75	75	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
76	76	SECTION 1. AMENDATORY 49 O.S. 2011, Section 1, is
77	77	amended to read as follows:
78	78	Section 1. A. The Secretary of State shall appoint and
79	79	commission in this state notaries public, who shall hold their
80	80	office for four (4) years. An applicant for a notary comm ission
81	81	shall be eighteen (18) years of age or older, a citizen of the
82	82	United States, and employed within this state or a legal resident of
83	83	this state. A felony conviction shall not be grounds for
84	84	disqualifying a person for an appointment or for removal of a person
85	85	from the office of notary public unless the conviction was for a
86	86	felony crime that substantially relates to the provision of notarial
87	87	services. All notary commissions shall run in the name and by the

139	139	authority of the State of Oklahoma, be signed by the Secretary of
140	140	State, and sealed with the Great Seal of the State of Oklahoma.
141	141	Commissions shall not be attested. Any person filing an application
142	142	for a new notary commi ssion shall pay Twenty-five Dollars ($25.00)
143	143	to the Secretary of State with the application. Any person filing
144	144	an application for a renewal of a notary commission shall pay Twenty
145	145	Dollars ($20.00) to the Secretary of State with the application.
146	146	Any person requiring “same day filing service” shall pay Twenty-five
147	147	Dollars ($25.00) to the Secretary of State in addition to the
148	148	applicable filing fee. These funds shall be deposited in the
149	149	Revolving Fund created for the Secretary of State pursuant to the
150	150	provisions of Section 276.1 of Title 62 of the Oklahoma Statutes.
151	151	B. For the purpose of this section, “substantially relate s”
152	152	means the nature of criminal conduct for which the person was
153	153	convicted has a direct bearing on the fitness or ability to perform
154	154	one or more of the duties or responsibilities necessarily related to
155	155	the appointment and commission.
156	156	SECTION 2. This act shall become effective November 1, 2021.
