2755 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

2956 SECTION 1. AMENDATORY 12 O.S. 2011, Section 2506.2, is
3057 amended to read as follows:

3258 Section 2506.2. A. For purposes of this section:

3459 1. “Emergency services provider ” means any public employer that
3560 employs persons to provide firefighting services;

3761 2. “Emergency services personnel” means any employee of an
3862 emergency services provider who is engaged in providing firefighting
3963 services;

4164 3. “Employee assistance program ” means a program established by
4265 a law enforcement agency or emergency services provider to provide

4494 agency or emergency services provider;

4895 4. “Law enforcement agency ” means any county sheriff, municipal
4996 police department, the Oklahoma Highway Patrol , and any state or
5097 local public body that empl oys public safety personnel;

5298 5. “Public safety personnel ” means a sheriff, deputy sheriff,
5399 municipal police officer, state police officer, parole and probation
54100 officer, corrections employee, certified reserve officer,
55101 telecommunicator, or emergency medical dispatcher; and

57102 6. “Peer support counseling sessions ” means critical incident
58103 stress management sessions for public safety or emergency services
59104 personnel who have been involved in emotionally traumatic incidents
60105 by reason of their employment . The sessions may include
61106 participation of the immediate family of the public safety or
62107 emergency services personnel .

64108 B. Any communication made by a participant or counselor in a
65109 peer support counseling session conducted by a law enforcement
66110 agency or by an emerge ncy services provider for public safety
67111 personnel or emergency services personnel, and any oral or written
68112 information conveyed in the peer support counseling session, is
69113 confidential and may not be disclosed by any person participating in
70114 the peer support counseling session.

72115 C. Any communication relating to a peer support counseling
73116 session made confidential under subsection B of this section that is

74144 made between counselors, between counselors and the supervisors or
75145 staff of an employee assistance program , or between the supervisors
76146 or staff of an employee assistance program, is confidential and may
77147 not be disclosed.

79148 D. The provisions of this section apply only to peer support
80149 counseling sessions conducted by an employee or other person who:
81-
82150 1. Has been designated by a law enforcement agency or emergency
83151 services provider, or by an employee assistance program, to act as a
84152 counselor; and
85-
86153 2. Has received training in counseling and in providing
87154 emotional and moral support to public safety personnel or emerg ency
88155 services personnel who have been involved in emotionally traumatic
89156 incidents by reason of their employment.

93157 E. The provisions of this section apply to all oral
94158 communications, notes, records and reports arising out of a peer
95159 support counseling sessio n. Any notes, records or reports arising
96160 out of a peer support counseling session are not public records for
97161 the purposes of Sections 24A.1 through 24A.29 of Title 51 of the
98162 Oklahoma Statutes.

100163 F. Any communication made by a participant or counselor in a
101164 peer support counseling session subject to this section, and any
102165 oral or written information conveyed in a peer support counseling
103166 session subject to this section, is not admissible in any judicial
104167 proceeding, administrative proceeding, arbitration proceed ing, or

105195 other adjudicatory proceeding. Communications and information made
106196 confidential under this section shall not be disclosed by the
107197 participants in any judicial proceeding, administrative proceeding,
108198 arbitration proceeding, or other adjudicatory proc eeding. The
109199 limitations on disclosure imposed by this subsection include
110200 disclosure during any discovery conducted as part of an adjudicatory
111201 proceeding.

113202 G. Nothing in this section limits the discovery or introduction
114203 in evidence of knowledge acquired by any public safety personnel or
115204 emergency services personnel from observation made during the course
116205 of employment, or material or information acquired during the course
117206 of employment, that is otherwise subject to discovery or
118207 introduction in evidence.

120208 H. This section does not apply to:

122209 1. Any threat of suicide or homicide made by a participant in a
123210 peer support counseling session, or any information conveyed in a
124211 peer support counseling session relating to a threat of suicide or
125212 homicide;

127213 2. Any information relating to abuse of children or of the
128214 elderly, or other information that is required to be reported by
129215 law;

131216 3. Any admission of criminal conduct; or

133217 4. Any admission of a plan to commit a crime.

137245 I. This section shall not prohibit any communicatio ns between
138246 counselors who conduct peer support counseling sessions, or any
139247 communications between counselors and the supervisors or staff of an
140248 employee assistance program.
