7575 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
7676 SECTION 1. AMENDATORY 49 O.S. 2011, Section 1, is
7777 amended to read as follows:
7878 Section 1. A. The Secretary of State shall appoint and
7979 commission in this state notaries public, who shall hold their
8080 office for four (4) years. An applicant for a notary comm ission
8181 shall be eighteen (18) years of age or older, a citizen of the
8282 United States, and employed within this state or a legal resident of
8383 this state. A felony conviction shall not be grounds for
8484 disqualifying a person for an appointment or for removal of a person
8585 from the office of notary public unless the conviction was for a
8686 felony crime that substantially relates to the provision of notarial
8787 services. All notary commissions shall run in the name and by the

139139 authority of the State of Oklahoma, be signed by the Secretary of
140140 State, and sealed with the Great Seal of the State of Oklahoma.
141141 Commissions shall not be attested. Any person filing an application
142142 for a new notary commi ssion shall pay Twenty-five Dollars ($25.00)
143143 to the Secretary of State with the application. Any person filing
144144 an application for a renewal of a notary commission shall pay Twenty
145145 Dollars ($20.00) to the Secretary of State with the application.
146146 Any person requiring “same day filing service” shall pay Twenty-five
147147 Dollars ($25.00) to the Secretary of State in addition to the
148148 applicable filing fee. These funds shall be deposited in the
149149 Revolving Fund created for the Secretary of State pursuant to the
150150 provisions of Section 276.1 of Title 62 of the Oklahoma Statutes.
151151 B. For the purpose of this section, “substantially relate s”
152152 means the nature of criminal conduct for which the person was
153153 convicted has a direct bearing on the fitness or ability to perform
154154 one or more of the duties or responsibilities necessarily related to
155155 the appointment and commission.
156156 SECTION 2. This act shall become effective November 1, 2021.
