7575 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
7676 SECTION 1. AMENDATORY 59 O.S. 2011, Section 353.7, as
7777 last amended by Section 4, Chapter 106, O.S.L. 2018 (59 O.S. Supp.
7878 2020, Section 353.7), is amended to re ad as follows:
7979 Section 353.7. The State Board of Pharmacy shall have the power
8080 and duty to:
8181 1. Regulate the practice of pharmacy;
8282 2. Regulate the sale and distribution of drugs, medicines,
8383 chemicals and poisons;
8484 3. Regulate the dispensi ng of drugs and medicines in all places
8585 where drugs and medicines are compounded and/or dispensed;

137137 4. Examine and issue appropriate certificates of licensure as
138138 Doctor of Pharmacy to all applicants whom the Board deems qualif ied
139139 under the provisions of th e Oklahoma Pharmacy Act;
140140 5. Issue licenses to manufac turers, repackagers, outsourcing
141141 facilities, wholesale distributors, third -party logistics providers,
142142 pharmacies, and other dispensers, medical gas suppliers , and medical
143143 gas distributors;
144144 6. Issue sterile compounding and drug supplier permits for
145145 pharmacies at the fee set by the Board, with the expiratio n date of
146146 such permits to coincide with the pharmacy license annual expiration
147147 date;
148148 7. Prescribe minimum standards with respect to floor space and
149149 other physical characteristics of pharmacies and hospita l drug rooms
150150 as may be reasonably necessary for the maintenance of professional
151151 surroundings and for the protection of the safety and welfare of the
152152 public, and to refuse t he issuance of new or renewal licenses for
153153 failure to comply with such standards. M inimum standards for
154154 hospital drug rooms shall be c onsistent with the State Department of
155155 Health, Hospital Standards, as defined in OAC 310:667;
156156 8. Authorize its inspector s, compliance officers , and duly
157157 authorized representatives to enter and inspect any and all places,
158158 including premises, vehicles, equi pment, contents and records, where
159159 drugs, medicines, chemicals , or poisons are stored, sold, vended,

212212 transported;
213213 9. Employ the number of ins pectors and pharmacist compliance
214214 officers necessary in the investigation of criminal activity or
215215 preparation of administrative actions at an annual salary to be
216216 fixed by the Board, and to authorize nec essary expenses. Any
217217 inspector certified as a peace o fficer by the Council of Enforcement
218218 Education and Training shall have statewide jurisdiction to perform
219219 the duties authorized by this section. In addition, the inspectors
220220 shall be considered peace off icers and shall have the same powers
221221 and authority as that granted to peace officers. In addition, such
222222 inspectors or pharmacist compliance officers shall have the
223223 authority to take and copy records and the duty to confiscate all
224224 drugs, medicines, chemica ls or poisons found to be stored, sold,
225225 vended, given away, compounded, dispensed or manufactured contrar y
226226 to the provisions of the Oklahoma Pharmacy Act;
227227 10. Investigate complaints, subpoena witnesses and records,
228228 initiate prosecution, and hold hearings;
229229 11. Administer oaths in all manners pertaining to th e affairs
230230 of the Board and to take evidence and com pel the attendance of
231231 witnesses on questions pertaining to the enforcement of the Oklahoma
232232 Pharmacy Act;
233233 12. Reprimand, place on probation, suspend, r evoke permanently
234234 and levy fines not to exceed Three T housand Dollars ($3,000.00) for

286286 each count for which any person charged with violating the Oklahoma
287287 Pharmacy Act or Oklahoma Board of Pharmacy administrative rules has
288288 been convicted in Board hearings. The Board also may take other
289289 disciplinary action. T he Board may impose as part of any
290290 disciplinary action the payment of costs expended by the Board for
291291 any legal fees and costs , including, but not limited to, staff time,
292292 salary and travel expense, witn ess fees and attorney fees. The
293293 Board may also requir e additional continuing education , including
294294 attendance at a live continuing education program, and may require
295295 participation in a rehabilitation program for the impaired. The
296296 Board may take such actio ns singly or in combination, as the nature
297297 of the violation requires;
298298 13. Adopt and establish rules of p rofessional conduct
299299 appropriate to the establishment and maintenance of a high standard
300300 of integrity and dignity in the p rofession of pharmacy. Such r ules
301301 shall be subject to amendment or repeal by the Bo ard as the need may
302302 arise;
303303 14. Make and publish ru les such as may be necessary for
304304 carrying out and enforcing the provisions of the Oklahoma Pharmacy
305305 Act, Oklahoma drug la ws and rules, federal drug law s and
306306 regulations, and make such other rules as in its discretion may be
307307 necessary to protect the health, safety, and welfare of the public;
308308 15. Establish and collect appropriate fees for licenses,
309309 permits, inspections , and services provided; and such fee s shall be

361361 nonrefundable. Such fees shall be promulga ted to implement the
362362 provisions of the Oklahoma Pha rmacy Act under the provisions of the
363363 Administrative Procedures Act;
364364 16. Regulate:
365365 a. personnel working in a pharmacy, s uch as interns and
366366 supportive personnel, including technicians, and issue
367367 pharmacy technician permits and intern licenses,
368368 b. interns, preceptors and training areas through which
369369 the training of applicants occurs for licensure as a
370370 pharmacist, and
371371 c. such persons regarding all aspects relating to the
372372 handling of drugs, medicines, chemical s, and poisons;
373373 17. Acquire by purchase, lease, gi ft, solicitation of gift or
374374 by any other manner, and to maintain, use and operate or to contract
375375 for the maintenance, use and operation of or lease of any and all
376376 property of any kind, real, personal or mi xed or any interest
377377 therein unless otherwise provid ed by the Oklahoma Pharmacy Act;
378378 provided, all contracts for real property shall be subject to the
379379 provisions of Section 63 of Title 74 of the Oklahoma Statutes;
380380 18. Perform other such duties, exercise ot her such powers and
381381 employ such personnel as the pr ovisions and enforcement of the
382382 Oklahoma Pharmacy Act may require; and
383383 19. Approve pilot projects designed to utilize n ew or expanded
384384 technology or processes and provide patients with better pharmacy

437437 manner. Such approvals may include provisions granting exemptions
438438 to any rule adopted by the Board ;
439439 19. Understanding the health hazards that would result if suc h
440440 guidelines were not enforced , ensure that all licensed pharmacie s
441441 that ship drugs into this state comply with all manufacturer
442442 guidelines relating to packaging and storage of the drugs with no
443443 greater than a twelve -hour deviation from the guidel ines, at which
444444 time the pharmacy shall be in compliance; and
445445 20. Perform other such dutie s, exercise other such powers and
446446 employ such personnel as the provis ions and enforcement of the
447447 Oklahoma Pharmacy Act may require .
448448 SECTION 2. This act shall become effective November 1, 2 021.
