149	149	SECTION 1. AMENDATORY 70 O.S. 2011, Se ction 3243, is
150	150	amended to read as fol lows:
151	151	Section 3243. A. Beginning with the 2004-2005 academic year,
152	152	public or private postsecondary educational i nstitutions shall
153	153	provide detailed information on t he risks associated with
154	154	meningococcal disease and the risks and benefits of the vaccinatio n
155	155	as well as the availability of vaccine to students who reside or
156	156	plan to reside in on -campus student housing.
157	157	B. Beginning with the 2004-2005 2021-2022 academic year, no
158	158	public or private postsecondary education al institution shall
159	159	require students who are first-time enrollees in any public or
160	160	private postsecondary educational institution in this state and who
161	161	reside in on-campus student housing shall to be vaccinated against
162	162	meningococcal disease , unless:
163	163	1. In the case of an individual who is eighteen (18) years of
164	164	age or older, the individual signs a written waiver provided by the
165	165	institution of higher education stating that the individual has
166	166	received and reviewed the information provided and has chosen not to
167	167	be vaccinated against meningococcal dise ase; or
168	168	2. In the case of an individual who is a minor, the
169	169	individual’s parent or guardian signs a written waive r provided by
170	170	the institution of higher education s tating that the parent or
171	171	guardian has received and re viewed the information provided and h as

224	224	disease.
225	225	C. The Oklahoma State Regents for Higher Education shall
226	226	consult the State Department of Health regarding the preparation of
227	227	the informational material and waiver form required in subsection B
228	228	A of this section. The Regents shall provide the material and form
229	229	to all public or private post secondary educational institutions with
230	230	on-campus student housing in this state. It shall be the
231	231	responsibility of the governing body or boar d of regents for each
232	232	public or private postsecondary institution or group of institutions
233	233	to adopt policies for t he implementation of this section.
234	234	D. A public or private postsecondary institution may request
235	235	that an enrolled student submit writ ten documentation of whether the
236	236	student has been vaccinated against meningococcal disease .
237	237	E. Any employee of a public or private postsecondary
238	238	educational institution who coerces or in any way influence s a
239	239	student enrolled in the institution to receive a vaccina tion against
240	240	meningococcal disease shall be guilty of a misdemeanor .
241	241	F. Public or private postsecondary instituti ons in this state
242	242	shall not be required to provide or pay for vaccinations against
243	243	meningococcal disease.

297	297	Section 3244. A. 1. Beginning with the 2004-2005 2021-2022
298	298	academic year, in order to enroll as a full-time or part-time
299	299	student in an no institution within The Oklah oma State System of
300	300	Higher Education or a private institution of higher learning located
301	301	within this state and accredited pursuant to Section 4103 of Title
302	302	70 of the Oklahoma Statut es, an individual this title shall provide
303	303	written documentation of vaccinations require that enrolled full-
304	304	time or part-time students be vaccinated against hepatitis B,
305	305	measles, mumps, and rubella (MMR).
306	306	2. The requirement shall not apply to students enr olling in
307	307	courses delivered via the Internet or dista nce learning in which the
308	308	student is not required to attend class on campus.
309	309	B. Beginning with the 2 004-2005 academic year, institutions
310	310	shall notify students of the requirements of subsection A of this
311	311	section and provide students with educational inform ation on
312	312	hepatitis B, measles, mumps, and rubella (MMR) upon enrollment.
313	313	Such information shall also include the risks and benefits of the
314	314	vaccination. Institutions shall not be required to provide or pay
315	315	for vaccinations against hepatitis B, measles, mumps, and rubella
316	316	(MMR).
317	317	C. A written statement from a licensed physician indicating
318	318	that a vaccine is medically contraindicated shall exempt a student
319	319	from the vaccination. A student shall be exempt fr om the
320	320	vaccination if the student submits a written, signed statement

373	373	student’s moral or religious tenets or, if the student is a minor,
374	374	the student’s parent or guardian provides a written statement that
375	375	the administration of the vaccine con flicts with the parent ’s or
376	376	guardian’s moral or religious tenets A public or private
377	377	postsecondary institution may request that an enrolled student
378	378	submit written documentation of whether the student has been
379	379	vaccinated against hepatitis B, measles, mump s and rubella (MMR).
380	380	D. Any employee of a public or private postsec ondary
381	381	educational institution who coerces or in any way influence s a
382	382	student enrolled in the institution to receive a vaccination agains t
383	383	hepatitis B, measles, mumps and rubella (MMR) shall be guilty of a
384	384	misdemeanor.
385	385	D. E. It shall be the responsibility of the governing body or
386	386	board of regents for each public or private postsecondary
387	387	institution or group of institutions to adopt policie s for the
388	388	implementation of this section. In adopting these policies the
389	389	relevant governing body or board of regents ma y include exceptions
390	390	for certain categories of students at its discretion.
391	391	SECTION 3. NEW LAW A new section of law to be codified
392	392	in the Oklahoma Statutes as Section 3244.1 of Title 70, unless there
393	393	is created a duplication in numbering, reads as follows:
394	394	No institution within The Oklahoma State System of Higher

449	449	time students receive any vaccination, be required to use any
450	450	medical device or be required to undergo an y medical procedure,
451	451	surgical procedure or physical examination.
452	452	SECTION 4. This act shall become effective July 1, 2021.
453	453	SECTION 5. It being immediately necessary for the preservation
454	454	of the public peace, health or safety, an emergency is hereby
455	455	declared to exist, by reason whereof thi s act shall take effect and
456	456	be in full force from and after its passage and approval.
