8181 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
8282 SECTION 1. NEW LAW A new section of law to be codified
8383 in the Oklahoma Statutes as Secti on 5026.1 of Title 63, unless there
8484 is created a duplication in numbering, reads as f ollows:
8585 A. The Oklahoma Health Care Authority , to the extent
8686 permissible under federal law, shall provide Medicaid coverage for
8787 medically necessary pasteurized donor brea st milk provided:
8888 1. A physician, physician assistant or Advanced Practice
8989 Registered Nurse licensed in this state signs an order stating th at

141141 such milk is medically necessary for an infant Medicaid beneficiary ;
142142 and
143143 2. a. the infant is medically or physic ally unable to
144144 receive maternal breast milk or participate in
145145 breastfeeding, or
146146 b. the infant’s mother is medically or physically unable
147147 to produce maternal breast milk in sufficient
148148 quantities.
149149 B. The Oklahoma Health Care Authority Board shall promulgate
150150 rules to implement the provisions of this section including, but not
151151 limited to, establishing infant birth weight and health conditions
152152 that may make the provision of pasteurized donor breast milk
153153 medically necessary and time limits for Medicaid coverage of
154154 pasteurized donor breast milk. The Board may adopt a policy or
155155 procedure to implement the provisions of this section while in the
156156 process of promulgating rules; provided, such policy or procedure is
157157 posted on the Internet web site of the Authority prior to adoption of
158158 the policy.
159159 C. The Authority shall seek any federal approval necessa ry to
160160 implement this section.
161161 SECTION 2. This act shall become effective July 1, 2021.
162162 SECTION 3. It being immediately necessary for the preservation
163163 of the public peace, health or safety, an emergency is hereby
