75	75	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
76	76	SECTION 1. AMENDATORY 63 O.S. 2011, Secti on 1-206, is
77	77	amended to read as follows:
78	78	Section 1-206. A. A county department of health, a district
79	79	department of health, a cooperative department of health , and a
80	80	city-county department of health shall , in their respective
81	81	jurisdictions:
82	82	1. Maintain programs for disease prevention and control, health
83	83	education, guidance, maternal and child health , including school
84	84	health services, health in the working enviro nment, nutrition and
85	85	other matters affecting the public health;
86	86	2. Provide preventive services to the chronically ill and aged;
87	87	3. Maintain vital records and statistics;

139	139	4. Make available birth control to members of the public during
140	140	hours of operation;
141	141	5. Assist the State Commissioner of Health in the performance
142	142	of official duties, and perform such other acts as may be required
143	143	by the Commissioner; and
144	144	5. 6. Enter into written agreements w ith the governing body of
145	145	any municipality or county for the perf ormance of services within
146	146	the respective jurisdictions and authorities that are necessary a nd
147	147	proper pursuant to the authority granted to municipalities and
148	148	counties by the Constitution and the laws of this state.
149	149	B. A county department of health, a dist rict department of
150	150	health, a cooperative department of health, and a city-county
151	151	department of health may maintain programs for mental health and day
152	152	care for children.
153	153	C. Nothing contained herein relating to pollution shall be in
154	154	conflict with the existi ng jurisdiction of any other state
155	155	environmental agency.
156	156	D. Except as otherwise provided by law, responsibility for the
157	157	licensing and inspection of nursing facilities and specialized
158	158	facilities, as defined in the Nursing Home Care A ct and for the
159	159	enforcement of state health and safety standards applicable to such
160	160	facilities, shall be reserved to the State Department of Health and
161	161	shall be exercised pursuant to the provisions of the Nursing Ho me
162	162	Care Act.

214	214	E. Except as otherwise provi ded by law, responsibil ity for the
215	215	licensing and inspection of a ny establishment where food or drink is
216	216	offered for sale or sold, in accordance with the provisions of
217	217	Section 1-1118 of this title, and for the enfor cement of state
218	218	health and safety standard s applicable to such es tablishments, shall
219	219	be reserved to the St ate Department of Health.
220	220	F. A county department of health, a district department of
221	221	health, a cooperative department of health and a city-county
222	222	department of health shall remain open a minimum of forty-five (45)
223	223	hours per week. Hours of operation shall include, but not be
224	224	limited to, 8:00 a.m. until 5:00 p.m., Monday through Friday.
225	225	SECTION 2. This act shall become effective November 1, 20 21.
