81	81	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
82	82	SECTION 1. NEW LAW A new section of law to be codified
83	83	in the Oklahoma Statutes as Secti on 5026.1 of Title 63, unless there
84	84	is created a duplication in numbering, reads as f ollows:
85	85	A. The Oklahoma Health Care Authority , to the extent
86	86	permissible under federal law, shall provide Medicaid coverage for
87	87	medically necessary pasteurized donor brea st milk provided:
88	88	1. A physician, physician assistant or Advanced Practice
89	89	Registered Nurse licensed in this state signs an order stating th at

141	141	such milk is medically necessary for an infant Medicaid beneficiary ;
142	142	and
143	143	2. a. the infant is medically or physic ally unable to
144	144	receive maternal breast milk or participate in
145	145	breastfeeding, or
146	146	b. the infant’s mother is medically or physically unable
147	147	to produce maternal breast milk in sufficient
148	148	quantities.
149	149	B. The Oklahoma Health Care Authority Board shall promulgate
150	150	rules to implement the provisions of this section including, but not
151	151	limited to, establishing infant birth weight and health conditions
152	152	that may make the provision of pasteurized donor breast milk
153	153	medically necessary and time limits for Medicaid coverage of
154	154	pasteurized donor breast milk. The Board may adopt a policy or
155	155	procedure to implement the provisions of this section while in the
156	156	process of promulgating rules; provided, such policy or procedure is
157	157	posted on the Internet web site of the Authority prior to adoption of
158	158	the policy.
159	159	C. The Authority shall seek any federal approval necessa ry to
160	160	implement this section.
161	161	SECTION 2. This act shall become effective July 1, 2021.
162	162	SECTION 3. It being immediately necessary for the preservation
163	163	of the public peace, health or safety, an emergency is hereby
