7979 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
8080 SECTION 1. AMENDATORY Section 1, Chapter 163, O.S.L.
8181 2019 (26 O.S. Supp. 2020, Section 3-130), is amended to read as
8282 follows:
8383 Section 3-130. A. The Secretary of the State Election Board
8484 shall have the authority to direct the secretary of the election
8585 board of selected counties to conduct a post-election audit of
8686 election results upon the completion of elections scheduled pursuant
8787 to Sections 1-101, 1-102, 1-103, 3-101 and 13A-103 of this title for
8888 the purpose of maintaining the security of the election system .
8989 Such audits shall verify whether the voting devices and software

142142 audits required pursuant to this subsection sh all be completed for
143143 no fewer than three elections in a minimum of three randomly
144144 selected counties.
145145 B. In addition to the post -election audits required pursuant to
146146 subsection A of this section, the Secretary of the State Election
147147 Board may direct the secretary of a county election board to co nduct
148148 a post-election audit of election results, for the purpose of
149149 maintaining the security of the elec tion system by ensurin g that
150150 voting devices and soft ware used in a particular election correctly
151151 tabulated votes.
152152 B. The method, timing and procedures for conducting a post -
153153 election audit shall be determ ined by the Secretary of the State
154154 Election Board.
155155 C. The secretary of a county election board shall re port the
156156 findings of a post-election audit required pursuant to this section
157157 to the Secretary of the State Election Board, and such re port shall
158158 be available to the public.
159159 D. The Secretary of the State Election Board may pro mulgate
160160 policies, rules and pr ocedures related to the method and timing of
161161 post-election audits and to otherwise implement the requirements of
162162 this section.
163163 E. For the purposes of this title, a “post-election audit” is
164164 defined as a manual or electronic ex amination of a limited number of

217217 authorized election officials following an election. A post -
218218 election audit shall be conducted only at the direction of the
219219 Secretary of the State Election Board an d only subject to the
220220 Secretary’s previously promulgated policies, rules or procedures.
221221 For a post-election audit conducted pursuant to subsection A of this
222222 section, all ballots shall receive a manual and electronic
223223 examination. For a post-election audit conducted pursuant to
224224 subsection B of this section, a limited number of ballots may b e
225225 audited by a manual or electronic examination.
226226 SECTION 2. It being immediately necessary for the preservation
227227 of the public peace, health or safety, an emergency is hereby
228228 declared to exist, by reason whereof this act shall take effect and
229229 be in full force from and after its passage an d approval.
