160	policies, rules and pr ocedures related to the method and timing of
161	161	post-election audits and to otherwise implement the requirements of
162	162	this section.
163	163	E. For the purposes of this title, a “post-election audit” is
164	164	defined as a manual or electronic ex amination of a limited number of

218	218	election audit shall be conducted only at the direction of the
219	219	Secretary of the State Election Board an d only subject to the
220	220	Secretary’s previously promulgated policies, rules or procedures.
221	221	For a post-election audit conducted pursuant to subsection A of this
222	222	section, all ballots shall receive a manual and electronic
223	223	examination. For a post-election audit conducted pursuant to
224	224	subsection B of this section, a limited number of ballots may b e
225	225	audited by a manual or electronic examination.
226	226	SECTION 2. It being immediately necessary for the preservation
227	227	of the public peace, health or safety, an emergency is hereby
228	228	declared to exist, by reason whereof this act shall take effect and
229	229	be in full force from and after its passage an d approval.
