7979 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
8080 SECTION 1. NEW LAW A new section o f law not to be
8181 codified in the Oklahoma Statutes r eads as follows:
8282 The Oklahoma State Regents for Higher Education are encouraged
8383 to adopt a policy authorizing institutions within The Oklahoma State
8484 System of Higher Education to provide additional online distance-
8585 learning opportunities for instructional c ontinuity in the event of
8686 an emergency, natural disaster or as a preventative measure in
8787 response to a potential threat to student and employee health or
8888 safety.

140140 SECTION 2. AMENDATORY 70 O.S. 2011, Section 3218.2, as
141141 amended by Section 1, Chapter 208, O.S.L. 2016 (70 O.S. Supp. 2020,
142142 Section 3218.2), is amended to read as follows:
143143 Section 3218.2. A. Resident tuition, nonresident tuition,
144144 distance education tuition and other fees to be required of students
145145 receiving instruction or other academic services provided by
146146 institutions of The Oklahoma State System of Higher Education shall
147147 be established by the Oklahoma State Regents for Higher Educati on
148148 with due regard for the provisions of Section 3218.14 of this title
149149 within limits prescribed by the Legislature. Nothing in this act
150150 Section 3201 et seq. of this title shall be construed as limiting or
151151 prohibiting the requirement of payment for goods or services
152152 provided by auxiliary en terprises operated by or in conjuncti on with
153153 institutions of The Oklahoma State System of Higher Education and
154154 authorized by the Ok lahoma State Regents for Higher Education.
155155 B. By January 1 of each year, the Oklahoma State Regents for
156156 Higher Education sha ll submit a report to the Governor, t he
157157 President Pro Tempore of the Senate, the Speaker of the House of
158158 Representatives, and the minority floor leaders and education
159159 committee chairs of both houses of the Oklahoma Legislature. The
160160 annual report shall inc lude the following information:
161161 1. Actions taken in regard to and the schedule of tuition and
162162 fees approved for The Oklahoma State System of Higher Education for
163163 the current academic year;

215215 2. Data on the impact of any tuition or fee increases on the
216216 ability of students to meet the costs of attendance, enrollment
217217 patterns, availability of financial aid;
218218 3. The budget prepared by the State Regents setting out in
219219 detail the necessary expenses of the State Regents for the next
220220 fiscal year;
221221 4. The budget requests or proposals submitted by each
222222 institution to the State Regents for the next fiscal year;
223223 5. The funding formula or allotmen t system used by the State
224224 Regents to allocate money to each institution, including a
225225 description of the functional goals of the formula or system for
226226 distributing funds to each institution;
227227 6. A calculation of any differences in the budget requests
228228 amounts for each institution and the actual amounts allocated to
229229 each institution, including an explanation for any differences; a nd
230230 7. Any other data considered rele vant by the State Regents.
231231 C. By January 1 of each year, each institution of The Oklahoma
232232 State System of Higher Education shall submit a report to the
233233 Governor, the President Pro Tempore of the Senate, the Speaker of
234234 the House of Representatives , and the minority floor leaders and
235235 education committee chairs of both houses of the Oklahoma
236236 Legislature. The annual report shall include the following

289289 1. A copy of reports submitted to the State Regents which
290290 itemizes the tuition and fees for each institution by campus or
291291 location; and
292292 2. The total budget of each institution for the previ ous fiscal
293293 year including the amount of revenue received from tuition and fees
294294 and other sources and expenses for each campus or location.
295295 SECTION 3. This act shall become effective July 1, 2021.
296296 SECTION 4. It being immediately necessary for the preservation
297297 of the public peace, health or safety, an emergency is hereby
298298 declared to exist, by reas on whereof this act shall take effect and
299299 be in full force from and after its passage and approval.
