6565 An Act relating to state government; creating the

7777 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
7878 SECTION 1. NEW LAW A new section of law to be codified
7979 in the Oklahoma Statutes as Section 777 of Title 74, unless there is
8080 created a duplication in numbering, reads as follows:
8181 A. There is hereby created the Oklahoma Commission on Race and
8282 Equality. The Commission shall consist of thirty (30) members. The
8383 members shall be appointed as follows : eight members shall be
8484 appointed by the Governor, eight members shall be appointed by the
8585 President Pro Tempore of the Senate , eight members shall be
8686 appointed by the Speaker of the House of Repres entatives, and six
8787 members shall be app ointed by the Oklahoma Legislative Black Caucus .

140140 authority for a term of three (3) years commencing with the date
141141 that the previous appointee ’s term expired. Each member shall serve
142142 no more than three terms. The member shall only serve two
143143 consecutive terms and shall be inactive for a period of one (1) year
144144 prior to serving the maximum three-term limit. In making such
145145 appointments, consideration shall be give n to making the membership
146146 broadly representative of the geographic areas of the state and the
147147 several racial and et hnic groups residing in the st ate. Each member
148148 shall hold office until the successor of the member is appointed and
149149 has qualified. A member of the Commission may be removed by the
150150 appropriate appointing authority for cause. A member appointed to
151151 fill a vacancy occurring before the e xpiration of a term of a member
152152 separated from the Commission for any cause shall b e appointed for
153153 the remainder of the term of the member whose offic e has been so
154154 vacated. Members of the Commission shall receive no salary but
155155 shall be entitled to travel reimbursement as provided by t he State
156156 Travel Reimbursement Act from funds available to the appropriate
157157 appointing authority.
158158 B. The Office of Manage ment and Enterprise Services shall
159159 provide staff support to the Oklahoma Commission on Race and
160160 Equality and make arrangements for sui table meeting space for the
161161 Commission as needed.
162162 C. The President Pro Tempore of the Senate shall name the chair
163163 of the Oklahoma Commission on Race and Equal ity, and the Speaker of

215215 the House of Representatives shall name the v ice-chair. Any other
216216 officers deemed necessary sh all be elected from among the members at
217217 the first meeting of the Commission. Thereafter, at the fi rst
218218 meeting of each fiscal year, the Commission shall elect a chair, a
219219 vice-chair and such other officers deemed necessary to conduct the
220220 business of the Commission from among its members. The Commission
221221 shall meet at least once every three (3) months and at such other
222222 times as called by the chair or by a majority of the Commission.
223223 D. The Oklahoma Commissio n on Race and Equality shal l have the
224224 power and the duty to:
225225 1. Advise on equality issues relating to racial discrimination
226226 and bias, state agencies and employees, communities, organizations
227227 and businesses of this state which desire the services of the
228228 Commission;
229229 2. Monitor legislation to determine whether legislation is
230230 discriminatory toward one race or ethni city or whether the race, or
231231 ethnicity of an individual would have an effect o n the enforcement
232232 of the legislation;
233233 3. Act as a resource and a cle aringhouse for research on issues
234234 related to racial discrimination and bias;
235235 4. Act as a resource in any state appointments to commissions
236236 and boards for diversity,
237237 5. Conduct meetings and se minars within the state as
238238 appropriate to support the goals and duties of the Commission; and

290290 6. Report to the Governor, the Presiden t Pro Tempore of the
291291 Senate and the Speaker of the House of Representatives of its
292292 activities. The report recommendations may include recommendations
293293 concerning needed legislation or regulatory changes re lating to
294294 racial discrimination and bias.
295295 SECTION 2. NEW LAW A new section of law to be codified
296296 in the Oklahoma Statutes as Section 777.1 of Title 74, unless there
297297 is created a duplication in nu mbering, reads as follows:
298298 There is hereby created in the State Treasury a revolving fund
299299 for the Office of Management and Enterprise Services designated the
300300 “Oklahoma Commission on Race and Equality Revolving Fund”. The fund
301301 shall be a continuing fund, n ot subject to fiscal year limitations ,
302302 and shall consist of all gifts and d onations contributed to sup port
303303 the work of the Oklahoma Commission on Race and Equality. All
304304 monies accrued to the credit of the fund are hereby appropriated and
305305 may be budgeted and expended by the Director of the Of fice of
306306 Management and Enterprise Servi ces on behalf of the Okla homa
307307 Commission on Race and Equality for the purposes prescribed by the
308308 Legislature in creating the Commission. Expenditures from the fund
309309 shall be made upon warrants issued by the State Trea surer against
310310 claims filed as prescribed by law with the Direct or of the Office of
311311 Management and Enterprise Services for approval and paym ent.
