48	39		amending 19 O.S. 2011, Section 455 , which relates to
49	40		county reward fund; providing for a plea agreement in
50	41		dispersion of reward; providing for consideration by
51	42		board of county commissioners and local law
52	43		enforcement following attorney’s report; providing
53	44		criteria by which the board of county comm issioners
54	45		may consider reward amount; requiring conviction or
55	46		plea agreement before dispersion of reward; and

61	52		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
62	53		SECTION 1. AMENDATORY 19 O.S. 2011, Section 455, is
63	54		amended to read as follows:
64	55		Section 455. A. The board of county commissioners of each
65	56		county is hereby authorized t o offer and pay a rew ard, from county
66	57		funds, in an amount not to exceed One Thousand Dollars ($1,000.00)
67	58		for the arrest and conviction or plea agreement, or for evidence
	59	+	leading to the arrest and conviction or plea agreement of any person
	60	+	stealing or defacing county road signs or any other county property.
	61	+	B. The board of county commissioners may create and maintai n a
	62	+	reward fund of not to exceed Two Thousand Dollars ($2,000.00) from

97		-	B. The board of count y commissioners may create and maintain a
98		-	reward fund of not to exceed Two Thousand Dollars ($2,000.00) from
99	89		which to pay the rewards provided for in subsection A of this
100	90		section.
101	91		C. All claims relating to a conviction or plea agreement shall
102	92		be considered together by the board of county comm issioners and
103	93		local law enforcement following receipt of the prosecutin g
104	94		attorney’s report.
105	95		D. In determining the amount of the r eward, the board of county
106	96		commissioners shall have sole discretion to honor or deny the claim,
107	97		but shall consider:
108	98		1. The severity of the offense;
109	99		2. The size of the fine imposed;
110	100		3. The number of persons claiming a reward and the degree to
111	101		which each claimant was responsible for the arres t or conviction;
112	102		4. The burden, if any, incurred by the claimant including cost
113	103		to appear at trial; and
114	104		5. Other factors which the board or governing body de ems
115	105		appropriate.
116	106		E. No reward shall be authorized by the county until the
117	107		conviction or plea agreement of the accused.

	109	+	in lieu of the fine be required to depos it like amount into the
	110	+	county reward fund.
	111	+	SECTION 2. This act shall become effective December 1, 2021.
