AS INTRODUCED 
 
An Act relating to vulnerable adults; establishing 
cause of action for certain abuse, neglect or 
exploitation; authorizing action to be brought by 
certain persons; authorizing award of actual and 
punitive damages in certain action; authorizing award 
of court cost and attorney fees; providing for 
cumulative remedies; providing for codification; and 
providing an effective date . 
 
 
 
 
BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: 
SECTION 1.     NEW LAW     A new section of law to be codified 
in the Oklahoma Statutes as Section 10-111.2 of Title 43A, unless 
there is created a duplication in numb ering, reads as foll ows: 
A vulnerable adult as defined pursuant to Section 10 -103 of 
Title 43A of the Okl ahoma Statutes shall have a cause of action 
against any perpetrator of abuse, neglect or exploitation and may 
recover actual and punitive damages.  The action may be broug ht in 
any court of competent jur isdiction by the vulnerable adult or the 
adult’s guardian, by a person or organization acting on behalf of 
the vulnerable adult with the consent of th e adult or the adult’s 
guardian or by the personal representative of the e state of a

deceased victim without regard to whether the cause of death 
resulted from the abuse, neglect or exploitation.  The court may 
award court costs and attorney fees to the prevailing party in the 
action.  The remedies provided in th is section shall be in addition 
to and cumulative with other legal and administrative remedies 
available to a vulnerable adult. 
SECTION 2.  This act shall become effective November 1, 2021.
