77	77	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
78	78	SECTION 1. NEW LAW A new section of law to be codified
79	79	in the Oklahoma Statutes as Section 777 of Title 74, unless there is
80	80	created a duplication in numbering, reads as follows:
81	81	A. There is hereby created the Oklahoma Commission on Race and
82	82	Equality. The Commission shall consist of thirty (30) members. The
83	83	members shall be appointed as follows : eight members shall be
84	84	appointed by the Governor, eight members shall be appointed by the
85	85	President Pro Tempore of the Senate , eight members shall be
86	86	appointed by the Speaker of the House of Repres entatives, and six
87	87	members shall be app ointed by the Oklahoma Legislative Black Caucus .
88	88	All members shall be appointed by the appropriat e appointing

140	140	authority for a term of three (3) years commencing with the date
141	141	that the previous appointee ’s term expired. Each member shall serve
142	142	no more than three terms. The member shall only serve two
143	143	consecutive terms and shall be inactive for a period of one (1) year
144	144	prior to serving the maximum three-term limit. In making such
145	145	appointments, consideration shall be give n to making the membership
146	146	broadly representative of the geographic areas of the state and the
147	147	several racial and et hnic groups residing in the st ate. Each member
148	148	shall hold office until the successor of the member is appointed and
149	149	has qualified. A member of the Commission may be removed by the
150	150	appropriate appointing authority for cause. A member appointed to
151	151	fill a vacancy occurring before the e xpiration of a term of a member
152	152	separated from the Commission for any cause shall b e appointed for
153	153	the remainder of the term of the member whose offic e has been so
154	154	vacated. Members of the Commission shall receive no salary but
155	155	shall be entitled to travel reimbursement as provided by t he State
156	156	Travel Reimbursement Act from funds available to the appropriate
157	157	appointing authority.
158	158	B. The Office of Manage ment and Enterprise Services shall
159	159	provide staff support to the Oklahoma Commission on Race and
160	160	Equality and make arrangements for sui table meeting space for the
161	161	Commission as needed.
162	162	C. The President Pro Tempore of the Senate shall name the chair
163	163	of the Oklahoma Commission on Race and Equal ity, and the Speaker of

215	215	the House of Representatives shall name the v ice-chair. Any other
216	216	officers deemed necessary sh all be elected from among the members at
217	217	the first meeting of the Commission. Thereafter, at the fi rst
218	218	meeting of each fiscal year, the Commission shall elect a chair, a
219	219	vice-chair and such other officers deemed necessary to conduct the
220	220	business of the Commission from among its members. The Commission
221	221	shall meet at least once every three (3) months and at such other
222	222	times as called by the chair or by a majority of the Commission.
223	223	D. The Oklahoma Commissio n on Race and Equality shal l have the
224	224	power and the duty to:
225	225	1. Advise on equality issues relating to racial discrimination
226	226	and bias, state agencies and employees, communities, organizations
227	227	and businesses of this state which desire the services of the
228	228	Commission;
229	229	2. Monitor legislation to determine whether legislation is
230	230	discriminatory toward one race or ethni city or whether the race, or
231	231	ethnicity of an individual would have an effect o n the enforcement
232	232	of the legislation;
233	233	3. Act as a resource and a cle aringhouse for research on issues
234	234	related to racial discrimination and bias;
235	235	4. Act as a resource in any state appointments to commissions
236	236	and boards for diversity,
237	237	5. Conduct meetings and se minars within the state as
238	238	appropriate to support the goals and duties of the Commission; and

291	291	Senate and the Speaker of the House of Representatives of its
292	292	activities. The report recommendations may include recommendations
293	293	concerning needed legislation or regulatory changes re lating to
294	294	racial discrimination and bias.
295	295	SECTION 2. NEW LAW A new section of law to be codified

298	298	There is hereby created in the State Treasury a revolving fund
299	299	for the Office of Management and Enterprise Services designated the
300	300	“Oklahoma Commission on Race and Equality Revolving Fund”. The fund
301	301	shall be a continuing fund, n ot subject to fiscal year limitations ,
302	302	and shall consist of all gifts and d onations contributed to sup port
303	303	the work of the Oklahoma Commission on Race and Equality. All
304	304	monies accrued to the credit of the fund are hereby appropriated and
305	305	may be budgeted and expended by the Director of the Of fice of
306	306	Management and Enterprise Servi ces on behalf of the Okla homa
307	307	Commission on Race and Equality for the purposes prescribed by the
308	308	Legislature in creating the Commission. Expenditures from the fund
309	309	shall be made upon warrants issued by the State Trea surer against
310	310	claims filed as prescribed by law with the Direct or of the Office of
311	311	Management and Enterprise Services for approval and paym ent.
