7575 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
7676 SECTION 1. AMENDATORY Section 5, Chapter 317, O.S.L.
7777 2013 (22 O.S. Supp. 20 20, Section 1373.4), is amended to read as
7878 follows:
7979 Section 1373.4. A. After the motion requesting forensic DNA
8080 testing and subsequent response have been filed, the se ntencing
8181 court shall hold a hear ing to determine whether DNA forensic testing
8282 will be ordered. A court shall order DNA tes ting only if the court
8383 finds:
8484 1. A reasonable probability that the petitioner would not have
8585 been convicted if favorable results had been obtained through DNA
8686 testing at the time of the original prosecution . For the purposes
8787 of this paragraph, “reasonable probability ” means that a petitioner

139139 must show by a preponderance o f the evidence that he or she woul d
140140 not have been prosecuted or convicted if exculpatory results had
141141 been obtained through DNA testing. Exculpatory results include, but
142142 are not limited to, evidence that wo uld impeach a witness ;
143143 2. The request for DNA testing is made to demo nstrate the
144144 innocence of the convicted perso n and is not made to unreasonabl y
145145 delay the execution of the sentence or the administration o f
146146 justice;
147147 3. One or more of the items of evidence the convicted person
148148 seeks to have tested still exists;
149149 4. The evidence to be tested was secured in relation t o the
150150 challenged conviction and either was not previously subject to DNA
151151 testing or, if previ ously tested for DNA, the evidence can be
152152 subjected to additional DNA testing that will provide a reasonable
153153 likelihood of more probative results; and
154154 5. The chain of custody of the evidence to be tested is
155155 sufficient to establish that the evidence has no t been substituted,
156156 tampered with, replaced or altered in any material respect or, if
157157 the chain of custody does not est ablish the integrity of the
158158 evidence, the testing itself has the potential t o establish the
159159 integrity of the evidence. For purposes of this act the
160160 Postconviction DNA Act, evidence that has been in the custody of law
161161 enforcement, other government officials or a public or private
162162 hospital shall be presumed to satisfy the chain -of-custody

214214 requirement of this subsection absent specific eviden ce of material
215215 tampering, replacement or alteration.
216216 B. If at the close of the hearing the court orders DNA forensic
217217 testing to be conducted, the court by written order shall require
218218 the attorney representing the state to effect the transfer of the
219219 item or items of evidence to be tested along with any documents,
220220 logs or reports relating to the items of evidence collected in
221221 connection with the crim inal case to the designated laboratory or
222222 laboratories within thirty (30) days of the order. In addition, the
223223 court shall require the attorney representing the state to assist
224224 the petitioner in locating any evidence the state contends was lost,
225225 destroyed or in the possession of any other governmental entity,
226226 public or private hospital, laboratory or other facilit y.
227227 C. If the attorney representing the state or the petitioner
228228 previously conducted any DNA analysis or other biological -evidence
229229 testing without the knowledge of the other party, such testing shall
230230 be revealed in the motion requesting forensic DNA testin g or
231231 response.
232232 D. The court may order DNA testing to be performed by the
233233 Oklahoma State Bureau of Investigation (OSBI), an accredited
234234 laboratory operating under contract with the OSBI or anoth er
235235 accredited laboratory, as defined in Section 150.37 of Title 74 of
236236 the Oklahoma Statutes. If the OSBI or an accredited laboratory
237237 under contract with the OSBI conducts the testing, the state shall

289289 bear the costs of the testing. If another laboratory c onducts the
290290 testing because neither the OSBI nor an accredited laboratory under
291291 contract with the OSBI has the ability or the resources to conduct
292292 the type of DNA testing to be performed, or if an accredited
293293 laboratory that is neither the OSBI nor under co ntract with the OSBI
294294 is chosen for some other reason, then the court shall require the
295295 petitioner to pay for the testing.
296296 E. The results of any postconviction DNA testing conducted
297297 under the provisions of this act the Postconviction DNA Act,
298298 including any laboratory reports prepared in connection with the
299299 testing, the underlying data or other laboratory documents, shall be
300300 disclosed to the petitioner, the attorney for the state and the
301301 court.
302302 F. If an accredited laboratory ot her than the OSBI or one under
303303 contract with the OSBI performs the DNA testing, the co urt shall
304304 impose reasonable conditions on the testing of the evidence to
305305 protect the interests of the parties in the integrity of the
306306 evidence and testing process and to preserve the evidence to the
307307 greatest extent possible.
308308 SECTION 2. This act shall become effective November 1, 2021.
