75	75	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
76	76	SECTION 1. AMENDATORY 63 O.S. 2011, Section 1 -1962, as
77	77	last amended by Section 3, Chapter 77, O.S.L. 2017 (63 O.S. Supp.
78	78	2020, Section 1-1962), is amended to read as follo ws:
79	79	Section 1-1962. A. No home care agency as that term is defined
80	80	by the Home Care Act shall operate without first obtaining a license
81	81	as required by the Home Care Act.
82	82	B. 1. No home care agen cy, except as otherwise provided by
83	83	this subsection, shall place an individual in the ro le of supportive
84	84	home assistant with a client on a full-time, temporary, per diem, or
85	85	other basis, unless the individual has completed agency -based
86	86	supportive home assi stant training taught by a registered nurse in
87	87	the sections applicable to the assistance required by the client.

139	139	Each supportive home assi stant who successfully completes agency -
140	140	based training shall demonstrate competence by testing th rough an
141	141	independent entity approved by the State Department of Health. The
142	142	requirements related to applica tion, approval, renewal, and denial
143	143	of such testing entities shall be set forth in administrative rules
144	144	promulgated by the State Board Commissioner of Health.
145	145	2. The home care agen cy shall develop a written training plan
146	146	that shall include, at a minimum, the following:
147	147	a. observation, reporting, and docum entation of client
148	148	status and the standby assistance or other services
149	149	furnished,
150	150	b. maintenance of a clean, safe, and healthy env ironment,
151	151	c. recognizing an emergency and necessary emergency
152	152	procedures,
153	153	d. safe techniques to provide standby assistance wit h
154	154	bathing, grooming, and toileting,
155	155	e. assistance with meal preparation and safe food
156	156	handling and storage,
157	157	f. client rights and responsibilities and the need for
158	158	respect for the client and for the privacy and
159	159	property of the client, and
160	160	g. basic infection control practices to include, at a
161	161	minimum, instruction in acceptable hand hygiene

215	215	3. Supervisory visits shall be made according to the client
216	216	need, as determined by the nursing supervisor, but no l ess than once
217	217	every six (6) months.
218	218	4. No supportive home assistant shall provide services to a
219	219	client until a criminal history b ackground check and a check of the
220	220	nurse aide registry maintained by the St ate Department of Health is
221	221	performed in accordance with Section 1-1950.1 of this title and the
222	222	assistant is found to have no notations of abuse of any kind on the
223	223	registry and no convictions of the crimes listed in subsection F of
224	224	Section 1-1950.1 of this title.
225	225	5. No home care agency may employ a suppor tive home assistant
226	226	listed on the Department of Human Services Community Services Worker
227	227	Registry.
228	228	6. No licensed health care fac ility, licensed physician,
229	229	advanced practice registered nurse, physician as sistant, or state
230	230	agency employee acting in the per formance of his or her duties shall
231	231	refer a client for personal care services as defined in parag raph 8
232	232	of Section 1-1961 of this title or for companion or sitter services
233	233	as defined in paragraph 1 of subs ection A of Section 1-1972 of this
234	234	title, except to an agency licensed to provide such services. For
235	235	purposes of this subsection, "licensed health care facility" shall
236	236	include acute care hospitals, long -term acute care hospitals,

289	289	living facilities, residential care homes, home care agencies, adult
290	290	day care centers and hospice agencies.
291	291	C. 1. No employer or contractor, except as otherwise provided
292	292	by this subsection, shall employ or contract w ith any individual as
293	293	a home health aide for more t han four (4) months, on a full -time,
294	294	temporary, per diem or other basis, unless the individual is a
295	295	licensed health professional o r unless the individual has satisfied
296	296	the requirements for certification an d placement on the home health
297	297	aide registry mainta ined by the State Department of Health.
298	298	2. a. Any person in the employment of a home care agency as
299	299	a home health aide on June 30, 1992, with continuous
300	300	employment through June 30, 1993, shall be granted
301	301	home health aide certification by the Department on
302	302	July 1, 1993. The home care agency shall maintain
303	303	responsibility for assurance of specific compe tencies
304	304	of the home health aide a nd shall only assign the home
305	305	health aide to tasks for which the aide has b een
306	306	determined to be competent.
307	307	b. Any home health aide employed between the dates of
308	308	July 1, 1992, and June 30, 1993, shall be eligible for
309	309	certification by passing a competency ev aluation and
310	310	testing as required by the Department.

362	362	c. Any home health aide employed on and after July 1,
363	363	1996, shall complete any specified training,
364	364	competency evaluation and testing required by the
365	365	Department.
366	366	D. The provisions of the Home Care Act sha ll not apply to:
367	367	1. A person acting alone who provides services in the hom e of a
368	368	relative, neighbor or friend;
369	369	2. A person who provides maid services only;
370	370	3. A nurse service or home aide service conducted by and for
371	371	the adherents to any religious denom ination, the tenets of which
372	372	include reliance on spiritual means through pr ayer alone for
373	373	healing;
374	374	4. A person providing hosp ice services pursuant to the Oklahoma
375	375	Hospice Licensing Act;
376	376	5. A nurse-midwife;
377	377	6. An individual, agency, or organization that contracts with
378	378	the Oklahoma Health Care Authority to provide services under the
379	379	Home- and Community-Based Waiver for persons w ith developmental
380	380	disabilities or that contracts with the Department of Human Services
381	381	to provide community services to persons wi th developmental
382	382	disabilities; provided, that staff members and individuals providing
383	383	the services shall receive a level of tr aining, approved by the
384	384	Department of Human Services, which meets or exceeds the level
385	385	required pursuant to the Home Care Act. An individual, agency or

437	437	organization otherwise covered under the Home Care A ct shall be
438	438	exempt from the act only for those para professional direct care
439	439	services provided under contracts referenced in this paragraph;
440	440	7. An individual, agency or organization that provides or
441	441	supports the provision of personal care services to an in dividual
442	442	who performs individual employer responsib ilities of hiring,
443	443	training, directing and managing a personal care attendant as part
444	444	of the Oklahoma Health Care Authority Consum er-Directed Personal
445	445	Assistance Supports and Services (CD -PASS) waiver program. An
446	446	individual, agency or organization otherwi se covered under the
447	447	provisions of the Home Care Act shall be exempt from the act only
448	448	for those paraprofessional direct care serv ices provided under
449	449	Oklahoma Health Care Authority contracts referenced in this
450	450	paragraph, but shall not be exempt from the cr iminal history
451	451	background check required under the Home Care Act and Section 1 -
452	452	1950.1 of this title for other paraprofessional dir ect care service
453	453	providers. A personal care attendant hired by a consumer under the
454	454	CD-PASS program shall be exempt from cert ification as a home health
455	455	aide, provided such personal care attendant receives the training
456	456	required and approved by the Departme nt of Human Services;
457	457	8. An individual who only provides Medicaid home - and
458	458	community-based personal care services pursuant t o a contract with
459	459	the Oklahoma Health Care Authority;
460	460	9. An individual who:

513	513	to provide personal care services on a live-in basis
514	514	in the home,
515	515	b. has no convictions pursuant to a criminal history
516	516	investigation as provided in Section 1 -1950.1 of this
517	517	title,
518	518	c. is being continuously trained by a registered nurse to
519	519	provide care that is spec ific to the needs of the
520	520	particular client receiving the care, and
521	521	d. is supervised by a registered nurse via an o n-site
522	522	visit at least once each month;
523	523	10. A home or facility approved and annually reviewed by the
524	524	United States Department of Veterans Aff airs as a medical foster
525	525	home in which care is provided exclusiv ely to three or fewer
526	526	veterans; or
527	527	11. A person qualified by the Department as a certified nurse
528	528	aide pursuant to the provisions of Section 1 -1951 of this title.
529	529	SECTION 2. This act shall become effective November 1, 2021.
