5187 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5288 SECTION 1. NEW LAW A new section of law to be codified
5389 in the Oklahoma Statutes as Section 1350 of Title 36, unless there
5490 is created a duplication in numbering, rea ds as follows:
5591 A. As used in this section:
5692 1. “Health insurance carrier ” means any entity which provides
5793 health insurance, health benefits or contracts for health car e
58-services, including prescription drug coverage, to large groups,
59-small groups or individuals in this state and that is subject to t he
60-insurance laws and regulations of this state or the jurisdiction of
61-Insurance Commissioner ;
62-2. “Nonstate public employer ” means a county, municipality or
63-other political subdivision of the state, including a board of

145+services, including prescription drug coverage, to large groups,
146+small groups or individuals in this state and that is subject to t he
147+insurance laws and regulations of this state or the jurisdiction of
148+Insurance Commissioner ;
149+2. “Nonstate public employer ” means a county, municipality or
150+other political subdivision of the state, including a board of
91151 education, quasi-public agency, state uni versity system or the Board
92152 of Trustees of the Teachers’ Retirement System of Oklahoma ; and
93153 3. “Qualified private employer ” means a self-insured private
94154 employer doing business in this state.
95155 B. There is hereby established the “State Prescription Drug
96156 Purchasing Pool”. The Office of Enterprise and Management Services
97157 may offer nonstate public em ployers, qualified private employers a nd
98158 health insurance carriers the option to pur chase prescription drugs,
99159 as defined in Section 367.2 of Title 59 of the Oklahoma Statutes,
100160 for their employees, dependents of employees and retirees under the
101161 purchasing authority of this state, subject to the provisions of
102162 subsection E of this section.
103163 C. The Office may establish procedures to determine
104164 participation in the State Prescription Drug Purchasing Pool by
105165 nonstate public employers, qualified private employers and health
106166 insurance carriers pursua nt to subsection A of this section, which
107167 shall include but are not limited to eligibility requirements,
108168 enrollment procedures, duration of participation, requirements
109-regarding payment, and procedures for withdraw al or termination from
110-the Pool
111-D. The Office may offer to nonstate public employers, qualified
112-private employers or health insurance carriers that choose to
113-participate in the State Prescription Drug Purchasing Pool , pursuant

221+the Pool
222+D. The Office may offer to nonstate public employers, qualified
223+private employers or health insurance carriers that choose to
224+participate in the State Prescription Drug Purchasing Pool , pursuant
141225 to subsection A of this section , the option to purchase stop -loss
142226 coverage from an insurer at a rat e negotiated by the Office.
143227 E. Two or more nonstate public employers or qualified private
144228 employers may operate together for the purpose of purchasing
145229 prescription drugs for their employees, dependents of employees and
146230 retirees. This arrangement shall not constitute a multiple employer
147231 welfare arrangement, as defined in Section 3 of the Emp loyee
148232 Retirement Income Security Act of 1974, 29 U.S.C., Section
149233 1002(40)(A), as amended.
150234 F. Nonstate public employers, qualified private e mployers and
151235 health insurance carriers that participate in the Stat e Prescription
152236 Drug Purchasing Pool pursuant to this sectio n shall pay the full
153237 cost of their own claims and prescription drugs.
154238 G. The Office may coordinate the State Prescription Drug
155239 Purchasing Pool with any prescription drug assistance program
156240 established through the Rx for Oklahoma Act pursuant to Section
157241 5040.2 et seq. of Title 74 of the Oklahoma Statutes . This
158242 coordination may include purchasing prescription drugs for the
159243 program through the Pool and offering discounts, rebates and prices
160-secured through the Pool to participants of the prescription drug
161-assistance program.
162-H. The Office may obtain stop -loss insurance coverage pursuant
163-to Section 7401 of Title 36 of the Oklahoma Sta tutes provided,

297+H. The Office may obtain stop -loss insurance coverage pursuant
298+to Section 7401 of Title 36 of the Oklahoma Sta tutes provided,
191299 however, that the coverage complies wit h the provisions of t his
192300 section.
193301 I. The Office of Enterprise and Manag ement Services is
194302 authorized to promulgate rules to implement the provisions of this
195303 act.
196304 SECTION 2. This act shall become effective November 1, 2021.
