7979 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOM A:
8080 SECTION 1. NEW LAW A new section of law to be codified
8181 in the Oklahoma Statutes as Section 983c of Title 22, unless there
8282 is created a duplication in numbering, reads as follows:
8383 A. There is hereby created the Council on Justice System
8484 Funding until December 1, 2023. The Council shall:
8585 1. Study current financial o bligations of criminal defendants
8686 and how those financial obligations are used to fund and subsidize
8787 core functions of the court system;
8888 2. Study and determine optimal methods of supporting and
8989 funding the court system without the use of criminal fines and fees;

141141 3. Research methods for tracking the collective total of fines
142142 and fees assessed annually to felony defen dants; and
143143 4. Research methods for tracking the distribution of crimi nal
144144 fines, fees and court costs upon collection.
145145 B. The Council shall be comprised of fourteen (14) members as
146146 follows:
147147 1. The Administrative Director of the Courts, or designee;
148148 2. A District Court Judge, to be appointed by the
149149 Administrative Director of the Courts;
150150 3. A District Attorney, who is currently s erving in that
151151 capacity, who shall be appointed by the District Attorneys Council;
152152 4. A representative of the Probation and Parole Services unit
153153 of the Department of Corrections , who shall be appointed by the
154154 Director of the Department of Corrections;
155155 5. A public defender, who shall be appointed by the
156156 Administrative Director of the Courts;
157157 6. The Executive Director of the Oklahoma Indigent Defense
158158 System, or designee;
159159 7. The Chair of the Senate Appropriations Commit tee, or
160160 designee;
161161 8. The Chair of the House of Representatives Appropriations and
162162 Budget Committee, or designee;

215215 10. One current member of the Senate who shall be appointed by
216216 the President Pro Tempore of the Senate ;
217217 11. One current member of the House of Representat ives who
218218 shall be appointed by the Speaker of the House of Representatives ;
219219 12. A member of a nonprofit organization whose focus is on
220220 criminal justice reform, who shall be appointed by the President Pro
221221 Tempore of the Senate;
222222 13. A member of a nonprofit organization whose focus is on
223223 criminal justice refor m, who shall be appointed by the Spe aker of
224224 the House of Representatives ; and
225225 14. A member of the business comm unity, who shall be appointed
226226 by the Governor.
227227 C. The Chair of the Council shal l be elected by majority vote
228228 of the Council members . The Chair shall call the f irst meeting no
229229 later than thirty (30) days after the effective date of this act.
230230 The Council may meet as often as necessary in order to perform the
231231 duties imposed upon it. A quorum of the Council shall be required
232232 to approve any final action or r ecommendation of the Counci l. For
233233 purposes of this section, eight members of the Council shall
234234 constitute a quorum.
235235 D. The meetings of the Council shall be subject to the
236236 provisions of the Oklahoma Open Meeting Act.
237237 E. The members of the Council shall receive no compensation,
238238 but travel reimbursement may be provided by their respective

290290 organizations within the limits provided for s tate employees in the
291291 State Travel Reimbursement Act.
292292 F. Administrative support for the Council shall be provided by
293293 the Office of Management and Enterprise Services.
294294 G. The Council shall submit a report of its findings and
295295 recommendations including fiscal impact statements on all of the
296296 recommendations of the Council, annually by November 1, 2022, and
297297 the same day thereafter to the Governor, the President P ro Tempore
298298 of the Senate and the Speaker of the House of Representatives .
299299 SECTION 2. This act shall become effective November 1, 2021.
