77	77	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
78	78	SECTION 1. NEW LAW A new section of law to be codified
79	79	in the Oklahoma Statutes as Section 10-111.2 of Title 43A, unless
80	80	there is created a duplication in numb ering, reads as foll ows:
81	81	A vulnerable adult as defined pursuant to Section 10 -103 of
82	82	Title 43A of the Okl ahoma Statutes shall have a cause of action
83	83	against any perpetrator of abuse, neglect or exploitation and may
84	84	recover actual and punitive damages. The action may be broug ht in
85	85	any court of competent jur isdiction by the vulnerable adult or the
86	86	adult’s guardian, by a person or organization acting on behalf of
87	87	the vulnerable adult with the consent of th e adult or the adult’s
88	88	guardian or by the personal representative of the e state of a

141	141	resulted from the abuse, neglect or exploitation. The court may
142	142	award court costs and attorney fees to the prevailing party in the
143	143	action. The remedies provided in th is section shall be in addition
144	144	to and cumulative with other legal and administrative remedies
145	145	available to a vulnerable adult.
146	146	SECTION 2. This act shall become effective November 1, 2021.
