6565 An Act relating to schools; prohibiting com pulsory

7979 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
8080 SECTION 1. NEW LAW A new section of law to be codified
8181 in the Oklahoma Statutes as Section 1210.190 of Title 70, unless
8282 there is created a duplication in numbering, reads as follows:
8383 A. No child shall be required to receive any immunization as a
8484 condition of admittan ce to any public, private or parochial school .
8585 Such school shall not use any coercive means to compel immunization.
8686 B. The State Department of Health may recommend, but shall not
8787 require, a list of immunizations for children. A public, private or
8888 parochial school may provide immunizations recommended by the
8989 Department to a child who has not received such immunizations if the

141141 school complies with applicable law including, but not limited to,
142142 Section 1-116.2 of Title 70 of the Oklahoma Statutes and the
143143 Parents’ Bill of Rights.
144144 C. The appropriate authority of a public, private or paroch ial
145145 school who violates this section shall be in violation of the
146146 Parents’ Bill of Rights and may be punished as provided in Section
147147 2004 of Title 25 of the Oklahoma S tatutes.
148148 SECTION 2. REPEALER 70 O.S. 2011, Sections 1210.191,
149149 1210.192 and 1210.193 are hereby repealed.
150150 SECTION 3. This act shall become effective July 1, 2021.
151151 SECTION 4. It being immediately necessary f or the preservation
152152 of the public peace, health or safety, an emergency is hereby
153153 declared to exist, by reason whereof this act shall take effect and
154154 be in full force from and after its passage and approval.
