59 | 55 | | SECTION 1. AMENDATORY 51 O.S. 2011, Section 24A.8, as |

63 | 59 | | available for public inspection and copying, if kept, the following |
---|

211 | 204 | | depicted in the recording. T he option to protect the |

212 | 205 | | identity of a law enforcement officer shall not be |
---|
213 | 206 | | available to the law enforcement agency after the la w |
---|
214 | 207 | | enforcement agency has concluded the investigat ion and |
---|
215 | 208 | | rendered a decision as to final d isciplinary action. |
---|
216 | 209 | | At such time when an investigation has concluded and |
---|

263 | 255 | | arrested, cited, charg ed or receiving a written |
---|

---|
265 | 257 | | (6) detentions of any length for the purpose of |
---|
266 | 258 | | investigation, |
---|
297 | 288 | | (8) actions by a law enforcement officer that have |

298 | 289 | | become the cause of an investigation or charges |

300 | 291 | | (9) recordings in the public i nterest that may |

---|

---|

304 | 295 | | (10) any contextual events occurring before or after |
---|
305 | 296 | | the events depicted in divisions (1) through (9) |
---|
306 | 297 | | of this subparagraph. |
---|
307 | 298 | | b. Notwithstanding the provisions of subparagraph a of |
---|
308 | 299 | | this paragraph, the law enforcement agency may, before |
---|
309 | 300 | | releasing any audio or video recording provided for in |
---|
310 | 301 | | this paragraph, redact or obscure specific portions of |
---|
311 | 302 | | the recording that: |
---|
312 | 303 | | (1) depict the death of a person or a dead body, |
---|
313 | 304 | | unless the death was effecte d by a law |
---|
314 | 305 | | enforcement officer, |
---|
315 | 306 | | (2) depict nudity, |
---|
316 | 307 | | (3) would identify minors under the a ge of sixteen |
---|
317 | 308 | | (16) years or would undermine any r equirement to |
---|

361 | 351 | | provided in Section 1 -109 or Section 3-428 of |
---|
362 | 352 | | Title 43A of the Oklahoma Statutes for detention |
---|
363 | 353 | | or transportation for mental health evaluation or |
---|
364 | 354 | | treatment or drug or alcohol detoxification |
---|
365 | 355 | | purposes, |
---|
366 | 356 | | (8) identify alleged victims of s ex crimes or |
---|
367 | 357 | | domestic violence, |
---|
399 | 388 | | or the information provided could reasonably be |
---|
400 | 389 | | expected to threaten or endanger the physical |
---|
401 | 390 | | safety or property of the person or the physical |
---|
402 | 391 | | safety or property of others, |
---|
403 | 392 | | (10) undermine the assertion of a privilege to keep |
---|
404 | 393 | | the identity of an informer confidential as |
---|
405 | 394 | | provided for in Section 2510 of Title 12 of the |
---|
406 | 395 | | Oklahoma Statutes, |
---|
407 | 396 | | (11) include personal information o ther than the name |
---|
408 | 397 | | or license plate number of a p erson not |
---|
409 | 398 | | officially arrested, cited, cha rged or issued a |
---|
410 | 399 | | written warning. Suc h personal information shall |
---|
411 | 400 | | include any government-issued identification |
---|
412 | 401 | | number, date of birth, address or financial |
---|
413 | 402 | | information, |
---|
414 | 403 | | (12) include information that would materially |
---|
415 | 404 | | compromise an ongoing criminal investiga tion or |
---|
416 | 405 | | ongoing criminal prosecution, provided that: |
---|
417 | 406 | | (a) ten (10) days followi ng the formal |
---|
418 | 407 | | arraignment or initial appearance, whichever |
---|
450 | 438 | | that were temporarily withheld b y reliance |
---|
451 | 439 | | on this division. Provided, before |
---|
452 | 440 | | potential release of a recording as provi ded |
---|
453 | 441 | | for in this subdivision, the prosecutor or |
---|
454 | 442 | | legal representative of the person charged |
---|
455 | 443 | | may request from the appropriate distr ict |
---|
456 | 444 | | court an extension of time during wh ich the |
---|
457 | 445 | | recording may be withheld under the |
---|
458 | 446 | | provisions of this division. When a request |
---|
459 | 447 | | for an extension of time has been filed with |
---|
460 | 448 | | the court, the recording in question may be |
---|
461 | 449 | | withheld until the court has issued a |
---|
462 | 450 | | ruling. Such requests for an extension of |
---|
463 | 451 | | the time during which the recording may be |
---|
464 | 452 | | withheld may be made on the grounds that |
---|
465 | 453 | | release of the recording will materially |
---|
466 | 454 | | compromise an ongoing criminal investigation |
---|
467 | 455 | | or criminal prosecution or on the grounds |
---|
468 | 456 | | that release of the recording will |
---|
469 | 457 | | materially compromise the right of an |
---|
501 | 488 | | interests asserted by the parties. In |
---|
502 | 489 | | response to such requests, the court shall |
---|
503 | 490 | | order that the recording be made available |
---|
504 | 491 | | for public inspectio n and copying with no |
---|
505 | 492 | | redaction of the portions t hat were |
---|
506 | 493 | | temporarily withheld by reliance on this |
---|
507 | 494 | | division or order an extensio n of time |
---|
508 | 495 | | during which the recording may be withheld |
---|
509 | 496 | | under the provisions of this division. |
---|
510 | 497 | | Provided further, each such time ex tension |
---|
511 | 498 | | shall only be ordered by the court for an |
---|
512 | 499 | | additional six-month period of time or l ess |
---|
513 | 500 | | and cumulative time extensions sha ll not add |
---|
514 | 501 | | up to more than eighteen (18) months, or |
---|
515 | 502 | | (b) in the event that one hundred twenty (120) |
---|
516 | 503 | | days expire from the date of the events |
---|
517 | 504 | | depicted in the recording without any person |
---|
518 | 505 | | being criminally charged in the ca se in |
---|
519 | 506 | | question and release of a record ing or |
---|
520 | 507 | | portions of a recording have been denied on |
---|
552 | 538 | | expired since the creation of the recording, |
---|
553 | 539 | | criminal charges have not bee n filed against |
---|
554 | 540 | | a person and the recording is being withheld |
---|
555 | 541 | | on the grounds provided for in this |
---|
556 | 542 | | division, courts considering appeals to the |
---|
557 | 543 | | use of the provisions of this divisio n for |
---|
558 | 544 | | temporarily withholding a record ing shall |
---|
559 | 545 | | conduct a hearing and consider whether the |
---|
560 | 546 | | interests of the public outweigh the |
---|
561 | 547 | | interests of the parties protected by this |
---|
562 | 548 | | division. In response to such appeals, the |
---|
563 | 549 | | district court shall order that the |
---|
564 | 550 | | recording be made available for public |
---|
565 | 551 | | inspection and copying with no redaction of |
---|
566 | 552 | | the portions that were temporarily withheld |
---|
567 | 553 | | by reliance on this division or order an |
---|
568 | 554 | | extension of time during which the recording |
---|
569 | 555 | | may be withheld under the provisions of this |
---|
570 | 556 | | division. An order granting an extension of |
---|
571 | 557 | | time shall be applicable to the reco rding |
---|
603 | 588 | | month period of time or less and cumulative |
---|
604 | 589 | | time extensions shall not add up to more |
---|
605 | 590 | | than three (3) years. Provided, charges |
---|
606 | 591 | | being filed against a person in the case in |
---|
607 | 592 | | question automatically cancels any extension |
---|
608 | 593 | | of time. A new request for an extension of |
---|
609 | 594 | | time following an arraignment or initial |
---|
610 | 595 | | appearance may be requested by the parties |

---|
615 | 600 | | recording on the grounds provided for i n this |
---|
616 | 601 | | division shall expire in totality four (4) years |
---|
617 | 602 | | after the recording was made at which time all |
---|
618 | 603 | | recordings previously wit hheld on the grounds |
---|
619 | 604 | | provided for in this divisio n shall be made |
---|
620 | 605 | | available for public insp ection and copying, or |
---|
621 | 606 | | (13) reveal the identity of law enforcement officers |
---|
622 | 607 | | who have become subject to internal investigation |
---|
654 | 638 | | agency after the law enforcement agency has |

---|

663 | 647 | | video recordings withheld on the grounds provided |
---|
664 | 648 | | for in this division shall be available for |
---|
665 | 649 | | public inspection and copying before the |
---|
666 | 650 | | conclusion of the investigation if the |
---|
667 | 651 | | investigation lasts for an unreasonable amount of |
---|
668 | 652 | | time. |
---|
669 | 653 | | B. Except for the records listed in subsection A of t his |
---|
670 | 654 | | section and those made open by oth er state or local laws, law |
---|
671 | 655 | | enforcement agencies may deny access to law enforcement records |
---|
672 | 656 | | except where a court finds that the public interest or the interest |
---|
673 | 657 | | of an individual outweighs the reason for denial. The pro visions of |
---|
705 | 688 | | C. Nothing contained in thi s section imposes any new |
---|
706 | 689 | | recordkeeping requirements. Law enforcement records shall be kept |
---|
707 | 690 | | for as long as is now or may hereafter be specified by law. Absent |
---|
708 | 691 | | a legal requirement for the keeping of a law enforceme nt record for |
---|
709 | 692 | | a specific time period, law enforcement agencies shall maintain |
---|
710 | 693 | | their records for so long as needed for a dministrative purposes. |
---|
711 | 694 | | D. Registration files maintained by the Department of |
---|
712 | 695 | | Corrections pursuant to the provisions of the Sex Offender s |
---|
713 | 696 | | Registration Act shall be made availabl e for public inspection in a |
---|
714 | 697 | | manner to be determined by the Department. |
---|
715 | 698 | | E. The Council on Law Enforcement Education and Training |
---|
716 | 699 | | (C.L.E.E.T.) shall keep confidential all records it maintains |
---|
717 | 700 | | pursuant to Section 331 1 of Title 70 of the Oklahoma Statutes an d |
---|
718 | 701 | | deny release of records relating to any employed or certified full - |
---|
719 | 702 | | time officer, reserve officer, retired officer or other person; |
---|
720 | 703 | | teacher lesson plans, tests and o ther teaching materials; and |
---|
721 | 704 | | personal communicati ons concerning individual students except under |
---|
722 | 705 | | the following circumstances: |
---|
723 | 706 | | 1. To verify the current certification st atus of any peace |
---|
724 | 707 | | officer; |
---|
756 | 738 | | 4. To provide, upon written request, to any law enforcement |
---|
757 | 739 | | agency conducting an official inve stigation, copies of the records |
---|
758 | 740 | | of any peace officer who is the subject of such investiga tion; |
---|
759 | 741 | | 5. To provide final orders of a dministrative proceedings where |
---|
760 | 742 | | an adverse action was taken against a peace officer; and |
---|
761 | 743 | | 6. Pursuant to an order of the distric t court of the State of |
---|
762 | 744 | | Oklahoma. |
---|
763 | 745 | | F. The Department of Public Safety shall keep confident ial: |
---|
764 | 746 | | 1. All records it maintains purs uant to its authority under |
---|
765 | 747 | | Title 47 of the Oklahoma Statutes relating to the Oklahoma Highway |
---|
766 | 748 | | Patrol Division, the Communicatio ns Division, and other divisions of |
---|
767 | 749 | | the Department relating to: |
---|
768 | 750 | | a. training, lesson plans, teaching materials, tests , and |
---|
769 | 751 | | test results, |
---|
770 | 752 | | b. policies, procedures , and operations, any of which are |
---|
771 | 753 | | of a tactical nature, and |
---|
772 | 754 | | c. the following information from ra dio logs: |
---|
773 | 755 | | (1) telephone numbers, |
---|
774 | 756 | | (2) addresses other than the location of incidents to |
---|
775 | 757 | | which officers are dispatched, and |
---|
807 | 788 | | 2. For the purpose of prev enting identity theft and invasion of |
---|
808 | 789 | | law enforcement computer systems, except as provided in Title 47 of |
---|
809 | 790 | | the Oklahoma Statutes, all driving records. |
---|
810 | 791 | | SECTION 2. It being immediately necessa ry for the preservation |
---|
811 | 792 | | of the public peace, healt h or safety, an emergency is hereby |
---|
812 | 793 | | declared to exist, by reason whereof this resolution shall take |
---|
813 | 794 | | effect and be in full force from and after its passage and approval. |
