73	73	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
74	74	SECTION 1. AMENDATORY Section 1, Chapter 228, O.S.L .
75	75	2017 (59 O.S. Supp. 2020, Section 478), is amende d to read as
76	76	follows:
77	77	Section 478. A. As used in this act:
78	78	1. “Store and forward technologies ” means the transmission of a
79	79	patient’s medical information from an originating site to the
80	80	physician or practitioner at the distant site; provided, photographs
81	81	visualized by a telecommunications system shall be specific to the
82	82	patient’s medical condition and adequate for furnishing or
83	83	confirming a diagnosis or treatment plan; and
84	84	2. “Telemedicine” means the practice of health care delivery,
85	85	diagnosis, consultat ion, evaluation and treatment, transfer of
86	86	medical data or exchange of medical education information by means

140	140	with access to and reviewing the patient’s relevant clinical
141	141	information prior to the telemedicine visit.
142	142	“Telemedicine” and “store and forward technologies ” shall not
143	143	include consultations provided by telephone audio-only
144	144	communication, electronic mail, text message, i nstant messaging
145	145	conversation, adaptive website questionnaire , nonsecure or secure
146	146	video conference or facsimile machine .
147	147	SECTION 2. This act shall become effective November 1, 2021.
