7575 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
7676 SECTION 1. AMENDATORY 63 O.S. 2011, Section 1 -1962, as
7777 last amended by Section 3, Chapter 77, O.S.L. 2017 (63 O.S. Supp.
7878 2020, Section 1-1962), is amended to read as follo ws:
7979 Section 1-1962. A. No home care agency as that term is defined
8080 by the Home Care Act shall operate without first obtaining a license
8181 as required by the Home Care Act.
8282 B. 1. No home care agen cy, except as otherwise provided by
8383 this subsection, shall place an individual in the ro le of supportive
8484 home assistant with a client on a full-time, temporary, per diem, or
8585 other basis, unless the individual has completed agency -based
8686 supportive home assi stant training taught by a registered nurse in
8787 the sections applicable to the assistance required by the client.

139139 Each supportive home assi stant who successfully completes agency -
140140 based training shall demonstrate competence by testing th rough an
141141 independent entity approved by the State Department of Health. The
142142 requirements related to applica tion, approval, renewal, and denial
143143 of such testing entities shall be set forth in administrative rules
144144 promulgated by the State Board Commissioner of Health.
145145 2. The home care agen cy shall develop a written training plan
146146 that shall include, at a minimum, the following:
147147 a. observation, reporting, and docum entation of client
148148 status and the standby assistance or other services
149149 furnished,
150150 b. maintenance of a clean, safe, and healthy env ironment,
151151 c. recognizing an emergency and necessary emergency
152152 procedures,
153153 d. safe techniques to provide standby assistance wit h
154154 bathing, grooming, and toileting,
155155 e. assistance with meal preparation and safe food
156156 handling and storage,
157157 f. client rights and responsibilities and the need for
158158 respect for the client and for the privacy and
159159 property of the client, and
160160 g. basic infection control practices to include, at a
161161 minimum, instruction in acceptable hand hygiene

215215 3. Supervisory visits shall be made according to the client
216216 need, as determined by the nursing supervisor, but no l ess than once
217217 every six (6) months.
218218 4. No supportive home assistant shall provide services to a
219219 client until a criminal history b ackground check and a check of the
220220 nurse aide registry maintained by the St ate Department of Health is
221221 performed in accordance with Section 1-1950.1 of this title and the
222222 assistant is found to have no notations of abuse of any kind on the
223223 registry and no convictions of the crimes listed in subsection F of
224224 Section 1-1950.1 of this title.
225225 5. No home care agency may employ a suppor tive home assistant
226226 listed on the Department of Human Services Community Services Worker
227227 Registry.
228228 6. No licensed health care fac ility, licensed physician,
229229 advanced practice registered nurse, physician as sistant, or state
230230 agency employee acting in the per formance of his or her duties shall
231231 refer a client for personal care services as defined in parag raph 8
232232 of Section 1-1961 of this title or for companion or sitter services
233233 as defined in paragraph 1 of subs ection A of Section 1-1972 of this
234234 title, except to an agency licensed to provide such services. For
235235 purposes of this subsection, "licensed health care facility" shall
236236 include acute care hospitals, long -term acute care hospitals,

288288 rehabilitation hospitals, skilled nursing facilities, assisted
289289 living facilities, residential care homes, home care agencies, adult
290290 day care centers and hospice agencies.
291291 C. 1. No employer or contractor, except as otherwise provided
292292 by this subsection, shall employ or contract w ith any individual as
293293 a home health aide for more t han four (4) months, on a full -time,
294294 temporary, per diem or other basis, unless the individual is a
295295 licensed health professional o r unless the individual has satisfied
296296 the requirements for certification an d placement on the home health
297297 aide registry mainta ined by the State Department of Health.
298298 2. a. Any person in the employment of a home care agency as
299299 a home health aide on June 30, 1992, with continuous
300300 employment through June 30, 1993, shall be granted
301301 home health aide certification by the Department on
302302 July 1, 1993. The home care agency shall maintain
303303 responsibility for assurance of specific compe tencies
304304 of the home health aide a nd shall only assign the home
305305 health aide to tasks for which the aide has b een
306306 determined to be competent.
307307 b. Any home health aide employed between the dates of
308308 July 1, 1992, and June 30, 1993, shall be eligible for
309309 certification by passing a competency ev aluation and
310310 testing as required by the Department.

362362 c. Any home health aide employed on and after July 1,
363363 1996, shall complete any specified training,
364364 competency evaluation and testing required by the
365365 Department.
366366 D. The provisions of the Home Care Act sha ll not apply to:
367367 1. A person acting alone who provides services in the hom e of a
368368 relative, neighbor or friend;
369369 2. A person who provides maid services only;
370370 3. A nurse service or home aide service conducted by and for
371371 the adherents to any religious denom ination, the tenets of which
372372 include reliance on spiritual means through pr ayer alone for
373373 healing;
374374 4. A person providing hosp ice services pursuant to the Oklahoma
375375 Hospice Licensing Act;
376376 5. A nurse-midwife;
377377 6. An individual, agency, or organization that contracts with
378378 the Oklahoma Health Care Authority to provide services under the
379379 Home- and Community-Based Waiver for persons w ith developmental
380380 disabilities or that contracts with the Department of Human Services
381381 to provide community services to persons wi th developmental
382382 disabilities; provided, that staff members and individuals providing
383383 the services shall receive a level of tr aining, approved by the
384384 Department of Human Services, which meets or exceeds the level
385385 required pursuant to the Home Care Act. An individual, agency or

437437 organization otherwise covered under the Home Care A ct shall be
438438 exempt from the act only for those para professional direct care
439439 services provided under contracts referenced in this paragraph;
440440 7. An individual, agency or organization that provides or
441441 supports the provision of personal care services to an in dividual
442442 who performs individual employer responsib ilities of hiring,
443443 training, directing and managing a personal care attendant as part
444444 of the Oklahoma Health Care Authority Consum er-Directed Personal
445445 Assistance Supports and Services (CD -PASS) waiver program. An
446446 individual, agency or organization otherwi se covered under the
447447 provisions of the Home Care Act shall be exempt from the act only
448448 for those paraprofessional direct care serv ices provided under
449449 Oklahoma Health Care Authority contracts referenced in this
450450 paragraph, but shall not be exempt from the cr iminal history
451451 background check required under the Home Care Act and Section 1 -
452452 1950.1 of this title for other paraprofessional dir ect care service
453453 providers. A personal care attendant hired by a consumer under the
454454 CD-PASS program shall be exempt from cert ification as a home health
455455 aide, provided such personal care attendant receives the training
456456 required and approved by the Departme nt of Human Services;
457457 8. An individual who only provides Medicaid home - and
458458 community-based personal care services pursuant t o a contract with
459459 the Oklahoma Health Care Authority;
460460 9. An individual who:

512512 a. is employed by a licensed home care agency exclusi vely
513513 to provide personal care services on a live-in basis
514514 in the home,
515515 b. has no convictions pursuant to a criminal history
516516 investigation as provided in Section 1 -1950.1 of this
517517 title,
518518 c. is being continuously trained by a registered nurse to
519519 provide care that is spec ific to the needs of the
520520 particular client receiving the care, and
521521 d. is supervised by a registered nurse via an o n-site
522522 visit at least once each month;
523523 10. A home or facility approved and annually reviewed by the
524524 United States Department of Veterans Aff airs as a medical foster
525525 home in which care is provided exclusiv ely to three or fewer
526526 veterans; or
527527 11. A person qualified by the Department as a certified nurse
528528 aide pursuant to the provisions of Section 1 -1951 of this title.
529529 SECTION 2. This act shall become effective November 1, 2021.
