7777 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
7878 SECTION 1. NEW LAW A new section of law to be codified
7979 in the Oklahoma Statutes as Section 10-111.2 of Title 43A, unless
8080 there is created a duplication in numb ering, reads as foll ows:
8181 A vulnerable adult as defined pursuant to Section 10 -103 of
8282 Title 43A of the Okl ahoma Statutes shall have a cause of action
8383 against any perpetrator of abuse, neglect or exploitation and may
8484 recover actual and punitive damages. The action may be broug ht in
8585 any court of competent jur isdiction by the vulnerable adult or the
8686 adult’s guardian, by a person or organization acting on behalf of
8787 the vulnerable adult with the consent of th e adult or the adult’s
8888 guardian or by the personal representative of the e state of a

140140 deceased victim without regard to whether the cause of death
141141 resulted from the abuse, neglect or exploitation. The court may
142142 award court costs and attorney fees to the prevailing party in the
143143 action. The remedies provided in th is section shall be in addition
144144 to and cumulative with other legal and administrative remedies
145145 available to a vulnerable adult.
146146 SECTION 2. This act shall become effective November 1, 2021.
