69	69	school districts to provide remediation courses for
70	70	students who score below c ertain benchmarks on
71	71	certain exams; allowing certain types of remediation;

73	73	effective date; and declaring an emergency .

79	79	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
80	80	SECTION 1. AMENDATORY Section 1, Chapter 61, O.S .L. 2017
81	81	(70 O.S. Supp. 2020, Section 11 -107.1), is amended to read as
82	82	follows:
83	83	Section 11-107.1. A. Each Beginning with the 2021 -2022 school
84	84	year, each school district in this state may offer a shall provide
85	85	remediation course courses for high school students who score below
86	86	a nineteen (19) on the benchmarks on subject-area portions of the
87	87	American College Testing (ACT ) exam or below an equivalent score
88	88	scores on the SAT exam in the most recent year for which student
89	89	performance data is available.

141	141	B. Remediation required by subsection A of this section may
142	142	include but is not limited to:
143	143	1. Extended instructional time during the school day;
144	144	2. A summer academy;
145	145	3. Tutoring;
146	146	4. Online coursework;
147	147	5. Repetition of an y course in which the student has
148	148	demonstrated academic deficiency by scoring below the benchmarks in
149	149	subject-area portions of the ACT or SAT; or
150	150	6. Other supplementary services.
151	151	C. Nothing in subsection A of this section shall be construed
152	152	to require that a teacher providing instruction i n the remediation
153	153	course be certified in any subjec t matter that is tested on the ACT
154	154	or SAT exam.
155	155	D. The State Board of Education may promulgate rules to
156	156	implement the provisions of this section.
157	157	SECTION 2. This act shall become effectiv e July 1, 2021.
158	158	SECTION 3. It being immediately necessary for the preservation
159	159	of the public peace, health or safety, an emergency is hereby
160	160	declared to exist, by reason whereof thi s act shall take effec t and
161	161	be in full force from and afte r its passage and approval.
