357357 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
358358 SECTION 1. NEW LAW A new section of law not to be
359359 codified in the Okla homa Statutes reads as follows:
360360 This act shall be known and may be cited as the “Equal
361361 Protection and Equal Justice Act ”.
362362 SECTION 2. NEW LAW A new section of law not to be
363363 codified in the Okla homa Statutes reads as follows:
364364 A. Acting upon the Section 1 of Article I of the Oklahoma
365365 Constitution, which provides that the Constitution of the United
366366 States is the supreme law of the land ; and acknowledging the
367367 sanctity of innocent human life, created in the image of God, which
368368 should be equally protected from fertilization to natural death; the
369369 purpose of this act is:
370370 1. To ensure the right to life and equal protection of the laws
371371 to all unborn children from the moment of fertilization;
372372 2. To establish that a living human unborn child, from the
373373 moment of fertilization and at every stage of development, is
374374 entitled to the same rights, powers and privileges as are secured or
375375 granted by the laws of this state to any other human person;

427427 3. To rescind all licenses to kill unborn children by repealing
428428 discriminatory provisions and making all alleged offenders equally
429429 subject to the law, including its defenses and justifications such
430430 as duress, necessity and mistake of fact and immunities;
431431 4. To recognize that the Constitution of the United States and
432432 the laws of the United States which shall be made in pursuance
433433 thereof, are the supreme law of the land; and to fulfill our oaths
434434 to such Constitution, so help us God, by refusing to assent to the
435435 legal fiction that such Constitution prohibits this state from
436436 exercising its reserved police powers to outlaw homicide and from
437437 exercising its constitutional and God-given duties to provide equal
438438 protection to all persons wi thin its jurisdiction . As Supreme Court
439439 Justice Clarence Thomas recently stated, “The Constitution does not
440440 constrain the States’ ability to regulate or even prohibit
441441 abortion.” June Med. Servs. L.L.C. v. Russo , 140 S. Ct. 2103, 2149
442442 (2020) (Thomas, J., di ssenting); and
443443 5. To treat as void and of no effect any and all federal
444444 statutes, regulations, treaties, orders and court rulings which
445445 would deprive an unborn child of the right to life or prohibit the
446446 equal protection of such right .
447447 B. Nothing in this act shall be construed as an intent by this
448448 state to withdraw from the United States o f America. To the
449449 contrary, this act is in accordance with and in furtherance o f the
450450 Constitution of the United States and the principles which made

502502 America great. This state urges the federal government to honor the
503503 same by supporting this act which equ ally secures the right to lif e
504504 to all preborn people within this state.
505505 SECTION 3. AMENDATORY 12 O.S. 2011, Section 1053, as
506506 amended by Section 2, Chapter 149, O.S.L. 2020 (12 O.S. Supp. 2020,
507507 Section 1053), is amended to read as follows:
508508 Section 1053. A. When the death of one is caused by the
509509 wrongful act or omission of another, the personal representative of
510510 the former may maintain an action therefor against the latte r, or
511511 his or her personal representative if he or she is also deceased, if
512512 the former might have maintained an action, had he or she lived,
513513 against the latter, or his or her representative, for an injury for
514514 the same act or omission. The action must be co mmenced within two
515515 (2) years.
516516 B. The damages recoverable in actions for wrongful death as
517517 provided in this section shall include the followi ng:
518518 1. Medical and burial expenses, which shall be distributed to
519519 the person or governmental agency as defined in Section 5051.1 of
520520 Title 63 of the Oklahoma Statutes who paid these expenses, or to the
521521 decedent’s estate if paid by the estate. The provisio ns of this
522522 paragraph shall not apply to the cost of an abortion in actions
523523 maintained pursuant to subsection F of t his section;
524524 2. The loss of consortium and the grief of the surviving
525525 spouse, which shall be distributed to the surviving spouse;

577577 3. The mental pain and anguish suffered by the decedent, which
578578 shall be distributed to the surviving spouse and children, if any,
579579 or next of kin in the same proportion as personal property of the
580580 decedent. For the purposes of actions maintained pursuant to
581581 subsection F of this section, “next of kin” as used in this
582582 paragraph shall mean the parent or grandparent who maintained the
583583 action as provided for in paragraph 3 of subsection F of this
584584 section;
585585 4. The pecuniary loss to the survivors based upon properly
586586 admissible evidence with regard thereto including, but not limited
587587 to, the age, occupation, earning capacity, health habi ts, and
588588 probable duration of the decedent’s life, which must inure to the
589589 exclusive benefit of the surviving spouse and children, if any, or
590590 next of kin, and shall be distributed to them according to their
591591 pecuniary loss. For the purposes of actions maint ained pursuant to
592592 subsection F of this section, “next of kin” as used in this
593593 paragraph shall mean the parent or grandparent who maintained t he
594594 action as provided for in paragraph 3 of subsection F of this
595595 section; and
596596 5. The grief and loss of companionsh ip of the children and
597597 parents of the decedent, which shall be distributed to them
598598 according to their grief and loss of companionship.
599599 C. In proper cases, as provided by Section 9.1 of Title 23 of
600600 the Oklahoma Statutes, punitive or exemplary damages may a lso be

652652 recovered against the person proximately causing the wrongful death
653653 or the person’s representative if such person is deceased. Such
654654 damages, if recovered, shall be distributed to the surviving spouse
655655 and children, if any, or next of kin in the same proportion as
656656 personal property of the decedent. For the purposes of actions
657657 maintained pursuant to subsection F of this section, “next of kin”
658658 as used in this paragraph shall mean the parent or grandparent who
659659 maintained the action as provided for in pa ragraph 3 of subsection F
660660 of this section.
661661 D. Where the recovery is to be distributed according to a
662662 person’s pecuniary loss or loss of comp anionship, the judge shall
663663 determine the proper division.
664664 E. The above-mentioned distributions shall be made after the
665665 payment of legal expenses and costs of the action.
666666 F. 1. The provisions of this section shall also be available
667667 for the death of an un born person as defined in Section 1-730 691 of
668668 Title 63 21 of the Oklahoma Statutes.
669669 2. The provisions of this subsec tion shall apply to acts wh ich
670670 cause the death of an unborn person in utero if:
671671 a. the physician who performed the abortion or the
672672 referring physician fails to obtain and document the
673673 voluntary and informed consent of the pregnant woman
674674 pursuant to Section 1-738.2 of Title 63 of the
675675 Oklahoma Statutes,

727727 b. the pregnant woman withdraws her cons ent to the
728728 abortion prior to performance of the abo rtion,
729729 c. the pregnant woman undergoes the abortion due to
730730 coercion from a third party,
731731 d. the physician fails to obta in and document proof of
732732 age demonstrating that the pregnant woman is not a
733733 minor, or, in the case of a minor, fails to obtain:
734734 (1) parental consent to the abortion pursuant to
735735 Section 1-740.2 of Title 63 of the Oklahoma
736736 Statutes,
737737 (2) proof that the pregna nt woman, although a minor,
738738 is emancipated, or
739739 (3) judicial authorization of the aborti on without
740740 parental notification pursuant to Sectio n 1-740.3
741741 of Title 63 of the Oklahoma Statutes,
742742 e. the physician who performed the abortion causes the
743743 woman physical or psychological harm, the possibility
744744 of which she did not foresee or was not informed of at
745745 the time of her consent,
746746 f. the physician who performed the abortion fails to
747747 screen the pregnant woman and document such screening
748748 for risk factors associated wi th a heightened risk of
749749 adverse consequences from abortion which a reasonably
750750 prudent physician would screen for,

802802 g. the physician fails t o screen the pregnant woman and
803803 document such screening for physical or psychological
804804 impairment of judgment due to fa ctors including, but
805805 not limited to, drugs, alcohol, illness or fatigue,
806806 h. the physician fraudulently induces the pregnant woman
807807 to obtain the abortion or gives misleading or false
808808 information in response to a pregnant woman ’s inquiry,
809809 or
810810 i. there exist any other circumstances whic h violate
811811 state law.
812812 The provisions of this paragraph shall not be construed to apply
813813 to cases in which a physi cian licensed to practice medicine in this
814814 state attempts, in a reasonably prudent manner, to prevent the death
815815 of an unborn person or a pregnant woman.
816816 3. A parent or grandparent of the deceased unborn p erson is
817817 entitled to maintain an action against the physician who caused the
818818 death of an unborn person under the conditions provided by
819819 subparagraphs a through i of para graph 2 of this subsection;
820820 provided, however, the parent or grandparent may not mainta in such
821821 action if the parent or grandparent coerced the mother of the unborn
822822 person to abort the unborn person.
823823 4. Liability for wrongful death by the physician under t his
824824 section shall not be wa ived by the pregnant woman prior to
825825 performance of the abort ion. A physician shall not request, orally,

10981098 Section 652. A. Every person who intentionally and wrongfully

13981398 B. Except as otherwise provided by law, no hospital as defined
13991399 in Section 1-701 of Title 63 of the Oklahoma Statutes may p ermit
14001400 surgical procedures to be performed upon a minor in its facilities
14011401 without first having received a written consent from a parent or
14021402 legal guardian of the minor.
14031403 C. The provisions of this section shall no t apply when it has
14041404 been determined by a physi cian that an emergency exists and that it
14051405 is necessary to perform such surgical procedures for the treatment
14061406 of an injury, illness or drug abuse, or to save the life of the
14071407 patient, or when such parent or other adult authorized by law to
14081408 consent on behalf of a minor cannot be located or contacted afte r a
14091409 reasonably diligent effort.
14101410 D. The provisions of this section shall n ot apply to an
14111411 abortion, which shall be governed by the provisions of Sections 1 -
14121412 740 through 1-740.6 and Sections 1 -744 through 1-744.6 of Title 63
14131413 of the Oklahoma Statutes or any su ccessor statute.
14141414 E. A person who violates a provision of this section is guilty
14151415 of a misdemeanor, punishable by a fine of not more than One Thousand
14161416 Dollars ($1,000.00) or imprisonment of not more than one (1) year in
14171417 the county jail, or by both such fine and imprisonment.

15601560 indirect result, the false statement was made.
15611561 C. The provisions o f this section shall not be construed to
15621562 prohibit any payment, business arrangement or payment practice not
15631563 prohibited by 42 U.S.C., Section 1320a -7b(b) or any regulations
15641564 promulgated pursuant thereto or to prohibit any payment, business

17711771 B. If the State Board of Hea lth determines that accreditation
17721772 of genetic counseling training programs by the American Board of
17731773 Genetic Counseling or of medical genetics training programs by the
17741774 American Board of Medical Genetics is depend ent on criteria, or
17751775 applied in a manner, incom patible with the provisions of subsection
17761776 A of this section, it shall establish or recognize and apply
17771777 criteria for accreditation of alternative genetic counseling
17781778 training programs or medical genetics training programs compatible
17791779 with the provisions of su bsection A of this section and any genetic
17801780 counseling training programs or medical genetics training programs
17811781 accredited thereunder shall be deemed accredited for the purposes of
17821782 paragraph 3 of subsection A of Section 4 1-564 of this act title.
17831783 C. If the State Board of Health determines that the examination
17841784 required for certification as a genetic counselor by the American
17851785 Board of Genetic Counseling or the American Board of Medical
17861786 Genetics or as a medical geneticist by th e American Board of Medical
17871787 Genetics is incompatible with the provisions of subsection A of this
17881788 section, it shall establish or recognize an alternative e xamination
17891789 compatible with the provisions o f that subsection and an individual
17901790 who passes such an exam ination shall be deemed to meet the relevant
17911791 requirements of paragraph 4 of subsection A of Section 4 1-564 of
17921792 this act title.

19291929 categories, of illness and injury;
19301930 4. “Critical access hospital ” means a hospital determined by
19311931 the State Department of Health to be a necessary provid er of health
19321932 care services to residents of a rural community;
19331933 5. “Emergency hospital” means a hospital that provides
19341934 emergency treatment an d stabilization services on a twenty -four-hour
19351935 basis that has the ab ility to admit and treat patients for short
19361936 periods of time;
19371937 6. “Birthing center” means any facility, place or in stitution,
19381938 which is maintained or established primarily for the purpose of
19391939 providing services of a certified midwife or licensed medical docto r
19401940 to assist or attend a woman in delivery and bi rth, and where a woman
19411941 is scheduled in advance to give birth follo wing a normal,

19951995 7. “Day treatment program” means nonresidential, partial
19961996 hospitalization programs, day treatment programs , and day hospital
19971997 programs as defined by subsection A of Section 175.20 of Title 10 of
19981998 the Oklahoma Statutes; and
19991999 8. a. “Primarily engaged” means a hospital shall b e
20002000 primarily engaged, defined by this section and as
20012001 determined by the State Department of Health, in
20022002 providing to inpatients the following care by or under
20032003 the supervision of physicians:
20042004 (1) diagnostic services and therapeutic services for
20052005 medical diagnosis, treatment and care of injured,
20062006 disabled or sick persons, or
20072007 (2) rehabilitation services for the rehabilitation of
20082008 injured, disabled or sick persons.
20092009 b. In reaching a determination as to whether an entity is
20102010 primarily engaged in providing inpatient hospi tal
20112011 services to inpatients of a hospital, the De partment
20122012 shall evaluate the total facility operations and
20132013 consider multiple factors as provided in subparagraphs
20142014 c and d of this subsection.
20152015 c. In evaluating the total facility operations, the

20742074 definition of primarily engaged include, but are not
20752075 limited to:
20762076 (1) a minimum of four inpatient beds,
20772077 (2) the entity’s average daily census (ADC),
20782078 (3) the average length of stay (ALOS),
20792079 (4) the number of off-site campus outpatient
20802080 locations,
20812081 (5) the number of provider-based emergency
20822082 departments for the entity,
20832083 (6) the number of inpatient beds related to the size
20842084 of the entity and the s cope of the services
20852085 offered,
20862086 (7) the volume of outpatient surgical procedures
20872087 compared to the inpatient surgical pr ocedures, if
20882088 surgical services are provided,
20892089 (8) staffing patterns, and
20902090 (9) patterns of ADC by day of the week.

21432143 an entity shall be considered primarily engaged in
21442144 providing inpatient hospital services to inpatients if
21452145 the hospital has had an ADC of at least two (2) and an
21462146 ALOS of at least two (2) midnights over the past
21472147 twelve (12) months. A critical access hospital shall
21482148 be exempt from the ADC and ALOS determination. ADC
21492149 shall be calculated by addin g the midnight daily
21502150 census for each day of the twelve -month period and
21512151 then dividing the total number by days in the year. A
21522152 facility that has been operating for less than (12)
21532153 months at the time of the sur vey shall calculate its
21542154 ADC based on the number of months the facility has
21552155 been operational, but not less than thr ee (3) months.
21562156 If a first survey finds noncompliance with the ADC and
21572157 ALOS, a second survey may be required by the
21582158 Department to demonstrate compliance with state
21592159 licensure.
21602160 SECTION 18. AMENDATORY 63 O.S. 2011, Section 1-728c, is

22202220 1. An abortion as defined in Sect ion 1-730 of Title 63 of the
22212221 Oklahoma Statutes. The provisions of this section shall not apply if
22222222 the pregnant woman suffers from a physical disorder, physical
22232223 injury, or physical illness which, as certifi ed by a physician,
22242224 causes the woman to be in immine nt danger of death unless an
22252225 abortion is immediately performed or induced and there are no other
22262226 competent personnel available to attend to the woman. As used in
22272227 this act, the term “abortion” shall not include the prescription of
22282228 contraceptives;
22292229 2. An experiment or medical procedure that des troys an in vitro
22302230 human embryo or uses cells or tissue derived from t he destruction of
22312231 an in vitro human embryo;
22322232 3. 2. An experiment or medical procedure on an in vitr o human
22332233 embryo that is not related to the beneficia l treatment of the in
22342234 vitro human embryo;
22352235 4. 3. An experiment or medical procedure on a developing child
22362236 in an artificial womb, at any stage of development, that is not
22372237 related to the beneficial treatment of the developing child;
22382238 5. 4. A procedure, including a transplant procedure, that use s
22392239 fetal tissue or organs t hat come from a source other than a

25992599 SECTION 39. NEW LAW A new section of law not to be
26002600 codified in the Oklahoma Statutes reads as follows:
26012601 This act is prospective only and shall not apply to crimes
26022602 committed prior to the effective date of this act. For purposes of
26032603 this section, a crime is committed before the effective date of thi s
26042604 act if any element of the crime occurs before the effective date.

26072607 A. Any federal statute, regulation, treaty, executive order or
