5581 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5682 SECTION 1. AMENDATORY 27A O.S. 2011, Section 2 -7-403, is
5783 amended to read as follows:
5884 A. The Department of Environmental Quality shall have the power
5985 and authority to license , supervise, govern and regulate highway
6086 remediation and cleanup se rvices and highway remediation and cleanup
6187 service operators in this state except as provided in Section 2 of
6288 this act.
6389 B. The Environmenta l Quality Board is authorized to adopt rules
6490 as necessary to implement the provisions of this act. The rules

93143 vehicles, the records to be kept by operators and liability
94144 insurance and other insura nce or bonding requirements in such sums
95145 and with such provisions as the Department deems necessary to
96146 adequately protect the interests of the public. The rule s may
97147 address such other matters as the Board deems necessary for the
98148 protection of the public.
99149 SECTION 2. AMENDATORY 17 O.S. 2011, Section 52, as
100150 amended by Section 1, Chapter 77, O.S.L. 2016 (17 O.S. Supp. 2020,
101151 Section 52), is amended to read as follows:
102152 Section 52. A. 1. Except as otherwise provided by this
103153 section, the Corporation Commission is hereby vested with ex clusive
104154 jurisdiction, power and authority with reference to:
105155 a. the conservation of oil and gas,
106156 b. field operations for geologic and geophysical
107157 exploration for oil, gas and brine , including seismic
108158 survey wells, stratigraphic test wells and core test
109159 wells,
110160 c. the exploration, drilling, development, producing or
111161 processing for oil and gas on the lease site,
112162 d. the exploration, drilling, development, production and
113163 operation of wells used in connection with the
114164 recovery, injection or disposal of mineral br ines,
115-e. reclaiming facilities only for the processing of salt
116-water, crude oil, natural gas condensate and tank

217+water, crude oil, natural gas condensate and tank
144218 bottoms or basic sediment from crude oil tanks,
145219 pipelines, pits and equipment associated with the
146220 exploration, drilling, development, producing or
147221 transportation of oil or gas,
148222 f. injection wells known as Class I I wells under the
149223 federal Underground Injection Control Program, and any
150224 aspect of any CO2 sequestration facility , including
151225 any associated CO2 injection well, over which the
152226 Commission is given jurisdiction pursuant to the
153227 Oklahoma Carbon Capture and Geol ogic Sequestration
154228 Act. Any substance that the United States
155229 Environmental Protection Agency allows to be injected
156230 into a Class II well may continue to be so injected,
157231 g. tank farms for storage of crude oil and petroleum
158232 products which are located outside the boundaries of
159233 refineries, petrochemical manufacturing plants,
160234 natural gas liquid extraction plants, or other
161235 facilities which are subject to the jurisdiction of
162236 the Department of Env ironmental Quality with regard to
163237 point source discharges,
164238 h. the construction and operation of pipelines and
165239 associated rights-of-way, equipment, facilities or
166-buildings used in the transportation of oil, gas,
167-petroleum, petroleum products, anhydrous ammo nia or

292+petroleum, petroleum products, anhydrous ammo nia or
195293 mineral brine, or in the treatment of oil, gas or
196294 mineral brine during the course of transportation but
197295 not including line pipes in any:
198296 (1) natural gas liquids extraction plant,
199297 (2) refinery,
200298 (3) reclaiming facility other than for those
201299 specified within subparagraph e of this
202300 subsection,
203301 (4) mineral brine processing plant, and
204302 (5) petrochemical manufacturing plant,
205303 i. the handling, transportation, storage and disposition
206304 of saltwater, mineral brines, waste oil and other
207305 deleterious substances produc ed from or obtained or
208306 used in connection with the drilling, developm ent,
209307 producing and operating of oil and gas wells, at:
210308 (1) any facility or activity specifically listed in
211309 paragraphs 1 and 2 of this subsection as being
212310 subject to the jurisdiction of th e Commission,
213311 and
214312 (2) other oil and gas extraction facilities and
215313 activities,

366+facilities and activities specified in paragraph 1 of
245367 this subsection or associated with other oil and gas
246368 extraction facilities and activities, and
247369 k. subsurface storage of oil, natural gas and liquefied
248-petroleum gas in geologic st rata, and
370+petroleum gas in geologic strata.
249371 l. the licensing, supervising, governing and regulating
250372 of highway remediation and cleanup services and
251373 highway remediation and cleanup service operators in
252374 this state for the remediation of brin e and oil, as
253375 defined in this section.
254376 2. As used in this section :
255377 a. “brine” means subterranean saltwater and all of its
256378 constituent parts and chemical substances therein
257-contained including, but not limited to, bromine,
379+contained including, but not limited to bromine,
258380 magnesium, potassium, lithium, boron, chl orine,
259381 iodine, calcium, strontium, sodium, sulphur, barium or
260382 other chemical substances produced wit h or separated
261383 from such saltwater. Brine produced as an incident to
262384 the production of oil or gas, unless such brine is
263385 saved or sold for the purposes of re moving chemical
264386 substances therefrom, shall not be considered brine
265387 for the purposes of this act. Gas, whether found in
266-solution or otherwise, shall not be included within
267-the meaning of the term “brine”, and

439+solution or otherwise, shall not be included within
440+the meaning of the term “brine”,
295441 b. “oil” means crude petroleum oil and all oth er
296442 hydrocarbons, regardless of gravity, which are
297443 produced in liquid form, but does not include liqu id
298444 hydrocarbons which were originally in a gaseous phase
299445 in the reservoir.
300446 2. 3. The exclusive jurisdiction, power and authority of the
301447 Corporation Commission shall al so extend to the construction,
302448 operation, maintenance, site remedi ation, closure and abandonment of
303449 the facilities and activities described in paragraph 1 of this
304450 subsection.
305451 3. 4. When a deleterious substance from a Commission -regulated
306452 facility or activity enters a point source discharge of pollutants
307453 or storm water from a facility or activity regulated by the
308454 Department of Environmental Quality, the Department shall have sole
309455 jurisdiction over the point source discharge of the commingled
310456 pollutants and storm water from the two facilities or activities
311457 insofar as Department-regulated facilities and activities are
312458 concerned.
313459 4. 5. For purposes of the Federal Clean Water Act, any facilit y
314460 or activity which is subject to the jurisdiction of the Corporation
315461 Commission pursuant to paragraph 1 of this subsection and any other
316462 oil and gas extraction facility or activity which requires a permit
317-for the discharge of a pollutant or storm water to waters of the
318-United States shall be subject to the direct jurisdicti on of the

514+for the discharge of a pollutant or storm water to waters of the
515+United States shall be subject to the direct jurisdicti on of the
346516 United States Environmental Protection Agency and shall not be
347517 required to be permitted by the Department of Environmental Quality
348518 or the Corporation Commission for such discha rge.
349519 5. 6. The Corporation Commission shall have jurisdiction over:
350520 a. underground storage tanks that contain antifreeze,
351521 motor oil, motor fuel, gasoline, kerosene, diesel, or
352522 aviation fuel and that are not located at refineries
353523 or at upstream or intermediat e shipment points of
354524 pipeline operations, including, but not limite d to,
355525 tanks from which these materials are dispensed into
356526 vehicles, or tanks used in wholesale or bulk
357527 distribution activities, as well as leaks from pumps,
358528 hoses, dispensers, and other anc illary equipment
359529 associated with the tanks, whether above the groun d or
360530 below; provided that any point source discharge of a
361531 pollutant to waters of the United States during site
362532 remediation or the off -site disposal of contaminated
363533 soil, media, or debris sh all be regulated by the
364534 Department of Environmental Quality,
365535 b. aboveground storage tanks that contain antifreeze,
366536 motor oil, motor fuel, gaso line, kerosene, diesel, or
367537 aviation fuel and that are not located at refineries
368-or at upstream or intermediate shi pment points of
369-pipeline operations, including, but not limited to,

404598 remediation or the off -site disposal of contaminated
405599 soil, media, or debris shall b e regulated by the
406600 Department of Environmental Quality, and
407601 c. the Petroleum Storage Tank Release Environmental
408602 Cleanup Indemnity Fund and Pro gram and the Leaking
409603 Underground Storage Tank Trust Fund.
410604 6. 7. The Department of Environmental Quality shall have s ole
411605 jurisdiction to regulate the transportation, discharge or re lease of
412606 deleterious substances or hazardous or solid waste or other
413607 pollutants from rolling stock and rail facilities. The Department
414608 of Environmental Quality shall not have any jurisdiction with
415609 respect to pipeline transportation of carbon dioxide.
416610 7. 8. The Department of Environmental Quality shall have sole
417611 environmental jurisdic tion for point and nonpoint source discharges
418612 of pollutants and storm water to waters of the state from:
419-a. refineries, petrochemical manufacturing plants and
420-natural gas liquid extraction plants,

448666 b. manufacturing of oil and gas related equipment and
449667 products,
450668 c. bulk terminals, aboveground and underground storage
451669 tanks not subject to the jurisdiction of the
452670 Commission pursuant to this subsection, and
453671 d. other facilities, activ ities and sources not subject
454672 to the jurisdiction of the Corporation Commission o r
455673 Department of Agriculture as specified by this
456674 section.
457675 8. 9. The Department of Environmental Quality shall have s ole
458676 environmental jurisdiction to regulate air emissions f rom all
459677 facilities and sources subject to operating permit requirements
460678 under Title V of the Federal Clean Air Act as amended.
461679 B. The Corporation Commission and incorporated cities and towns
462680 shall have exclusive jurisdiction over permit fees for the drill ing
463681 and operation of oil and gas wells.
464682 C. The Corporation Commission shall comply with and enforce the
465683 Oklahoma Water Quality Standards.
466684 D. For purposes of immediately responding to emergency
467685 situations having potentially critical environmental or publi c
468686 safety impact and resulting from activities within its jurisdiction,
469687 the Corporation Commission may take whatever action is necessary,
470-without notice and hearing , including without limitation the
471-issuance or execution of administrative agreements by the Oil and
472688
