7373 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
7474 SECTION 1. AMENDATORY Section 1, Chapter 228, O.S.L .
7575 2017 (59 O.S. Supp. 2020, Section 478), is amende d to read as
7676 follows:
7777 Section 478. A. As used in this act:
7878 1. “Store and forward technologies ” means the transmission of a
7979 patient’s medical information from an originating site to the
8080 physician or practitioner at the distant site; provided, photographs
8181 visualized by a telecommunications system shall be specific to the
8282 patient’s medical condition and adequate for furnishing or
8383 confirming a diagnosis or treatment plan; and
8484 2. “Telemedicine” means the practice of health care delivery,
8585 diagnosis, consultat ion, evaluation and treatment, transfer of
8686 medical data or exchange of medical education information by means

140140 with access to and reviewing the patient’s relevant clinical
141141 information prior to the telemedicine visit.
142142 “Telemedicine” and “store and forward technologies ” shall not
143143 include consultations provided by telephone audio-only
144144 communication, electronic mail, text message, i nstant messaging
145145 conversation, adaptive website questionnaire , nonsecure or secure
146146 video conference or facsimile machine .
147147 SECTION 2. This act shall become effective November 1, 2021.
