47	40		4, Chapter 22, O.S.L. 2017 (19 O.S. Supp. 20 20,

49	42		reproduction of records; modifying requirements for
50	43		destruction of certain records; and providing an

57	50		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKL AHOMA:
58	51		SECTION 1. AMENDATORY 19 O.S. 2011, Section 215.22, as
59	52		last amended by Section 4, Chapter 22, O.S.L. 2017 (19 O.S. Supp.
60	53		2020, Section 215.22), is amended to read as follows:
61	54		Section 215.22. A. The district attorney is hereby authorized
62	55		to destroy all or a portion of his or her office records and files
63	56		relating to:
64	57		1. Any felony case or record relating to a felony invest igation
65	58		except where a homicide is involved, provided if a period of ten
66	59		(10) years shall have has elapsed since the last action in said the
	60	+	case and provided or if the district attorney shall digitize has
	61	+	digitized or provide provided computer storage for such felony cases
	62	+	or records;

97	89		2. Any misdemeanor, wildlife or traffic case or record rela ting
98	90		to a misdemeanor, wildlife or traffic investigation, provided if a
99	91		period of five (5) years shall have has elapsed since the last
100	92		action in said the case and provided or if the district attorney in
101	93		his or her discretion may digitize has digitized or provide provided
102	94		computer storage for such m isdemeanor, wildlife or traffic cases to
103	95		be destroyed;
104	96		3. Any juvenile case , provided if a period of ten (10) years
105	97		shall have has elapsed since the last action in said the case and
106	98		provided or if the district attorney in his or her discretion may
107	99		digitize has digitized or provide provided computer storage for such
108	100		juvenile case to be destroyed; and
109	101		4. Any civil case, provided if a period of ten (10) years shall
110	102		have has elapsed since the last action in said the case and provided
111	103		or if the district attorney in his or her discretion may digitiz e
112	104		has digitized or provide provided computer storage for such civil
113	105		case to be destroyed.
114	106		B. The district attorney is authorized to reproduce a copy of
115	107		such a record, file or case stored digitally or in computer stor age
116	108		as provided in this section and such copy or computer -generated
	109	+	image or record may be used by the district attorney in lieu of the
	110	+	destroyed record, file or case, for all purpo ses.
	111	+	SECTION 2. This act shall become effective November 1 , 2021.
