5854 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAH OMA:
5955 SECTION 1. AMENDATORY 51 O.S. 2011, Section 24A.8, as
6056 last amended by Section 2, Chapter 370, O.S.L. 2015 (51 O.S. Supp.
6157 2020, Section 24A.8), is amended to read as follows:
6258 Section 24A.8. A. Law enforcement agencies shall make
6359 available for public inspection and copying, if kept, the following
6460 records:
61+1. An arrestee description , including the name, date of birth,
62+address, race, sex, phys ical description, and occupation of the
63+arrestee;

144-to law enforcement vehicles or unmanned aircraft as defined in
145-Section 322 of Title 3 of the Oklahoma Statutes , associated audio
146140 recordings from recording equipment on the pers on of a law

148142 source used by a law enforcement agency ; provided, the law
149143 enforcement agency may, before releasing any audio or video
150144 recording provided for in this paragraph, redact or obscure specific

162+f. include personal medical information that is not

195-f. include personal medical information that is no t

197190 g. would undermine the assertion of a privilege provided
198191 in Section 1-109 or Section 3-428 of Title 43A of the
199192 Oklahoma Statutes for detention or transportation for
200193 mental health evaluation or treatment or drug or
201194 alcohol detoxification purpos es,
202195 h. include personal information other than the name or
203196 license plate number of a per son not arrested, cited,
204197 charged or issued a writ ten warning. Such personal
205198 information shall include any government -issued
206199 identification number, date of birth, addre ss or
207200 financial information, or
208201 i. reveal the identity of law enforcement officers who
209202 have become subject to internal investigation by t he
210203 law enforcement agency as a result of an event
211204 depicted in the recording. T he option to protect the
212205 identity of a law enforcement officer shall not be
213206 available to the law enforcement agency after the la w
214207 enforcement agency has concluded the investigat ion and
215208 rendered a decision as to final d isciplinary action.
216209 At such time when an investigation has concluded and
210+the law enforcement agency has rendered its decision
211+as to final disciplinary action, the po rtions of the
212+recordings previously withheld as p rovided for in this
213+subparagraph shall be available for public inspection

244-the law enforcement agency has rendered its decision
245-as to final disciplinary action, the portions of the
246-recordings previously withheld as provided for in this
247-subparagraph shall be available for public inspection
248240 and copying. The audio and video recordings withheld
249241 as provided for in this subparagraph shall be
250242 available for public inspection a nd copying before the
251243 conclusion of the investiga tion if the investigation
252244 lasts for an unreasonable amount of time; and
253245 10. a. Audio and video recordings from recordin g equipment
254246 attached to the person of a law enforcement officer
255247 that depict:
256248 (1) the use of any physical force or violence by a
257249 law enforcement officer,
258250 (2) pursuits of any kind,
259251 (3) traffic stops,
260252 (4) any person being arrested, cited, charged or
261253 issued a written warning,
262254 (5) events that directly led to any person being
263255 arrested, cited, charg ed or receiving a written
264256 warning,
265257 (6) detentions of any length for the purpose of
266258 investigation,
259+(7) any exercise of authority by a law enforcement
260+officer that deprives a citizen of his or her
261+liberty,

294-(7) any exercise of authority by a law enforcement
295-officer that deprives a citizen of his or her
296-liberty,
297288 (8) actions by a law enforcement officer that have
298289 become the cause of an investigation or charges
299290 being filed,
300291 (9) recordings in the public i nterest that may
301292 materially aid a dete rmination of whether law
302293 enforcement officers are appropriately performing
303294 their duties as public servants, or
304295 (10) any contextual events occurring before or after
305296 the events depicted in divisions (1) through (9)
306297 of this subparagraph.
307298 b. Notwithstanding the provisions of subparagraph a of
308299 this paragraph, the law enforcement agency may, before
309300 releasing any audio or video recording provided for in
310301 this paragraph, redact or obscure specific portions of
311302 the recording that:
312303 (1) depict the death of a person or a dead body,
313304 unless the death was effecte d by a law
314305 enforcement officer,
315306 (2) depict nudity,
316307 (3) would identify minors under the a ge of sixteen
317308 (16) years or would undermine any r equirement to
309+keep certain juvenile recor ds confidential as

396-law enforcement or the information provided by
397-that person when that person requests anonymity
398-or where disclosure of the identity of the person
399388 or the information provided could reasonably be
400389 expected to threaten or endanger the physical
401390 safety or property of the person or the physical
402391 safety or property of others,
403392 (10) undermine the assertion of a privilege to keep
404393 the identity of an informer confidential as
405394 provided for in Section 2510 of Title 12 of the
406395 Oklahoma Statutes,
407396 (11) include personal information o ther than the name
408397 or license plate number of a p erson not
409398 officially arrested, cited, cha rged or issued a
410399 written warning. Suc h personal information shall
411400 include any government-issued identification
412401 number, date of birth, address or financial
413402 information,
414403 (12) include information that would materially
415404 compromise an ongoing criminal investiga tion or
416405 ongoing criminal prosecution, provided that:
417406 (a) ten (10) days followi ng the formal
418407 arraignment or initial appearance, whichever
408+occurs first, of a person cha rged in the
409+case in question, the recording shall be
410+made available for public inspection and
411+copying with no redaction of the p ortions

447-case in question, the recording shall be
448-made available for public inspection and
449-copying with no redaction of the portions
450438 that were temporarily withheld b y reliance
451439 on this division. Provided, before
452440 potential release of a recording as provi ded
453441 for in this subdivision, the prosecutor or
454442 legal representative of the person charged
455443 may request from the appropriate distr ict
456444 court an extension of time during wh ich the
457445 recording may be withheld under the
458446 provisions of this division. When a request
459447 for an extension of time has been filed with
460448 the court, the recording in question may be
461449 withheld until the court has issued a
462450 ruling. Such requests for an extension of
463451 the time during which the recording may be
464452 withheld may be made on the grounds that
465453 release of the recording will materially
466454 compromise an ongoing criminal investigation
467455 or criminal prosecution or on the grounds
468456 that release of the recording will
469457 materially compromise the right of an
458+accused to a fair trial that has yet to
459+begin. Courts considering such requests
460+shall conduct a hearing and consider whether
461+the interests of the public outweigh the

500-the interests of the public outweigh the
501488 interests asserted by the parties. In
502489 response to such requests, the court shall
503490 order that the recording be made available
504491 for public inspectio n and copying with no
505492 redaction of the portions t hat were
506493 temporarily withheld by reliance on this
507494 division or order an extensio n of time
508495 during which the recording may be withheld
509496 under the provisions of this division.
510497 Provided further, each such time ex tension
511498 shall only be ordered by the court for an
512499 additional six-month period of time or l ess
513500 and cumulative time extensions sha ll not add
514501 up to more than eighteen (18) months, or
515502 (b) in the event that one hundred twenty (120)
516503 days expire from the date of the events
517504 depicted in the recording without any person
518505 being criminally charged in the ca se in
519506 question and release of a record ing or
520507 portions of a recording have been denied on
508+the grounds provided for in this division,
509+an appeal of such denial may be ma de to the
510+appropriate district court. In situati ons
511+where one hundred twenty (120) days h ave

549-an appeal of such denial may be made to the
550-appropriate district court. In situations
551-where one hundred twenty (120) days have
552538 expired since the creation of the recording,
553539 criminal charges have not bee n filed against
554540 a person and the recording is being withheld
555541 on the grounds provided for in this
556542 division, courts considering appeals to the
557543 use of the provisions of this divisio n for
558544 temporarily withholding a record ing shall
559545 conduct a hearing and consider whether the
560546 interests of the public outweigh the
561547 interests of the parties protected by this
562548 division. In response to such appeals, the
563549 district court shall order that the
564550 recording be made available for public
565551 inspection and copying with no redaction of
566552 the portions that were temporarily withheld
567553 by reliance on this division or order an
568554 extension of time during which the recording
569555 may be withheld under the provisions of this
570556 division. An order granting an extension of
571557 time shall be applicable to the reco rding
558+against all appellants for the duration of
559+the extension. Provided, each such tim e
560+extension shall only be ordered by the
561+district court for an additional twelve-

600-the extension. Provided, each such time
601-extension shall only be ordered by the
602-district court for an additional twelve -
603588 month period of time or less and cumulative
604589 time extensions shall not add up to more
605590 than three (3) years. Provided, charges
606591 being filed against a person in the case in
607592 question automatically cancels any extension
608593 of time. A new request for an extension of
609594 time following an arraignment or initial
610595 appearance may be requested by the parties
611596 on the grounds and under the terms provided
612597 for in subdivision (a) of this division.
613598 The options presented in this division to
614599 potentially withhold a recording or portions of a
615600 recording on the grounds provided for i n this
616601 division shall expire in totality four (4) years
617602 after the recording was made at which time all
618603 recordings previously wit hheld on the grounds
619604 provided for in this divisio n shall be made
620605 available for public insp ection and copying, or
621606 (13) reveal the identity of law enforcement officers
622607 who have become subject to internal investigation
608+by the law enforcement agency as a resul t of an
609+event depicted in the recording. The opt ion to
610+protect the identity of a law enfo rcement officer
611+shall not be available to the law enforcement

652-protect the identity of a law enforcement officer
653-shall not be available to the law enforcement
654638 agency after the law enforcement agency has
655639 concluded the investigation and rendered a
656640 decision as to final disciplinary action. At
657641 such time when an in vestigation has concluded and
658642 the law enforcement agency has rendered its
659643 decision as to final disciplinary action, the
660644 portions of the recordings previously withheld as
661645 provided for in this division shall b e available
662646 for public inspection and copying. T he audio and
663647 video recordings withheld on the grounds provided
664648 for in this division shall be available for
665649 public inspection and copying before the
666650 conclusion of the investigation if the
667651 investigation lasts for an unreasonable amount of
668652 time.
669653 B. Except for the records listed in subsection A of t his
670654 section and those made open by oth er state or local laws, law
671655 enforcement agencies may deny access to law enforcement records
672656 except where a court finds that the public interest or the interest
673657 of an individual outweighs the reason for denial. The pro visions of
658+this section shall not oper ate to deny access to law enforcement
659+records if such records have been previously made available to the
660+public as provided in t he Oklahoma Open Records Act or as otherwise
661+provided by law.

701-this section shall not operate to deny access to law enforceme nt
702-records if such records have been previously made available to the
703-public as provided in the Oklahoma Open Records Act or as otherwise
704-provided by law.
705688 C. Nothing contained in thi s section imposes any new
706689 recordkeeping requirements. Law enforcement records shall be kept
707690 for as long as is now or may hereafter be specified by law. Absent
708691 a legal requirement for the keeping of a law enforceme nt record for
709692 a specific time period, law enforcement agencies shall maintain
710693 their records for so long as needed for a dministrative purposes.
711694 D. Registration files maintained by the Department of
712695 Corrections pursuant to the provisions of the Sex Offender s
713696 Registration Act shall be made availabl e for public inspection in a
714697 manner to be determined by the Department.
715698 E. The Council on Law Enforcement Education and Training
716699 (C.L.E.E.T.) shall keep confidential all records it maintains
717700 pursuant to Section 331 1 of Title 70 of the Oklahoma Statutes an d
718701 deny release of records relating to any employed or certified full -
719702 time officer, reserve officer, retired officer or other person;
720703 teacher lesson plans, tests and o ther teaching materials; and
721704 personal communicati ons concerning individual students except under
722705 the following circumstances:
723706 1. To verify the current certification st atus of any peace
724707 officer;
708+2. As may be required to perform the duties imposed by Secti on
709+3311 of Title 70 of the Oklahoma Statutes;
710+3. To provide to any peace officer copies o f the records of
711+that peace officer up on submitting a written request;

753-3311 of Title 70 of the Oklahoma Statutes;
754-3. To provide to any peace officer copies of the records of
755-that peace officer upon submitting a written request;
756738 4. To provide, upon written request, to any law enforcement
757739 agency conducting an official inve stigation, copies of the records
758740 of any peace officer who is the subject of such investiga tion;
759741 5. To provide final orders of a dministrative proceedings where
760742 an adverse action was taken against a peace officer; and
761743 6. Pursuant to an order of the distric t court of the State of
762744 Oklahoma.
763745 F. The Department of Public Safety shall keep confident ial:
764746 1. All records it maintains purs uant to its authority under
765747 Title 47 of the Oklahoma Statutes relating to the Oklahoma Highway
766748 Patrol Division, the Communicatio ns Division, and other divisions of
767749 the Department relating to:
768750 a. training, lesson plans, teaching materials, tests , and
769751 test results,
770752 b. policies, procedures , and operations, any of which are
771753 of a tactical nature, and
772754 c. the following information from ra dio logs:
773755 (1) telephone numbers,
774756 (2) addresses other than the location of incidents to
775757 which officers are dispatched, and
758+(3) personal information which is contrary to the
759+provisions of the Driver ’s Privacy Protection
760+Act, 18 United States Code, Sections 2 721 through
761+2725; and
