6565 An Act relating to higher education student s;
6666 amending 70 O.S. 2011, Section 3243 , which relates to

149149 SECTION 1. AMENDATORY 70 O.S. 2011, Se ction 3243, is
150150 amended to read as fol lows:
151151 Section 3243. A. Beginning with the 2004-2005 academic year,
152152 public or private postsecondary educational i nstitutions shall
153153 provide detailed information on t he risks associated with
154154 meningococcal disease and the risks and benefits of the vaccinatio n
155155 as well as the availability of vaccine to students who reside or
156156 plan to reside in on -campus student housing.
157157 B. Beginning with the 2004-2005 2021-2022 academic year, no
158158 public or private postsecondary education al institution shall
159159 require students who are first-time enrollees in any public or
160160 private postsecondary educational institution in this state and who
161161 reside in on-campus student housing shall to be vaccinated against
162162 meningococcal disease , unless:
163163 1. In the case of an individual who is eighteen (18) years of
164164 age or older, the individual signs a written waiver provided by the
165165 institution of higher education stating that the individual has
166166 received and reviewed the information provided and has chosen not to
167167 be vaccinated against meningococcal dise ase; or
168168 2. In the case of an individual who is a minor, the
169169 individual’s parent or guardian signs a written waive r provided by
170170 the institution of higher education s tating that the parent or
171171 guardian has received and re viewed the information provided and h as

223223 chosen not to have the individual vaccinated against meningococcal
224224 disease.
225225 C. The Oklahoma State Regents for Higher Education shall
226226 consult the State Department of Health regarding the preparation of
227227 the informational material and waiver form required in subsection B
228228 A of this section. The Regents shall provide the material and form
229229 to all public or private post secondary educational institutions with
230230 on-campus student housing in this state. It shall be the
231231 responsibility of the governing body or boar d of regents for each
232232 public or private postsecondary institution or group of institutions
233233 to adopt policies for t he implementation of this section.
234234 D. A public or private postsecondary institution may request
235235 that an enrolled student submit writ ten documentation of whether the
236236 student has been vaccinated against meningococcal disease .
237237 E. Any employee of a public or private postsecondary
238238 educational institution who coerces or in any way influence s a
239239 student enrolled in the institution to receive a vaccina tion against
240240 meningococcal disease shall be guilty of a misdemeanor .
241241 F. Public or private postsecondary instituti ons in this state
242242 shall not be required to provide or pay for vaccinations against
243243 meningococcal disease.

297297 Section 3244. A. 1. Beginning with the 2004-2005 2021-2022
298298 academic year, in order to enroll as a full-time or part-time
299299 student in an no institution within The Oklah oma State System of
300300 Higher Education or a private institution of higher learning located
301301 within this state and accredited pursuant to Section 4103 of Title
302302 70 of the Oklahoma Statut es, an individual this title shall provide
303303 written documentation of vaccinations require that enrolled full-
304304 time or part-time students be vaccinated against hepatitis B,
305305 measles, mumps, and rubella (MMR).
306306 2. The requirement shall not apply to students enr olling in
307307 courses delivered via the Internet or dista nce learning in which the
308308 student is not required to attend class on campus.
309309 B. Beginning with the 2 004-2005 academic year, institutions
310310 shall notify students of the requirements of subsection A of this
311311 section and provide students with educational inform ation on
312312 hepatitis B, measles, mumps, and rubella (MMR) upon enrollment.
313313 Such information shall also include the risks and benefits of the
314314 vaccination. Institutions shall not be required to provide or pay
315315 for vaccinations against hepatitis B, measles, mumps, and rubella
316316 (MMR).
317317 C. A written statement from a licensed physician indicating
318318 that a vaccine is medically contraindicated shall exempt a student
319319 from the vaccination. A student shall be exempt fr om the
320320 vaccination if the student submits a written, signed statement

373373 student’s moral or religious tenets or, if the student is a minor,
374374 the student’s parent or guardian provides a written statement that
375375 the administration of the vaccine con flicts with the parent ’s or
376376 guardian’s moral or religious tenets A public or private
377377 postsecondary institution may request that an enrolled student
378378 submit written documentation of whether the student has been
379379 vaccinated against hepatitis B, measles, mump s and rubella (MMR).
380380 D. Any employee of a public or private postsec ondary
381381 educational institution who coerces or in any way influence s a
382382 student enrolled in the institution to receive a vaccination agains t
383383 hepatitis B, measles, mumps and rubella (MMR) shall be guilty of a
384384 misdemeanor.
385385 D. E. It shall be the responsibility of the governing body or
386386 board of regents for each public or private postsecondary
387387 institution or group of institutions to adopt policie s for the
388388 implementation of this section. In adopting these policies the
389389 relevant governing body or board of regents ma y include exceptions
390390 for certain categories of students at its discretion.
391391 SECTION 3. NEW LAW A new section of law to be codified
392392 in the Oklahoma Statutes as Section 3244.1 of Title 70, unless there
393393 is created a duplication in numbering, reads as follows:

447447 this state and accredited pursuant to Section 4103 of Title 70 of
448448 the Oklahoma Statutes shall require that enrolled full-time or part-
449449 time students receive any vaccination, be required to use any
450450 medical device or be required to undergo an y medical procedure,
451451 surgical procedure or physical examination.
452452 SECTION 4. This act shall become effective July 1, 2021.
453453 SECTION 5. It being immediately necessary for the preservation
454454 of the public peace, health or safety, an emergency is hereby
455455 declared to exist, by reason whereof thi s act shall take effect and
456456 be in full force from and after its passage and approval.
