4855 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
4956 SECTION 1. NEW LAW A new section of law to be codified
5057 in the Oklahoma Statutes as Section 1450.1 of Title 12, unless there
5158 is created a duplication in numbering, reads as follows:
5259 A. As used in this section:
53-1. "Algorithm" means a set of instruct ions designed to perform
60+1. Algorithm means a set of instructions desig ned to perform
5461 a specific task;
55-2. "Hate speech" means a phrase concerning content that an

5663 individual arbitrarily finds offensive based on his or her personal

87-4. "Political speech" means speech relating to the state, the
92+3. “Obscene” means that to the average person, applying
93+contemporary community stan dards, the dominant theme of the mate rial
94+taken as a whole appeals to prurient interest;
95+4. “Political speech” means speech relating to the state, the
8896 government, the body politic, public administration or government
8997 policymaking. Political speech includ es speech by the government or
9098 candidates for office and any discussion of social issues.
9199 Political speech does not include speech concerning the
92100 administration or the law of or relating to the civil aspects of
93101 government;
94-5. "Religious speech" means a set of unproven answers, truth
102+5. Religious speech means a set of unproven answers, truth
95103 claims, faith-based assumptions and naked assertions that attempt to
96104 explain the greater questions like how things were created, what
97105 humans should or should not be doing and what happens after death;

99-6. "Social media website" means a website or application that
100-allows a user to construct a public or semi -public profile and
101-enables users to communicate with each other for the primary purpose
102-of posting information, comments, messages or images and:

103110 a. is open to the public,
104111 b. has more than seventy -five million (75,000,000)
105112 subscribers, and
106113 c. has not been specifically affiliated with any one
107114 political party or religion from its inception.
108-"Social media website " shall not include electronic m ail or any
109-online service, application or website consi sting primarily of news,
110-sports, entertainment or other information or content that is not

137-user-generated but is preselected or curated by the provider and for
138-which any chat, comment or interacti ve functionality is inciden tal
139-to, directly related to or dependent on the provision of such
140-content.
141142 B. The owner or operator of a social media website who
142143 contracts with users in this state is subject to a private right of
143144 action by a social media website user if the so cial media website
144145 purposely:
145-1. Deletes or censors a social media website us er's political
146+1. Deletes or censors a social media website user ’s political
146147 speech or religious speech; or
147148 2. Uses an algorithm to suppress political speech or religious
148149 speech.
149150 C. 1. Damages available to a social media website user und er
150151 this section shall include:
151-a. damages in an amount not to exceed Seventy-five
152-Thousand Dollars ($75,000.00) per intentional deletion
153-or censoring of the social media website user's
154-speech,
152+a. a minimum of Seventy-five Thousand Dollars
153+($75,000.00) per intentional deletion or censoring of
154+the social media website us er’s speech,
155155 b. actual damages,
156156 c. punitive damages if aggravating factors are present,
157157 and
158158 d. other applicable forms of equitable reli ef.
159159 2. The prevailing party in a cause of action under this secti on
160160 may be awarded costs and reasonable attorney fees.
161+3. A social media website that restores from deletion or
162+removes the censoring of a social media w ebsite user’s speech in a
163+reasonable amount of time may use such fact to mitigate any damages.

187-3. A social media website that restores from deletion or
188-removes the censoring of a so cial media website user's speech in a
189-reasonable amount of time may use such fact to mitigate any damages.
190191 D. A social media website may not use the social media website
191-user's alleged hate speech as a basis for justification or defense
192+users alleged hate speech as a basis for justification or defense
192193 to the action against the social media website at trial.
193194 E. 1. A social media website shall be immune from liability
194195 under this section if it deletes or censors a social media website
195-user's speech or uses an algorithm to disfavor or censure speech

211+G. The Attorney General may bring a civil cause of action under

236-F. Only users who are eighteen (18) years of age or older shall
