77	77	BE IT ENACTED BY THE PEO PLE OF THE STATE OF OK LAHOMA:
78	78	SECTION 1. NEW LAW A new section of law to be codified
79	79	in the Oklahoma Statutes as Section 8 10 of Title 17, unless there is
80	80	created a duplication in numbering, reads as follows:
81	81	A. As used in this sect ion, “Distributed energy resource (DER)
82	82	utility” means any company that produces, delivers or furnishes
83	83	retail electric current for light, heat or power to a customer
84	84	through a power purchase agreement wit h a customer provided that:
85	85	1. Generation occurs on the property of the customer that is
86	86	contiguous with the use of that power; and
87	87	2. Generation shall not exceed one hundred twenty percent
88	88	(120%) of the previous annual load of the customer.

140	140	B. As used in this section, “Customer” means an individual or a
141	141	business partnership, limited liability company, corporation or
142	142	other legal entity receiving service from an electric utility in the
143	143	name of the individual or the entit y.
144	144	A customer of a DER utility shall be limited to churches,
145	145	synagogues, mosques and other faith-based institutions, unless
146	146	otherwise provided by law. For the purposes of this section,
147	147	“faith-based institution” means an organization, association,
148	148	facility or program that offers s ervices within a context of
149	149	religious beliefs that are articu lated by the organization ’s,
150	150	association’s, facility’s or program’s mission statement,
151	151	affiliations or sponsoring entities .
152	152	C. A DER utility shall no t be subject to the provisions of the
153	153	Retail Electric Supplier Certified Territory Act, Section 158.21 et
154	154	seq. of Title 17 of the Oklahoma Statutes , provided that the DER
155	155	utility:
156	156	1. Files an application for grid interconnection with the
157	157	Corporation Commission;
158	158	2. Submits an annual report on power gener ated by the DER
159	159	utility to the Commission;
160	160	3. Receives approval from an applicable rate-setting entity the
161	161	DER utility would operate within; and
162	162	4. Complies with any additional requirement established by the
163	163	Commission.

215	215	D. The Corporation Commission sha ll promulgate rules as
216	216	necessary to implement the provisions of this act.
217	217	E. The provisions of th is act shall be valid until November 1,
218	218	2031, at which time a report shall be issued by the Office of the
219	219	Secretary of Energy and Environment within one (1) y ear, for
220	220	consideration and determin ation of continuance of the provisions of
221	221	this act.
222	222	SECTION 2. This act shall become effective November 1, 2021.
