6565 An Act relating to crime and punishment; making

7373 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
7474 SECTION 1. NEW LAW A new section of law to be codifi ed
7575 in the Oklahoma Statutes as Section 761 of Title 21, unless there is
7676 created a duplication in numb ering, reads as follows:
7777 A. It shall be unlawful for a person under the age of twenty-
7878 one (21) years to undergo gender reassignment medical treatment in
7979 this state.
8080 B. It shall be unlawful for a parent, guardian or other person
8181 in this state having charge, control or custody of a child under the
8282 age of eighteen (18) years to obtain gender reassignment medical
8383 treatment for the child.
8484 C. It shall be unlawful for a health care professional to
8585 intentionally perform gender reassignment medical treatment on a
8686 person who is under the age of twen ty-one (21) years.

138138 D. “Gender reassignment medical treatment” means any health
139139 care to facilitate the tra nsitioning of a patient’s assigned gender
140140 identity on the patien t’s birth certificate, to the gender identity
141141 experienced and defined by the patient. The term shall include, but
142142 not be limited to:
143143 1. Medical procedures to suppress the develop ment of endogenous
144144 secondary sex characteristics;
145145 2. Medical procedures to align the patient’s appearance or
146146 physical body with the patient’s gender identity. This does not
147147 include clothing, hairs tyles, the use of makeup or other non -
148148 permanent actions of the patient; and
149149 3. Medical procedures to alleviate the sympto ms of clinically
150150 significant distress res ulting from gender dysphoria, as defined in
151151 the Diagnostic and Statistical Manual of Mental Disorders, 5 th
152152 Edition. The term does not include behavioral health care services ,
153153 such as mental health counseling.
154154 E. Any person guilty of the provisions of subsection A, B or C
155155 shall be guilty of a felony punishable by imprisonment in the
156156 custody of the Department of Corrections for a term of not less than
157157 three (3) years nor more th an life and a fine of not more than
158158 Twenty Thousand Dollars ($20,000.00).
159159 SECTION 2. This act shall become ef fective November 1, 2021.
