79	79	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
80	80	SECTION 1. AMENDATORY 62 O.S. 2011, Se ction 34.96, as
81	81	last amended by Secti on 3, Chapter 168, O.S.L. 2015 (62 O.S. Supp.
82	82	2020, Section 34.96), is amended to read as follows:
83	83	Section 34.96. A. There is hereby established the Legislative
84	84	Oversight Committee on State Budget Performance. The pu rposes of
85	85	this committee shall includ e oversight of the implementation of a
86	86	system of program performance-based budgeting for implementation by
87	87	state agencies.
88	88	B. The Committee’s duties shall also include:

143	143	2. Directing studies to aid in the development of legislative
144	144	and procedural changes to further improve the budgetary, financial,
145	145	accounting, reporting, personnel, and pu rchasing processes and
146	146	systems of the state;
147	147	3. Direction of program evaluation and mana gement studies;
148	148	4. Oversight and reporting on executive branch compliance with
149	149	the legislative intent of appropriation measures. Such oversight
150	150	and reporting duties may include:
151	151	a. agency reorganization actions,
152	152	b. executive orders calling for reduction of full-time-
153	153	equivalents or hiring freezes, and
154	154	c. transfer of funds by the executive branch;
155	155	5. The development of revenue and expenditure estimates and
156	156	analyses;
157	157	6. Study of the management, operations , programs and fiscal
158	158	needs of the agencies and inst itutions of Oklahoma state government
159	159	pursuant to the Oklahoma Program Performance Budgeting and
160	160	Accountability Act;
161	161	7. Review of the executive budget, agency strateg ic plans and
162	162	the estimate of needs of each state agency and institution. Reports
163	163	may be issued by the Committee as it deems appropriate; and

215	215	8. Implementation of an ongoing evaluation review procedure of
216	216	existing programs based on performance -informed budgeting techniques
217	217	pursuant to the Oklahoma Program Performance Budgeting and
218	218	Accountability Act. The committee in cooperation with the Office of
219	219	Management and Enterprise Services shall establish a schedule to
220	220	review strategic plans and existing programs for each agency a
221	221	minimum of once every four (4) years. The committee shall issue an
222	222	evaluation report for each agency once every four (4) years which
223	223	will include but not be limited to the following information:
224	224	a. a review of the agency ’s programs, performance and
225	225	management,
226	226	b. whether the agency has demonstrated that there is a
227	227	need for the services and programs which justifies the
228	228	agency’s continued existence, and
229	229	c. whether the agency is the most appropriate provider of
230	230	the programs and services fur nished by the agency.
231	231	C. Any reference in the Oklahoma Statutes to the Joint
232	232	Legislative Committee on Budget and Program Oversight shall be a
233	233	reference to the Legislative Oversight Committee on State Budget
234	234	Performance.
235	235	D. The Committee shall be composed of three members appointed
236	236	by the President Pro Tempore of the Senate, three members app ointed
237	237	by the Speaker of the House of Representatives, two members by the
238	238	minority leader of the Senate and two members appointed by the

290	290	minority leader of the House o f Representatives. The Chair and Vic e
291	291	Chair of the Committee shall rotate every two (2) years between the
292	292	Senate and the House of Representatives beginning with a Senate
293	293	member serving as Chair in 2003. The Committee shall meet at least
294	294	four (4) times per year and at other times as called b y the Chair.
295	295	The Legislative Oversight Committee on State Budget Performance
296	296	shall function as a committee of the Legislature when the
297	297	Legislature is in session and is not in session. Each member of the
298	298	Committee shall serve until a successor is appointe d. The duties of
299	299	the Committee may be performed by the Appropriations Committee of
300	300	the Senate and the Appropriations and Budget Committee of the House
301	301	of Representatives or subcommittees thereof.
302	302	E. The Committee shal l be staffed jointly by the staff of the
303	303	fiscal divisions of the Senate and the House of Representatives.
304	304	F. The Committee may make use of all available teleconferencing
305	305	technology to facilitate meetings of the Committee when the
306	306	Legislature is not in ses sion. The Committee shall take any
307	307	appropriate action to make such teleconferenced meeti ngs comply with
308	308	the provisions of the Oklahoma Open Meeting Act, Section 301 et seq.
309	309	of Title 25 of the Oklahoma Statutes.
310	310	G. The Committee shall periodically meet in different
311	311	geographical regions of th e state to enhance the Committee ’s
312	312	understanding of local conditions and to help educate the public as
313	313	to the fiscal condition of the state.

365	365	H. 1. Any person offering testimony before the Legislative
366	366	Oversight Committee on State Budget Performance, the A ppropriations
367	367	Committee of the Senate or the Appropr iations and Budget Committee
368	368	of the House of Representatives , or any subcommittee thereof, shall
369	369	have an oath administered that he or she will testify truly, or that
370	370	any written testimony provided is true or believed to be true.
371	371	2. A person shall be guilty of a misdemeanor if the person
372	372	violates the oath required in paragraph 1 of this subsection by
373	373	knowingly and willfully:
374	374	a. falsifying or concealing any material fact ,
375	375	b. making any materially false, fic titious or fraudulent
376	376	statement or representation, or
377	377	c. presenting any false writing or document.
378	378	SECTION 2. It being immediately necessary for the preservation
379	379	of the public peace, health or safety, a n emergency is hereby
380	380	declared to exist, by reason whereof this act shall take effect and
381	381	be in full force from and after its passage and approval.
