7575 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
7676 SECTION 1. AMENDATORY 63 O.S. 2011, Secti on 1-206, is
7777 amended to read as follows:
7878 Section 1-206. A. A county department of health, a district
7979 department of health, a cooperative department of health , and a
8080 city-county department of health shall , in their respective
8181 jurisdictions:
8282 1. Maintain programs for disease prevention and control, health
8383 education, guidance, maternal and child health , including school
8484 health services, health in the working enviro nment, nutrition and
8585 other matters affecting the public health;
8686 2. Provide preventive services to the chronically ill and aged;
8787 3. Maintain vital records and statistics;

139139 4. Make available birth control to members of the public during
140140 hours of operation;
141141 5. Assist the State Commissioner of Health in the performance
142142 of official duties, and perform such other acts as may be required
143143 by the Commissioner; and
144144 5. 6. Enter into written agreements w ith the governing body of
145145 any municipality or county for the perf ormance of services within
146146 the respective jurisdictions and authorities that are necessary a nd
147147 proper pursuant to the authority granted to municipalities and
148148 counties by the Constitution and the laws of this state.
149149 B. A county department of health, a dist rict department of
150150 health, a cooperative department of health, and a city-county
151151 department of health may maintain programs for mental health and day
152152 care for children.
153153 C. Nothing contained herein relating to pollution shall be in
154154 conflict with the existi ng jurisdiction of any other state
155155 environmental agency.
156156 D. Except as otherwise provided by law, responsibility for the
157157 licensing and inspection of nursing facilities and specialized
158158 facilities, as defined in the Nursing Home Care A ct and for the
159159 enforcement of state health and safety standards applicable to such
160160 facilities, shall be reserved to the State Department of Health and
161161 shall be exercised pursuant to the provisions of the Nursing Ho me
162162 Care Act.

214214 E. Except as otherwise provi ded by law, responsibil ity for the
215215 licensing and inspection of a ny establishment where food or drink is
216216 offered for sale or sold, in accordance with the provisions of
217217 Section 1-1118 of this title, and for the enfor cement of state
218218 health and safety standard s applicable to such es tablishments, shall
219219 be reserved to the St ate Department of Health.
220220 F. A county department of health, a district department of
221221 health, a cooperative department of health and a city-county
222222 department of health shall remain open a minimum of forty-five (45)
223223 hours per week. Hours of operation shall include, but not be
224224 limited to, 8:00 a.m. until 5:00 p.m., Monday through Friday.
225225 SECTION 2. This act shall become effective November 1, 20 21.
