9191 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
9292 SECTION 1. AMENDATORY 75 O.S. 2011, Section 250.4a, is
9393 amended to read as follows:
9494 Section 250.4a. A. Any agency exempt from all or part of the
9595 Administrative Procedures Act pursuant to subsect ion A of Section

147147 250.4 of this title shall maintain and make available for public
148148 inspection its exempt rules at its principal place of business , and
149149 shall also publish its exempt rules on its website .
150150 B. It is recognized by the Ok lahoma Legislature that agencies
151151 specified by subsection A of this section have published rules
152152 containing obsolete rules or internal policy statements or agency
153153 statements which do not meet the Administrative Procedures Act
154154 definition of rules. Therefore , by December 31, 2005, each such
155155 agency shall conduct an internal review o f its rules to determine
156156 whether each of its rules is current and is a rule as such term is
157157 defined by the Administrative Procedures Act. Any rule determined
158158 by an agency to be obs olete or an internal pol icy statement or any
159159 agency statement which does no t meet the definition of a rule
160160 pursuant to the Administrative Procedures Act shall be deleted by
161161 the agency. Notice of such deletion shall be submitted to the
162162 Speaker of the House of Representatives, the President Pro Tempore
163163 of the Senate and the Govern or for informational purposes.
164164 C. The provisions of this section shall not be construed to
165165 authorize any agency to amend any rule or to delete any rule which
166166 affects any private ri ghts or procedures avail able to the public.
167167 SECTION 2. AMENDATORY 75 O.S. 2011, Section 250.10, as

221221 Section 250.10. The Governor by Execu tive Order or either house
222222 of the Legislature or bo th houses of the Legislature by resolution,
223223 or a small business, may request an agency to review its rules to
224224 determine whether or not the rules in question should be amended,
225225 repealed or redrafted. The a gency shall respond to requests from
226226 the Governor or the Legislature within ninety (90) thirty (30)
227227 calendar days of such request and shall respond to requests from a
228228 small business within ninety (90) calendar days of such request .
229229 SECTION 3. AMENDATORY 75 O.S. 2011, Section 302, is
230230 amended to read as follows:
231231 Section 302. A. In addition to other rulemaking requirements
232232 imposed by law, each agency which has rulemaking authority, shall:
233233 1. Promulgate as a rule a description of th e organization of
234234 the agency, stating the general c ourse and method of the operations
235235 of the agency and the methods whereby the public may obtain
236236 information or make submissions or requests;
237237 2. Promulgate rules of practice setting forth the nature and
238238 requirements of all formal and informal procedures ava ilable,
239239 including a description of all forms and instructions issued by the
240240 agency for use by the public;
241241 3. Make available for public inspection and publish on its
242242 website all rules and all other written statements of policy or
243243 interpretations formulated , adopted, promulgated or used by the
244244 agency in the discharge of its functions;

299299 B. 1. An agency shall maintain an official rulemaking record
300300 for each proposed rule or promulgated rule. The record and
301301 materials incorporated by reference shall be available for public
302302 inspection and shall be publish ed on the agency’s website .
303303 2. The agency rulemaki ng record shall contain:
304304 a. copies of all publications in "The Oklahoma Register"
305305 with respect to the rule or the proceeding upon which
306306 the rule is based,
307307 b. copies of any portions of the agency's public
308308 rulemaking docket containing entries relating to the
309309 rule or the proceeding upon which the rule is based,
310310 c. all written petitions, requests, submissions, and
311311 comments received by the agency and all other written
312312 materials considered by the agency in connec tion with
313313 the formulation, proposal, or adoption of the rule or
314314 the proceeding upon which the rule is based,
315315 d. any official transcript of oral presentations made in
316316 the proceeding upon which the rule is based or, if not
317317 transcribed, any tape recording or stenographic record
318318 of those presentations, and any memorandum prepared by

371371 presentations,
372372 e. a copy of any regulatory analysis prepared for the
373373 proceeding upon which the rule is based,
374374 f. a copy of the rule and analysis of each such rule
375375 filed with the Office pursuant to Section 251 of this
376376 title,
377377 g. all petitions for exceptions to, amendments of, or
378378 repeal or suspension of, the rule,
379379 h. a copy of the rule impact statement, if ma de, and
380380 i. such other information concerning such rules as may be
381381 determined necessary by the agency.
382382 3. Upon judicial review, the record required by this section
383383 constitutes the official agency rulemaking record with respect to a
384384 rule. Except as otherwi se required by a provisi on of law, the
385385 agency rulemaking record need not co nstitute the exclusive basis for
386386 agency action on that rule or for judicial review thereof.
387387 C. 1. By December 31, 2002, each Each agency that issues
388388 precedent-setting orders shall maintain and index all such orders
389389 that the agency intends to rely upon as precedent. The index and
390390 the orders shall be available for public inspection and copying in
391391 the main office and each regional or district office of the agency
392392 and shall be publish ed on the agency’s websi te. The orders shall be

445445 2. After December 31, 2002, an An order shall not be relied
446446 upon as precedent by an agency to the detriment of any person until
447447 it has been made avai lable for public inspection and, indexed, and
448448 published in the manner described in this subsection.
449449 3. An agency shall consistently apply rules to each person
450450 subject to the jurisdiction of the agency regarding issuance of
451451 orders.
452452 D. An agency shall not by internal policy, memorandum, or ot her
453453 form of action not o therwise authorized by the Administrative
454454 Procedures Act:
455455 1. Amend, interpret, implement, or repeal a statute or a rule;
456456 2. Expand upon or limit a statute or a rule; and
457457 3. Except as authorized by the Constitution of the United
458458 States, the Oklahoma Cons titution or a statute, expand or limit a
459459 right guaranteed by the Constitution of the United States, the
460460 Oklahoma Constitution, a statute, or a rule.
461461 E. Any agency memorandum, internal policy, or other form of
462462 action violative of th is section or the spirit thereof is null,
463463 void, and unenforceable.
464464 F. This section shall not be construed to prohibit an agency
465465 issuing an opinion or administrative decision which is authorized by
466466 statute provided that, unless such opinion or administrati ve
467467 decision is issued pu rsuant to the procedures required pursuant to

520520 not have the force and effect of law.
521521 SECTION 4. AMENDATORY 75 O.S. 2011, Section 303, as
522522 amended by Section 50, Chapt er 227, O.S.L. 2013 (75 O.S. Supp. 20 20,
523523 Section 303), is amended to read as follows:
524524 Section 303. A. Prior to the adoption of any rule or amendment
525525 or revocation of a rule, the agency shall:
526526 1. Cause notice of any intended actio n to be published in "Th e
527527 Oklahoma Register" pursuant to subsection B of th is section;
528528 2. For at least thirty (30) days after publication of the
529529 notice of the intended rulemaking action, afford a comment period
530530 for all interested persons to submit data, v iews or arguments,
531531 orally or in writing. The agency shall consider fully a ll written
532532 and oral submissions respecting the proposed rule;
533533 3. Hold a hearing, if required, as provided by subsection C of
534534 this section;
535535 4. Consider the effect its intended acti on may have on the
536536 various types of business and governmental entities. Ex cept where
537537 such modification or variance is prohibited by statute or
538538 constitutional constraints, if an agency finds that its actions may
539539 adversely affect any such entity, the agency may modify its actions
540540 to exclude that type of entity, or may "tier" its a ctions to allow
541541 rules, penalties, fines or reporting procedures and forms to vary
542542 according to the size of a business or governmental entity or its

594594 ability to comply or both. For b usiness entities, the ag ency shall
595595 include a description of the probable qu antitative and qualitative
596596 impact of the proposed rule, economic or otherwise, and use
597597 quantifiable data to the extent possible, taking into account both
598598 short-term and long-term consequences; and
599599 5. Consider the effect its intended action may have on the
600600 various types of consumer groups. If an agency finds that its
601601 actions may adversely affect such groups, the agency may modify its
602602 actions to exclude that type of activity.
603603 B. The notice required by para graph 1 of subsection A of this
604604 section shall include, but not be limited to:
605605 1. In simple language, a brief summary of the rule;
606606 2. The proposed action being taken;
607607 3. The circumstances which created the need for the rule;
608608 4. The specific legal author ity authorizing the proposed rule;
609609 5. The intended effect of the rule;
610610 6. If the agency determines that the rule affects business
611611 entities, a request that such entities provide the agency, within
612612 the comment period, in dollar amou nts if possible, the inc rease in
613613 the level of direct costs such as fees, an d indirect costs such as
614614 reporting, recordkeeping, equipment, construction, labor,
615615 professional services, revenue loss, or other costs expected to be
616616 incurred by a particular entity due to compliance with the proposed
617617 rule;

669669 7. The time when, the place whe re, and the manner in which
670670 interested persons may present their views thereon pursuant to
671671 paragraph 3 of subsection A of this section;
672672 8. Whether or not the agency intends to issu e a rule impact
673673 statement according to subsection D of this section and whe re copies
674674 of such impact statement may be obtained for review by the public;
675675 9. The time when, the place where, and the manner in which
676676 persons may demand a hearing on the proposed rule if the notice does
677677 not already provide for a hearing. If the notice provides for a
678678 hearing, the time and place of the hearing shall be specified in the
679679 notice; and
680680 10. Where copies of the proposed rules may be obtained for
681681 review by the public. An agency may charge perso ns for the actual
682682 cost of mailing a copy of the pro posed rules to such persons.
683683 The number of copies of such notice as specified by the
684684 Secretary shall be submitted to the Secretary who shall publish the
685685 notice in "The Oklahoma Regi ster" pursuant to the pr ovisions of
686686 Section 255 of this title.
687687 Prior to or within three (3) days after publication of the
688688 notice in "The Oklahoma Register", the agency shall cause a copy of
689689 the notice of the proposed rule adoption and the rule impact
690690 statement, if available, to b e mailed to all persons who have made a
691691 timely request of the agency for advance notice of its rulemaking
692692 proceedings. Provided, in lieu of mailing copies, an agency may

745745 rule and the rule impact statement, if available, may be viewed on
746746 the agency's website. If an agency posts a copy of the proposed
747747 rule and rule impact statement on its website, the agency shall not
748748 charge persons for the cost of downloading or pr inting the proposed
749749 rule or impact statement. Each agency shall maintain a listing of
750750 persons or entities requesting such notice.
751751 C. 1. If the published notice does not already provide for a
752752 hearing, an agency shall schedule a hearing on a proposed rule if,
753753 within thirty (30) days after the published notice of the proposed
754754 rule adoption, a written request for a hearing is submitted by:
755755 a. at least ten persons,
756756 b. a political subdivision,
757757 c. an agency, or
758758 d. an association having not less than twenty -five members.
759759 At that hearing persons may present oral argument, data, and
760760 views on the proposed rule.
761761 2. A hearing on a proposed rule may not be held earlier than
762762 thirty (30) days after notice of the hearing is published pursuant
763763 to subsection B of this sect ion.
764764 3. The provisions of this subsection shall not be construed to
765765 prevent an agency from holding a hearing or hearings on the proposed
766766 rule although not required by the provisions of this subsection;

819819 Oklahoma Register" at least thirty (30) days prior to such heari ng.
820820 D. 1. Except as otherwise provided in this subsection, an
821821 agency shall issue a rule impact statement of a proposed rule prior
822822 to or within fifteen (15) days after the date of publication of the
823823 notice of proposed rule adoption. The rule impact state ment may be
824824 modified after any hearing or comment period afforded pursuant to
825825 the provisions of this section.
826826 2. Except as otherwise provided in this subsection, the rule
827827 impact statement shall include, b ut not be limited to:
828828 a. a brief description of the purpose of the proposed
829829 rule,
830830 b. a description of the classes of persons who most
831831 likely will be affected by the proposed rule,
832832 including classes that will bear the costs of the
833833 proposed rule, and any inf ormation on cost impacts
834834 received by the agency fro m any private or public
835835 entities,
836836 c. a description of the classes of persons who will
837837 benefit from the proposed rule,
838838 d. a description of the probable economic impact of the
839839 proposed rule upon affected cla sses of persons or
840840 political subdivisions , including a listing of all fee

894894 e. the probable costs and benefits to the agency and to
895895 any other agency of the implementation and enfor cement
896896 of the proposed rule, the source of revenue to be used
897897 for implementation and enforcement of the proposed
898898 rule, and any anticipated effect on state revenues ,
899899 including a projected net loss or gain in such
900900 revenues if it can b e projected by the agenc y,
901901 f. a determination of whether implementation of the
902902 proposed rule will have an economic impact on any
903903 political subdivisions or require their cooperation in
904904 implementing or enforcing the rule,
905905 g. a determination of whether implem entation of the
906906 proposed rule may have an adverse economic effect on
907907 small business as provided by the Oklahoma Small
908908 Business Regulatory Flexibility Act,
909909 h. an explanation of the measures the agency has taken to
910910 minimize compliance costs and a determinati on of
911911 whether there are less costly or nonregulatory methods
912912 or less intrusive methods for achieving the purpose of
913913 the proposed rule,
914914 i. a determination of the effect of the proposed rule on
915915 the public health, safety and environment and, if the

967967 proposed rule is designed to reduc e significant risks
968968 to the public health, safety an d environment, an
969969 explanation of the nature of the risk and to what
970970 extent the proposed rule will reduce the risk,
971971 j. a determination of any detrimental effect on the
972972 public health, safety and environment if the proposed
973973 rule is not implemented, and
974974 k. the date the rule impact statement was prepared and if
975975 modified, the date modified.
976976 3. To the extent an agency for good cause finds the preparation
977977 of a rule impact statement or the s pecified contents thereo f are
978978 unnecessary or contrary to the public interes t in the process of
979979 adopting a particular rule, the agency may request the Governor to
980980 waive such requirement. Such request shall be in writing and shall
981981 state the agency’s finding s and the justification for such findings.
982982 Upon request by an agency, the Governor may also waive the rule
983983 impact statement requirements if the agency is required to implement
984984 a statute or federal requirement that does not require an agency to
985985 interpret or describe the requireme nts, such as federally mandated
986986 provisions which afford the agency no discretion to consider less
987987 restrictive alternatives. If the Governor fails to waive such
988988 requirement, in writing, prior to publication of the notice of the
989989 intended rulemaking action, the rule impact statement shall be

10471047 may adopt a proposed rule. No rule is valid unless adopted in
10481048 substantial compliance with the provisions of this section.
10491049 SECTION 5. AMENDATORY 75 O. S. 2011, Section 307.1, is
10501050 amended to read as follo ws:
10511051 Section 307.1. A. The Speaker of the House of Representatives
10521052 and the President Pro Tempore of the Senate may each establish a
10531053 rule review committee or designate standing comm ittees of each such
10541054 house to review administrative rules.
10551055 B. Such committees may meet separately or jointly at any time,
10561056 during sessions of the Legislature and in the interim.
10571057 C. The function of the committees so established or designated
10581058 shall be the review and promotion of ad equate and proper rules by
10591059 agencies and developing an understanding on the part of the public
10601060 respecting such rules. Such function shall be advisory only.
10611061 Each committee may review all adopted rules and such other rules
10621062 the committee deems appropriate and may make recommendations
10631063 concerning such rules to their respective house of the Legislature,

11171117 D. In addition to the review of agency-adopted rules pursuant
11181118 to this act Section 250 et seq. of this title , each such committee
11191119 shall have the power and duty to:
11201120 1. Conduct a continuous study and investigations as to whether
11211121 additional legislation or changes in legislation are needed b ased on
11221122 various factors, including, but not limited to, review of proposed
11231123 rules, review of existing rules including , but not limited to,
11241124 consideration of amendments to or repeal of existing rules, the lack
11251125 of rules, the ability of agencies to promulgate such rules, and the
11261126 needs of administrative agencies;
11271127 2. Conduct a continuo us study of the rulemaking process of all
11281128 state agencies including those agencies exempted by Section 250.4 of
11291129 this title for the purpose of improving the rulemaking process;
11301130 3. Conduct such other studies and investigations relating to
11311131 rules as may be determined to be necessary by the committee; and
11321132 4. Monitor and investigate compliance of agencies with the
11331133 provisions of the Administrative Procedures Act, make periodic
11341134 investigations of the rulemaking act ivities of all agencies and
11351135 evaluate and report on all rules in terms of their propriety, legal
11361136 adequacy, relation to statutory authorization, economic and
11371137 budgetary effects and public policy.

11891189 SECTION 6. AMENDATORY 75 O.S. 2011, S ection 308, as
11901190 amended by Section 4, Chapter 357, O .S.L. 2013 (75 O.S. Supp. 20 20,
11911191 Section 308), is amended to read as follows:
11921192 Section 308. A. Upon receipt of any adopted rules, the Speaker
11931193 of the House of Representatives and the Pr esident Pro Tempore o f the
11941194 Senate shall assign such rules to the appropr iate committees of each
11951195 house of the Legislature for review. Except as otherwise provided
11961196 by this section:
11971197 1. If such rules are received on or before April 1, the
11981198 Legislature shall have until the last da y of the regular legislative
11991199 session of that year t o review such rules; and
12001200 2. If such rules are received after April 1, the Legislature
12011201 shall have until the last day of the regular legislative session of
12021202 the next year to review such rules.
12031203 B. By the adoption of a joint resolution during the review
12041204 period specified in subsection A of this section, the Legislature
12051205 may disapprove or, approve or amend any rule. Any such action may
12061206 apply to any rule in whole or in part. The Legislature may also
12071207 take any such action and provide further instructions to the ag ency
12081208 that promulgated the rule.
12091209 C. Unless otherwise authorized by the Legislature, whenever a
12101210 rule is disapproved as provided in subsection B of this section, the
12111211 agency adopting such rules shall not have authority to resubmit an
12121212 identical rule, except du ring the first sixty (60) calendar days of

12651265 which would have been superseded by a disapproved permanent rule
12661266 shall be deemed null and void on the date the Legislature
12671267 disapproves the perman ent rule. Rules may be disapproved in part or
12681268 in whole by the Legislature. Upon enactment of any joint resolution
12691269 disapproving or amending a rule, the agency shall file notice of
12701270 such legislative disappr oval or amendment with the Secretary of
12711271 State for publication in "The Oklahoma Register ".
12721272 D. Unless otherwise provided by specific vote of the
12731273 Legislature, joint resolutions introduced for purposes of
12741274 disapproving or, approving or amending a rule or the omnibus joint
12751275 resolution described in Section 6 308.3 of this act title shall not
12761276 be subject to regular legislative cutoff dates, shall be limited to
12771277 such provisions as may be necessary for disapproval or, approval or
12781278 amendment of a rule, and any such other direction or mandate
12791279 regarding the rule deemed nec essary by the Legislature. The
12801280 resolution shall contain no other provisions.
12811281 E. A proposed permanent rule shall be deemed finally adopted
12821282 if:
12831283 1. Approved or amended by the Legislature pursua nt to Section 6
12841284 308.3 of this act title, provided that any such joint resolution
12851285 becomes law in accordance with Section 11 of Article VI of the
12861286 Oklahoma Constitution;

13481348 F. Prior to final adoption of a rule, an agency may withdraw a
13491349 rule from legislative review. N otice of such withdrawal shall be
13501350 given to the Governor, the Speaker of the House of Representatives,
13511351 the President Pro Tempore of the Senate, and to the Secretary of
13521352 State for publication in "The Oklahoma Register".
13531353 G. An agency may promulgate an emergen cy rule only pursuant to
13541354 Section 253 of this title.
13551355 H. Any rights, privileges, or interests gained by any person by
13561356 operation of an emergency rule, shall not be affected by reason of
13571357 any subsequent disapproval or, rejection or amendment of such rule
13581358 by either house of the Legislature.
13591359 SECTION 7. AMENDATORY 75 O.S. 2011, Section 308.1, as

14921492 otherwise provided by law, rules shall be p rima facie evidence of
14931493 the proper interpretation of th e matter to which they refer.
14941494 SECTION 9. AMENDATORY Section 6, Chapter 357, O.S.L.
14951495 2013 (75 O.S. Supp. 20 20, Section 308.3), is amended to read as
14961496 follows:
14971497 Section 308.3. A. The Legislature shall have an omnibus joint
14981498 resolution prepared for consideration each session.
14991499 B. The joint resolution shall be substantially in the following
15001500 form: "All proposed permanent rules of Oklahoma state agencies
15011501 filed on or before April 1 are hereby approved except for the
15021502 following:".
15031503 C. For the purpose of this section, a proposed permanent rule
15041504 may be disapproved, in whole or in part, or amended, in the omnibus
15051505 joint resolution considered by the Legislature.
15061506 D. 1. If an agency believes tha t a rule has not been approved
15071507 by the Legislature purs uant to this section and should be approved
15081508 and finally adopted, the agency may seek the Governor 's declaration
15091509 approving the rule.

15611561 2. In seeking the approval of a proposed permanent rule, the
15621562 agency shall submit a petition to the Governor that affirmativ ely
15631563 states:
15641564 a. the rule is necessary, and
15651565 b. a citation to the source of its authority to make the
15661566 rule.
15671567 3. a. If the Governor finds that the necessity does exist,
15681568 and that the agency has the authority to make the
15691569 rule, the Governor may declare the rule to be approved
15701570 and finally adopted by publishing that declaration in
15711571 "The Oklahoma Register " on or before July 17 of that
15721572 year.
15731573 b. The declaration shall set forth the rule to be
15741574 approved, the reasons the approval is necessary, and a
15751575 citation to the source of the agency's authority to
15761576 make the rule.
15771577 4. If the omnibus joint resolution fails to pass both houses of
15781578 the Legislature and be signed by the Governor or is found by the
15791579 Governor to have a technical legal defect non-substantive error
15801580 preventing approval of administrative rules intended to be approved
15811581 by the Legislature, the Governor may declare all rules to be
15821582 approved and finally adopted by publishing a single declaration in
15831583 "The Oklahoma Register " on or before July 17 without meeting
15841584 requirements of paragraphs 2 and 3 of this subsection. If the
