79	79	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
80	80	SECTION 1. NEW LAW A new section o f law not to be
81	81	codified in the Oklahoma Statutes r eads as follows:
82	82	The Oklahoma State Regents for Higher Education are encouraged
83	83	to adopt a policy authorizing institutions within The Oklahoma State
84	84	System of Higher Education to provide additional online distance-
85	85	learning opportunities for instructional c ontinuity in the event of
86	86	an emergency, natural disaster or as a preventative measure in
87	87	response to a potential threat to student and employee health or
88	88	safety.

140	140	SECTION 2. AMENDATORY 70 O.S. 2011, Section 3218.2, as
141	141	amended by Section 1, Chapter 208, O.S.L. 2016 (70 O.S. Supp. 2020,
142	142	Section 3218.2), is amended to read as follows:
143	143	Section 3218.2. A. Resident tuition, nonresident tuition,
144	144	distance education tuition and other fees to be required of students
145	145	receiving instruction or other academic services provided by
146	146	institutions of The Oklahoma State System of Higher Education shall
147	147	be established by the Oklahoma State Regents for Higher Educati on
148	148	with due regard for the provisions of Section 3218.14 of this title
149	149	within limits prescribed by the Legislature. Nothing in this act
150	150	Section 3201 et seq. of this title shall be construed as limiting or
151	151	prohibiting the requirement of payment for goods or services
152	152	provided by auxiliary en terprises operated by or in conjuncti on with
153	153	institutions of The Oklahoma State System of Higher Education and
154	154	authorized by the Ok lahoma State Regents for Higher Education.
155	155	B. By January 1 of each year, the Oklahoma State Regents for
156	156	Higher Education sha ll submit a report to the Governor, t he
157	157	President Pro Tempore of the Senate, the Speaker of the House of
158	158	Representatives, and the minority floor leaders and education
159	159	committee chairs of both houses of the Oklahoma Legislature. The
160	160	annual report shall inc lude the following information:
161	161	1. Actions taken in regard to and the schedule of tuition and
162	162	fees approved for The Oklahoma State System of Higher Education for
163	163	the current academic year;

215	215	2. Data on the impact of any tuition or fee increases on the
216	216	ability of students to meet the costs of attendance, enrollment
217	217	patterns, availability of financial aid;
218	218	3. The budget prepared by the State Regents setting out in
219	219	detail the necessary expenses of the State Regents for the next
220	220	fiscal year;
221	221	4. The budget requests or proposals submitted by each
222	222	institution to the State Regents for the next fiscal year;
223	223	5. The funding formula or allotmen t system used by the State
224	224	Regents to allocate money to each institution, including a
225	225	description of the functional goals of the formula or system for
226	226	distributing funds to each institution;
227	227	6. A calculation of any differences in the budget requests
228	228	amounts for each institution and the actual amounts allocated to
229	229	each institution, including an explanation for any differences; a nd
230	230	7. Any other data considered rele vant by the State Regents.
231	231	C. By January 1 of each year, each institution of The Oklahoma
232	232	State System of Higher Education shall submit a report to the
233	233	Governor, the President Pro Tempore of the Senate, the Speaker of
234	234	the House of Representatives , and the minority floor leaders and
235	235	education committee chairs of both houses of the Oklahoma
236	236	Legislature. The annual report shall include the following

290	290	itemizes the tuition and fees for each institution by campus or

292	292	2. The total budget of each institution for the previ ous fiscal
293	293	year including the amount of revenue received from tuition and fees
294	294	and other sources and expenses for each campus or location.
295	295	SECTION 3. This act shall become effective July 1, 2021.
296	296	SECTION 4. It being immediately necessary for the preservation
297	297	of the public peace, health or safety, an emergency is hereby
298	298	declared to exist, by reas on whereof this act shall take effect and
299	299	be in full force from and after its passage and approval.
