7979 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
8080 SECTION 1. AMENDATORY 27 O.S. 2011, Section 11, is
8181 amended to read as follows:
8282 Section 11. Where a condemnation proceeding is instituted by
8383 any person, agency or other entity to acquire real property for use
8484 as provided in Section 9 of this title and
8585 1. The final judgment is that t he real property cannot b e
8686 acquired by condemnation;
8787 2. The proceeding is a bandoned; or
8888 3. If the award of the jury exceeds the greater of the award of
8989 the court-appointed commissioners by at least ten percent (10%) or

141141 the last written offer of just compensation made by the cond emning
142142 authority, the owner of any right, title or interest in such real
143143 property may be paid such sum as in the opinion of the court will
144144 reimburse such owner for his reasonable attorney, appraisal and
145145 engineering fees, actually incurred by written contract because of
146146 the condemnation proceedings. Such d etermination by the court shall
147147 be appealable to the Supreme Court in the same manner as any other
148148 final order. The final award of such sums will be paid by the
149149 person, agency or other entity which sought to condemn the property.
150150 SECTION 2. AMENDATORY 66 O.S. 2011, Section 55, is
151151 amended to read as follows:
152152 Section 55. (A) A. The report of the commissioners may be
153153 reviewed by the district court, on written exceptions filed by
154154 either party, in the clerk ’s office within thirty (30 ) days after
155155 the filing of such report; and the court shall make such order
156156 therein as right and justice may require, either by confirmation,
157157 rejection or by ordering a new appraisement on good cause shown; or
158158 either party may within sixty (60) days after the filing of such
159159 report file with the clerk a written demand for a trial by jury, in
160160 which case the amount of damages shall be assessed by a jury, and
161161 the trial shall be conducted and judgment ente red in the same manner
162162 as civil actions in the district c ourt. If the party dem anding such
163163 trial does not recover a verdict more favorable to him than the

215215 assessment of the commissioners, all costs in the district court may
216216 be taxed against him such party.
217217 (B) B. Within ten (10) days after the report of commis sioners
218218 is filed, the court clerk sha ll forward to the attorney of record
219219 for the condemnor, the attorney of record for each condemnee, and to
220220 all unrepresented condemnees, a copy of the commissioners ’ report
221221 and a notice stating the time limits for filing an exception or
222222 demand for jury tria l as specified in paragraph (A) subsection A of
223223 this section. This notice shall be on a form prepared by the Court
224224 Administrator, which shall be approved by the S upreme Court, and
225225 shall be distributed to all clerks of the district court by said the
226226 Court Administrator. I f a party has been served by publication, the
227227 clerk shall forward a copy of the report of commissioners and notice
228228 of time limits for filing an ex ception or demand for jury trial to
229229 the last-known mailing address, if any, and shall cause a copy of
230230 the notice of time limits to be published in one (1) issue of a
231231 newspaper qualified to publish legal notices, as defined in Section
232232 106 of Title 25 of the Oklahoma Statutes. After issuing the notices
233233 provided herein, the court clerk shall endorse on the notice form
234234 filed in the case, the date and that a copy of the report together
235235 with the notice was mailed to each party or his party’s attorney of
236236 record, or the date the notice was published in compliance with the
237237 provisions hereof.

289289 (C) C. The time limits for filing an exception and demand for
290290 jury trial, as prescribed in paragraph (A) subsection A of this
291291 section, shall be calculated from the date the repo rt of the
292292 commissioners is filed in the case. On failu re of the court clerk
293293 to give notice within the time prescribed in paragraph (B)
294294 subsection B of this section, the c ourt, on application of any
295295 party, may extend the time for filing an exception to the report or
296296 a demand for trial by jury for a period not to exceed twenty (20)
297297 days from the date the application is heard.
298298 (D) D. Where the party instituting a condemnation p roceeding
299299 abandons such proceeding, or where the final judgment is that the
300300 real property cannot be acquired by condemnation , or if the award of
301301 the jury exceeds the award of the court -appointed commissioners by
302302 at least ten percent (10%) or exceeds the last written offer of just
303303 compensation made by the cond emning authority, whichever i s greater,
304304 then the owner of any right, title or inter est in the property
305305 involved may be paid such sum as in the opinion of the court will
306306 reimburse such owner for his reasonable attorney, appraisal,
307307 engineering, and expert witness fees actually incurred by written
308308 contract because of the condemnation proceeding. The sum awarded
309309 shall be paid by the party instituting the condemnation proceeding.
310310 SECTION 3. This act shall become effective November 1, 2021.
