79	79	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOM A:
80	80	SECTION 1. NEW LAW A new section of law to be codified
81	81	in the Oklahoma Statutes as Section 983c of Title 22, unless there
82	82	is created a duplication in numbering, reads as follows:
83	83	A. There is hereby created the Council on Justice System
84	84	Funding until December 1, 2023. The Council shall:
85	85	1. Study current financial o bligations of criminal defendants
86	86	and how those financial obligations are used to fund and subsidize
87	87	core functions of the court system;
88	88	2. Study and determine optimal methods of supporting and
89	89	funding the court system without the use of criminal fines and fees;

141	141	3. Research methods for tracking the collective total of fines
142	142	and fees assessed annually to felony defen dants; and
143	143	4. Research methods for tracking the distribution of crimi nal
144	144	fines, fees and court costs upon collection.
145	145	B. The Council shall be comprised of fourteen (14) members as
146	146	follows:
147	147	1. The Administrative Director of the Courts, or designee;
148	148	2. A District Court Judge, to be appointed by the
149	149	Administrative Director of the Courts;
150	150	3. A District Attorney, who is currently s erving in that
151	151	capacity, who shall be appointed by the District Attorneys Council;
152	152	4. A representative of the Probation and Parole Services unit
153	153	of the Department of Corrections , who shall be appointed by the
154	154	Director of the Department of Corrections;
155	155	5. A public defender, who shall be appointed by the
156	156	Administrative Director of the Courts;
157	157	6. The Executive Director of the Oklahoma Indigent Defense
158	158	System, or designee;
159	159	7. The Chair of the Senate Appropriations Commit tee, or
160	160	designee;
161	161	8. The Chair of the House of Representatives Appropriations and
162	162	Budget Committee, or designee;
163	163	9. The Governor, or designee;

215	215	10. One current member of the Senate who shall be appointed by
216	216	the President Pro Tempore of the Senate ;
217	217	11. One current member of the House of Representat ives who
218	218	shall be appointed by the Speaker of the House of Representatives ;
219	219	12. A member of a nonprofit organization whose focus is on
220	220	criminal justice reform, who shall be appointed by the President Pro
221	221	Tempore of the Senate;
222	222	13. A member of a nonprofit organization whose focus is on
223	223	criminal justice refor m, who shall be appointed by the Spe aker of
224	224	the House of Representatives ; and
225	225	14. A member of the business comm unity, who shall be appointed
226	226	by the Governor.
227	227	C. The Chair of the Council shal l be elected by majority vote
228	228	of the Council members . The Chair shall call the f irst meeting no
229	229	later than thirty (30) days after the effective date of this act.
230	230	The Council may meet as often as necessary in order to perform the
231	231	duties imposed upon it. A quorum of the Council shall be required
232	232	to approve any final action or r ecommendation of the Counci l. For
233	233	purposes of this section, eight members of the Council shall
234	234	constitute a quorum.
235	235	D. The meetings of the Council shall be subject to the
236	236	provisions of the Oklahoma Open Meeting Act.
237	237	E. The members of the Council shall receive no compensation,
238	238	but travel reimbursement may be provided by their respective

291	291	State Travel Reimbursement Act.
292	292	F. Administrative support for the Council shall be provided by
293	293	the Office of Management and Enterprise Services.
294	294	G. The Council shall submit a report of its findings and
295	295	recommendations including fiscal impact statements on all of the
296	296	recommendations of the Council, annually by November 1, 2022, and
297	297	the same day thereafter to the Governor, the President P ro Tempore
298	298	of the Senate and the Speaker of the House of Representatives .
299	299	SECTION 2. This act shall become effective November 1, 2021.
