8989 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
9090 SECTION 1. AMENDATORY 43 O.S. 2011, Section 139, as
9191 amended by Section 1, Chapter 111, O.S.L. 2020 (43 O. S. Supp. 2020,
9292 Section 139), is amended to read as follows:
9393 Section 139. The Legislature finds and declares that child
9494 support is a basic legal right of the state ’s parents and children,

146146 that mothers and fathers ha ve a legal obligation to provide
147147 financial support for their children and that child support payments
148148 can have a substantial impact on child poverty and state welfare
149149 expenditures. It is therefore the Legislature ’s intent to encourage
150150 payment of child sup port to decrease overall costs to the sta te’s
151151 taxpayers while increasing t he amount of financial support collected
152152 for the state’s children by authorizing the district courts of this
153153 state and the Department of Human Ser vices to order the revocation,
154154 suspension, nonissuance or nonrenewal of an occupational,
155155 professional, business or any recreational license or permit, or
156156 permit including, but not limited to, a hunting and fishing license
157157 or other authorization issued purs uant to the Oklahoma Wildlife
158158 Conservation Code, Section 1 -101 et seq. of Title 29 of the Oklahoma
159159 Statutes, and certificates of title for vessels and mo tors and other
160160 licenses of registration issued pursuant to the Oklahoma Vessel and
161161 Motor Registration A ct, Section 4001 et seq. of Title 63 of the
162162 Oklahoma Statutes, and the driving privilege of or to order
163163 probation for a parent w ho is in noncompliance with an order for
164164 support for at least ninety (90) days or failing, after receiving
165165 appropriate notice to comply with subpoenas or warrants r elating to
166166 paternity or child support pro ceedings.

222222 of Title 47 of the Oklahoma Statu tes:
223223 1. “Licensing board” means any bureau, department, division,
224224 board, agency or commission of this state or of a municipality in
225225 this state that issues a licens e;
226226 2. “Noncompliance with an order for s upport” means that the
227227 obligor has failed to make c hild support payments required by a
228228 child support order in an amount equal to the child support payable
229229 for at least ninety (90) days or has failed to make full pay ments
230230 pursuant to a court-ordered payment plan for at least ninety (90)
231231 days or has failed t o obtain or maintain health insurance coverage
232232 as required by an orde r for support for at least ninety (90) days or
233233 has failed, after receiving appropriate notice t o comply with
234234 subpoenas or orders relatin g to paternity or child support
235235 proceedings or has failed to comply with an order to submit to
236236 genetic testing to determ ine paternity;
237237 3. “Order for support” means any judgment or order for the
238238 support of dependent children or an order to submit to geneti c
239239 testing to determine paternity issued by any cour t of this state or
240240 other state or any judgment or order issued in acc ordance with an
241241 administrative procedure established by state law that affords
242242 substantial due process and is subject to judicial review ;
243243 4. “License” means a license, certificate, regis tration,
244244 permit, approval or other similar document issued by a licen sing

296296 board granting to an individual a right or privilege to eng age in a
297297 profession, occupation or business, or any recreational license or
298298 permit including, but not limited to, a hunting and fishing license
299299 or other authorization issued pursuant to the Ok lahoma Wildlife
300300 Conservation Code, or certificates of title for vessels and motors
301301 and other licenses or registrations issued pursuant t o the Oklahoma
302302 Vessel and Motor Registration Act , or a driver license or other
303303 permit issued pursuant to Title 47 of the Oklahoma Statutes;
304304 5. “Obligor” means the person who is required to make payments
305305 or comply with other provisions of an order for supp ort;
306306 6. “Oklahoma Child Support Services (OCSS) (CSS)” means the
307307 state agency designated to administer a statewide plan for child
308308 support pursuant to Section 237 of Title 56 of the Oklahoma
309309 Statutes;
310310 7. “Person entitled” means:
311311 a. a person to whom a supp ort debt or support obligation
312312 is owed,
313313 b. the OCSS CSS or a public agency of another state that
314314 has the right to receiv e current or accrued support
315315 payments or that is providing support enforcement
316316 services, or
317317 c. a person designated in a support order or as otherwise
318318 specified by the court; and

370370 8. “Payment plan” includes, but is not limited to, a plan
371371 approved by the court that provides sufficient security to ensure
372372 compliance with a support order and/or that inco rporates voluntary
373373 or involuntary income assignment or a similar plan for periodic
374374 payment on an arrearage and, if applicable, current and future
375375 support.
376376 B. 1. Except as otherwise provided by this subsection, the
377377 district courts of this state are hereby authorized to order the
378378 revocation, suspension, nonissuance or nonrenewal of a license or
379379 the placement of the obligor on probation who is in noncompliance
380380 with an order for support.
381381 2. If the obligor is a licensed attorney, the court may report
382382 the matter to the State Bar Association to revoke or suspend the
383383 professional license of the obligor or other appropriate action in
384384 accordance with the rules of professi onal conduct and discipl inary
385385 proceedings.
386386 3. Pursuant to Section 6-201.1 of Title 47 of th e Oklahoma
387387 Statutes, the district or adminis trative courts of this state are
388388 hereby authorized to order the revocation or suspension of a driver
389389 license of an obligor who is in noncom pliance with an order of
390390 support.
391391 4. The remedy under this section is in ad dition to any other
392392 enforcement remedy av ailable to the court.

444444 C. 1. At any hearing involv ing the support of a child, after
445445 giving notice to the obli gor that licenses may be suspended or
446446 revoked, if the district court finds evidence presented at the
447447 hearing that an obligor is in noncompliance w ith an order for
448448 support and the obligor is license d by any licensing board, the
449449 court, in addition to any other enforc ement action available, may
450450 suspend or revoke the license of the obligor who is in noncompliance
451451 with the order of support or place the o bligor on probation pursuant
452452 to paragraph 2 of this subsection.
453453 2. a. To be placed on probation, the obligor shall agre e to
454454 a payment plan to:
455455 (1) make all future child support payments as
456456 required by the current or der during the period
457457 of probation, and
458458 (2) pay the full amount of the arrearage:
459459 (a) by lump sum by a date certain, if the court
460460 determines the obligor has the ability, or
461461 (b) by making monthly payments in addition to
462462 the monthly child support amount purs uant to
463463 Section 137 of this title.
464464 b. The payments required to be made pursuant to this
465465 section shall continue until the child support
466466 arrearage and interest wh ich was the subject of the
467467 license revocation action have been paid in full.

519519 3. If the obligor is placed on probation, the obligor shall be
520520 allowed to practice or continue to practice the profession,
521521 occupation or business of the obligor, or to operate a motor
522522 vehicle. If the court orders probatio n, the appropriate licensing
523523 board shall not be noti fied and no action is required of that bo ard.
524524 4. Probation shall be conditioned upon full c ompliance with the
525525 order. If the court grants probation, the probat ionary period shall
526526 not exceed three (3) yea rs from the date of entry of the in itial
527527 order of revocation or probation .
528528 5. If the obligor is placed on probation not in compliance with
529529 the terms of probation, the obligee or OCSS CSS may request a
530530 hearing file a notice at any time to review the status of the
531531 obligor’s compliance with the payment plan a nd to request with the
532532 court for immediate suspension or revocation of the obligor ’s
533533 license. The obligor shall be served with the notice of the hearing
534534 by regular mail to the obligor ’s address of record pursuant to
535535 Section 112A of this title. The obligor may request a hearing
536536 within thirty (30) days to show cause that the licenses of the
537537 obligor should not be suspended or revoked. If the obligor does not
538538 request a hearing within such time period, the court shall order
539539 immediate suspension or r evocation of the obligor’s licenses. If
540540 the licenses of the obligor are suspended or revoke d, the obligor
541541 may subsequently apply for reinstatement pursuant to subsection D or
542542 E of this section.

594594 6. If, by the completion of time allotted for the probationary
595595 period, the obligor has failed to fully comply w ith the terms of
596596 probation, the licenses of the obl igor shall be automatically
597597 suspended or revoked without further hea ring. If the licenses of
598598 the obligor are suspended or revoked, the obligor may thereafter
599599 apply for reinstatement in compliance with sub section D or E of this
600600 section.
601601 D. When all support due is paid in full and the obligor has
602602 complied with all other pr ovisions of the order for support, the
603603 obligor, the obligee or OCSS may file a motion with the c ourt for
604604 reinstatement of the obligor ’s licenses or termination of probation
605605 and the motion shall be set for hearing. If the court finds the
606606 obligor has paid all support due in full and has complied with all
607607 other provisions of the order for support, the court shall reinstate
608608 the obligor’s licenses or terminate the probation.
609609 E. 1. An obligor whose When an obligor’s licenses have been
610610 suspended or revoked , the obligor, the obligee or CSS may file a
611611 motion with request the court for reinstatement of to reinstate the
612612 licenses of the obligor prior to payment in full of all support due
613613 and the motion shall be set for hearin g.
614614 2. The court may shall reinstate the licenses of the obligor if
615615 the obligor has:
616616 a. paid all support due in full or paid the current chil d
617617 support and the monthly arrearage pa yments each month

670670 preceding, or paid an amount equivalent to t hree (3)
671671 months of child support and arrearage payments which
672672 satisfies the current child support and m onthly
673673 arrearage payments for the curr ent month and two (2)
674674 months immediately preceding,
675675 b. disclosed all information regarding health insurance
676676 availability and obtained and maintained health
677677 insurance coverage required by an order for support,
678678 c. complied with all subpoenas and orders relat ing to
679679 paternity or child support proceedings,
680680 d. complied with all orders to submit to genetic testing
681681 to determine paternity, and
682682 e. disclosed all employment and address information.
683683 3. If the obligor has not met the conditions in paragraph 2 of
684684 this subsection, the court may reinstate licenses upon a s howing
685685 that reinstatement of licenses would increase the likelihood of the
686686 obligor paying consistent, reliable child supp ort or for good cause
687687 shown.
688688 4. If the court terminates the order of suspension, re vocation,
689689 nonissuance or nonrenewal, it shall place the obligor on probation,
690690 conditioned upon compliance with any payment plan and the provisions
691691 of the order for support.

743743 4. If the obligor fails to comply with the t erms of probation,
744744 the court may refuse to reinstate the licenses of the obligor unless
745745 the obligor makes additional payments in an amount determined by the
746746 court to be sufficient to ensure future compliance, and the obligor
747747 complies with the other terms s et by the court.
748748 F. The obligor shall serve on the custodian or the state a copy
749749 of the motion for reinstatement of the licenses of the obligor and
750750 notice of hearing pursuant to Section 2005 of Title 12 of the
751751 Oklahoma Statutes, or if there is an address of record, by regular
752752 mail to the address of record on file with the central case registr y
753753 pursuant to Section 112A of this title. When child support services
754754 are being provided pursuant to Section 237 of Title 56 of the
755755 Oklahoma Statutes, the obligor sha ll serve a copy of the motion for
756756 reinstatement of the licenses of the obligor on OCSS.
757757 G. E. If the court orders termination of the order of
758758 suspension or revocation, the obligor shall send a copy of the order
759759 reinstating the licenses of the obligor to t he licensing board, the
760760 custodian and OCSS CSS when child support services are being
761761 provided pursuant to Section 237 of Title 56 of the Oklahoma
762762 Statutes.
763763 H. F. Entry of this order does not limit the ability of the
764764 court to issue a new order requiring the li censing board to revoke
765765 or suspend the license of the same obligor in the event of an other
766766 delinquency or failure to comply.

818818 I. G. Upon receipt of a court orde r to suspend or revoke the
819819 license of an obligor, the licensing board shall comply with the
820820 order by:
821821 1. Determining if the licen sing board has issued a license to
822822 the individual whose name appears on the order for support;
823823 2. Notifying the obligor of th e suspension or revocation;
824824 3. Demanding surrender of the license, if required;
825825 4. Entering the suspension or revocation of the license on the
826826 appropriate records; and
827827 5. Reporting the suspension or revocation of the license as
828828 appropriate.
829829 J. H. Upon receipt of a court or der to not issue or not renew
830830 the license of an obligor, the licensing boar d shall implement by:
831831 1. Determining if the licensing board has received an
832832 application for issuance or renewal of a license from the individual
833833 whose name appears on the order of support;
834834 2. Notifying the obligor of the nonissuance or nonrenewal; and
835835 3. Entering the nonissuance or nonr enewal of the license as
836836 appropriate.
837837 K. I. An order, issued by the court, directing the licensing
838838 board to suspend, revoke, not issue or not renew t he license of the
839839 obligor shall be processed and implemented by the lice nsing board
840840 without any additional review or hearing and shall continue until
841841 the court or appellate court advises the licensing board by order

893893 that the suspension, revocation, nonissu ance or nonrenewal is
894894 terminated.
895895 L. J. The licensing board has no juri sdiction to modify,
896896 remand, reverse, vacate, or stay the order of the court for the
897897 suspension, revocation, nonissuance or nonrenewal of a license.
898898 M. K. In the event of suspension, revocat ion, nonissuance or
899899 nonrenewal of a license, any funds paid by the obligor to the
900900 licensing board for costs related to issuance, renewal, or
901901 maintenance of a license shall not be refunded to the obligor.
902902 N. L. A licensing board may charge the obligor a fee t o cover
903903 the administrative costs incurred by the licensing boar d to
904904 administer the provisions of this section. Fees collected pursuant
905905 to this section by a licensing board which has an agency revolving
906906 fund shall be deposi ted in the agency revolving fund for the use by
907907 the licensing board to pay the costs of administ ering this section.
908908 Otherwise, the administrative costs shall be deposited in the
909909 General Revenue Fund of the state.
910910 O. M. Each licensing board shall promulga te rules necessary for
911911 the implementation and administration of this section.
912912 P. N. The licensing board is exempt from liability to the
913913 obligor for activities conducted in complian ce with Section 139 et
914914 seq. of this title.
915915 Q. O. The provisions of this se ction may be used to suspend or
916916 revoke the licenses and driving privileg es of the custodian of a

970970 P. A final order entered pursuant to this section may be
971971 appealed to the Supreme Court of Oklahoma pursuant to Section 990A
972972 of Title 12 of the Oklahoma Statutes.
973973 SECTION 3. NEW LAW A new section of law to be codified
974974 in the Oklahoma Statutes as Section 6-201.1A of Title 47, unless
975975 there is created a duplication in numb ering, reads as follows:
976976 A. In addition to other qualifications and cond itions
977977 established by law, the driving privilege of an individual is
978978 subject to the requirements of this section.
979979 B. Upon receipt of an order from a court or from the Office of
980980 Administrative Hearings: Child Support of the Department of Human
981981 Services, hereinafter referred to as “OAH”, that a person obligated
982982 to pay child support who owns or operates a motor vehicle is not in
983983 compliance with an order for support, the Commissioner of Public
984984 Safety shall revoke the person ’s driving privilege.
985985 C. 1. Whenever a court or the OAH finds that a person is not

10431043 revoke a person’s driving privilege for noncompliance with an order
10441044 of support shall be upon a Notification of Revocation form
10451045 prescribed by the Department of Public Safety. The Department of
10461046 Public Safety shall prepa re and distribute the Notification form to
10471047 be used by the courts and the OAH.
10481048 2. In addition to the Departmen t of Public Safety, the court or
10491049 the OAH, as applicable, shall send a copy of the No tification of
10501050 Revocation to the person obligated to pay child s upport by first
10511051 class, postage prepaid mail. The Notification shall:
10521052 a. include the name, address, date of b irth, physical
10531053 description and, if known, the driver license number
10541054 of the person,
10551055 b. require the Department to revoke the driving privilege
10561056 of the person required to pay child support,
10571057 c. require the Department to not reinstate the person ’s
10581058 driving privilege until:
10591059 (1) the court or the OAH issues a release that states
10601060 such person is in compliance with the order of
10611061 support or until a court or the OAH otherwise
10621062 authorizes reinstatement of the person ’s driving
10631063 privilege, and
10641064 (2) the person has paid to the Dep artment the fees
10651065 required by Section 6-212 of Title 47 of the
10661066 Oklahoma Statutes and has met all other statutory

11201120 d. specify the reason and statutory ground for the
11211121 revocation and the effectiv e date of the revocation,
11221122 e. inform the person that in order to apply for
11231123 reinstatement of the person’s driving privilege, the
11241124 person must obtain a release from the OAH or the
11251125 court, as applicable , and
11261126 f. inform the person that the person may file a petiti on
11271127 for judicial review of the Not ification of Revocation
11281128 in district court within th irty (30) days after
11291129 receipt of the Notification.
11301130 D. Upon receipt of the Notification o f Revocation from a court
11311131 or the OAH, as applicable, that a person obligated to pay child
11321132 support is not in complianc e with an order of support, the
11331133 Department shall, in addition to any other authority to withdraw
11341134 driving privileges, revoke the driving pri vilege of the person named
11351135 in the Notification without hearing.
11361136 E. 1. The court or the OAH shall furnish a release to the
11371137 Department whenever a person, whose driving privilege has been
11381138 revoked pursuant to this section, has established and is complying
11391139 with a payment schedule, as determined by the court or the OAH.
11401140 Upon receipt of such re lease, the Department shall rei nstate the
11411141 driving privileges of the person, if the person is otherwise

11951195 2. If the person defaults on the payment schedule, the court or
11961196 OAH may resubmit the notice of noncompliance as provided for in this
11971197 section. The court or the OAH shall furnish a release to the
11981198 Department whenever the person is once again complying with the
11991199 payment schedule, as determined by the court or the OAH. Upon
12001200 receipt of such release, the Department sha ll reinstate the driving
12011201 privileges of the person, if the person is otherwise eligible,
12021202 pursuant to Section 6 -212 of Title 47 of the Oklahoma Statutes ; and
12031203 3. A person whose driving privil ege has been revoked for
12041204 noncompliance due to defaulting on a payme nt schedule pursuant to
12051205 paragraph 2 of this subsect ion shall be required to meet all
12061206 statutory requirements for reinstatement of driving privileges
12071207 including, but not limited to, the pay ment of processing and
12081208 reinstatement fees, as provided for in Section 6-212 of Title 47 of
12091209 the Oklahoma Statutes .
12101210 F. If the court or the OAH, as applicable, i s unable to secure
12111211 the surrender to it of the driver license held by the person found
12121212 to be in noncompliance with an orde r of support, the Department,
12131213 upon revoking the driving privilege of the person, shall require
12141214 that the driver license held by the pers on be surrendered to the
12151215 Department. Upon reinstatement of the person ’s driving privileges
12161216 as provided for by law, the p erson’s valid and lawful driver license
