27	55		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

29	56		SECTION 1. AMENDATORY 12 O.S. 2011, Section 2506.2, is
30	57		amended to read as follows:

32	58		Section 2506.2. A. For purposes of this section:
33		-
34	59		1. “Emergency services provider ” means any public employer that
35	60		employs persons to provide firefighting services;
36		-
37	61		2. “Emergency services personnel” means any employee of an
38	62		emergency services provider who is engaged in providing firefighting
39	63		services;

41	64		3. “Employee assistance program ” means a program established by
42	65		a law enforcement agency or emergency services provider to provide

44	94		agency or emergency services provider;

48	95		4. “Law enforcement agency ” means any county sheriff, municipal
49	96		police department, the Oklahoma Highway Patrol , and any state or
50	97		local public body that empl oys public safety personnel;
51		-
52	98		5. “Public safety personnel ” means a sheriff, deputy sheriff,
53	99		municipal police officer, state police officer, parole and probation
54	100		officer, corrections employee, certified reserve officer,
55	101		telecommunicator, or emergency medical dispatcher; and
56		-
57	102		6. “Peer support counseling sessions ” means critical incident
58	103		stress management sessions for public safety or emergency services
59	104		personnel who have been involved in emotionally traumatic incidents
60	105		by reason of their employment . The sessions may include
61	106		participation of the immediate family of the public safety or
62	107		emergency services personnel .

64	108		B. Any communication made by a participant or counselor in a
65	109		peer support counseling session conducted by a law enforcement
66	110		agency or by an emerge ncy services provider for public safety
67	111		personnel or emergency services personnel, and any oral or written
68	112		information conveyed in the peer support counseling session, is
69	113		confidential and may not be disclosed by any person participating in
70	114		the peer support counseling session.

72	115		C. Any communication relating to a peer support counseling
73	116		session made confidential under subsection B of this section that is

74	144		made between counselors, between counselors and the supervisors or
75	145		staff of an employee assistance program , or between the supervisors
76	146		or staff of an employee assistance program, is confidential and may
77	147		not be disclosed.

79	148		D. The provisions of this section apply only to peer support
80	149		counseling sessions conducted by an employee or other person who:
81		-
82	150		1. Has been designated by a law enforcement agency or emergency
83	151		services provider, or by an employee assistance program, to act as a
84	152		counselor; and

86	153		2. Has received training in counseling and in providing
87	154		emotional and moral support to public safety personnel or emerg ency
88	155		services personnel who have been involved in emotionally traumatic
89	156		incidents by reason of their employment.

93	157		E. The provisions of this section apply to all oral
94	158		communications, notes, records and reports arising out of a peer
95	159		support counseling sessio n. Any notes, records or reports arising
96	160		out of a peer support counseling session are not public records for
97	161		the purposes of Sections 24A.1 through 24A.29 of Title 51 of the
98	162		Oklahoma Statutes.

100	163		F. Any communication made by a participant or counselor in a
101	164		peer support counseling session subject to this section, and any
102	165		oral or written information conveyed in a peer support counseling
103	166		session subject to this section, is not admissible in any judicial
104	167		proceeding, administrative proceeding, arbitration proceed ing, or

105	195		other adjudicatory proceeding. Communications and information made
106	196		confidential under this section shall not be disclosed by the
107	197		participants in any judicial proceeding, administrative proceeding,
108	198		arbitration proceeding, or other adjudicatory proc eeding. The
109	199		limitations on disclosure imposed by this subsection include
110	200		disclosure during any discovery conducted as part of an adjudicatory
111	201		proceeding.

113	202		G. Nothing in this section limits the discovery or introduction
114	203		in evidence of knowledge acquired by any public safety personnel or
115	204		emergency services personnel from observation made during the course
116	205		of employment, or material or information acquired during the course
117	206		of employment, that is otherwise subject to discovery or
118	207		introduction in evidence.

120	208		H. This section does not apply to:
121		-
122	209		1. Any threat of suicide or homicide made by a participant in a
123	210		peer support counseling session, or any information conveyed in a
124	211		peer support counseling session relating to a threat of suicide or
125	212		homicide;

127	213		2. Any information relating to abuse of children or of the
128	214		elderly, or other information that is required to be reported by
129	215		law;

131	216		3. Any admission of criminal conduct; or
132		-
133	217		4. Any admission of a plan to commit a crime.
