69	69	office; clarifying eligibility for placement on
70	70	certain primary and general election ballots;

77	77	BE IT ENACTED BY THE PEOPLE OF THE STA TE OF OKLAHOMA:
78	78	SECTION 1. NEW LAW A new section of law to be codified
79	79	in the Oklahoma Statutes as Section 5 -103.1 of Title 26, unless
80	80	there is created a duplication in numbering, r eads as follows:
81	81	A. Beginning with the 2022 election cycle, elections for any
82	82	county office shall be conducted on a nonpartisan basis. Candidates
83	83	for a county office shall file a Declaration of Candidacy with the
84	84	secretary of the county election board as provided in Section 5-103
85	85	of Title 26 of the Oklah oma Statutes but shall not declare a party
86	86	affiliation.
87	87	B. If more than two candidates qualify to have their names
88	88	appear on the ballot for a county office, the names of all such

140	140	candidates shall appear o n the Primary Election ballot. If no
141	141	single candidate receives more than fifty percent (50%) of the votes
142	142	cast at the Primary Election, the names of the two candidates
143	143	receiving the highest number of votes at the Prim ary Election shall
144	144	appear on the General Election ballot.
145	145	C. If only two candidates qual ify to have their names appear on
146	146	the ballot for a county office, the names of both candidates shall
147	147	appear on the General Election ballot.
148	148	SECTION 2. This act shall become effective Novem ber 1, 2021.
