7979 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
8080 SECTION 1. AMENDATORY 62 O.S. 2011, Se ction 34.96, as
8181 last amended by Secti on 3, Chapter 168, O.S.L. 2015 (62 O.S. Supp.
8282 2020, Section 34.96), is amended to read as follows:
8383 Section 34.96. A. There is hereby established the Legislative
8484 Oversight Committee on State Budget Performance. The pu rposes of
8585 this committee shall includ e oversight of the implementation of a
8686 system of program performance-based budgeting for implementation by
8787 state agencies.
8888 B. The Committee’s duties shall also include:

140140 1. Development of agency budget request forms an d instructions
141141 in conjunction with th e Office of Management and Enterprise
142142 Services;
143143 2. Directing studies to aid in the development of legislative
144144 and procedural changes to further improve the budgetary, financial,
145145 accounting, reporting, personnel, and pu rchasing processes and
146146 systems of the state;
147147 3. Direction of program evaluation and mana gement studies;
148148 4. Oversight and reporting on executive branch compliance with
149149 the legislative intent of appropriation measures. Such oversight
150150 and reporting duties may include:
151151 a. agency reorganization actions,
152152 b. executive orders calling for reduction of full-time-
153153 equivalents or hiring freezes, and
154154 c. transfer of funds by the executive branch;
155155 5. The development of revenue and expenditure estimates and
156156 analyses;
157157 6. Study of the management, operations , programs and fiscal
158158 needs of the agencies and inst itutions of Oklahoma state government
159159 pursuant to the Oklahoma Program Performance Budgeting and
160160 Accountability Act;
161161 7. Review of the executive budget, agency strateg ic plans and
162162 the estimate of needs of each state agency and institution. Reports
163163 may be issued by the Committee as it deems appropriate; and

215215 8. Implementation of an ongoing evaluation review procedure of
216216 existing programs based on performance -informed budgeting techniques
217217 pursuant to the Oklahoma Program Performance Budgeting and
218218 Accountability Act. The committee in cooperation with the Office of
219219 Management and Enterprise Services shall establish a schedule to
220220 review strategic plans and existing programs for each agency a
221221 minimum of once every four (4) years. The committee shall issue an
222222 evaluation report for each agency once every four (4) years which
223223 will include but not be limited to the following information:
224224 a. a review of the agency ’s programs, performance and
225225 management,
226226 b. whether the agency has demonstrated that there is a
227227 need for the services and programs which justifies the
228228 agency’s continued existence, and
229229 c. whether the agency is the most appropriate provider of
230230 the programs and services fur nished by the agency.
231231 C. Any reference in the Oklahoma Statutes to the Joint
232232 Legislative Committee on Budget and Program Oversight shall be a
233233 reference to the Legislative Oversight Committee on State Budget
234234 Performance.
235235 D. The Committee shall be composed of three members appointed
236236 by the President Pro Tempore of the Senate, three members app ointed
237237 by the Speaker of the House of Representatives, two members by the
238238 minority leader of the Senate and two members appointed by the

290290 minority leader of the House o f Representatives. The Chair and Vic e
291291 Chair of the Committee shall rotate every two (2) years between the
292292 Senate and the House of Representatives beginning with a Senate
293293 member serving as Chair in 2003. The Committee shall meet at least
294294 four (4) times per year and at other times as called b y the Chair.
295295 The Legislative Oversight Committee on State Budget Performance
296296 shall function as a committee of the Legislature when the
297297 Legislature is in session and is not in session. Each member of the
298298 Committee shall serve until a successor is appointe d. The duties of
299299 the Committee may be performed by the Appropriations Committee of
300300 the Senate and the Appropriations and Budget Committee of the House
301301 of Representatives or subcommittees thereof.
302302 E. The Committee shal l be staffed jointly by the staff of the
303303 fiscal divisions of the Senate and the House of Representatives.
304304 F. The Committee may make use of all available teleconferencing
305305 technology to facilitate meetings of the Committee when the
306306 Legislature is not in ses sion. The Committee shall take any
307307 appropriate action to make such teleconferenced meeti ngs comply with
308308 the provisions of the Oklahoma Open Meeting Act, Section 301 et seq.
309309 of Title 25 of the Oklahoma Statutes.
310310 G. The Committee shall periodically meet in different
311311 geographical regions of th e state to enhance the Committee ’s
312312 understanding of local conditions and to help educate the public as
313313 to the fiscal condition of the state.

365365 H. 1. Any person offering testimony before the Legislative
366366 Oversight Committee on State Budget Performance, the A ppropriations
367367 Committee of the Senate or the Appropr iations and Budget Committee
368368 of the House of Representatives , or any subcommittee thereof, shall
369369 have an oath administered that he or she will testify truly, or that
370370 any written testimony provided is true or believed to be true.
371371 2. A person shall be guilty of a misdemeanor if the person
372372 violates the oath required in paragraph 1 of this subsection by
373373 knowingly and willfully:
374374 a. falsifying or concealing any material fact ,
375375 b. making any materially false, fic titious or fraudulent
376376 statement or representation, or
377377 c. presenting any false writing or document.
378378 SECTION 2. It being immediately necessary for the preservation
379379 of the public peace, health or safety, a n emergency is hereby
380380 declared to exist, by reason whereof this act shall take effect and
381381 be in full force from and after its passage and approval.
