7979 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
8080 SECTION 1. AMENDATORY 70 O.S. 2011, Section 18 -201.1, as
8181 last amended by Section 3, Chapter 61, O.S.L. 2020 (70 O.S. Supp.
8282 2020, Section 18-201.1), is amended to read as follows:
8383 Section 18-201.1. A. Beginning with the 2020 -21 school year,
8484 and each school year thereafter, the weighted membership of a school
8585 district for calculation of Foundation Aid purp oses pursuant to
8686 paragraph 1 of subsection D of Section 18 -200.1 of this title shall

142142 calculation of Salary Incentive Aid purposes pursuant to paragraph 3
143143 of subsection D of Section 18 -200.1 of this title shall be the sum
144144 of the weighted pupil grade level calculation, t he weighted pupil
145145 category calculation, the weighted district calculation and the
146146 weighted teacher experience and degree calculation.
147147 B. The weighted calculations provided for in subsection A of
148148 this section shall be based on the highest weighted average daily
149149 membership of the first nine (9) weeks of the current school year,
150150 the preceding school year or the second preceding school year of a
151151 school district, unless otherwise specified. The highest of the
152152 three (3) weighted average daily memberships shall be used
153153 consistently in all of the calculations; however, the weighted
154154 calculation for a statewide virtual charter school experiencing a
155155 significant decline in membership sh all be based on the first nine
156156 (9) weeks of the current school year and not on the preceding school
157157 year or the second preceding school year for the statewide virtual
158158 charter school. For purposes of this subsection, “significant
159159 decline in membership ” means equal to or greater than a fifteen
160160 percent (15%) decrease in average daily membe rship from the
161161 preceding school year to the average daily membership of the first
162162 nine (9) weeks of the current school year. The average daily
163163 membership data used for all calculations in paragraphs 1, 2, 3 an d
164164 4 of this subsection shall be the same as us ed in the calculation of

236236 eligible for the early chi ldhood program weight shall be pursua nt to
237237 the provisions of Section 1 -114 of this title. The pupils eligible
238238 for the out-of-home placement pupil weight shall be students who are
239239 not residents of the school district in which they are receiving

291291 education pursuant to the provisions of subsecti on D of Section 1-
292292 113 of this title. Such wei ght may be claimed by the district
293293 providing educational services to such student for the days that
294294 student is enrolled in that district. If claimed, the out -of-home
295295 placement weight shall be in lieu of the pu pil grade level and any
296296 pupil category weights for that student. Provided, if a student
297297 resides in a juvenile detention center that is restricted to less
298298 than twelve (12) beds, the out -of-home placement pupil weight fo r
299299 such students shall be calculated a s follows: for a center with six
300300 (6) beds - 3.0; for a center with eight (8) beds - 2.3 and for a
301301 center with ten (10) beds - 1.80.
302302 2. The weighted pupil category calculation shall be determined

376376 Except as otherwise provided, multiply the number of pupils approved
377377 in the school year with the highest average daily membership in each

380380 school district. For the 1996 -97 school year, the number to be
381381 multiplied by the weight assigned to the gifted category in
382382 subparagraph g of this paragr aph shall be the lesser of (1) the su m
383383 of the number of students who scored in the top three percent (3%)
384384 on any national standardized test of intellectual ability plus the
385385 number of students identified as gifted pursuant to subparagraphs a
386386 through d of paragraph 1 of Section 1210.301 of this title or (2)
387387 the sum of the number of student s who scored in the top three

442442 For the 1997-98 school year and subseq uent school years, the number
443443 to be multiplied by the weight assigned to the gifted category in
444444 subparagraph g of this paragraph shall be the lesser of (1) the sum
445445 of the number of students who scored in the to p three percent (3%)
446446 on any national standardi zed test of intellectual ability plus the
447447 number of students identified as gifted pursuant to subparagraphs a
448448 through d of paragraph 1 of Section 1210.301 of this title, or (2)
449449 the sum of the number of students who scored in the top three
450450 percent (3%) on any national standardized test of intellectual
451451 ability plus eight percent (8%) of the total average daily
452452 membership of the school district for the first nine (9) weeks of
453453 the school year.
454454 3. The weighted distr ict calculation shall be determined by
455455 determining the calculations for each school district for both the
456456 small school district formula and the district sparsity - isolation
457457 formula, applying whichever is the greater of the calculations of
458458 the two formulas and then applying the restrictions pursuant t o
459459 subparagraph c of this paragraph.
460460 a. Small school district formula: 529 minus the average
461461 daily membership divided by 529 times .2 times total
462462 average daily membership.
463463 The small school district formula calc ulation shall apply

516516 membership is less than 529 pupils. School districts which
517517 are consolidated or annexed after July 1, 2003, pursuant to
518518 the Oklahoma School Volunt ary Consolidation and Annexation
519519 Act shall have the weighted district size calculat ion for
520520 the three (3) school years following the fiscal year in
521521 which such consolidation occurred calculated to be the sum
522522 of the individual consolidated districts computed as if the
523523 consolidation had not taken place. Thereafter, any such
524524 district which is consolidated pursuant to the Oklahoma
525525 School Voluntary Consolidation and Annexation Act shall not
526526 qualify for the weighted district calculation unless the
527527 district can satisfy the specifications herein. Subj ect to
528528 the provisions of subparagraph c of thi s paragraph, the
529529 resulting number shall be counted as additional students
530530 for the purpose of calculating State Aid.
531531 b. District sparsity - isolation formula:
532532 The district sparsity - isolation formula calculatio n shall
533533 apply only to school districts:
534534 (1) whose total area in square miles is greater than
535535 the average number of square miles for all school
536536 districts in this state; and
537537 (2) whose areal density is less than one -fourth (1/4)
538538 of the state average areal den sity. Areal

602602 The school district student cost factor shall be calculated

604604 The school district’s average daily membership shall
605605 be categorized into the following grade level groups
606606 and applied to the appropriate formulas as comput ed

686686 The State Board of Education shall define geographical barriers

741741 Board deems necessary allow additiona l square miles to be used for
742742 the purposes of calculations used for the weighted di strict sparsity
743743 - isolation formula. Provided, that the additional square miles
744744 allowed for geographical barriers shall not exceed thirty percent
745745 (30%) of the district ’s actual size.
746746 c. State Aid funds which a district is calculated to
747747 receive as a result of the weighted district
748748 calculation shall be restricted as follows:
749749 If, after the weighted district calculation is
750750 applied, the district ’s projected per pupil
751751 revenue exceeds one hundred fifty percent (150%)
752752 of the projected state average per pupil reven ue,
753753 then the district’s State Aid shall be reduced by
754754 an amount that will restrict the district ’s
755755 projected per pupil revenue to one hundred fifty
756756 percent (150%) of the proj ected state average per
757757 pupil revenue. Provided, in applying the
758758 restriction provided in this division, the
759759 district’s State Aid shall not be reduced by an
760760 amount greater than by the amount of State Aid
761761 which was generated by the weighted district
762762 calculation.

830830 The December calculation of the projected per pupil
831831 revenue shall be determined by dividing the highest of
832832 the district’s first nine (9) weeks of the current
833833 school year or the two (2) preceding school years
834834 average daily membership (ADM) as weighted by the
835835 pupil grade level, the pupil category, the district
836836 and the teacher experience degree index calculations
837837 for projected State Aid into the district ’s projected
838838 total revenues including funds for the December
839839 calculation of the current year State Aid Formula, net

898898 The district’s projected total revenues for each
899899 calculation shall exclude the following collections
900900 for the second preceding year: federa l revenue,
901901 insurance loss payments, r eimbursements, recovery of
902902 overpayments and refunds, unused reserves, prior
903903 expenditures recovered, prior year surpluses, and
904904 other local miscellaneous revenues.
905905 4. The weighted teacher experience and degree calculatio n shall
906906 be determined in accordance w ith the teacher experience and degree
907907 index. The State Department of Education shall determine an index
908908 for each state teacher by using data supplied in the school
909909 district’s teacher personnel reports of the preceding year and
910910 utilizing the index as follo ws:

971971 The school district teacher index for each schoo l district shall
972972 be determined by subtracting the weighted average state teacher from
973973 the weighted average district teacher. Multiply the school district
974974 teacher index if greater than zero by .7 and then multiply that
975975 product by the sum of the district ’s weighted pupil grade level
976976 calculation provided in paragraph 1 of this subsection and the
977977 weighted pupil category calculation provided in subparagraph m of
978978 paragraph 2 of this subsection to determine the weighted teache r
979979 experience and degree calculation.
980980 C. School districts that receive State Aid funds as a result of
981981 qualifying for the “bilingual” pupil category weight pursuant to
982982 subparagraph k of paragraph 2 of subsection B of this section shall
983983 use the funds to prov ide professional development for teac hers who
984984 offer instruction in English as a second l anguage. Expenditures
985985 shall be reported using the Oklahoma Cost Accounting System.
986986 SECTION 2. This act shall become effective July 1, 2021.
987987 SECTION 3. It being immediatel y necessary for the preservation
